Vice Chair’s Report: Announcements/Introductions The Vice Chair introduced the Board’s newest member Karen Boyer and asked
her to say a little bit about herself. The Board and staff members also introduced themselves.
The Vice Chair asked the audience to introduce themselves.
Approval of the Previous Minutes – June 1, 2017
The Vice Chair called for a motion in regards to the minutes of the May 4, 2017 meeting. There being no corrections, upon a motion by Ms. Daub, seconded by Mr. Joslyn, it was voted on and unanimously carried to approve the minutes of the June 1, 2017 meeting as circulated.
Executive Officer’s Conferences/Seminars/Meetings Report:
2017 NCSBN Discipline Case Management Conference, June 12-14, 2017, Pittsburgh, Pennsylvania
The DAG reported the conference was very good and she will be providing a written report to the EO. All the event presentations are available on NCSBN’s webpage.
2017 Tri-Regulator Symposium, July 25-26, 2017, Chicago, Illinois The EO reported that she will be attending. 2017 NCSBN Annual Meeting, August 16-18, 2017, Chicago, Illinois The EO reported that Ms. Kodama, Mr. Joslyn, Vice Chair, Ms. Napoleon, Ms.
Daub and Ms. Kim will be attending. 2017 NCSBN NCLEX Conference, September 25, 2017, Chicago, Illinois The EO reported that Ms. Boyer will be attending instead of Ms. Daub.

2017 Legislature
The EO reported on the status of the following bills: SB 984, HD1, CD1 Relating to Workers’ Compensation Physician This bill was transmitted to the Governor’s office for his approval/veto. As of
7/7/17 no evidence that Governor has approved yet. HB 912, HD2, SD1 Relating to Nursing Act 88 was signed into law on 7/5/17, effective upon approval. SB 505, SD1, HD2, CD1 Relating to Health Act 66 was signed into law 7/3/17, effective 7/1/17. Amendments to Title 16, Chapter 89 – Status Report The EO reported that the DAG is still working on her review and that any non-
substantive corrections will be sent to office services.
Amendments include, but is not limited to the following:
• Placing a limit (3) as to how many times a candidate may sit for the NCLEX before being required to take a remedial course;
• Allows the Board to require all nurse applicants to obtain an additional background check, including a self-query report from the National Practitioner Data Bank;
• Includes failure to report oneself or the director of nursing, nursing supervisor, peer or colleague, any disciplinary action, termination or resignation of a nurse before conclusion of any disciplinary proceeding as “unprofessional conduct”;
• Amends APRN “recognition” to APRN “license”; and
• Allows the Board to conduct a random audit of the renewal of APRNs with prescriptive authority compliance with the continuing education requirement.
The DAG left the meeting 8:57 a.m. Continuing Competency Program (“CCP”)
Inquiry from Nadine Luke Cho – Continuing Education – Art Therapy Class? The Board discussed an inquiry from Ms. Cho asking if a CE Art Therapy for Non-
Art Therapists could be credited towards the CE learning activity option to renew her Hawaii nurse license.

The Board reviewed the information submitted for the course/workshop and
determined that the provider of the course does not appear to fall under a recognized national certifying body or local and national nursing or other professional association recognized by the Board.
Based on the information provided, it was the consensus of the Board to deny Ms.
Cho’s request. Joanna Smith – CE Tracker and Documentation Tool The EO asked Ms. Smith to address the Board regarding her CE Tracker and
Documentation Tool. Ms. Smith stated she worked on 2 separate forms for potential standardization of attestation documentation that the Board may consider using to help both licensees and the board. The forms are meant to help licensees with tracking, and to help the board streamline the verification process.
The EO stated that normally a summary chart prepared by the individual is not
acceptable as evidence. Ms. Smith stated it is mainly meant for the licensee to be able to track whatever
competences they’ve performed, not necessarily to be submitted as evidence. Mr. Joslyn stated these are great tools, however if it is posted on the Board’s
webpage there needs to be a disclaimer that these are only tools for the licensee and not to be used as evidence should they be selected for audit.
Evan Weiner – CE Broker The Board reviewed a request from a CE broker that maintains CEs for the
individual nurse. The EO stated that as this no-cost report would not be from the individual nurse but from a third party that receives the information directly from the provider, if the Board is okay with this, it should be okay to accept as evidence of completion of CE’s.
After a brief discussion, the Board by consensus agreed to accept reports from
this CE broker and other organizations that track and verify directly from the provider an individual nurses CEs.
Criminal Background Checks – Status Report on Implementation
The EO stated we have encountered some problems with employers that also
require a criminal background check/fingerprint. When a nurse applies for license, they go and get fingerprinted thinking it will cover both the employer and us, and it does not. The Board will also be discussing how to handle some of the reports that have been received in executive session.

