================================================================== BACKGROUND Education Code 60119 states the governing board of a school district shall hold a public hearing at which the board shall encourage participation by parents, teachers, members of the community interested in the affairs of the school district, and bargaining unit leaders. At this hearing a determination shall be made, through a resolution, as to whether each pupil has sufficient textbooks or instructional materials, or both, to use in class and to take home. These textbooks or instructional materials shall be aligned to the content standards pursuant to Education Code 60605 or 60605.8 in each of the following subjects, that are consistent with the content and cycles of the curriculum framework adopted by the state board in mathematics, science, history-social science, English language arts, including the English language development component of an adopted program, foreign language and health. Approval of this item supports the goals identified within the District’s Strategic Plan. RECOMMENDATION It is recommended the Board of Education: a) Conduct a public hearing regarding the sufficiency of instructional materials 2015/2016, and b) Adopt Resolution 2015/2016-30 Sufficiency of Instructional Materials 2015/2016. Sufficiency of Instructional Materials WHEREAS, the Board of Education of the Chino Valley Unified School District, in order to comply with the requirements of Education Code 60119, held a public hearing on October 1, 2015, at 7:00 pm, which is on or before the eighth week of school (between the first day that students attend school and the end of the eighth week from that day) and which did not take place during or immediately following school hours; WHEREAS, the Board provided at least 10 days notice of the public hearing by posting it in at least three public places within the district stating the time, place, and purpose of the hearing; WHEREAS, the Board encouraged participation by parents/guardians, teachers, members of the community, and bargaining unit leaders in the public hearing; WHEREAS, information provided at the public hearing detailed the extent to which textbooks and instructional materials were provided to all students, including English learner, in the Chino Valley Unified School District;
WHEREAS, the definition of “sufficient textbooks or instructional materials” means that each student, including each English learner, has a standards-aligned textbook and/or instructional materials to use in class and to take home, which may include materials in a digital format but shall not include photocopied sheets from only a portion of a textbook or instructional materials copied to address a shortage;
WHEREAS, the definition of “sufficient textbooks or instructional materials” also
means that all students who are enrolled in the same course within the Chino Valley Unified School District, have standards-aligned textbooks or instructional materials from the same adoption cycle;
WHEREAS, sufficient textbooks or instructional materials were provided to each student, including each English learner, that are aligned to the academic content standards and consistent with the cycles and content of the curriculum frameworks in the following subjects:

Student Showcase: Marshall ES Music teacher Dr. Stan Berger led students in a musical performance. 2. Backpack Donations to CARE/HOPE from St. Paul the Apostle Church President Blair presented certificates of recognition to volunteers from St.
Paul the Apostle Catholic Church Clothing Ministry for their efforts in procuring over 450 backpacks filled with school supplies for students in need.
3. Professional Development Plan Grace Lee, Director of Professional Development and the Professional
Development Team provided a presentation regarding SB77-Educator Effectiveness Grant and Professional Development Plan.
4. California Assessment of Student Performance and Progress Julian Rodriguez, Director of Assessment and Instructional Technology,
provided a presentation regarding an update on the California Assessment of Student Performance and Progress.
I.D. COMMENTS FROM STUDENT REPRESENTATIVE Shweta Shah was absent. I.E. COMMENTS FROM EMPLOYEE REPRESENTATIVES Todd Hancock, A.C.T. President, acknowledged Marshall ES students who
performed and Dr. Berger’s accordion performance; acknowledged the efforts of St. Paul the Apostle Catholic Church for their efforts in helping students; quoted Roger Lewin regarding giving children answers to remember rather than problems to solve; spoke about professional development for teachers and asked that BTSA be considered as professional development for beginning teachers; thanked teachers for their help on testing; shared a story about an 18-year-old girl named Jena regarding her struggle with anxiety and depression and the support she received from teachers; and spoke about education reformist Horace Mann.

Yvette Farley, CHAMP President, said she and Butterfield Ranch ES Principal Rod Federwisch attended an event hosted by the California Association of Latino Superintendents and Administrators and said it was inspiring to hear Dr. David Verdugo, Executive Director, speak about Latinos in leadership, and spoke about the importance of mentors for students; announced Week of the School Administrators on October 11; and read the Starfish parable and The Bridge metaphor.

