• Please remember that purchaser spaces will be limited, so only ONE person per business will be

allowed entry • No children under 16 years old will be able to attend the sales and this must be strictly adhered

to as entry will be refused • Pregnant ladies must not attend the sale • 2m social distancing must be observed wherever possible • Viewing will be regulated by a one-way system throughout the mart and is to be permitted for

registered buyers only. Please refer to individual sales for the respective Viewing days and times

• Face coverings are mandatory for all persons entering the mart. These must be worn without exception while in the market including the sales rings and pens

• To facilitate the Test and Trace system, all customers/visitors will be required to sign into the market.

This process will include a declaration that they have not been in contact with anyone displaying symptoms of COVID-19, nor are displaying symptoms personally

• Hand sanitiser stations will be available throughout the mart; however, it is strongly recommended that

both consignors and buyers have an adequate personal supply and to use it regularly • Please follow instructions from market staff and security staff. A private security firm will be in

attendance to assist H&H in ensuring social distancing is observed wherever possible • Strictly no private videoing/broadcasting on Social media, or phones etc in the pens or ring • If you are unable or do not wish to attend the mart but would like to bid on animal(s), then the

auctioneers will faithfully execute commission bids for buyers. Please contact them and put your instructions in writing 48 hours in advance of the sale. Alternatively, you can arrange to make a telephone bid during the sale

● Hauliers and farmers delivering livestock must disinfect their boots before and after loading or unloading.

● Livestock purchased or unsold will not be allowed to move unless an authorised “pass slip” has been issued by the main office.

● No livestock will be allowed to remain on the premises after a sale.

● Only staff, livestock hauliers, owners or their agents are permitted to load or unload livestock.

● Wash hands thoroughly when leaving pennage areas.

General Information & Sale Notes

LOCATION: This sale will be held in the Borderway Mart, Carlisle Cumbria. Motorists should leave the M6 at Junction 43 and follow CARLISLE signs. The market is on the left hand side of the road within 1/4 mile of M6.

ARRIVAL OF STOCK: Friday 25th September 3pm - 6pm Saturday 26th September 7am - 8am

HOTELS: There are many hotels within the area, ranging from four star to excellent Bed and Breakfast accommodation, a list of which may be found on page 4 of the catalogue.

CONDITIONS OF SALE: Sold under the Blue Texel Sheep Society Sale Rules and the Livestock Auctioneers Terms & Conditions of Sale.

A commission will be charged at 5.25% on all sheep.

All sheep must have ear tags to comply with current ministry regulations.

The vendor shall be responsible for all faults. The buyer has one hour after the end of the sale to complain.

PRE-SALE INSPECTION: All sheep forward for the sale will be subject to a Society Inspection. Any animal which does not reach the Inspection standard will not be eligible for sale. The In-spection decision will be final and any animal failed will be removed from the sale and forfeit the entry fee.

PEDIGREE TRANSFER: A transfer fee of £5 (+VAT) per sheep is payable by the purchaser and paid to BTSS

SOCIETY LEVY of 1% will be deducted from vendors account and paid to the BTSS.

UPSET PRICE An upset price of 200gns is set for all sheep, ie, if no opening bid is received asforementioned, that lot will be passed out of the ring unsold.

METHOD OF SALE: All sheep will be sold in guineas (105 pence) and strictly in catalogue order, unless any alteration is announced by the Auctioneers.

COMMISSIONS: The auctioneers will dutifully execute commissions to purchase for buyers unable to attend the sale personally, upon receipt of written instructions.

INSURANCE: A representative of Auctioneers Insurance Brokers will be present at the sale and will be pleased to quote purchasers for transit and other risks.

SETTLEMENT AND CLEARANCE OF STOCK: Settlement in full is due immediately at the close of sale. No animal may leave the sale premises without an offical ‘pass slip’ obtainable only from the Auctioneers upon settlement.

CONDITIONS OF SALEAll sheep are sold under the Conditions of Sale as displayed in the market

recommended for use by the Livestock Auctioneers’ Association Ltd

SCHEDULE 2 – SHEEP 36 Definitions

In this Schedule the words or expression:

“In Lamb” or “Due to Lamb” means any female sheep carrying a lamb but shall not imply that any lamb due will be born alive

and, where the female sheep is stated to be In Lamb or Due to Lamb to a named ram the Vendor shall provide the Auctioneer with details of the ram, his ear tag number and any breed society registration number together with such, if any, further information that may be required of him, such information to be included in any catalogue for the sale and announced at the sale.

37 Female sheep

37.1 Vendor’s warranty

Each female sheep is warranted not to be In Lamb at the time of sale. This warranty is a 14 weeks and 5 Day Warranty.