GEPN Student Temporary Nurse License
The EO reported that she still has to discuss with the DAG whether or not statutory
amendments have to be made in order to implement a temporary license for GEPN students.
Correspondence
Inquiry Regarding Emergency/Disasters and Compact License The Board deferred responding to the following email questions below from the
last meeting for additional information on any State law that allows licensees from other states to come to Hawaii during a State of Emergency and “practice” without a Hawaii license.
“I am a volunteer with the Kidney Community Emergency Response team
and we are gathering information on the following items and would appreciate it if you’d take the time to answer a few questions:
1. If a nurse licensed in another state is needed to provide dialysis services in
an emergency or disaster situation such as a hurricane or earthquake what steps would the nurse need to take?
2. Would the nurse be able to complete the process on line? 3. Is there any pending legislature moving toward becoming a compact state? 4. What is the timeframe one might expect if applying for emergency licensure? “
During the discussion, the Board reviewed the following section: (emphasis added)
[§127A-13] Additional powers in an emergency period. (a) In the event of a state of emergency declared by the governor pursuant to [section] 127A-14, the governor may exercise the following additional powers pertaining to emergency management during the emergency period:
(2) Relieve hardships and inequities, or obstructions to the public health, safety, or welfare, found by the governor to exist in the laws and to result from the operation of federal programs or measures taken under this chapter, by suspending the laws, in whole or in part, or by alleviating the provisions of laws on such terms and conditions as the governor may impose, including licensing laws, quarantine laws, and laws relating to labels, grades, and standards;
(3) Suspend any law that impedes or tends to impede or be detrimental to the expeditious and efficient execution of, or to conflict with, emergency functions, including laws which by this chapter specifically are made applicable to emergency personnel;

It was the consensus of the Board to respond to Ms. Deziel questions as follows:
1. If a nurse licensed in another state is needed to provide dialysis services in an emergency or disaster situation such as a hurricane or earthquake what steps would the nurse need to take? Answer: Based on the statute cited above, the nurse from another
state would have to ensure that his/her license is current and unencumbered and that he/she has their credentials if working as a nurse during a State of Emergency.
2. Would the nurse be able to complete the process on line?
Answer: Not applicable.
3. Is there any pending legislature moving toward becoming a compact
state? Answer: Not at this time.
4. What is the timeframe one might expect if applying for emergency licensure?
Answer: Not applicable.

Aidan Hamilton, Remote Area Medical Nurse Volunteer The Board reviewed the following emailed inquiry: “I am writing you on behalf of Remote Area Medical (RAM) — a non-profit whose
mission is to provide free, quality healthcare to the indigent. To accomplish this mission, RAM relies on the generosity of physicians, dentists, nurses, and optometrists, who volunteer their time to serve those in need. Therefore, it is imperative that we understand the legal requirements of medical volunteer licensure in Hawaii.
May nurses licensed to practice within Hawaii volunteer their time in Hawaii? If so,
what is the necessary paperwork that in-state nurses need to complete to volunteer? If possible, please either attach the necessary paperwork to your response or provide a link to the paperwork. To whom is the paperwork submitted and when must the paperwork be submitted?

