SECTION-I (DETAILED NOTICE INVITING RFP)

BHUBANESWAR MUNICIPAL CORPORATION

REQUEST FOR PROPOSAL

Bhubaneswar Municipal Corporation (BMC) invites Request for Proposal (RFP) in two bid system for implementation of the project, “Construction of Decentralised Modern Drinking Water Purification Plants with Water Dispensing Units (WATER ATMS) Coupled with Smart Card facility at Various locations of Bhubaneswar City” on Design-Built-Operate-Maintain-Transfer (DBOMT) Basis. Intending participants/agencies should fulfill the eligibility criteria mentioned below.

ELIGIBILITY CRITERIA (TECHNICAL & FINANCIAL): a. TECHNICAL CRITERIA

Each intending participant (individual or registered Govt./Semi-Govt./Private Company/Firm/Society/Public or Private Enterprise or Entrepreneur or Undertaking should have completed at least one similar nature of work during last three years ending 2014-15. Copy(s) of the documentary evidence in support of this experience certificate duly signed and issued by competent authority should be submitted.

b. FINANCIAL CRITERIA Average annual turnover of each intending participant over last three consecutive financial years ending 2014-15 should not be less than Rs. 2.00 Crores. Audited financial statements should be submitted to substantiate the turnover.

Agency(s) participating in this RFP but not satisfying the above two eligibility criteria shall be declared as disqualified and their financial bid(s) shall not be opened/ considered for evaluation.

INFORMATION FOR THE INTENDING BIDDERS

a. Brief Project Report prepared by BMC for the aforesaid work is hereby uploaded in the website mentioned below with this RFP for reference and guidance of the intending participants.

b. This RFP along with other related/connected documents including the Project Report can be seen and downloaded from the websites; www.odisha.gov.in/ www.tendersorissa.gov.in/ www.bmc.gov.in/ www.urbanodisha.gov.in .

c. The RFP comprises two Parts; Part-I(Technical Proposal) and Part-II (Financial Proposal).

d. The RFP shall be available in the aforesaid websites from 11.00 A.M of dt.19.10.15 to 5.00 P.M of dt.24.11.15 for view and download. Intending agency(s) are requested to download the same, go through it and submit required proposal duly signed at appropriate places.

e. Queries/request for clarification can also be received through e-mail

[email protected] till 17.00 hrs. of dt.05.11.15. Decision clarification to be given in the aforesaid pre-proposal submission meeting shall be uploaded in the above websites for information of all concerned. It is, therefore, urged that the intending agency(s) should visit the aforesaid websites regularly to keep himself/herself/themselves abreast of the latest developments in connection with this RFP. Before submission of the proposal, each intending agency is urged to acquaint themselves with the local site conditions and other facilities, bottlenecks, socio-economic and environmental aspects, etc., and accordingly submit the proposal.

f. A Pre-Proposal Submission Meeting shall be held on dt.07.11.15 at 11.00 hrs. in this office. Intending agency(s) or his/her/their authorized representative(s) may attend the same for clarification/suggestion, if any, regarding this RFP.

g. Each Technical Proposal (Part-I) must be accompanied with self attested copies of valid Registration Certificate featuring constitution of the Firm/Agency/Organization and its authorized signatory. The proposal should also include copies of valid documents of EPF, VAT CC or CST CC or Service Tax Registration Certificate (as applicable) & PAN card. Each proposal should also accompany with Earnest Money Deposit /Bid Security amounting to Rs.4.40 lakhs and Cost of RFP Documents (non-refundable) @ Rs. 10,500/-. The EMD should have been pledged/issued (as applicable) in favour of Municipal Commissioner, Bhubaneswar Municipal Corporation in shape of Term Deposit Receipt or Fixed Deposit Receipt or Demand Draft or Banker‟s Cheque of any Nationalised or Scheduled Bank(s) or in shape of Small Savings Instrument of Govt. of India or in a combined shape of two or more of the aforesaid financial instruments. The cost of RFP Documents should be in shape of Demand Draft and drawn on any Nationalized/Schedule Bank in favour of Municipal Commissioner, Bhubaneswar Municipal Corporation. Without EMD & Cost of RFP Documents, the Proposal shall not be considered for evaluation. The Demand Draft to be submitted by each intending agency(s) towards cost of RFP Documents should have been issued/drawn on or after the date of issue of this Notice and should essentially remain valid at least for three months from the date of its issue. Similarly, Demand

