Mr. Michael Brinchek, Smith & Gardner Engineering, presented the information explaining that Wilson County Solid Waste Services desires to expand the current West Side C&D Landfill located on Highway 42 East, in Wilson, North Carolina. The proposed expansion is comprised of an approximate 46-acre waste footprint located on existing County property and has an estimated gross waste disposal capacity of 2,000,000 cubic yards (CY).

B. Conduct public hearing to consider the REDD (Rural Economic Development Division)

as a Community Development Block Grant for the Wilson County Senior Center. Commissioner Boyette called the public hearing to order. Ms. Tiffany Purdy, Grants Administrator, presented the public hearing to consider the REDD (Rural Economic Development Division) as a Community Development Block Grant for the Wilson Senior Center to analyze the facilities design, improve wellness and screening opportunities and increase needed space. WILSON COUNTY AND FIRST TRANSIT, INC. THIS Modification Agreement is made and entered into as of the 1st day of July 2020 by and between County of Wilson, North Carolina (“County”) and First Transit, Inc. (“First Transit”), Diversified Opportunities, Wilson County Services for the Blind, Wilson County Department of Social Services, Wilson County Senior Citizen Affairs, Wilson County Senior Center and Wilson Transit (collectively “the Agencies” and all named parties collectively “the Parties”).

WHEREAS, County and First Transit entered into that certain Contract for Wilson County Coordinated Transportation Services dated February 1, 2016 (hereinafter the “Agreement”) and amended and extended Agreement on July 1, 2016 (hereinafter the “First Amendment and Extension”); and amended and extended Agreement on November 1, 2016 (hereinafter the “Second Amendment and Extension”); and amended and extended Agreement on July 1, 2017 (herein after the “Third Amendment and Extension”); and amended and extended Agreement on July 1, 2019 (herein after the “Fourth Amendment and Extension”) WHEREAS, County and First Transit desire to extend the contract NOW, THEREFORE, the parties mutually agree as follows:

1. TERM. This Fifth Amendment is effective July 1, 2020. The terms of this Fifth Amendment, the Fourth Amendment, Third the Third Amendment, the Second Amendment and the Agreement, the First Amendment and Agreement and the Agreement shall continue through June 30, 2022; this amended and extended agreement is the final of such extension under the existing contract.

impacts of the CARES Act supplemental funding for the Community Services Block Grant (CSBG) Program for the Board’s information.

The total CARES Act supplemental funding for $679,438 is for two years for all three counties. Wilson County will receive $232,803. NEED has submitted the work plan for all three counties served. The hope is to serve as many clients as possible. They are looking at outcome measures for employment, education and housing that has been impacted by COVID-19. D. 2. April Tax Collection Report for information.

After presenting his information, Mr. Faircloth stated what an honor it had been to serve Wilson County for the past 34 years. He stated that the Wilson County Board of Commissioners was the best board he had ever worked with and he appreciated the opportunity.

Commissioner Boyette stated that county commissioners appreciate the hard work and dedication from Mr. Faircloth over the past 34 years to this county. Commissioners gathered for a group picture.

E. Ms. Teresa Ellen, Health Director, provided an update on COVID-19 and Ms. Lynn

Anders, Chair, presented the Child Fatality Prevention Annual Report.

Ms. Ellen stated we have 360 positive COVID-19 cases in Wilson County. 69% of cases are estimated or assumed recovered. Ms. Ellen complimented her staff and community partners for their hard work and dedication with this virus. We are continuing to work with partners for additional testing and targeting vulnerable populations. Ms. Ellen complimented local education facilities and companies that are working hard to stop the spread of the virus. Health department staff are learning new contact tracing software. Commissioners asked questions about the current situation in Wilson County. Ms. Ellen answered and discussed the ongoing work in Wilson County. Ms. Anders gave an overview of the Child Fatality Prevention Annual Report. It is a state mandated committee with mandated community representation. Wilson County had 21 child fatalities before the age of 21. A review of each age category was given. Underlying causes range from illnesses, birth defects, accidents and homicides. The team discusses if there is anything community partners could have done to improve the health and safety of children in Wilson County. The committee has been actively involved in trauma-informed training and processes. F. Mr. Michael Cobb, EMS Director, presented the following.