May nurses licensed to practice within another state volunteer their time in
Hawaii? If so, what is the necessary paperwork that out-of-state nurses need to complete to volunteer? If possible, please either attach the necessary paperwork to your response or provide a link to the paperwork. To whom is the paperwork submitted and when must the paperwork be submitted?...”
During the discussion, the Board reviewed the following section: (emphasis added)
§457-1 Purpose. In order to safeguard life and health, any person
practicing or offering to practice as an advanced practice registered nurse, a registered nurse, or a licensed practical nurse in this State for compensation shall be required to submit evidence that the person is qualified to so practice, and shall licensed as provided in this chapter. It shall be unlawful for any person not licensed under this chapter to practice or offer to practice nursing as an advanced practice registered nurse, a registered nurse or a licensed practical nurse; or to use any sign, card, or device, or in any manner indicate or imply that the person is an advanced practice registered nurse, a registered nurse or a licensed practical nurse.
After careful consideration, the Board determined that in order to safeguard the
residents of this State in the practice of nursing, all individuals who practice or offer to practice nursing, notwithstanding any other law to the contrary, shall be required to hold a current and active Hawaii nurse license. Therefore, it was the consensus of the Board to respond to the questions as follows:
May nurses licensed to practice within Hawaii volunteer their time in Hawaii? Answer: Yes, with a current and active nurse license. If so, what is the necessary paperwork that in-state nurses need to complete to
volunteer? Answer: No separate paperwork or application as long as the individual has a current and active Hawaii nurse license. May nurses licensed to practice within another state volunteer their time in
Hawaii? Answer: Yes, if they hold a current and active Hawaii nurse license. If so, what is the necessary paperwork that out-of-state nurses need to complete
to volunteer?

Answer: Any applicant for a Hawaii nurse license shall complete the
endorsement application that is available on the Board’s web page.

Diane Okumura, Question regarding nursing practice The Board reviewed the following emailed inquiry: “A question came up regarding if facilities are required to obtain current licensure
status of PMD (Private Medical Doctor) as they give orders to RNs for meds, treatment, etc. I looked in NCSBN model act and only states follow orders from physician. Is there a concern if the facility does not obtain current license? (The facility is questioning whether they need to obtain the current license of the Dr. before they receive orders from the Dr.).
Also, a question came up from one of the surveyors regarding nurses dispensing
meds if they take meds out of stock supply. The “stock supply” is what the facility purchases from the pharmacy and uses the stock medications (i.e.: Tylenol, milk of magnesia, cough medicines, etc.) I was told that the Board did make a determination regarding narcotics but this question pertains only to over the counter drugs, which may apply across the board for stock meds – can you please clarify?”
After some discussion, it was the consensus of the Board to refer Ms. Okumura to
the Office of Health Care Assurance (“OHCA”) on her question for facility’s requirements on PMD license information. OHCA is the appropriate State agency that performs all state licensing activities on healthcare facilities, agencies and organizations in Hawaii, including on-site state licensing surveys and Medicare certification surveys and for nurses “dispensing” stock meds of OTC drugs, an RN may use reasonable judgment in carrying out prescribed medical orders of a licensed physician or APRN or other licensed health care provider listed under the definition of “The practice of nursing as a registered nurse” in HRS 457-2.
The DAG returned to the meeting 9:33 a.m.
Article entitled “Spotting impairment in the healthcare workplace” The Board was provided with an Article entitled “Spotting impairment in the
healthcare workplace” for their information. The article talks about the risk factors, peer pressures, stress, family history of addictions, etc. It also talks about recognizing some of the signs of impairment like missing medications, discrepancies in medical reports and frequent request for patient needing more