Draft/Banker‟s Cheque, if submitted by any agency towards Bid Security (EMD) as described above, should have been issued/drawn on or after the date of issue of this Notice and should essentially remain valid for three months from the date of its issue. In case of interest bearing security(s)/deposit(s), as mentioned above, to be furnished towards EMD, the invested/deposited amount(s) shall only be taken into consideration as the amount of EMD furnished for the work, but not the amount(s) on maturity or the interest(s) likely to be accrued out of the said investment(s)/deposit(s). Accordingly, the intending agency(s) are urged to furnish the EMD(s).

h. Each Technical Proposal (Part-I) should also be accompanied with a General Affidavit in original. The affidavit should have been sworn before any Executive Magistrate or equivalent authority or Notary Public featuring that the documents and information submitted are true and correct. It should also feature that no information or document, wherein the agency has been forbidden/restricted/disqualified from participating in such proposal during the period this RFP remains open for participation, have been suppressed and/or not produced either by omission or commission. This affidavit is mandatory without which the proposal shall be rejected. Standard format for this affidavit is attached as „Annexure-I‟ to the Part-I: Technical Proposal. Similarly, agency(s), intending to submit RFP, but not registered under EPF Rules, are required to submit an affidavit in the prescribed format attached as ‟Annexure-II‟ to the Part-I: Technical Proposal. Regarding VAT/CST/Service Tax/EPF Registration/Agency(s) Registration documents required to be submitted, further clarification, if necessary, shall be furnished during Pre-Proposal Submission Meeting.

i. The Technical to be submitted by the intending agency(s)Proposal should also be accompanied with detailed schematic drawing of the system proposed, Brand/Make of the equipments to be installed along with detailed operation & maintenance proposal, ATM facility, etc. Operating range of the equipments should also be mentioned and assurance for timely supply & installation of equivalent/same/compatible equipments and/or spares should be submitted by each intending agency along with the Technical Proposal. Without these details the Technical Proposal shall be treated as incomplete and hence, shall be rejected.

j. Each part should be kept inside separate sealed envelop Superscribed as Part-I or II (as applicable) at top. These two separate sealed envelops should be kept inside another sealed cover superscribed at top with the „Bid Reference No.BMC-EED-I-10/2015-16‟. It should be submitted to the City Engineer, Bhubaneswar Municipal Corporation, Goutam Nagar, Bhubaneswar during office hours on working days through Regd. Post or Speed Post only on or before 2.00 P.M of Dt.24.11.15 The authority will not be held responsible for postal delay, if any, in the delivery of the documents and non-receipt of the same in time. The authority shall also not be held responsible for any damage caused to the documents during transit & handling.

k. The Proposal to be submitted by intending agency(s) should remain valid at least for a period of 120 days from the date of opening of Part-I: Technical Proposal. Subsequent extension of validity of the same shall be subject to consent of the respective agency(s).

l. Part-I (Technical Proposal) shall be opened at 4.00P.M on Dt.24.11.2015 in

the office Chamber of the City Engineer, BMC, Engineering Block, Bhubaneswar Municipal Corporation, Goutam Nagar, Bhubaneswar. If the same could not be opened on dt.24.11.2015 for any reason beyond the control of BMC, then the same shall be opened on the next official working/functioning day at 4.00 pm. After evaluation of the Technical Proposal, Part-II Proposal of the agency(s) who qualified in Part-I shall be opened and evaluated. The date of opening of Part-II (Financial Proposal) shall be intimated/informed subsequently.

m. For further verification of the documents to be submitted by the intending agency(s), this office reserves the right to make confidential correspondence, enquiry, etc., and its outcome shall have bearing on evaluation of the proposal(s) received.

n. Conditional and ambiguous proposals shall be rejected. Negotiation, if required, shall be the prerogative of BMC. After finalization and acceptance of the Proposal, letter of intent (LOI) shall be issued to the selected agency wherein, instruction shall be given to the agency to complete the balance official formalities such as; submission of VAT CC (if not submitted along with RFP), etc . The agency would also be asked to deposit Initial Security Deposit (ISD). The ISD amount shall be such that the EMD (mentioned above) and ISD put together shall constitute 2% of the accepted Financial Proposal. The shape and manner of ISD shall be the same as EMD. The selected/successful agency shall be required to enter into an agreement with BMC for due fulfillment of its obligation and completion of the project. The time to be allowed to the selected agency for completion of these formalities and draw the agreement shall be about one month from the date of issue of LOI. Non-compliance to this instruction shall make the Proposal of the selected agency liable for rejection with forfeiture of EMD followed by any other action deemed fit. No claim in any manner whatsoever, of the agency shall be entertained by BMC. In case, it happens, then BMC shall be at liberty to decide and take further course of action as it deemed fit to implement the project in greater interest of the prospective users/beneficiaries of this project. The RFP shall form a part of the agreement/MOU for the work to be drawn between the successful/selected agency and BMC, whether or not it is attached to the agreement/MOU. Other details can be seen in the detailed RFP uploaded in the aforesaid websites.

o. Intending agency(s), while submitting the Proposal, should sign & put his/her/their organization seal on all the pages and documents of the proposal as a proof of having read, understood and submitted the same.

p. The authority reserves the right to reject any or all the proposals without assigning any reason thereof subject to the limitations prescribed by Central Vigilance Commission.

