Item 3. Approval of Minutes – May 22, 2017 Motion by Mr. Kaiserman, second by Ms. Gulliver, to approve the May 22, 2017 meeting minutes. Hearing no objections the motion passed unanimously. Item 4. Attendance and Membership Policy (Sarah Kraum) Ms. Kraum stated the TPO has created a meeting evaluation form and would appreciate any feedback. Ms. Kraum stated the goal of this Agenda Item would allow an update to the policy and make room for new members. Ms. Kraum stated the BPTAC is written into the Space Coast TPO Policy which requires the group to follow specific rules and regulations. Ms. Kraum presented an overview of the BPTAC Policies. Ms. Sterk suggested we look into the number of municipalities represented and number of citizens represented in the membership of the BPTAC. Mr. Hann suggested that staff look into municipality and citizen alternates to the BPTAC membership. Ms. Metz suggested increasing the membership of the BPTAC. Mr. Thompson suggested staff to research and differentiate member representation as a citizen or municipality. Motion by Ms. Sterk, second by Ms. Bernard, to remove the three members Bakken, Karp and Van Heden if they do not respond to the correspondence about their attendance history. Hearing no objections the motion passed unanimously. Motion by Ms. Sterk, second by Mr. Thompson, to direct staff to prepare language for approval at the next meeting:

o Clarifying the definition of municipality versus citizen membership and who the member is representing. o Review of both the local government and citizen membership and total number of members allowed o Develop policy language about municipality alternates

Hearing no objections the motion passed unanimously. Item 5. East Coast Greenway Workshop (Sarah Kraum & Paul Haydt) Ms. Kraum stated she has been given internal direction to seek BPTAC and Growth Management Sub Committee input about the alignment of the East Coast Greenway. The goal is to discuss the primary and alternate route so she can work with the municipalities to complete the project. Mr. Haydt, East Coast Greenway Coordinator presented a PowerPoint on the East Coast Greenway. Ms. Kraum presented a PowerPoint on the East Coast Greenway alignment. Open Discussion: Mr. Kaiserman presented a suggestion on a greenway trail through Melbourne. Ms. Sterk stated evaluations have not been done on what has been constructed to make the decision on what is more feasible for an alignment. Ms. Kraum replied that nothing has been built to standards. Ms. Sterk stated base line data is needed. Ms. Kraum stated the BPTAC has options to choose an alignment and it doesn’t have to be decided now but, direction is needed. Mr. Corwin asked how a park can be designated and added to the East Coast Greenway. Ms. Kraum replied that Ms. McCall just went through the process and the TPO can help. Ms. Sterk asked when the Bike/Ped Mobility Plan will be updated. Ms. Kraum replied approximately March 2018. Ms. Sterk stated a sub-committee could be appointed to focus on the alignment of the East Coast Greenway trail. Motion by Ms. Sterk, second by Ms. Bernard, to request staff present a recommendation on a sub-committee to represent stakeholders focused on the East Coast Greenway Trail. Hearing no objections the motion passed unanimously.

4. Bicycle Pedestrian and Trails Advisory Committee (BPTAC). The Bicycle Pedestrian and Trails Advisory Committee shall review and provide direction and recommendations to the TPO Board on projects and activities related to bicycle, pedestrian and trails facilities.

Membership. The membership of the SCTPO Bicycle, Pedestrian and Trails Advisory Committee is open to all interested citizens or representatives of special interest groups, who reside in Brevard County. The committee shall consist of up to nineteen (19) members that may represent such agencies as local law enforcement, educators, engineers, local governments, bicycle retailers, equestrians, cyclists, hikers, environmentalists and interested citizens.

Appointments. Any interested individual may submit a formal letter of interest to the SCTPO Executive Director expressing their interest and requesting appointment to the Bicycle, Pedestrian and Trails Advisory Committee. The SCTPO Executive Director will have the responsibility of ensuring such requests for appointment are included on the TPO’s agenda.

