    [11th January, 1948]

    An Act to consolidate and amend the law relating to the regulation of conditions of work and employmentin shops, commercial establishments, residential hotels, restaurants, eating houses, theatres, other placesof public amusement or entertainment and other establishments

    !hereas it is e"pedient to consolidate and amend the law relating to the regulation of conditions of workand employment in shops, commercial establishments, residential hotels, restaurants, eating houses,theatres, other places of public amusement or entertainment and other establishments and for certainother purposes hereinafter specified #t is hereby enacted as follows$ %

    1. Sho%t title e3tent and ope%ation.%&1'(his Act may be called the )ombay *hops and +stablishmentsAct, 1948

    [&-' #t e"tends to the whole of the *tate of .aharashtra]

    &' #t shall in the first instance come into force in the local areas specified in schedule #$

    4[/ro0ided that, on the commencement of the )ombay *hops and +stablishments &+"tension andAmendment' Act, 192, .ah 33# of 191, all the pro0isions of this Act shall also come into force in eachof the areas in which the 5entral /ro0inces and )erar *hops and +stablishments Act, 1946, 5/ and )erarAct, 33## of 1946, or the 7yderabad *hops and +stablishments Act, 191, 7yd 3 of 191, was in forceimmediately before such commencement]4

    &4' (he [*tate]o0ernment shall by notification published in the :fficial a;ette direct that all or any ofthe pro0isions of this Act shall come into force in such other local areas ha0ing population of twenty%fi0ethousand and more as may be specified in the notification

    &' (he [*tate]o0ernment may also by a like notification direct that all or any of the pro0isions of thisAct shall come into force in such local areas ha0ing population of less than twenty%fi0e thousand as may

    be specified in the notification

    2. e#initions.% #n this Act, unless there is anything repugnant in the sub

    &' =@ay= means the period of twenty%four hours beginning at midnight$

    /ro0ided that in the case of an employee whose hours of work e"tend beyond midnight, day means the

    period of twenty%four hours beginning when such employment commences irrespecti0e of midnight>

    6[&' =+mployee= means a person wholly or principally employed, whether directly or through any agency,and whether for wages or other consideration in or in connection with any establishment> and includes an

    apprentice, but does not include a member of the employers family>]6

    &6' =+mployer= means a person owning or ha0ing ultimate control o0er the affairs of an establishment>

    &8' =+stablishment= means a shop, commercial establishment, residential hotel, restaurant, eating house,theatre, or other place of public amusement or entertainment to which this Act applies and includes suchother establishment as the [*tate]o0ernment may, by notification in the :fficial a;ette, declare to bean establishment for the purposes of this Act>

    &9' =Bactory= means any premises which is a factory within the meaning of 12 [clause &m' of section - ofthe Bactories Act, 1948,&C3### of 1948' or which is deemed to be a factory under section 8 of the saidAct]12>

    &12' =oods= includes all materials, commodities and articles>

    &11' =7oliday= means a day on which an establishment shall remain closed or on which an employee shallbe gi0en a holiday under the pro0isions of this Act>

    &1-'=#nspector= means an #nspector appointed under section 48>

    &1' =Cea0e= means lea0e pro0ided for in 5hapter ## of this Act>

    &14' =Cocal area= means any area or combination of areas to which this Act applies>

    6[&1' =Cocal authority= means a body specified in *chedule #%A and includes any other body which the*tate o0ernment may, by notification in the :fficial a;ette, declare to be a local authority for thepurposes of this Act ]6>

    &1' =.anager= means a person declared to be a manager under section 6>

    &16' =.ember of the family of an employer= means the husband, wife, son, daughter, father, mother,brother or sister of an employer who li0es with and is dependent on such employer>

    11 [&18' =:pened= means opened for the ser0ice of any customer, or for any business of the establishment,or for work, by or with the help of any employee of or connected with the establishment> ]11

    &19' =/eriod of work= means the time during which an employee is at the disposal of the employer>

    &-2' =/rescribed= means prescribed by rules made under this Act>

    &-1' =/rescribed authority= means the authority prescribed under the rules made under this Act>

    &--' =?egister of establishment= means a register maintained for the registration of establishments underthis Act>

    &-' =?egistration certificate= means a certificate showing the registration of an establishment>

    &-4' =?esidential hotel= means any premises used for the reception of guests and tra0ellers desirous ofdwelling or sleeping therein and includes 1- [residential club ]1->

    &-' =?estaurant or eating house= means any premises in which is carried on wholly or principally thebusiness of the supply of meal or refreshments to the public or a class of the public for consumption onthe premises>

    &-' =*chedule= means a *chedule appended to this Act>

    &-6'=*hop= means any premises where goods are sold, either by retail or wholesale or where ser0ices are

    rendered to customers, and includes an office, a store%room, godown, warehouse or work place, whetherin the same premises or otherwise, 1 [mainly used ]1in connection with such trade or business but does=>not include a factory, a commercial establishment, residential hotel, restaurant, eating house, theatre orother place of public amusement or entertainment>

    &-8' =*pread o0er= means the period between the commencement and the termination of the work of an

    employee on any day>

    &-9' =(heatre= includes any premises intended principally or wholly for the e"hibition of pictures or other

    optical effects by means of a cinematograph or other suitable apparatus or for dramatic performances orfor any other public amusement or entertainment>