BOARD MEMBERS AND SUPERINTENDENT James Na spoke about the passing of former administrator Mark Goldband and asked President Blair to close the meeting in his memory; asked for prayers for District locksmith Rich Garrison whose wife is having health issues; thanked Don Lugo staff and students for keeping the campus clean; acknowledged football players for coming and addressing the Board regarding their new football jerseys; said Don Lugo cheer team was inspiring at a recent game; said he agrees with Todd Hancock regarding BTSA; and thanked Board member Mrs. Orozco for having the heart of a mother for kids. Pamela Feix said that providing childcare for her grandson has limited her ability to attend events although she would love to; attended a staff development workshop for 6th grade teachers at the adult school; visited Don Lugo’s equestrian PE on Tuesday morning; and acknowledged Dr. Joann Merrick in the audience. Sylvia Orozco acknowledged retirements on the agenda; said the Bicycles for Children Charity is coming to the October 1 Board meeting; clarified questions regarding when the Board is acknowledging Los Angeles County Fair Chino and Chino Hills Junior Community Heroes; asked for student recognitions to be brought back as a regular presentation item; announced the city of Chino and Chino Liberty Courtyard’s Veterans Tribute Dinner on October 11; and spoke about an article highlighting Diana Taurasi, a Don Lugo HS graduate. President Blair asked for and received consensus to extend the meeting beyond 10:00 p.m.

Andrew Cruz visited Ms. Lopez’s 2nd grade class at Alicia Cortez; visited Ms. Walker’s class at Cal Aero Preserve; said Ms. Welch, Mr. Sandoval, Mr. Novic, and Mr. Jenkins provide stimulating educational environments; attended football games at Chino Hills HS and Don Lugo HS; said he met with the graphic/video teacher at Chino Hills HS and expressed his support; thanked Chino Valley Medical Center for participating in the 2015 Pink Glove Dance Contest raising breast cancer awareness and for working with Don Lugo HS, Walnut ES, AMR, and Chino fire and police in the video production; and closed by honoring the memory of Mark Goldband.
Superintendent Joseph invited people to join the Community Conversation regarding priorities for local schools by completing a community feedback form found on the District website; said the Hope committee met last week and reported last year the total number of families and students served through the HOPE Family Resource Centers was 608: since July 1 there have been 395 families and students served; a total of 2,017 of service calls, office visits or follow-up last year; and closed by honoring Mr. Mark Goldband.
President Blair reminded everyone about the family reading rally at Cal State San Bernardino on September 19; said Chino HS is offering $5.00, with a field trip slip, away game transportation; closed with comments by Horace Mann regarding education being a great equalizer; and thanked staff, teachers, and Superintendent for providing a quality public education to CVUSD students.

President Blair adjourned the regular meeting of the Board of Education at 10:08 p.m. in memory of Mark Goldband and all employees we have recently lost.

GRANT-PROFESSIONAL DEVELOPMENT PLAN FOR CHINO VALLEY UNIFIED SCHOOL DISTRICT

BACKGROUND
California Senate Bill 77 Section 58 provides Local Educational Agencies, County Office of Education (CDE) with one-time funding for professional development utilizing the Educators Effectiveness Grant. The anticipated funding is $1,400.00 per certificated staff based on the 2014/2015 certificated staffing. The District will receive the one-time funding during the fall of 2015, and can be used during the next three fiscal years (2015/2016, 2016/2017, and 2017/2018). The four categories in which the funds can be used are as follows:
1. Beginning teacher and administrator support, 2. Professional development and coaching for teachers needing improvement, 3. Professional development for teachers aligned to California state standards, and 4. General support for educator (teacher and leader) quality effectiveness.
The requirements for spending are as follows:
1. Present Professional Development Plan in a public meeting, 2. Adopt Professional Development Plan, and 3. Submit the report of detailed expenditure information to CDE.
On September 3 and 17, 2015, the Professional Development Plan was presented to the Board. Approval of this item supports the goals identified within the District’s Strategic Plan.