Agency, Organizations and Units of Local Government Appointments: In the event an agency, organization or unit of local government wishes to appoint a representative to the Bicycle, Pedestrian and Trails Advisory Committee, they shall submit a formal written request to SCTPO Executive Director requesting such appointment of an individual to represent their agency, organization or unit of local government. The SCTPO Executive Director will have the responsibility of ensuring such requests for appointment are included on the TPO’s agenda. All nominees representing any unit of local government, shall reside within the jurisdictional boundaries of that unit of local government. The total number of members appointed to the Bicycle, Pedestrian and Trails Advisory Committee from specific agencies, organizations, and units of local government shall be limited to a maximum of fifteen (15), thus allowing for at least four (4) members of the committee to be interested citizens.

If there are no vacancies on the committee at the time a request for appointment is received, a review of the membership will be conducted by SCTPO staff. Membership will be reviewed and will identify if any one agency, organization or unit of local government has multiple (more than one) representation on the Committee. If such multiple representation is identified, the agency, organization or unit of local government with the multiple representation shall be contacted by SCTPO staff and advised that one of their seats must be vacated. If two or more agencies, organizations or units of local government have multiple representation, the determination of which agency, organization or unit of local government that will be requested to vacate a seat on the Committee will be determined by a majority vote of the Bicycle, Pedestrian and Trails Advisory Committee.

Multiple individuals representing any one agency, organization or unit of local government may still attend all meetings and provide public comment, but shall only have the number of votes based upon total number of officially appointed members.

If there are no vacancies available even after a review of membership, requests will be kept by SCTPO staff for not more than 365 days. If a vacancy occurs on the Bicycle, Pedestrian, and Trails Advisory Committee during the aforementioned period, the individual, agency, organization or unit of local

government will be notified of if any openings that arise, and an inquiry will be made to determine if there is still interest in serving as a voting member.

No individual shall be eligible to vote on the Bicycle, Pedestrian and Trails Advisory Committee until the appointment of that individual is approved by the Space Coast TPO Governing Board.

Voting Representatives. No individual shall be eligible to vote on the Bicycle Pedestrian Trails Advisory Committee until the appointing municipality, agency or citizen volunteer certifies in writing to the SCTPO Executive Director that they have been duly authorized to vote as the representative of the nominating entity and the SCTPO has appointed said individual to the Bicycle Pedestrian Trails Advisory Committee. All appointed members are required to register a vote on all issues presented, except in the event that there is, or appears to be, a voting conflict of interest as provided in Section 112.3143, Florida Statutes,1 or as specified in Section 286.012, Florida Statutes.2 Abstentions are not permitted, except as provided by law. Votes should be consistent with the public interest.

Alternate Voting Representatives. In addition, each member that is representing a municipality as staff or as appointed by a governing municipal council may also have one (1) alternate representative as appointed by the representing municipality. Citizen Representatives will not be permitted an alternate. Further clarification of a municipality representative and a citizen representative in section below. Alternate representatives on the Board shall vote, participate for the purpose of forming a quorum, make or second motions, and otherwise act as a member of the Bicycle, Pedestrian and Trails Advisory Committee, only in the absence of the representative that the alternate has been appointed to serve in place of; provided, however, that alternate representatives may always attend committee meetings and participate in debate.