pain medications. The article goes on to talk about what we should do and that we have a requirement to not only possibly save their life but also a requirement to disclose this. It is a very well written article.
Sharilyn Butteling, Inquiry on TelePsych Practice The Board reviewed the following emailed inquiry:
“I presently work at Aloha House which is a non-profit community based dual diagnosed program. I am their RN and recently became a PMHNP-BC. I am waiting for my license to be processed in July sometime. However, in the meantime Aloha House asked me to find out how I may work out of my home on days where I cannot get to the office due to accidents, fires, weather or other unforeseen problems and still see my clients. I may also use Tele-psychiatry on a regular basis if Aloha House wants me to work more hours.
Therefore, I wanted to start any process I can until I get my license in. Aloha
House is already starting the credentialing process with the different insurance companies.
At this point I would be contracted out by Aloha House as an LLC business. I have
done telepsychiatry with another PsychNP for a year as she does telepsych out of her home on Maui with a clinic in Arizona. Her situation is different as the health company set up all of her software equipment to be encrypted and she has a license in AZ to practice.
So my question is how does one set up a telepsychiatry so that it follows the rules
and regulations of the State of Hawaii BON have put in place?” The Board reviewed the definition of “Telehealth” under HRS §457-2 that states: "Telehealth" means the use of telecommunications as that term is defined in
section 269-1, to encompass four modalities: store and forward technologies, remote monitoring, live consultation, and mobile health; and which shall include but not be limited to real-time video conferencing-based communication, secure interactive and non-interactive web-based communication, and secure asynchronous information exchange, to transmit patient medical information, including diagnostic-quality digital images and laboratory results for medical interpretation and diagnosis, to support long-distance clinical health care while a patient is at an originating site and the nurse is at a distant site, patient and professional health-related education, public health and health administration, to the extent that it relates to nursing.

It was the consensus of the Board to refer Ms. Butteling to the definition of
“Telehealth” in HRS Chapter 457 as there are no further nurse licensing requirements to perform telehealth.
Summer Hobbs, Question on Resort Care Nursing The Board reviewed the following email inquiry: “I am an RN who has relocated to Hawaii. I have an opportunity to be a nurse
living on site at a new geriatric and special needs resort. I know I will require personal nursing insurance. Do I need to inform the board of nursing if I accept this position?
Also, does the resort require a permit or permission to advertise that a nurse lives
on site and can provide non-invasive care? If there were tenants who require invasive care such as IV therapy or colostomy care etc would we need a special permit for that?”
The Board reviewed the following definition in HRS 457-2 in conjunction with this
inquiry: "The practice of nursing as a registered nurse" means the performance of
professional services commensurate with the educational preparation and demonstrated competency of the individual having specialized knowledge, judgment, and skill based on the principles of the biological, physical, behavioral, and sociological sciences and nursing theory, whereby the individual shall be accountable and responsible to the consumer for the quality of nursing care rendered. The foregoing may include but shall not be limited to observation, assessment, development, implementation, and evaluation of a plan of care, health counseling, supervision and teaching of other personnel, and teaching of individuals, families, and groups in any stage of health or illness; administration, supervision, coordination, delegation, and evaluation of nursing practice; provision of health care to the patient in collaboration with other members of the health care team as autonomous health care professionals providing the nursing component of health care; or use of reasonable judgment in carrying out prescribed medical orders of a licensed dentist, physician, osteopathic physician, or podiatrist licensed in accordance with chapter 448, 453, 460, or 463E; orders of an advanced practice registered nurse licensed in accordance with this chapter; or the orders of a physician assistant licensed pursuant to chapter 453, practicing with physician supervision as required by chapter 453, and acting as the agent of the supervising physician.
(b) Definitions applicable to this chapter shall also include those used in the NCSBN Model Nursing Practice Art and the Model Nursing Administrative Rules unless the context otherwise requires. Where a definition in the NCSBN Model Nursing Practice Act or Model Nursing Administrative Rules conflicts with a

