If prospective bidders desired to bid more than one bid package, a separate prequalification for each bid package is required. Multiple Bid Packages cannot be combined on this prequalification application. The prospective bidder shall have a duly authorized owner, officer or principal complete the questionnaire and the financial statement who shall verify the truth of the information provided. Note: In addition to this project specific prequalification the successful bidder for each trade will be responsible for electronically entering into the Swinerton Builders prequalification data base prior to receiving an executed subcontract. 4. Certificate of Accountant

The certificate of an accountant certified by the State of California will be required in all cases. The form of Certificate of Accountant is attached. A reviewed financial statement by an accredited accountant will be acceptable if a certificate is not submitted.

The Certificate of Accountant shall not be made by any individual who is in the regular employ of the individual, partnership, or corporation submitting the financial statement, nor by any individual with more than a ten percent (10%) financial interest therein.

5. Letter of Bondability

The prospective bidder must attach a letter from an admitted surety insurer authorized to issue bonds in the State of California, which states the prospective bidder’s current available bonding capacity. The surety must be an admitted surety in the State of California and have an “A -” or better rating by A.M. Best, Moody’s, or Standard and Poor’s.

6. Insurance

The prospective bidder must provide at least $2,000,000 in Comprehensive General Liability Insurance. The prospective bidder’s insurance company must be authorized to do business in the State of California. The insurance company must have an “A” or better rating by A.M. Best, Moody’s, or Standard and Poor’s.

Subcontractors with design responsibility (deferred approvals) shall provide the following additional coverage: An Architect’s and Engineer’s Professional Liability Policy with Limited Contractual Liability Coverage in favor of Swinerton Builders and Owner and a deductible no greater than $25,000 per claim and a Waiver of Subrogation in favor of Swinerton Builders and Owner. Any SIR must be clearly identified on a Certificate of Insurance and is subject to Swinerton’s approval. This insurance shall be maintained for not less than the duration of the project and five (5) years following completion of construction. Retroactive date of such policy must be on or before the date Subcontract and/or Consultant began

offering professional services. Limit of liability shall be not less than $1,000,000 Per Claim (specific to this project only).

7. Contractor License .

Each prospective Bid Package Contractor must have a California Contractor’s License current, active and in good standing with the California Contractor’s State License Board for the bid package herein.

8. Notification of Prequalification Results

All Bid Package Contractors which have submitted a Prequalification Questionnaire will be notified in writing of either successfully or not successfully achieving prequalification status.

9. Confidentiality The completed Prequalification Application submitted by prospective bidders are not public records and are not open to public inspection. All information provided will be kept confidential to the extent permitted by law. However, the contents may be disclosed to third parties for purpose of verification, investigation of substantial allegations, or as part of an appeal hearing if applicable.

10. Waiver of Irregularities.

Swinerton Builders reserves the right to waive minor irregularities and omissions in the information contained in the Prequalification Application submitted, to make all final determinations, and to determine at any time that the prequalification procedures will not be applied to a specific project.

11. Late or Incomplete Applications

Swinerton Builders shall refuse to grant prequalification where the requested information and materials are not provided, or not provided by the specified date and time. There is no appeal from a failure to submit a complete application or the submission of a late application, but re-application for a later project is permitted. The closing time for bids will not be changed to accommodate supplementation of an incomplete submission of an Application, or the late submission of an Application.

12. Post-Bid Determination of Responsibility

While it is the intent of this Application to determine a prospective bidder’s responsibility prior to bid and to aid in selecting a responsive, responsible bidder, neither the fact of prequalification nor any prequalification rating will preclude Swinerton Builders from a post-bid consideration and determination of whether a prospective bidder has the quality, fitness, capacity and experience to satisfactorily perform the proposed work, and has demonstrated the requisite trustworthiness.

5. CONSTRUCTION EXPERIENCE

Submit Project Data on a minimum of three (3) and a maximum of five (5) comparable projects successfully completed within the last ten (10) years constructed in the State of California relative to your trade. Must be comparable in size, contract value and scope of what is listed for the Bid Package you are prequalifying for.

Submit the following Project Data Sheets for each project submitted as evidence of your firm's Contractor experience.

Listed projects must have been managed and constructed under the business name submitted for

prequalification. Projects completed by employees for former employers are not acceptable. A comparable project is defined by the following example building types:

and General Project Description:

Building 1: This scope of work consists of an existing four story 114,000SF building constructed of steel frame with metal deck, glass framed curtain wall system and framed exterior with stone veneer and composite metal accent treatments. The building is currently vacant and shell space on all floors with central core only on each floor. The existing roofing is a built-up roof system that will be reconstructed due to significant demolition of existing mechanical and structural systems currently present. Portions of new roof will be changed to a single ply roof system. The exterior skin is Glazing, Composite Metal, and Stone Veneer Systems. The interior remodel will be a complete remodel of what is now clear shell space and will consist of offices, classrooms, restrooms, storage, laboratory’s , library, conference rooms, faculty areas, Reading Rooms, and other educational support spaces. Major demolition will be include removing interior staircases and patch-back metal decks and slabs, removal of curtain wall systems to facilitate construction of three new stairwell towers on exterior of existing structure. New stairwell tower structures will be constructed of steel and tied into existing steel structure. Stairwell towers will include stainless steel guard rails, metal pan stair system, and be enclosed with a curtain wall system. Building 2: Is an existing four story parking structure. Remodel work includes construction of new Restroom Facilities, Storage rooms, Offices, IDF room, Workroom, Restriping of pavement markings, chainlink fence barriers, and construction of new 4 story stair structure as well as other miscellaneous retrofit work.. Sitework: The project site is approximately 12 acres in size. Significant sitework will be required. Work consists of: Mass earthwork, demolition of site structures, new underground utilities consisting of sewer, storm, water, fire water. New construction to consist of new underground utilities, concrete and masonry retaining walls structures, stone veneer over masonry, landscaping and irrigation, gabion retaining systems, site lighting, site concrete, trash enclosure, flagpole, loop vehicle road, parking lots, erosion control.
