I RECOMMEND THE BOARD OF COUNTY COMMISSIONERS (BCC) ACCEPT THE PET!TION TO VACATE, ADOPT THE ArrACHlED RESOLUTION, AND AUTHORIZE THE CLERK TO RECORD THE RESOLUTION IN THE PUBLIC RECORDS OF PINELM COUNTY.

Phis petition to vacate the unopened Basin Street public right-of-way, resewing a drainage and ingresslegress easement over the entire vacated area, is associated wSith the owners' desire to construct boardwalks leading out to docks. Unopened Basin Street is located in the Grand Bay Heights Subdivision, and separates the upland and waterfront portions of three properties fronting Hattie Street This Petition to Vacate will create contiguous ownership of their parcels, allow use of their riparian rights, and permit three owners to construct individual private docks. Portions of the unopened Basin Street right-of-way are wetlands, and there is minimal public use or access to the water via this pathway. The docks will land on the applicants' property such that traditional foot traffic will not be blocked.
Collectively, the petitioners are the fee simple title holders of that portion of the plat that is requested to be vacated. The vacation of this portion of the plat will not affect the ownership, or right of convenient access of persons owning other parts of the subdivision.
Staff has been queried for possible needs of the property and determined that the County will reserve a drainage and ingresslegress easement over the entire vacated area. The vacation will not have an adverse effect on the remaining right-of-way or traffic flow in the neighborhood.
Letters of No Objection, have been received from Bright House, Knology, Pinellas County Utilities, Progress Energy (DisUribution), Progress Energy (Transmission), TECO, and Verizon.
Research has found that there is no current Homeowners Association for the Grand Bay Heights Subdivision.

Notice was mailed by the Clerk of the Court to the adjacent property owners and nearby residents, in accordance with Florida Statute requirements. The Deputy Clerk will report any citizen support or opposition to the BCC.
