Lisa Bradshaw, Clerk Bronson Berg, Mayor PUBLISHED: August 28, 2020 20149 ORDINANCE NO. 2020-05 AN ORDINANCE MODIFYING THE TOWN’S TOBACCO REGULATION TO CONFORM WITH STATE AND FEDERAL LAW WHEREAS, the State of Wyoming and the Federal Government have recently modi- fied tobacco and vaping laws to prohibit flavored electronic e-cigarette juice and to raise the minimum age for possession and/or use to twenty-one; and WHEREAS, the Town wishes to conform with State and Federal Law. NOW THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THE TOWN OF LYMAN, UINTA COUNTY, WYOMING THAT THE TOWN CODE SHOULD BE MODIFIED IN THE FOLLOWING WAY: 4-4-1: DEFINITIONS: YOUTH: Any person who has not attained twenty-one (21) years of age. (No other portion of 4-4-1 is altered by passage of this Ordinance.) 5-2G-4: TOBACCO SALES: A. Definitions: As used in this section, the following words and terms shall have the meanings ascribed to them in this subsection: TOBACCO PRODUCTS: means any substance containing tobacco leaf, including, but not limited to, cigarettes, cigars, pipe tobacco, snuff, chewing tobacco or dipping tobacco. It also includes any electronic cigarette, pipe, hookah, vaporizer, personal vaporizer or other device designed to introduce a smoke, vapor or aerosol into a person for recreational purposes. The definition of tobacco products, herein, does not include any scheduled controlled substance, and nothing in these Ordinances shall be read as authorizing the use of or decriminalization of such substances without a valid and authorized prescription by a duly licensed Wyoming Physician taken in the manner prescribed by said physician VENDING MACHINE: Any mechanical, electric or electronic self-service device which, upon insertion of money, tokens or any other form of payment, dispenses tobacco products. B. Prohibited Sales Or Delivery: 1. Prohibited: No person shall sell, offer for sale, give away or deliver tobacco products to any person under the age of twenty-one (21) years. 2. Defense to Prosecution: It is a defense to a prosecution under subsection B1 of this section if, in the case of a sale, the person who sold the tobacco product was presented with, and reasonably relied upon, an identification card which identified the person buying or receiving the tobacco product as being over twenty-one (21) years of age. C. Posted Notice Required; Location Of Vending Machines: 1. Sign Required: Any person who sells tobacco products shall post signs inform- ing the public of the age restrictions provided in this section at or near every display of tobacco products and on or upon every vending machine which offers tobacco products for sale. Each sign shall be plainly visible and shall state: THE SALE OF TOBACCO PRODUCTS TO PERSONS UNDER TWENTY-ONE YEARS OF AGE IS PROHIBITED BY LAW 2. Location Of Vending Machines: No person shall sell or offer tobacco products for sale by use of a vending machine unless the vending machine is located in a business premises where alcoholic or malt beverages are sold or dispensed and where entry by individuals under twenty-one is prohibited. D. Purchase By Minors Prohibited: No person under the age of twenty-one (21) years shall purchase tobacco products, or misrepresent his identity or age, or use any false or altered identification for the purpose of purchasing tobacco products. E. Possession Or Use By Persons under twenty-one (21): It is unlawful for any person under the age of twenty-one (21) years to possess or use any tobacco products. PUBLIC HEARING NOTICEThe Town of Lyman Planning and Zoning will hold a public hearing regarding a

variance request from Kasey and Janessa Bright. Mr. and Mrs. Bright are asking for a variance to allow a garage to be built at 1704 Powers Ave. prior to the house being built. The hearing is scheduled for September 1, 2020 at 6:30 p.m. in the conference room at the Lyman Town Hall.

Mr. Nelson is asking for a variance to allow a garage to be built at 304 West Clark prior to the house being built. The hearing is scheduled for September 1, 2020 at 6:30 p.m. in the conference room at the Lyman Town Hall.

The Town of Lyman Planning and Zoning will hold a public hearing regarding a conditional use request from Laiken Pope. Mrs. Pope is asking for a conditional use permit to allow a hair/lash salon at her residence 234 Prairie View.