RFP PART-I SECTION-II (ADDITIONAL CONDITIONS OF RFP)

1. Intending Agency(s) are required to submit self attested copies of valid Odisha

VAT Clearance Certificates along with their offers, failing which their offers will

not be considered for evaluation. Any agency from outside the State of Odisha

intending to participate in this tender but not registered under Odisha VAT Act is

also allowed to participate subject to the condition that he/she/they should

submit a Declaration-cum-Undertaking featuring that he/she/they is/are not

registered under the Odisha VAT Act as he/she/they has/have not started any

business in the State and he/she/they has/have no liability under the said Act.

Such agency, if became successful, then he/she/they will have to produce the

Odisha VAT Clearance Certificate in the required form VAT-612 within a month

from the date of intimation of the letter of intent (LOI). Failure to comply this

instruction within the stipulated period shall render his /her/their proposal

incomplete and shall be rejected with other punitive action against the said

defaulter agency as deemed fit by BMC.

2. RFP received in incomplete shape are liable for rejection.

3. No claim shall be entertained from any agency towards expenses made by him/her/them for submission of the RFP cancellation/rejection of the whole proposal or proposal of RFP of any agency(s), if any and also for.

4. The successful agency shall be responsible for safe custody of his materials at site. BMC will not be responsible for any loss or damage of the same for any reason, whatsoever.

5. The successful agency shall furnish a guarantee to the effect that all items of the

work constructed and supplied by him shall be free from any defect both in terms of materials and workmanship for a period of not less than 12 months from the date of completion, testing & trial run of the work. During this period the agency shall replace the defective materials or rectify the defects, if any, at his/her/their own cost.

6. Unilateral stoppage of work by the successful agency without prior written

permission of the Engineer-in Charge shall be considered as breach of contract and the Corporation reserves the right to take such actions as it may deem fit against the agency.

7. The successful agency shall deploy and engage at least one competent, qualified and authorized resident domain expert who shall represent the agency for the project (execution-operation-maintenance).

8. The successful agency shall take every precaution not to cause any damage to

life or property either in full or in part. In the event of any damage, the successful agency shall be responsible for the same and compensate in the manner decided by BMC and/or as per law.

9. The successful agency shall not subcontract the work to be assigned to him/her/them without written consent of BMC and at such terms and conditions, as BMC may deem fit.

10. The successful agency shall not employ for the purpose of this contract, any person who is below the age of eighteen years and shall pay to each labour for the work done by such labour, wages not less than the wages prescribed by Government of Odisha. The rules & guidelines of Deptt. of Labour, Odisha, EPF, ESIC should be followed by the successful agency.

11. No escalation of cost shall be admissible and/or paid by BMC for any reason, whatsoever.

12. The intending agencies are required to quote rate for each item shown in the

schedule of quantities in words and figures. In case of variation of the written rate(s) between words and figures, the rate(s) quoted in word shall be considered for evaluation.

13. BMC shall undertake statutory deductions as applicable under the Income Tax

Act, 1961, Orissa Value Added Tax Act, 2004 and any other statutory deductions from the bill amount to be paid to the successful agency.

1. I/We hereby declare that I/we are not currently deprived from participating in RFP/Tender by any Govt. Organisation including BMC and I/We have furnished the required eligibility documents as a valid agency for the above mentioned work.

3. I/We hereby authorise and request any bank, person, firm or organisation to furnish information to BMC as deemed necessary by it in connection with my/our eligibility criteria and document verification related to my/our Proposal for the work. I/We also authorise BMC to refer, peruse, consider & correlate my/our documents submitted by me/us in connection with works/proposals in any Govt organisation and I/We have no objection, if such documents, either in whole or part, are perused, referred and considered by BMC.

4. The undersigned undertake to submit further information/ documents as may be requested for/required by BMC in connection with this Proposal within the stipulated period to be intimated by BMC either through letter or through my/our Telephone No. furnished below. Non-response to this instruction by me/us within the stipulated period shall render my/our Proposal as non-response/incomplete and hence BMC shall be at liberty to take any action as deemed fit against me/us as well as to decide/cancel my/our Proposal for the work and I/we will have no claim against such decision of BMC.