1. The Transfer of Ambulance to the Wilson County Rescue Squad.

RESOLUTION Authorizing Transfer of Property

WHEREAS, the County of Wilson owns a 2010 Chevrolet ambulance, VIN 1GB9G5B61A1106426; and WHEREAS, the vehicle would be better served under the ownership of community partners that assist Wilson County; VIN 6426 for Wilson County Rescue Squad; and WHEREAS, pursuant to NCGS 160A-279 “Whenever a city or county is authorized to appropriate funds to any public or private entity which carries out a public purpose, the city or county may, in lieu of or in addition to the appropriation of funds, convey by private sale to such an entity any real or personal property which its owns.” Wilson County Rescue Squad assists Wilson County EMS in carrying out a public purpose to our citizenry; NOW, THEREFORE, BE IT RESOLVED THAT THE WILSON COUNTY BOARD OF COMMISSIONERS hereby authorizes in accordance with General Statute 160A-279, the transfer of an ambulance, VIN 6426, to Wilson County Rescue Squad.

2. Update of the Wilson County EMS Fees for July 1, 2020.

Mr. Cobb referred commissioners to the packet pages with updates to the EMS fee schedule to align more closely with current recommended rates. A review of rates was given. Current and proposed rates are attached. EMS Management & Consultants (EMS|MC) is the third party contracted to manage billing for Wilson County EMS, effective June 1, 2020. Rates are proposed after considering Medicare allowable amounts and industry best practices.

G. Mr. Gordon Deno, Emergency Management Director, presented the certificate of Approval for a Tax-Exempt Loan for Black Creek Volunteer Fire Department for the Board’s consideration.

Black Creek is building a new fire station and this tax-exempt loan must be approved by the board. The loan has been approved by Southern Bank and this allows them to enter into that financial agreement. RESOLUTION AUTHORIZING APPROPRIATIONS AND EXPENDITURES FOR THE PURPOSE OF ECONOMIC DEVELOPMENT

BY APPROPRIATING FUNDS TO GLASS-NORTH AMERICA ARDAGH GROUP WHEREAS, the Local Development Act of 1925 authorizes cities and counties to make appropriations for the purposes of aiding and encouraging the location of manufacturing enterprises, making industrial surveys and locating industrial and commercial plants in the county; and WHEREAS, Glass-North America Ardagh Group is in the process of making an approximate $40,018,000 investment in Wilson, North Carolina; and WHEREAS, said expansion will increase the tax base in Wilson County and the company will retain approximately 280 full time jobs with benefits at an average annual wage of $54,000; and WHEREAS, Glass-North America Ardagh Group has requested Wilson County to assist it with an economic development incentive; and WHEREAS, Glass-North America Ardagh Group will receive a ten (10) year economic incentive equal to $841,000, said incentive will be paid to Glass-North America Ardagh Group annually over ten (10) years. Said incentive cannot exceed the total real and personal property taxes paid in any given year. If Glass-North America Ardagh Group challenges the tax values, real or personal property of the above described company investment, the incentive package will be voided; and WHEREAS, the investment must be listed on the company’s real and personal property tax listing and taxes paid prior to the payment of the incentive. Glass-North America Ardagh Group will request the County Manager to issue a check after paying their taxes each year and until a total of $841,000 has been paid; and WHEREAS, Wilson County has approved payment of this incentive in the amount of $841,000; and WHEREAS, a public hearing has been duly noticed, advertised and held as required by North Carolina General Statute, Section 158-7.1; and WHEREAS, the Wilson County Board of Commissioners desires to authorize appropriations and expenditures in that said appropriations and expenditures will increase the population, taxable property, and business prospects of Wilson County as contemplated by General Statute, Section 158-7.1. NOW, THEREFORE, be it resolved by the Wilson County Board of Commissioners that:

1. The Board of Commissioners does hereby approve the third of ten appropriations to Glass-North America Ardagh Group for the total of $112,000 for the purpose of assisting, Glass-North America Ardagh Group Wilson, North Carolina for economic development purposes.

2. The funds are to be appropriated from the Economic Development line item of the Wilson

ELDER ABUSE AWARENESS WHEREAS, Wilson County and North Carolina joins the world in recognizing World Elder Abuse Awareness Day every June 15th; and WHEREAS, protecting Wilson County’s vulnerable and older adults is a community responsibility and all citizens are charged under state law to report suspected abuse, neglect or exploitation to their local County Department of Social Services; and WHEREAS, Wilson County’s and North Carolina’s vulnerable and older adults of all social, economic, racial and ethnic backgrounds may be targets of abuse, neglect or exploitation which can occur in families, long-term care settings and communities; and WHEREAS, the NC Division of Aging and Adult Services partners with Wilson County Department of Social Services, Wilson County Senior Center and other agencies at the county and state level to offer statewide programs for adult protective services and to increase awareness about elder abuse and consumer fraud; and WHEREAS, the Wilson County Department of Social Services and many community partners and service providers work to protect our elders and to enhance their lives on a daily basis; WHEREAS, the State of North Carolina enacted the nation’s first elder abuse law and recognizes the need for a comprehensive system of protection for vulnerable and older adults; and NOW, THEREFORE, I, Rob Boyette, Chair of the Wilson County Board of commissioners in the State of North Carolina, do hereby proclaim June 15, 2020 as “ELDER ABUSE AWARENESS DAY” in Wilson County, North Carolina and commend its observance to all citizens. CHAIRMAN'S REPORT A. There will be a Budget Public Hearing on Tuesday, June 2, 2020 at 7:00 pm at the

Wilson County Agricultural Center. B. The NCACC 113th Annual Conference is scheduled for August 13-15, 2020. This year

the conference will be a virtual event instead of an in-person conference and will be offered to all county officials at no charge. More information on the schedule will be forthcoming.