RECOMMENDATION It is recommended the Board of Education adopt Senate Bill 77: Educator Effectiveness Grant-Professional Development Plan for the Chino Valley Unified School District. FISCAL IMPACT An estimated $1.7 million in one-time funding from the Educators Effectiveness Grant for professional development.

School-sponsored trips may be conducted in connection with the District’s course of study or school related social, educational, cultural, athletic, school band activities, or other extracurricular or cocurricular activities. Resources will be identified and established at the school site to assist economically disadvantaged students in obtaining funding for field trips and, in some cases, student travel. Field trips that require overnight stay or are in excess of 250 miles (one way) require board approval. Approval of this item supports the goals identified within the District’s Strategic Plan. RECOMMENDATION It is recommended the Board of Education approve the following school-sponsored trips:

The Superintendent or designee shall arrange for the sale or disposal of District personal property in accordance with Board policy and the requirements of Education Code 17545. Lists of surplus items are emailed to the Facilities/Planning Department to be placed on an upcoming Board agenda. After Board approval, items may be picked up by District warehouse or a liquidation company for public auction. Proceeds of the sale are deposited into the General Fund.

During the course of construction, modifications to the original approved plans are made due to unforeseen conditions, revisions, or amended project scope. The following change order has been reviewed and recommended for approval by District staff and Vanir Construction Management.

Week of the School Administrator WHEREAS, leadership matters for California’s public education system and the more than 6 million students it serves; WHEREAS, school administrators are passionate, lifelong learners who believe in the value of quality public education; WHEREAS, the title “school administrator” is a broad term used to define many education leadership posts. Superintendents, assistant superintendents, principals, assistant principals, special education and adult education leaders, curriculum and assessment leaders, school business officials, classified education leaders, and the other district employees are considered administrators; WHEREAS, providing quality service for student success is vital for the profession; WHEREAS, most school administrators began their careers as teachers. The average administrator has served in public education for more than a decade. Most of California’s superintendents have served in education for more than 20 years. Such experience is beneficial in their work to effectively and efficiently lead public education and improve student achievement; WHEREAS, school leaders depend on a network of support from school communities – fellow administrators, teacher, parents, students, businesses, community members, board trustees, colleges, and universities, community and faith-based organizations, elected officials and district and county staff and resources – to promote ongoing student achievement and school success; WHEREAS, research shows great schools are led by great principals, and great districts are led by great superintendents. Service-Learning Agreement California State Polytechnic University, Pomona
This agreement (“Agreement”) is between the Trustees of the California State University on behalf of California State Polytechnic University, Pomona and ______________________________________ (“Learning Site”). In consideration of the mutual promises set forth below, the University and Learning Site (“parties”) agree as follows:
I. Learning Site’s Responsibilities
A. Identify the student’s supervisor. The supervisor agrees to meet with the student regularly to facilitate the student’s learning experience, provide support, review progress on assigned tasks, verify service hours and give feedback.
B. Provide an orientation that includes a site tour; an introduction to staff; a description of the characteristics of and risks associated with the Learning Site’s operations, services and/or clients; a discussion concerning safety policies and emergency procedures; and information detailing where students check-in and how they log their time.
C. Provide student with a written description of the student’s tasks and responsibilities. D. Provide appropriate training, equipment, materials and work area for students prior to students
performing assigned tasks or working with the Learning Site’s clients. E. Inform student of the need for a background check, fingerprinting and/or a tuberculosis test; obtain the
student’s fingerprints, background check and/or tuberculosis test; and maintain the confidentiality of any results as required by federal and state law.
F. Evaluate the student if requested by the University and contact the University if the student fails to perform assigned tasks or engages in misconduct.
G. Notify the University as soon as is reasonably possible of any injury or illness to a student participating in a learning activity at the Learning Site.
II. University’s Responsibilities
A. The University will advise the student(s) of their responsibility to:
1. Participate in all training required by the Learning Site. 2. Exhibit professional, ethical and appropriate behavior when at the Learning Site. 3. Complete all assigned tasks and responsibilities in a timely and efficient manner. 4. Abide by the Learning Site’s rules and standards of conduct. 5. Maintain the confidentiality of the Learning Site’s proprietary information, records and
information concerning its clients.
B. The University will advise student that neither the University nor the Learning Site assumes any financial responsibility in the event he/she is injured or becomes ill as a result of his/her participation a learning activity at the Learning Site.
C. Provide the student with general and professional liability insurance in the amount of $1,000,000 per occurrence, $3,000,000 general aggregate. This insurance only applies if both parties have signed this Agreement.
III. General Provisions A. This Agreement will become effective as of the date last written below and continue for a period of 5
years unless terminated by either party after giving the other party 30 days written notice of the intent to terminate. If the Learning Site terminates this Agreement, it will permit any student working at the Learning Site at the time of termination to complete his/her work. At the 5 year termination date the