1 Section 112.3143(3)(a), Florida Statutes, provides that “[n]o county, municipal, or other local public officer shall vote in an official capacity upon any measure which would inure to his or her special private gain or loss; which he or she knows would inure to the special private gain or loss of any principal by whom he or she is retained or to the parent organization or subsidiary of a corporate principal by which he or she is retained, other than an agency as defined in s. 112.312(2); or which he or she knows would inure to the special private gain or loss of a relative or business associate of the public officer.” 2 Section 286.012, Florida statutes, provides that “286.012 Voting requirement at meetings of governmental bodies.—A member of a state, county, or municipal governmental board, commission, or agency who is present at a meeting of any such body at which an official decision, ruling, or other official act is to be taken or adopted may not abstain from voting in regard to any such decision, ruling, or act; and a vote shall be recorded or counted for each such member present, unless, with respect to any such member, there is, or appears to be, a possible conflict of interest under s. 112.311, s. 112.313, s. 112.3143, or additional or more stringent standards of conduct, if any, adopted pursuant to s. 112.326. If there is, or appears to be, a possible conflict under s. 112.311, s. 112.313, or s. 112.3143, the member shall comply with the disclosure requirements of s. 112.3143. If the only conflict or possible conflict is one arising from the additional or more stringent standards adopted pursuant to s. 112.326, the member shall comply with any disclosure requirements adopted pursuant to s. 112.326. If the official decision, ruling, or act occurs in the context of a quasi-judicial proceeding, a member may abstain from voting on such matter if the abstention is to assure a fair proceeding free from potential bias or prejudice.”

Definition of Representation. The Bicycle, Pedestrian and Trails Advisory Committee is made up of both Municipality Representatives and Citizen Representatives. They are defined as follows:

Municipality Representative – technical staff that has an appointment letter from a supervisor or governing municipal council. i.e. public works employee, transit provider employee, etc.

Citizen Representative – a member of the community that wishes to serve on the Bicycle, Pedestrian and Trails Advisory Committee as a special interest group, bicyclist, hiker, walker, equestrian, bicycle retailer, etc. They are not serving as a representative of a municipality’s technical staff.

Attendance. It shall be the responsibility of the designated Space Coast TPO staff member to monitor and notify appointing agencies, organizations, unit of local government or individuals by phone, email, or written communication of any member who is absent for three (3) or more consecutive meetings within a twelve (12) calendar month period.

Members of the Bicycle, Pedestrian, and Trails Advisory Committee serve at the pleasure of the SCTPO Governing Board. Additionally, the SCTPO Governing Board may remove any individual from the Bicycle, Pedestrian and Trails Advisory Committee, if such individual is absent from three (3) or more consecutive meetings within any twelve (12) calendar month period. At the first meeting of each calendar year an attendance record for the Bicycle, Pedestrian and Trails Advisory Committee from the previous year will be provided to the full SCTPO Board for review. The SCTPO may choose at that time or any other time to remove from the Bicycle, Pedestrian and Trails Advisory Committee member(s) who have not met the attendance requirement.

Notices of vacancies on the Bicycle, Pedestrian and Trails Advisory Committee shall follow the guidelines for filling such vacancies as identified in the SCTPO‘s adopted Public Participation Plan.

Officers. A Chairman and Vice-Chairman for the Bicycle, Pedestrian and Trails Advisory Committee shall be elected by a majority of the committee members voting at the Committee’s last regularly scheduled meeting each calendar year, or if said meeting is not held for any reason, then at the next meeting of the committee. The Chairman and Vice-Chairman shall serve for a period of one (1) year, starting on January 1st of each year or until a successor is elected. The Chairman and Vice-Chairman shall be members of the Bicycle, Pedestrian and Trails Advisory Committee.

Chairman; Vice-Chairman. The Chairman shall call and preside over all meetings of the Bicycle, Pedestrian and Trails Advisory Committee. The Chairman is authorized to execute on behalf of the Committee all documents which have been approved by the Bicycle, Pedestrian and Trails Advisory Committee or to execute said documents subject to ratification by the Committee. The Chairman shall coordinate with SCTPO staff on topics for agendas and assist with meeting decorum. The Vice-Chairman shall serve as Chairman in the absence of the Chairman.

Minutes. Designated SCTPO staff shall be responsible for recording and transcribing Bicycle, Pedestrian and Trails Advisory Committee meeting minutes. Said minutes shall accurately reflect the proceedings of the Committee.

Quorum. At least seven (7) voting members of the Bicycle Pedestrian Trails Advisory Committee must be present for the committee to have a quorum and conduct business.