definition in chapter 457 or 436B, the definitions contained in chapter 457 or 436B and the rules of the board shall apply.
After some discussion, it was the consensus of the Board to respond to Ms. Hobbs
inquiry as follows: I am an RN who has relocated to Hawaii. I have an opportunity to be a nurse
living on site at a new geriatric and special needs resort. I know I will require personal nursing insurance. Do I need to inform the board of nursing if I accept this position?
Answer: No, you do not need to notify the Board of your new nurse
position. Also, does the resort require a permit or permission to advertise that a nurse lives
on site and can provide non-invasive care? If there were tenants who require invasive care such as IV therapy or colostomy care etc would we need a special permit for that?
Answer: You may contact the Office of Health Care Assurance (“OHCA”)
on your question for facility’s requirements or permits/license information. OHCA is the appropriate State agency that performs all state licensing activities on healthcare facilities, agencies and organizations in Hawaii, including on-site state licensing surveys and Medicare certification surveys.
The Board also wanted to inform Ms. Hobbs of the definition of “The practice of
nursing as a registered nurse” definition as it pertains to the provision of IV therapy or colostomy care by a registered nurse.
Working Solutions – July 2017 The Board was provided with a copy of the current Working Solutions for their
information. Hawaii State Ms. Reichhardt reported that they have received more survey responses this past Center for Nursing: renewal than in the last two years. Applications: The Board moved into Executive Session. Executive Session: At 9:44 a.m. upon a motion by Ms. Daub, seconded by Mr. Joslyn, it was voted on
and unanimously carried to move into Executive Session in accordance with HRS, 92-5(a) (1) and (4), “To consider and evaluate personal information relating to individuals applying for nurse licensure;” and “To consult with the board’s attorney

At 10:15 a.m. upon a motion by Mr. Joslyn, seconded by Mr. Duldulao, it was voted on and unanimously carried to move out of executive session.
Chapter 91, HRS The Vice Chair called for a recess from the meeting at 10:15 a.m., to discuss and Adjudicatory Matters: deliberate on the following adjudicatory matters pursuant to Chapter 91, HRS:

§16-89-2 Definitions. As used in this chapter: "Certification" means a form of specialized credentialing, under sponsorship of a recognized national certifying body that has verified an applicant's advanced knowledge, skills, and abilities in defined areas of nurse practice specialties as listed in section 16-89-85. §16-89-85 Recognized national certifying body; certification. (a) National certifying bodies recognized by the board to certify the advanced practice registered nurse specialty include: (1) The American Nurses Credentialing Center; (2) The Pediatric Nurses Certification Board ; (3) The National Certification Corporation for Obstetric, Gynecologic and Neonatal Nursing Specialties; (4) The Council on Certification of the American College of Nurse-Midwives; (5) The National Board of Certification and Recertification for Nurse Anesthetists; and (6) The American Academy of Nurse Practitioners. (b) The board may recognize other national certifying bodies accredited by the ABNS or the NCCA, which provide competency-based certification examinations reflective of APRN knowledge of and expertise in their nursing specialties. §16-89-119 Prescriptive authority eligibility requirements. (a) The requirements for prescriptive authority are as follows: (4) Proof of a current, unencumbered certification for specialized and advanced nursing practice from a national certifying body recognized by the board;

After some discussion it was the consensus of the Board not to remove the conditions on Ms. Doherty’s expired license and should she submit a restoration application or re-reapply for license, the Board will assess at that time if conditions are still applicable.

Upon a motion by Mr. Joslyn, seconded by the Vice Chair it was voted on an unanimously carried to delegate the following to the EO:
• If nurse applicant answered “Yes” to prior conviction and provided documents and CBC report matches information that applicant provided, then EO to prepare for BON review or approve as delegated;

• If nurse applicant answered “Yes” to pending investigation and provided documents and CBC report DOES NOT match information that applicant provided, i.e. additional arrest or convictions on CBC record, then EO to prepare for BON review or approve as delegated.

volunteered for position of Vice Chair. There being no opposition, the Board by consensus appoints Ms. Tali as the Board Chair
