Advertising and Procedures Guidelines

NOTE: These Guidelines and any review by Get Up & Go! are not intended to substitute for complete review of promotions and advertisements by advertisers’ legal advisors. Get Up & Go! will not be responsible for any claims or damages against advertisers relating to any promotion of Get Up & Go! Certificates, other than those relating to advertisers’ use of Get Up & Go! trademarks. These Guidelines are intended to be informational only.

1. Any use of Get Up & Go! or participating hotels and resorts name or logo or pictures in the Certificates, or descriptions of the Certificates, or references about participating hotels and resorts will require prior review by Get Up & Go! and final authorization before use.

a. Logos must be in approved format provided by Get Up & Go!b. Use of names in copy must have the registered trademark ® appear at least once in

each promotional/ad.c. Ads with logo/name in copy must include “Get Up & Go! is a registered trademark of Get Up

& Go Travel, Inc.” Okay to be in mouse print.d. If using pictures of the Certificates, no changes or modifications of the original permitted. Only

Certificate promoted can be depicted in ads.e. All images, including logos, released for use are the property of Get Up & Go! and can only

be used as authorized. All images must be returned to Get Up & Go! Any reproduction or reuse in any way without prior permission is prohibited. All advertisers must sign an Image Release prior to use unless otherwise provided in agreement with Get Up & Go! Get Up & Go! Certificates are travel products developed and fulfilled by Get Up & Go Travel, Inc. and its affiliates.

g. Get Up & Go! Certificates are separate and distinct products from participating hotels and resorts vacation ownership products or other leisure products. Therefore, any mention of timeshare or vacation ownership or involvement in the timeshare/vacation ownership industry is prohibited without prior written authorization.

2. Use of the words “free” or “complimentary”a. Get Up & Go! Certificates are generally given to consumers as an incentive in exchange

for some specified conduct, such as test something, or buy something or attend something. Consumers cannot be charged for the Certificate. If the promotion states that the consumer gets the Certificate for “free”, the conduct required in exchange should be described in the ad in immediate proximity to the use of the word “free.” Please consult your legal advisor for compliance with FTC guidelines and other applicable laws about the use of the word “free” in advertising.

b. The use of the word “Free” or “Complimentary” in reference to the accommodations (or getaway or vacation) provided to consumers when they use Certificates is prohibited unless the disclosures about the following charges appear in the immediate proximity to such representation:• That a refundable deposit or reservation processing fee as applicable is required when

reservations requested • That the Certificates do not include transportation, airfare, room taxes, meals or any

incidental charges.

3. Representation of Retail Value The values stated on the Certificates represent the retail value of the accommodations and not the

retail value of the Certificates itself. Therefore, if stating value in the ad/promotion, the following language is recommended, modified for the particular Certificate advertised:

“Accommodations Valued up to $XXX” based on [destination selected], [dates of travel], [and hotel availability].”

4. Use of Get Up & Go! Certificates How consumers can use the Certificates and Terms and Conditions for use are clearly stated in the

Certificates. Advertisements referencing any details about how to activate or make reservations must be submitted prior to use for confirmation that representations are accurate and not misleading.

5. General Tipsa. Be consistent with your word choices when referencing the Get Up & Go! Certificate through

out promotion/ad campaign as compared to the “getaway” to be enjoyed by using the Certificate.

b. When listing a Certificate’s destination(s), please include all of them accurately. Or, if you name less than all of the destinations listed, please use phrases like “including” or “such as” as well as stating the total number of destinations available. Example: “21 destinations including Orlando, Las Vegas and Honolulu.”

c. Frequently Asked Questions (FAQ) - a series of questions and answers in a suggested format has been provided for your use for the Blue and Green Certificates (see following FAQ section). This format may be used as is or adapted for the other Certificates as needed. Please submit modifications for review.