Commissioner Boyette provided an update on Eastpointe. They are focusing on the mental health impact the virus might have and at the same time they are looking for the transition to a different care in the near future. According to plans as a part of Medicaid transformation, planning is going on regarding how they will manage physical care and mental care. They are partnering with others and they are ahead of most managed care organizations with this planning. Commissioner Atkinson provided an update on the Library. The Wilson County Public Library Board of Trustees is a seven-member advisory board with powers and duties delegated by the County Board of Commissioners. A bylaws revision in 2019 improved alignment with other County Boards and with NC State Law. Since then the Library Management Team has worked with Trustees to update Library policies, as well as to implement renovation of the Main Library and the addition of a Teen Room. Library Trustees approved revisions to Customer Conduct Policy and Child Safety Policy, approved Circulation Policy and technology Policy, as well as construction of a Teen Room, approved closing for Staff Day, ‘Food for Fines” forgiveness event, Membership Policy and Conflict of Interest Policy for Trustees and staff, approved new services hours for the Stantonsburg Branch, Service Animal Policy, Library closings for holidays, and Main Library renovations, had a presentation and discussion of Barriers to Public Library Services, including American Library Association Resolution on Monetary Fines as a Form of Social Inequity, and the Library Board approved new services and projects represented in the FY 2021 Library Budget, including the reduction in Penalties revenue due to elimination of overdue fines.

Commissioner Blackman provided an update on the Rocky Mount Wilson Airport. Due to the pandemic, operations over the past two months are down approximately 95% below normal. Nonetheless, the airport, terminal and FBO are all currently open and following the Governor’s COVID-19 Phase 2 Executive order #141 guidelines and we have recently noticed an uptick in traffic. In the interim, capital Improvement Projects have continued unabated. The Runway and Taxiway Pavement Rehabilitation project has been completed and we are currently working with the State to close out this grant. The T-Hanger project is near completion with Certificates of Occupancy for all three buildings in hand and we are waiting for the contractors to complete the paving work. The airport Strategic Master Plan has been completed by our Consulting Engineers and is being submitted to the DOC and FAA for review. The FAA has completed the MALSR Approach lighting project and they should be completed with their testing by August. The New Self-Service Fuel Farm should be completed by July.

The public hearing was opened regarding the economic incentives as part of the 2020-2021 budget consideration. There was no public comment. Commissioner Boyette ended the public hearing. Commissioner Blackman complimented the budget process and encouraged department heads to continue to be conservative. Commissioner Boyette asked to schedule a time before the holidays to have a session after the audit to know the revenues and expenditures and a session to concentrate on the budget and finances. Commissioner Hill stated he wants to set aside money annually in a capital ordinance to continue to put money aside for future projects. Commissioner R. Lucas stated the unknown of COVID-19 impacts has been a bit distracting. He complimented Denise and staff for their work. Commissioner S. Lucas expressed appreciation to the county manager and staff for being most conservative with their numbers. We are moving in the right direction and we are able to compensate our employees. I am pleased with this budget. Commissioner Atkinson stated he was very proud of staff and managers for their conservative management for the handling of this budget. Commissioner Daniels stated she agreed with Commissioner Hill on setting money aside for projects and for our school system to assist with their building projects. Commissioner Hill made a motion to approve the budget with the additional $100,000 for Wilson County Schools.

ADOPTION FEE POLICY

Preplacement Assessments Who must pay a fee: 1. Individuals or couples who are requesting an adoptive pre-placement assessment to adopt through

an independent placement. 2. Individuals or couples who request an adoptive pre-placement assessment in order to adopt through

a licensed adoption agency.

FEE EXEMPTIONS

• Prospective adoptive families in which the head of the household is WFFA (formerly AFDC) or SSI recipient

• Prospective adoptive families whose family income is below the State’s established Income.

• Prospective adoptive families who have identified an adoptee who us in the custody and placement responsibility of a local department of social services and continues to pursue the adoption of an identified child.

• Prospective adoptive families who desire to adopt a special need’s child as defined by NC Division of Social Services Family Services Manual, Vol, 1, Chapter IV.