AFFIDAVIT

[Applicable for the Agency(s) not Registered under EPF]

1. That as on date, I/we am/are not registered with RPFC (Regional Provident

Fund Commission), and solemnly affirm that, I/we shall follow the

“Employees Provident Fund and Misc. Provision Act, 1952 & rules /

schemes”, made thereunder, in case this work is awarded to me/us.

2. That I/we shall submit, after execution of work and before payment of any

bill, the detail list of labours, such as,

3. That, BMC authority will be at liberty to deduct 26% of the labour

ODISHA PWD / ELECTRICITY DEPARTMENT CONTRACTOR‟S LABOUR REGULATION

1. Short Title – These regulation may be called “ The Odisha Public Works Department / Electricity Department Contractor‟s Regulation”

2. Definition – In these Regulation, unless otherwise expressed or indicated the following words and expressions shall have the meaning hereby assigned to them respectively that is to say –

i. “Labour” means worker employed by a contractor of the Odisha Public Works

Department / Electricity Department directly or indirectly through a sub-contractor or other person, by an agent on his behalf

ii. “Fair Wages” means wages whether for the time or piecework described by the State Public Works Department / Electricity Department for the area in which the work is done

iii. “Contractor” shall include every person whether a sub-contractor or headman or agent employing labour on the work taken on contract

iv. “Wages” shall have the same meaning as define in the Payment of Wage Act

3. Display of notice regarding wages, etc: a. The Contractor shall Before he commence the work on contract display and

correctly maintain and continue to display and correctly maintain in a clean and legible condition, in conspicuous place on the work, notices in English and in the local Indian language spoken by the majority of the workers, giving the rate of wage prescribed by the State Public Works Department / Electricity Department for the district where the work is done.

b. Send a copy of such notices to the Engineer-in-charge of the work. 4. Payment of Wages: a. Wages due to every worker shall be paid to him direct b. All wages shall be paid in current coin or currency or in both 5. Fixation of Wage Period: a. The contractor shall fix the wage period in respect of which the wages be

6. Water Book and Wage Card : a. The Contactor shall maintain a wage book of each worker in such form as

may be convenient, but the same shall include the following particulars – i. Rate of daily or monthly wages ii. Nature of work on which employed iii. Total number of days work during each wage period iv. Total amount payable for the work during each wage period v. All deductions made from the wages with an indication in each case of

the ground for which the deduction is made vi. Wage actually paid for each work period

b. The Contactor shall also maintain a wage card for each worker employed on the work

c. The Engineer-in-Charge may grant an exemption from the maintenance of wage bond, wage cards to a contractor who, in his opinion may not directly or indirectly employ more than 10 persons on the work

7. Fines deduction which may be made from wages: a. The wages of a worker shall be paid to him without any deduction of any kind

except the following – i. Fines

ii. Deduction for absence from duty, ie for the place or places where by the terms of his employment he is required to work The amount of deductions shall be in proportion to the period for which he was absent

iii. Deduction for damage to or loss of goods expressly entrusted to the employed person for custody or for loss of money for which he is required to account where such damage or loss is directly attributable to his neglect or default

iv. Any other deductions, which the Odisha Government may from time to time allow.

b. No fines shall be imposed on a worker and no deduction for damage or loss shall be made from his wages until the worker has been given an opportunity or showing cause against the such fines or deductions

c. The total amount of fines which may be imposed in any one wage period on a work shall not exceeded an amount equal to five paisa in rupee of the wages payable to him in respect of that wage period

d. No fine imposed on any worker shall be recovered from him by installment, or after the expiry of 60 days from the date on which it was imposed.

8. Register of fines, etc: a. The contractor shall maintain a register of fines and of all deductions for

damage or loss Such Register shall mention the reason for which fine was imposed or deduction for damage or loss was made

b. The contractor shall maintain a list in English and in the local Indian language clearly defining acts and omission for which penalty or fine can be imposed It shall display such list and maintain it in a clean and legible condition in conspicuous places in the work

9. Preservation of Register: The wage register, the wage cards and the register of files deduction required to be maintained under these regulations shall be preserved for 12 months after date of the last entry made in them.