agreement can be renewed once it has been reviewed, updated as applicable and executed by the appropriate parties.
B. The Learning Site and the University agree to indemnify, defend and hold harmless each other from any and all liability for any personal injury, damages, wrongful death or other losses and costs, including but not limited to reasonable attorney fees and defense costs, arising out of the negligence or willful misconduct of their respective officers, employees, agents or volunteers in the performance of this Agreement. This paragraph will survive expiration or termination of this Agreement.
C. Each party agrees to maintain general liability coverage of at least $1,000,000 per occurrence, $2,000,000 aggregate and to provide evidence of coverage upon request. Insurance must be placed with insurers with a current A.M. Best rating of at least A: VII.
D. The Learning Site and the University will meet upon request or as necessary to resolve any potential conflicts and to facilitate a mutually beneficial experience for all involved.
E. The Learning Site may dismiss a student if the student violates its standards, mission or goals. The Learning Site will document its rationale for terminating a student and provide the University with a copy of the rationale upon request.
F. Students participating in a learning activity at the Learning Site are not officers, employees, agents or volunteers of the University or the Learning Site.
G. Nothing contained in this Agreement confers on either party the right to use the other party’s name without prior written permission, or constitutes an endorsement of any commercial product or service by the University.
H. This Agreement may not be altered unless both parties agree in writing. The parties agree to follow all applicable federal, state and local laws and regulations, including but not limited to laws prohibiting discrimination and harassment.

COMPLAINT REPORT SUMMARY FOR JULY THROUGH SEPTEMBER 2015
==================================================================== BACKGROUND In accordance with the Williams settlement legislation, Education Code 35186 states that the Superintendent or designee shall report summarized data on the nature and resolution of all Williams related complaints to the Board of Education and the San Bernardino County Superintendent of Schools on a quarterly basis. Williams related complaints are complaints specific to 1) insufficiency of instructional materials, 2) unsafe facilities, or 3) teacher vacancy or misassignment. The report shall include the number of complaints by general subject area with the number of resolved and unresolved complaints. These summaries shall be publicly reported on a quarterly basis at a regularly scheduled board meeting. Consideration of this item supports the goals identified within the District’s Strategic Plan. RECOMMENDATION It is recommended the Board of Education receive for information the Williams Settlement Legislation Quarterly Uniform Complaint Report Summary for July through September 2015. PERSONNEL – HEALTH EXAMINATIONS ================================================================== BACKGROUND Board policies, administrative regulations, and bylaws of the Board are routinely developed and revised as a result of changes in law, mandates, federal regulations, and current practice. Administrative Regulation 4112.4 All Personnel – Health Examinations is being revised to reflect new law AB 1667, which requires employees to complete a tuberculosis risk assessment. New language is provided in UPPER CASE while old language to be deleted is lined through. Consideration of this item supports the goals identified within the District’s Strategic Plan. HEALTH EXAMINATIONS Tuberculosis Tests No applicant shall be initially employed BY THE DISTRICT, OR EMPLOYED UNDER CONTRACT, in a classified or certificated position unless HE/SHE HAS SUBMITTED TO A TUBERCULOSIS RISK ASSESSMENT within the past 60 days AND, IF TUBERCULOSIS RISK FACTORS ARE IDENTIFIED, he/she has submitted to an intradermal or other APPROVED tuberculin EXAMINATION TO DETERMINE THAT HE/SHE IS FREE OF INFECTIOUS TUBERCULOSIS. test licensed by the Food and Drug Administration and, If THE RESULTS OF THE EXAMINATION ARE that test was positive, the applicant shall has subsequently obtained an x-ray of the lungs. (Education Code 49406) The cost of the pre-employment tuberculosis examination shall be paid by the applicant. An applicant who was previously employed in another California school district OR PRIVATE OR PAROCHIAL SCHOOL SHALL BE DEEMED TO HAVE may fulfillED the tuberculosis TESTING examination requirement IF HE/SHE PRODUCES either by producing a certificate showing that he/she was examined within the last four years and found to be free of INFECTIOUS active tuberculosis WITHIN 60 DAYS or by having his/her OF HIRE OR IF HIS/HER previous school district employer verify that it has on file a certificate ON FILE SHOWING THAT THE APPLICANT IS FREE FROM INFECTIOUS TUBERCULOSIS. (Education Code 49406) which contains that evidence THEREAFTER, Every EACH District employee who WAS FOUND FREE OF INFECTIOUS TUBERCULOSIS tests negative shall undergo a tuberculosis RISK ASSESSMENT, AND AN examination WHENEVER RISK FACTORS ARE IDENTIFIED, at least once every four years, or more often WHEN REQUIRED if so directed by the Board of Education upon recommendation of the county health officer, for as long as the

