The applicant is requesting a variance to allow the

The proposed area is 285 square feet and will be partiallyalongside an existing detached accessory building within 5
W,W, Park, F, or; oa feet to line up with the west side wall of the home.
In order to fit with the gable end alignment of the existing32789- 4386 home and the rear exit door of the home, the applicant is
seeking variances to construct the screen room onto therear of the residence with a sufficient size to be functional.
With regard to other places on the property to locate thisstructure, substantial structural changes would need to be
made to the sides of the existing great roam in order toaccommodate a new exit door into a screen enclosure built
out to the east or west side of this room. In addition, the
proposed location blends better with the architecture of
this great room by extending the new room to the rear.
This enclosure addition is well under the allowable
maximum floor area allowed and under the allowable
impervious coverage even though approximately 100square feet is being added.
Another unique feature to this property is that the rear lotline abuts the side yard of the adjacent lot that has a side
setback of 10 feet similar to the 10 foot rear setback
requested for this enclosure.

house sits 269". Neighbors have screen rooms and theyare wanting a screen room for their property.

Note: Financial reasons are not considered a hardship.This zoning requirement doesn' t allow them to have

We are submitting a variance application for our enclosure at 656 Randy Lane,Winter Park, FI. 32789. This letter is to give permission to Superior Aluminum
Installations to speak on our behalf for any questions or hearings pertaining to the
improvements on our enclosure.
We will be adding a 19' x 15' Gable Screen Room with a solid roof on the back ofour property. We don' t meet the required setbacks so we needed to apply for avariance. Superior Aluminum Installations is the company that we hired to do the
installation and that is why we want them to speak on our behalf in the event anyquestions or issues may come up.

This is an after- the- fact request where the owner engaged a
401 Park Avenue South fence company to construct this fence and the work wasdone without a permit. I understand that the fence companyhas not been responsive to helping the owner correct this
Winter Park, Florida violation. In addition, it appears that the fence on the
Picardy frontage has been placed in the public right of wayand will need to be removed back onto private property.

The Zoning Code allows a four foot high decorative openmetal fencing in a front or street side yard if it is set backfrom the lot line to allow landscaping such as a hedgebetween the lot line and the fence. Generally, we have beenrequiring that these fences be set back approximately 5 feetfrom the lot line. Open wood or PVC picket fences are also
allowed in a front or street side yard with a height limitation
of 3. 5 feet.
In this case, the owner has a substantial hedge in front of
the fence on both street frontages. However, the fencing is 4feet high and as mentioned above the fence along Picardyside is actually located 6 feet beyond the lot line into thestreet right of way. The fence along the Temple side is setback approximately 2. 5 feet from the sidewalk.
Options for Board:
I) Approve variance along the Temple Drive side and requireapplicant to either remove fence in right of way along PlacePicardy or obtain a Right of Way Utilization Permit from the PublicWorks Department to leave the fence within the right of way.2) Deny variance and require placement of new fence ( 3. 5'height) behind the hedge along the Temple Drive side and behindthe lot line on Place Picardy side.

Dear Board Mebers,
I am writing to apply for a variance for a fence that was installed on my property at 1341 Place Picardy.There are hardship circumstances unique to this situation that I hope will make my request seemreasonable, which I' ve outlined below:
Overview:
When we moved into the house in July, 2017, we had 2 kids and my wife was 8 months pregnant withour third child. Because we had two kids under 5( and a rescue dog) it was Imperative that we put afence on the property to keep the kids and the dog safe from the traffic on Temple.
We hired who I thought to be a reputable company, City Wide Fence.

The owner, Tom, convinced me that he had been in business since 1988( which it even says on their
website) and that he would do everything the right way, and according to code. I personally do notknow the Ins- and- outs of construction, home building, permitting or any of that so I took him at his
word. It is only now that I have learned that he did not get a permit, and that the fence he installedwould be 6 inches too tall. In fact, when I called him last week, he still insisted he was within code and
that 4 feet was allowed in Winter Park. When I showed him the City of Winter Park webpage, he began
to defend himself and his work( it was all very bizarre). He Is now refusing to correct the mistake.
In addition to being deceived by the fence company, there are a couple of other reasons why I amhopeful you will consider our situation to be unique and grant us a variance:
1) The fence does not Inhibit the site lines or aesthetics for any of our neighbors. I have a letter
from all the neighbors surrounding the house saying as much.2) In addition, I have had Keller Landscaping Install a podocarpus hedge that hides most of the
fence( see attached pictures). This was planned all along to inhibit road noise, but also acts as anatural barrier to hide the fence
fence Is set back 20 feet along Temple, and 18 feet from Place Picardy.
Please let me know next steps to move forward, and thank you for your consideration.