Procedures: Procedures for the BPTAC shall follow those described in the Space Coast TPO Governing Board Section of Policy PLC-1, items 1, 2, 4, 5, and 6. C.1, C.2., C.4., C.5, and C.6., listed above. If certain actions are not covered by these policies, Roberts Rules of Order, newly revised, most recent edition, shall be used to govern proceedings of the BPTAC Committee.

Space Coast TPO and Governing Board: The authority and responsibility of the SCTPO and the Governing Board is to manage a continuing, cooperative, and comprehensive transportation planning process that results in the development of plans and programs which are consistent, to the maximum extent feasible, with the approved local government comprehensive plans of the units of local government the boundaries of which are within the metropolitan areas of the SCTPO. The Governing Board of the SCTPO shall be the forum for cooperative decision making by officials of the affected governmental entities in the development of the plans and programs required by Title 23, United States Code, Section 134, as amended by the Intermodal Surface Transportation Efficiency Act of 1991 (Public Law 102-240, Dec. 18, 1991, 105 Stat. 1914); the Transportation Equity Act for the Twenty-first Century (Public Law 105-178, June 9, 1998, 112 Stat. 107); Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU), Public Law 109-59, Aug. 10, 2005, 119 Stat. 1839; Moving Ahead for Progress in the 21st Century Act (MAP-21), Public Law 112-141, July 6, 2012, 126 Stat. 500, and Fixing America’s Surface Transportation Act (FAST Act), Public Law 114-94, December 4, 2015, 49 United States Code Sections 5303-5307, 23 Code of Federal Regulations 450.306 and 450.310, and Section 339.175, Florida Statutes, all as amended from time to time.

1. Public Records. Unless exempt or confidential as provided by Federal or Florida law or regulation, all public records of the SCTPO are open for inspection and examination at the office of the Space Coast Transportation Planning Organization, 2725 Judge Fran Jamieson Way, Melbourne, Florida between the hours of 8:00 a.m. and 4:30 p.m. during regular business days.

2. Public Access. Unless otherwise permitted by Florida law, all Governing Board meetings, workshops and proceedings shall be open to the public.

4. Notice of Meetings and Workshops. Except in the case of emergency meetings or workshops, the Space Coast Transportation Planning Organization, shall give at least seven (7) days public notice of any meeting or workshop at which policy making decisions will be made, by posting an announcement about the meeting on the SCTPO’s internet web-site and in accordance with the SCTPO’s adopted Public Participation Plan. In addition, the SCTPO shall prepare and make available a courtesy said notice: to any interested person who has requested to be noticed; to representatives of any person named in said notice; and to any class of individuals to whom action is directed at the meeting or workshop being noticed. As referenced above, a courtesy notice is a notice which is not required by law or these rules to be sent but which is sent as an accommodation or courtesy. Failure to send a courtesy notice shall not be a basis for invalidating a meeting or workshop of the SCTPO or its committees.

a. The notice of such meeting or workshop shall provide:

i. The date, time, and place of the event.

ii. A brief description of the purpose of the event.

iii. A brief list of any items on which action may be taken at the event.

iv. The address and phone number where interested persons may obtain further information regarding the meeting or a copy of the agenda.

v. As provided in Section 286.0105, Florida Statutes, language relating to the responsibility for obtaining a verbatim recording of proceedings if a person decides to appeal any decision made by the agency.

vi. Contact information for persons with disabilities needing special accommodations to participate in the proceeding in accordance with the Americans with Disabilities Act and Section 286.26, Florida Statutes.

5. Agenda. At least seven (7) days prior to a non-emergency meeting or workshop, the SCTPO shall prepare and make available on the SCTPO’s website an agenda for the SCTPO Governing Board, and any of its committees. In addition the SCTPO shall provide a copy of the agenda upon request to any person.

The agenda shall list the items in the order they are to be considered; provided, however, that for good cause stated in the record by the person who is designated to preside at the event, items may be considered out of their listed order.