HOWEVER, ONCE an employee HAS with a documented positive test for tuberculosis infection FOLLOWED BY AN X-RAY, HE/SHE shall no longer be required to submit to the TUBERCULOSIS RISK ASSESSMENT examination but shall be referred to the county health officer within 30 days of the examination to determine the need for follow-up care. (Education Code 49406) THE COST OF THE PRE-EMPLOYMENT TUBERCULOSIS RISK ASSESSMENT AND/OR EXAMINATION SHALL BE PAID BY THE APPLICANT, UNLESS THE BOARD HAS DETERMINED THAT THE DISTRICT WILL REIMBURSE AN APPLICANT WHO IS SUBSEQUENTLY HIRED BY THE DISTRICT. THE DISTRICT SHALL REIMBURSE THE EMPLOYEE FOR THE COST, IF ANY, OF SUBSEQUENT TUBERCULOSIS RISK ASSESSMENTS AND EXAMINATIONS, THE DISTRICT MAY PROVIDE FOR THE RISK ASSESSMENT AND EXAMINATION OR MAY ESTABLISH A REASONABLE FEE FOR THE EXAMINATION THAT IS REIMBURSABLE TO THE EMPLOYEE. (EDUCATION CODE 49406) Tuberculosis tests for employees shall be provided by the District or at District expense. (Education Code 44839, 45122, 49406) WHENEVER THE DISTRICT CONTRACTS FOR THE TRANSPORTATION OF STUDENTS, THE CONTRACT SHALL REQUIRE THAT ALL DRIVERS WHO WILL BE TRANSPORTING STUDENTS COMPLETE THE TUBERCULOSIS RISK ASSESSMENT AND, IF INDICATED, THE EXAMINATION FOR INFECTIOUS TUBERCULOSIS WITHIN 60 DAYS OF INITIAL HIRE. (EDUCATION CODE 49406) (cf. 3312 – Contracts) (cf. 3540 – Transportation) (cf. 3542 – School Bus Drivers) THE FOLLOWING APPLICANTS OR EMPLOYEES SHALL BE EXEMPTED FROM THE REQUIREMENT TO SUBMIT TO A TUBERCULOSIS RISK ASSESSMENT AND/OR EXAMINATION: (EDUCATION CODE 49406)
1. AN APPLICANT/EMPLOYEE WHO If an employee's religious belief prevents him/her from undergoing a tuberculosis examination, the employee shall fileS an affidavit stating that he/she adheres to the faith or teachings of a well-recognized religious sect, denomination, or organization and, in accordance with its creed, tenets, or principles, depends for healing upon prayer in the practice of religion and that, to the best of his/her knowledge or belief, he/she is free from active tuberculosis. In order to exempt the individual, the board shall determine by