    &2' =!ages= means wages as defined in the /ayment of !ages Act, 19 of 19'>

    &1' =!eek= means the period of se0en days beginning at midnight of *aturday>

    6[&-' =Dear= means a year commencing on the first day of January ]6>

    &' =Doung person= means a person who is not a child and has not completed his se0enteenth year

    5. (e#e%ence to time o# day.%?eferences to the time of day in this Act are references to #ndian standardtime which is fi0e and a half hours ahead of reen%wich mean time

    4. E3emption.%Eotwithstanding anything contained in this Act, the pro0isions of this Act mentioned in thethird column of *chedule ## shall not apply to the establishments, employees and other persons mentionedagainst them in the second column of the said *chedule$

    . (e)ist%ation o# establishments.%&1' !ithin the period specified in sub%section &4', the employer ofe0ery establishment shall sent to the #nspector of the local area concerned a statement, in a prescribedform, together with such fees as may be prescribed, containing%

    &a' the name of the employer and the manager, if any>

    &b' the postal address of the establishment>

    &c' the name, if any, of the establishment>

    &d' the category of the establishment, ie, whether it is a shop, commercial establishment, residentialhotel, restaurant, eating house, theatre or other place of public amusement or entertainment> and

    &e' such other particulars as may be prescribed

    &-' :n receipt of the statement and the fees, the #nspector shall, on being satisfied about the correctnessof the statement, register the establishment in the register of establishments in such manner as may beprescribed and shall issue, in a prescribed form, a registration certificate to the employer (he registrationcertificate shall be prominently displayed at the establishment

    [&-%A' A registration certificate granted under sub%section &-', shall be 0alid up to the end of the year forwhich it is granted An application for the renewal of a registration certificate shall be submitted not lessthan fifteen days before the date of e"piry of the registration certificate or of the renewed registrationcertificate, as the case may be, and shall be accompanied by such fees, and the renewed registrationcertificate shall be in such form, as may be prescribed]14

    1 [&-%AA' #f the application for the renewal of a registration certificate is submitted after the e"piry of theperiod specified in sub%section &-A' but within thirty days after the date of e"piry of the registrationcertificate or of the renewed registration certificate, as the case may be, such application shall beaccompanied by an additional fee as late fee eFual to half the fee payable for the renewal of a registrationcertificate ]1

    [&-%)' Eotwithstanding anything contained in the preceding sub% sections of this section, any registration

    certificate granted under sub%section &-' or renewed under sub%section &-A' may, at the option of theemployer, be granted or renewed for a period of three years at a time, on payment of the fees for that

    period, so as to be 0alid up to the end of the third year from and including the year in which it is grantedor renewed, as the case may be]

    &' #n the e0ent of any doubt or difference of opinion between an employer and the #nspector as to thecategory to which an establishment should belong, the #nspector shall refer the matter to the prescribedauthority which shall, after such inFuiry as it thinks proper, decide the category of such establishment andits decision shall be final for the purposes of this Act

    &4' !ithin thirty days from the date mentioned in column &-' below in respect of an establishmentmentioned in column &1', the statement together with fees shall be sent to the #nspector under sub%section &1'$%

    &c' #f in any establishment any person is reFuired or allowed to work in contra0ention of sections 14, 1,1, 16, -1, --, -, -4, -8, -9, 2, or 1> or

    &d' #f in any establishment a child or young person or woman is reFuired or allowed to work incontra0ention of section -, or 4> or

    manager of an establishment is charged with an offence against this Act or the rules or orders madethereunder, he shall be entitled upon complaint duly made by him to ha0e any other person whom hecharges as the actual offender brought before the 5ourt at the time appointed for hearing the charge> andif, after the commission of the offence has been pro0ed, the employer or manager of the establishmentpro0es to the satisfaction of the 5ourt%

    &a' that he has used due diligence to enforce the e"ecution of this Act> and

    &b' that the said other person committed the offence in Fuestion without his know% ledge, consent orconni0ance, that other person shall be con0icted of the offence and shall be liable to the like fine as if he

    were the employer or manager, and the employer or manager shall be discharged from any liability underthis Act

    &-' !hen it is made to appear to the satisfaction of the #nspector at any time prior to the institution of theproceedings%

    or pri0ileges which an employee in any establishment is entitled to at the date this Act comes into force ina local area, under any other law, contract, custom or usage applicable to such establishment or anyaward, settlement or agreement binding on the employer and the employee in such establishment, if suchrights or pri0ileges are more fa0ourable to him than those to which he would be entitled under this Act

    in this Act shall be deemed to apply to a factory - [to which the pro0isions of the Bactories Act, 1948 &C3###of 1948' apply$

    /ro0ided that, where any shop or commercial establishment situate within the precincts of a factory is notconnected with the manufacturing process of the factory the pro0isions of this Act shall apply to it$

    /ro0ided further that, the *tate o0ernment may, by notification in the :fficial a;ette, apply all or any ofthe pro0isions of the Bactories Act, 1948 &C3### of 1948', to any shop or commercial establishment situate

    within the precincts of a factory and on the application of that Act to such shop or commercialestablishment, the pro0isions of this Act shall cease to apply to it]11