The agenda shall be specific as to items to be considered. All matters involving the exercise of agency discretion and policy making shall be listed on the agenda. The agenda shall include a disclaimer as required pursuant to Section 286.0105, Florida Statutes. Except for items needing emergency consideration, after publication of an agenda, any items added to an agenda as "old business," "new business," "other business," "other matters which may come before the agency," or similar terms shall be for consideration of solely ministerial or internal-administrative matters, which do not affect the interests of the public generally.

Any person desiring to have an item placed on the agenda of a meeting of the SCTPO Governing Board, or a committee, shall request in writing that the item be considered at the next regularly scheduled meeting of the SCTPO Governing Board, or a committee; provided, however, that such a request must be received twenty-one (21) days in advance of said regularly scheduled meeting. Written requests for placing an item on the agenda must describe and summarize the item and shall be mailed or delivered to: SCTPO Executive Director, Space Coast Transportation Planning Organization, 2725 Judge Fran Jamieson Way, Bldg. B-105, Melbourne, Florida, 32940.

A copy of the agenda package, including supporting documents which are a part of the agenda package distributed prior to a meeting, shall be made available for download from the SCTPO official website, www.spacecoasttpo.com, or by contacting by phone, email or by appearing in person at the Space Coast

Note, location update for SW Florida on September 14th.  The FGTS Plan establishes the vision for implementing a connected statewide system of greenways and trails for recreation, conservation, alternative transportation, healthy lifestyles, a vibrant economy, and a high quality of life. The Office of Greenways and Trails (OGT) is updating the FGTS 5‐Year Plan and holding 14 public open houses throughout the state.   The purpose of these meetings is to receive public input on the proposed update to the draft written 2018‐2022 FGTS Plan and Land and Water Opportunity & Priority Maps.   Please plan to join us at a location close to you.  If you are unable to participate in person, there is a comment form online which you can submit by e‐mail or conventional mail.  Comments accept through November 30, 2017.

St. Johns River-to-Sea Loop Summit and Trail Celebration

October 26 - 28, 2017 DeLand, Florida

Announcing the St. Johns River-to-Sea Loop Summit (SJR2C) and Trail Celebration to be held in DeLand on October 26 - 28, 2017. The Summit is sponsored by the St Johns River-to-Sea Loop Alliance in cooperation with FDOT Mobility Week and Greenways and Trails Month. The Summit will be a major milestone in the evolution of the St Johns River-to-Sea Loop and is presented by the nonprofit 501(c)3 St Johns River-to-Sea Loop Alliance in cooperation with the Office of Greenways and Trails, the East Central Florida Regional Planning Council, the Florida Department of Transportation, the River to Sea TPO, the Space Coast TPO, and others. The theme is synergy among trails, active mobility, safety, community spirit, multi-modal connections, bike-tourism, economic development, and health and fitness. The purpose of the Summit is to raise awareness of and support for the Loop and the Alliance and to celebrate trails. Presentations will focus on the evolution and status as well as the safety and health benefits of the SJR2C Loop, the potential economic impact of the Loop exemplified by the economic turn-around of cities such as Winter Garden, and the importance of municipalities, counties, destination marketing organizations, nonprofits and other interests working together to support and promote trails. The Summit will include three days of events, each with a different focus and purpose:

• Thursday, October 26 Stakeholder Meeting and evening reception/Happy Hour • Friday, October 27 Community outreach program celebrating the Loop and trails • Saturday, October 28 Fun events including a Halloween-themed kids bike ride and safety

Mobility Week promotes awareness of safe and sustainable

transportation choices. During Mobility Week, counties, cities and

transportation agencies host public events to promote other forms

of sustainable transportation such as walking, biking, ride-share

programs, public transportation, and more.  It is an ideal time for

agencies to highlight transportation achievements, roll out new

initiatives, or implement new policies.

Mobility Week is also an opportunity for residents to explore the

various transportation choices available to them. The grassroots

initiative gives people an opportunity to think about how

sustainable transportation reduces traffic congestion, benefits the

environment, and improves community health.