resolution, after a hearing, that the health of students would not be jeopardized. (Education Code 49406)
SUCH AN EXEMPTION SHALL BE ALLOWED ONLY IF THE BOARD DETERMINES BY RESOLUTION, AFTER A HEARING, THAT THE HEALTH OF STUDENTS WOULD NOT BE JEOPARDIZED. IF AT ANY TIME THERE IS PROBABLE CAUSE TO BELIEVE THAT THE APPLICANT/EMPLOYEE IS INFECTED WITH INFECTIOUS TUBERCULOSIS, HE/SHE MAY BE EXCLUDED FROM SERVICE UNTIL HE BOARD IS SATISFIED THAT HE/SHE IS NOT AFFLICTED. (cf. 4030 – Nondiscrimination in Employment)
2. The Superintendent or designee may exempt from the tuberculosis testing requirement A classified Employees who are employed for less than a school year AND WHOSE if their functions do not require frequent or prolonged contact with students.
3. The Superintendent or designee may exempt A pregnant employee WHO HAS
POSITIVE RESULTS ON A TUBERCULOSIS SKIN TEST, IN WHICH CASE SHE SHALL BE EXEMPTED from the requirement that a positive tuberculin test be TO followed UP by WITH an x-ray of the lungs for a period not to exceed 60 days AFTER THE END following termination of the pregnancy.
4. A PRIVATE CONTRACTED DRIVER WHO TRANSPORTS STUDENTS INFREQUENTLY WITHOUT PROLONGED CONTACT WITH STUDENTS.
EXAMINATION OF CERTIFICATED EMPLOYEES FOR DISABLING DISEASES Medical Certification for Communicable Diseases for Certificated Employees The Board shall not TO fill a CERTIFICATED position requiring certification with an applicant who has not previously been employed in a certificated position in California, or a retirant who has not been employed as a retirant, unless the District SHALL HAVE has on file a medical certification INDICATING THAT THE APPLICANT OR RETIRANT IS FREE FROM ANY DISABLING DISEASE WHICH WOULD RENDER HIM/HER UNFIT TO INSTRUCT OR ASSOCIATE WITH CHILDREN. (Education Code 44839, completed and submitted by a physician, physician assistant, registered nurse, or commissioned medical officer. HEALTH EXAMINATIONS (cont.) THE CERTIFICATE SHALL BE COMPLETED AND SUBMITTED DIRECTLY TO THE DISTRICT BY AN AUTHORIZED HEALTH CARE PROVIDER. The medical certification shall certify that the applicant or retirant is free from any disabling disease which would render him/her unfit to instruct or associate with children. The medical examination referred to in the certificate must have been conducted within six months of the date that the certificate is filed. (Education Code 44839, 44839.5; 5 CCR 5503) Applicants and retirants shall pay for the cost of obtaining the medical certification. (Education Code 44849, 44839.5) The Board may require Certificated employees and/or retirants SHALL BE REQUIRED to PERIODICALLY undergo, at District expense, a periodic medical examination pursuant to Education Code 44839 or 44839.5 to determine that they are free from any communicable disease making them unfit to instruct or associate with children. (Education Code 44839, 44839.5) Mental Examination for Certificated Employees WHENEVER THE BOARD IS CONSIDERING THE A certificated employee may be suspendSIONed or transferred OF A CERTIFICATED EMPLOYEE BASED ON ITS to other duties if the Board has reasonable cause to belieFve that the employee is suffering from mental illness of such a degree as to render him/her incompetent to perform his/her duties, THE EMPLOYEE SHALL BE OFFERED THE OPPORTUNITY OF BEING EXAMINED BY A THREE-MEMBER PANEL OF PSYCHIATRISTS AND PSYCHOLOGISTS IN ACCORDANCE WITH EDUCATION CODE 44942. The employee shall select the members of the panel from a list of psychiatrists and psychologists provided by the District. The examination shall be conducted, at District expense, within 15 days of the ordered suspension or transfer. The employee shall submit to the examination, but shall also be entitled to present a report of any psychiatrist, psychologist, or physician of his/her own choice. (Education Code 44942) In such a case, the District shall follow the process specified in Education Code 44942 and the District's collective bargaining agreement, including the opportunity for the employee to be examined by a panel of psychiatrists or psychologists.