• Prospective adoptive families who had begun the pre-placement assessment process before implementation of this policy.

• Wilson County Department of Social Services may exercise its option to reduce or waive the fee after verifying and documenting that the prospective adoptive family cannot pay the fee, or if any other reason exists that would result in the fee becoming a barrier to the adoption.

N.C.G.S.48-3-301 requires that Pre-placement Assessment be current within 18 months immediately preceding placement of a minor. Wilson County Department of Social Services will charge an update fee to those families desiring to keep the pre-placement assessment current. In the case of an appropriately dispatched ALS emergency service, if the ALS crew completes an ALS assessment, the services provided by the ambulance transportation service provider or supplier are covered at the ALS emergency level, regardless of whether the beneficiary required ALS intervention services during the transport, provided the ambulance transportation itself was medically reasonable and necessary and all other coverage requirements are met. **Advanced Life Support (ALS) intervention - a procedure that, in accordance with State and local laws, is required to be done by an Advanced EMT or a Paramedic. Application: An ALS intervention must be medically necessary to qualify as an intervention for payment for an ALS level of service.

Section 30: The Wilson County Board of Education is hereby authorized to budget fines and forfeitures in the amount of $450,000 for current expense. The County has appropriated $22,461,930 for current expense and $1,000,000 for capital outlay. An appropriation for technology is not budgeted. Proposed amendments which increase or decrease the amount of County appropriations allocated to any purpose or function in the public-school current expense budget by 10% or more shall be submitted to the Board of Commissioners for approval, pursuant to and in accordance with Chapter 115c-433 of the North Carolina General Statutes. Section 31: Wilson Community College. The County has appropriated $2,530,954 for current expense and $416,000 for capital outlay for existing facilities. Section 32: Departments within the Wilson County Government, except for the Tax Administration Department, is hereby authorized to charge a fee of $25 (the maximum allowed by the S.S.25-3-506 for any check written to Wilson County and returned by the bank unpaid). Administrator is hereby authorized by G.S 105-357 to charge a fee of 10% or $25 (whichever is greater) of the amount of any check written to that department and returned by the bank. Section 33: The County Manager or her designee is hereby authorized to transfer appropriations within and between funds contained herein subject to the following guidelines and restrictions: (1) The County Manager or her designee may transfer amounts between expenditure line items

within a department’s budget without limitation and without a report being required. (2) The County Manager or her designee may transfer amounts without limitation between

departments within the same fund and between funds. An official report on such transfers shall be provided to the Board of Commissioners (Board) at the monthly meeting.

(3) Upon notification of funding increases and decreases from state, federal, grants or pass through sources, budgets may be adjusted to match with the approval of the County Manager or her designee. Board of Commissioners’ action will not be required unless staffing is affected.

(4) Unexpended grants and other funds previously approved and budgeted by the Board, may be re-budgeted or rolled over into the FY2021 budget by the Manager or her designee. Board of Commissioners’ action will not be required.

(5) Movement of funds between/across expenditure categories (Personnel/Operating/Capital) may be requested by Department but require approval of the County Manager or her designee. No lapse salary can be used to fund any other operational expense, without the County Manager or her designee approval. Movement of funds to purchase unbudgeted Capital requires same approval.

This authorization applies only to the budget approved by the Board of County Commissioners. The Board of Commissioners must approve any budget amendments involving new monies. Section 34: The County Manager or designee shall have authority to execute the following contracts, amendments, or change orders, provided they comply with applicable laws and procedures and are within budgeted funds: (1) any lease agreement for one year or less; (2) any contract, amendment, or change order for apparatus, supplies, materials, equipment,

resolution of a claim, construction or repair work, or other lawful matter where formal bids are not required by law, including those committing no funds;

(3) amendments or change orders to other contracts, including service and information technology contracts as defined by G.S. 143-129.8, when the aggregate of the amendments requires less than a $200,000 increase in the expenditure of public funds in a single fiscal year; and

(4) grant agreements for public funds within budgeted amounts At the Manager's discretion, any lease, contract, amendment, or change order described in (1), (2), (3), or (4) may nevertheless be submitted to the Board. Contracts, amendments, or change orders duly approved by the Board may be executed by the Chairman or the Manager. Board action approving a contract, amendment, or change order shall be deemed to authorize necessary budget amendments. Section 35: This Budget Ordinance has been prepared in compliance with the Fiscal Control Act. Copies of the Budget Ordinance shall be furnished to the Budget Officer, Clerk to the Board, Finance Director and the Tax Assessor for direction in the carrying of their duties. Section 36: This Ordinance shall become effective July 1, 2020. Adopted this 2nd day of June 2020.
