General clause in its currently valid form: „Buildings must be constructed in such a way that fires and smoke are prevented from starting and spreading. In the event of a fire the construction of the building must also enable effective fire-fighting and fire-extinguishing prcedures and enable humans and animals to be rescued.“

• Inadequate fire protection is not coveredunder VOB or BGB, but is regarded as adeliberately concealed defect.
• 30-year liability for concealed defects.• In the event of harm to persons (death) the
laws of the StGB § 319 (violation of building regulations endangering public safety) and § 323a (full intoxication) apply in full.