When submitting promotions and advertisement for review, please observe the following:

1. Include a description of the entire campaign and all of the forms of media intended for use (such as print ads, TV and Radio, in-store posters, e-mail blasts, fax blasts, postcards, etc.).

2. Please send all materials to be used in a campaign at the same time. 3. Allow 28 business days for review of the campaign, which includes time for Get Up & Go!

initial review and any changes/revisions and final sign-off. If there is a change request you think is questionable, do not just release ads without changes. Rather, you must state your objections in writing as soon as possible for reconsideration.

4. Provide at least five live samples of each final ad/promotion and related materials to Get Up & Go! Failure to obtain written authorization in accordance with these procedures will result in

termination of rights to distribute Get Up & Go! Certificates.

GENERAL FAQ'SQ. What is the issue date?A. The “issue date” is the date the Certificate is presented to you. The Certificate must be activated within

45 days of this issue date.Q. Are there any Usage Limitations?A: You must be 21 years of age. You may not use this Certificate in conjunction with any other promotional

program by Get Up & Go! unless authorized in writing. This Certificate is non-transferable and may only be used by the original recipient. Only one Certificate per household per year may be used. Accommodations are based on availability and certain restrictions. This Certificate is not intended for conventions or group travel.

Q: How do I activate a Get Up & Go! Certificate?A: There are four ways to activate a Get Up & Go! Certificate: 1. Log on to www.XXXXX.com to activate the Certificate and request travel dates. 2. Activate by phone – xxx-xxx-xxxx. 3. Complete your request form that came with your Get Up & Go! Certificate and mail it to

Get Up & Go!, Address TBD. 4. Fax your request form on an 8.5” by 11” sheet of paper to xxx-xxx-xxxx.Q: When do I send in my refundable deposit?A: If a deposit is required, deposit is due at the time of reservation confirmation.Q: How is the deposit refunded and how long does this take?A: If a deposit is required, deposit is refunded within 30 days after travel. The deposit will be refunded back

to the credit card. Q: When do I send in my reservation processing fee?A: If a reservation fee is required, the one-time reservation-processing fee is due at the time of reservation

confirmation.Q: How many people can travel on this vacation?A: Get Up & Go! Certificates are valid for 2 adults 21 years of age or older and up to two children under

the age of 18. No pets.

A: Get Up & Go! Certificates offer standard hotel rooms rated 3 stars by Mobil or 3 diamonds by AAA or higher in each destination. Resort accommodations available on select products.

Q: Is there a choice of hotels when booking travel dates?A: When making reservations, you may discuss customizing your trip with a travel professional. Q: Are meals and transportation included?A: This Certificate is for hotel accommodations only and does not include transportation, airfare, room

taxes, meals and other miscellaneous expenses. Resort accommodations may include certain amenities.Q: Can I make additional travel arrangements when I use my Certificate?A: Yes. A travel professional will be able to assist you with booking airfare, rental cars or additional rooms

or nights.Q: Is this Certificate transferable?A: No. This Certificate is non-transferable and may only be used by the original recipient.Q: How long do I have to use this Get Up & Go! Certificate?A: You must complete your travel before the expiration of the Certificate. The Certificate is valid for

twelve (12) months from the activation date or no later than the expiration date printed in the Terms & Conditions, whichever comes sooner. You must activate your Certificate within 45 days of the issue date.

Q: Once the Certificate is activated is there a written confirmation?A: Yes. A written confirmation will be mailed within 72 hours. Please allow for mail time. You may also be

contacted by e-mail or phone.Q: When travel dates are requested is there a written confirmation that the dates are available and

reservations have been made?A: Yes. Once the travel dates have been confirmed, a written itinerary will be mailed out within three

business days. Please allow for mail time. You may also be contacted by e-mail or phone. Q: Can I change a confirmed reservation?A: Yes. Written notice of cancellation or changes to an active reservation must be received at least eight

days prior to scheduled arrival date. Failure to cancel or reschedule at least eight days prior to arrival will result in forfeiture of Certificate and deposit.