37.2 Purchaser’s rights

If the Purchaser proves a breach of warranty the Vendor shall pay to the Purchaser as Liquidated Damages a sum equal to 33.33 per cent of the purchase price.

Notice of a claim must be supported by a Veterinary Surgeon’s Certificate or a slaughter-house manager’s or other competent person’s certificate confirming the sheep to have been In Lamb for a period of at least 12 weeks on the day of sale.

38 Female sheep not described as In Lamb

38.1 Vendor’s warranty

The Vendor warrants that a female sheep not described in any catalogue for sale or at the time of sale as In Lamb is not In Lamb at the time of sale. This warranty is a 14 Week + 5 Day Warranty.

38.2 Purchaser’s rights

If the Purchaser proves a breach of warranty then, at the Purchaser’s option, either the Purchaser may exercise his rights under Schedule 6, or the Vendor shall pay to the Purchaser as Liquidated Damages a sum equal to the amount in paragraph (i) of the Appendix. Notice of a claim must be supported by a Veterinary Surgeon’s Certificate or a slaughterhouse manager’s or other competent person’s certificate confirming that the sheep was In Lamb

39 Female sheep described as correct

39.1 Vendor’s warranty The Vendor warrants that all female sheep described in the catalogue or at the time

of sale as correct are sound in mouth and udder, that is they are not lacking any of the 8 broad teeth and do not have any damaged or worn teeth or a defective udder. This warranty is a 5 Day Warranty.

39.2 Purchaser’s rights If the Purchaser proves a breach of warranty then, at the Purchaser’s option, either

the Purchaser may exercise his rights under Schedule 6, or the Vendor shall pay to the Purchaser as Liquidated Damages a sum equal to the amount in paragraph (i) of the Appendix. Notice of a claim must be supported by a Veterinary Surgeon’s Certificate.

40 Female sheep proving barren40.1 Vendor’s warranty The Vendor warrants that any female sheep sold as being In Lamb is In Lamb at

the time of sale. This warranty is a 21 Day Warranty.40.2 Purchaser’s rights If the Purchaser proves a breach of warranty he may exercise his rights under

Schedule 6. Notice of a claim must be supported by a Veterinary Surgeon’s Certificate.

41 Ewes with lambs at foot41.1 Vendor’s warranty The Vendor warrants that, unless stated to the contrary in any catalogue for the

sale or at the time of sale, in a Lot in which the ewes are described as with lamb or with lambs at foot every ewe is suckling one or more lambs, and every lamb has a mother in the Lot. This warranty is a 5 Day Warranty.

41.2 Purchaser’s rights If the Purchaser proves a breach of warranty he may exercise his rights under

Schedule 6 in respect of any ewe which does not have a lamb or any motherless lamb.

42 Castrated sheep42.1 Vendor’s warranty The Vendor warrants that, unless stated to the contrary in any catalogue for sale or

at the time of sale, any male sheep not expressly sold as rams: a) have been castrated; and b) have not been imperfectly castrated. The warranty in Condition 42.1 (a) is an After Sale Warranty and the warranty in

Condition 42.1 (b) is a 14 + 5 Day Warranty.42.2 Purchaser’s rights If the Purchaser proves a breach of warranty then, at the Purchaser’s option, either

he may exercise his rights under Schedule 6, or the Vendor shall pay to the Purchaser as Liquidated Damages a sum equal to 33.33 per cent of the purchase price of the sheep concerned. If other sheep had been sold in the Lot the compensation payment shall be calculated on the basis of the average price per head of all animals in the Lot.

43 Stock rams43.1 Vendor’s warranty The Vendor warrants that any ram sold as a stock ram for the amount in paragraph

(j) of the Appendix or more is capable of natural service. This warranty is a 10 Week Warranty.

43.2 Purchaser’s rights If the Purchaser proves a breach of warranty the Purchaser may return the ram to

the Vendor who shall, at the Purchaser’s option, either replace the ram with another ram of equal value which is capable of natural service, or refund the purchase price together with such other costs and charges as the Purchaser may be entitled to under these Conditions.

For the avoidance of any doubt if the Purchaser is able to obtain viable semen from the ram for use by artificial insemination he shall not be entitled to any claim against the Vendor for breach of warranty.

Notice of a claim must be supported by a Veterinary Surgeon’s Certificate confirming that:

a) the ram’s inability incapacity or ineffectiveness is not the result of injury, accident or illness happening after the time of the sale; and

b) the Purchaser’s breeding stock are not responsible for the ram’s inability incapacity or ineffectiveness.