The applicant is requesting a variance to allow the
ITT orWINTLRP99K construction of swimming pool while maintaining anonconforming impervious coverage of 71% whereas themaximum permitted coverage is 50%.

In a previous variance request on this same property a
variance was granted on January 18 of this year to allowWinter Park. Florida the enclosure of a second floor open roofed area located
8. 6 feet from the side lot line in lieu of the required setback
of 12 feet. In order to allow the additional enclosed area
327894386 the owner had purchased 2, 100 square feet of land from
the owner at the rear of the home which allowed additional
floor area on this home.
The applicant is the same owner, and is now requestingpermission to continue to exceed the maximum allowed
impervious coverage of 50% with the construction of a
swimming pool with no surrounding deck area by removinga comparable area of pavers at the rear of the home. The
pool and spa will only have an 8 inch beam around theperimeter and be surrounded with grass.
The pool will have an area of 280 square feet and the
applicant proposes to remove 350 square of pavers at the
rear of the property. No other deck or walkway to the poolis planned, although a slightly elevated wood deck allowingdrainage between the deck boards is not considered animpervious surface, and might be a potential source of
providing a walkway to or around part of the pool.

The applicant is requesting variances to allow the construction of a new homewith existing nonconforming setbacks of 18 feet from the McKean Circle lotline and 21 feet from the rear lot line whereas the required setbacks are 20

401 Park Avenue South After obtaining a demolition permit for the home on this property theapplicant proceeded with demolition of the home but left a nonconforming
three car garage which encroaches the rear and street side setbacks.
Winter Pa M, Florida Demolition of more than 50% of the value of a building requires that the
remainder of the building be brought up to the current Zoning Code standardsincluding meeting the required setbacks.

The owner authorized an architect to design a home complying with the
Zoning Code criteria and another home design home utilizing the existinggarage, which encroaches into the setbacks as stated above.
We would not have allowed this " partial demolition" if we were made aware
of the owners intent to keep the garage. The applicant would have beenrequired to apply for and obtain approval for this variance before proceedingwith demolition. A complete building demolition permit was obtained,however, garage portion of the home was left standing. Since the garage is aneyesore, we ve been trying to get the owner to remove the garage for manymonths without success. The owner has now finally come forward to make thisvariance request.
The adjacent home on the east side of this property was substantially
renovated by this applicant who is living there. This residential building projectlasted well over 3 years while we received complaints about the progress.
Therefore, I recommend the following if the Board is inclined to approve thisvariance:
Place a condition on the approval of the variance requiring that the new home
on this property be completed and receive a certificate of occupancy withinone year from the date of the issuance of the building permit or the owner will
be referred to the Code Compliance Board for violation of this condition andviolation of Chapter 22 of the Winter Park City Code.

As a neighbor, I request my objection to the approval of any variance requests on thehome at 721 Palmer, be entered into the minutes of your upcoming meeting. Pleaseforward our discussion and my objection to all board members in advance of the boardmeeting if appropriate. If not, please present during public comments. I am
unfortunately not available to attend the meeting.
There is no hardship. The existing garage is in terrible condition and should bedemolished and a new home constructed in compliance with our codes. Leaving this
garage is not necessary or desirable ( either financially or aesthetically) and it should beremoved. The only justification for leaving this poorly maintained garage is tocircumvent our setback codes. I would be happy to discuss this with anyone.
The adjacent property owner, Betty Gilleland contacted me this evening. She had manyquestions I could not answer. I have recommended she meet with you to understand

The applicant is requesting variances to allow theconstruction of a two story accessory guest house andgarage to be located 15. 7 feet from the side lot and 26. 4
UTT or WIHTtR PARK feet from the rear lot line whereas the required setbacks
are 19 feet and 35 feet to the second floor respectively andto allow 1, 433 square feet of living area whereas the

The property owners had a previous one story guestwinter Fa, k, Fl" dda house/ dwelling removed from their property some time ago
and are now requesting to build back a new two storyguest house which includes a garage. The location of this
327894386 new guest house is proposed to be at same location as theprevious guest house.
The property is large with 22, 000 square feet of area andlot dimensions of 110 feet in width by 200 feet in depth.The applicant states that they desire to place the newstructure back in the same location because this is the best
fit with the existing " historic" house, although the home isnot listed on the City' s historic registry. There appears tobe more than adequate space on this large lot to fullycomply with the required setbacks, and no justification isprovided to permit exceeding the allowable area for theguest house.
Under our Zoning Code regulations of accessory structures,there is a limitation which requires that an accessorybuilding be no higher than the main residence. In lookingat the existing one story home it appears that the new twostory guest house may exceed the height of the mainresidence. I am asking the applicant to provide more
precise information on the heights of the existing andproposed structure. Since the lot has a substantial grade
upward from the street, this elevation change must be
taken into consideration, particularly since the guest houselocation in the rear of the lot at a higher grade.