10. Power of Labour Welfare Officer to make investigation or inquiry :

The Labour Welfare Officer or any other persons authorized by the Government of Odisha on their behalf shall have power to make inquiries with a view for ascertaining and enforcing due and proper observance of the fair wage clauses and the provisions of these regulations He shall investigate to any complain regarding default made by the contractor, sub-contractor in regard to such provisions

11. Report of the Labour Welfare Officers: The Labour Welfare Officer or

others authorized as aforesaid shall submit a report of the results of his investigation or inquiry to the Engineer-in-Charge concerned, indicating the extend if any to which the default has been committed with a note that necessary deductions from the contractor‟s bill be made and wages and other dues be paid to the labourers concerned

12. Appeal against the decision of Labour Welfare Officers: Any person

aggrieved by the decision and recommendation of the Labour Welfare Officer or other persons so authorized may appeal against such decision to the Labour Commissioner within 30 days from the date of decision forwarding simultaneously a copy of his appeal to Engineer-in-Charge concerned but subject to such appeal, the decision of the officer shall be final and binding upon the contractor

13. Inspection of Register : The Contractor shall allow inspection of the wage

book and wage cards to any of his workers or to his agent at a convenient time and place after due notice is received, or to the Labour Commissioner or any other person authorized by the Government of Odisha on his behalf

14. Submission of Return: The contractor shall submit periodical returns as

may be specified from time to time. 15. Amendments : The Government of Odisha may from time to time , add to

or amend these regulations and on any question as to the application, interpretation of effect of these regulations, the decision of the Labour Commissioner or any other person authorized by the Govt of Odisha in that behalf shall be final.

PROJECT REPORT

1. INTRODUCTION:

Bhubaneswar is the capital city of Odisha. The city has a strong historic character of more than 3000 years. It is also known as the Temple City which elucidate the architectural legacy of the medieval period. Though the city was planned with wide roads, gardens and parks, but due to rapid urbanization and growing economic activity, the city has been extending in disproportionate dimension. Bhubaneswar city is situated at about 21º 15”

North latitude 85º 15‟ East longitudes. Its height above MSL is about 45.0m and is well connected through air, rail & road communication network.

2. CITY DEMOGRAPHIC DATA-VRS.-SLUM AND LABOUR:

The Urban Local Body (ULB) for the city is named as Bhubaneswar Municipal Corporation (BMC). It covers an approx. area of 135 km2. The city population as per 2001 census is about 8.40 lakhs. People are migrating to Bhubaneswar mainly from rural areas of the State as well as from the neighboring States of West Bengal, Andhra Pradesh and Bihar in pursuit of better livelihood and employment. This has been the cause of concern due to formation of new and growth of existing slums in the city. At present the slum population is about 30% of the total city population. It has been assessed through different sample surveys by NGOs that about 20% (50,000 people) of the total slum population generate their livelihood through engagement as daily labour in building and various infrastructure construction activities going on in the city. Since these activities are going on in an unorganized manner (not only in Bhubaneswar but also in any urban area of India), adequate data base, engagement profile and mobility of the daily labour are neither available nor mapped. But it has been well established that a strong linkage exists between the slum population and availability of daily labour force in the city for such building and infrastructure construction activities.

3. INITIATIVES FOR SLUM WELFARE:

Many plan and programme are being implemented through Govt., Semi-Govt. and Non-Govt. Organization for upgradation of the social, environmental and economical conditions of slum dwellers. Recent Govt. initiatives area BSUP, RAY, City Bus Service, Slum Rehabilitation and Development Policy, City Sanitation Plan, Cross-Subsidized Housing Schemes, etc. These programme and activities concentrate on the slum locations of the city. Little focus has been imparted in these programme for providing good quality drinking water at affordable price.

4. INITIATIVE OF BHUBANESWAR MUNICIPAL CORPORATION :

Bhubaneswar Municipal Corporation (BMC) is executing Roads, Drains, Buildings, Street Light Works, etc. in slum areas. But the action taken so far towards supply of drinking water in various slums is not quite encouraging.

The following problems have been observed in the slums of BMC.

(i) Scarcity/inadequacy of drinking water

(ii) Poor quality of water/contaminated water

The above problems aggravate exponentially during summer. But considering the climatic condition of Bhubaneswar city where hot and humid atmospheric condition prevail for about six months every year, it is observed that many slum dwellers depend on polythene pouched cold drinking water on payment to quench their thirst and satisfy their desire for cold water. This dependence has got the following adverse effects. (i) Non-food grade polythene pouch containing water may not be suitable

for drinking.

(ii) After drinking the pouch water, the slum dwellers used to throw empty

polythene pouch here and there which causes waste management

problem.

(iii) A part of the precious and hard earned money of the slum dwellers

gets utilized for purchase of these pouch.

5. PROPOSAL FOR INSTALLATION OF WATER PURIFICATION PLANTS AND DISPENSING UNITS (WATER ATMs) :

To get rid of the above problems and to provide good quality drinking water, specially for the slum dwellers, BMC intends to install state of the art technology equipped Reverse Osmosis (RO) with UV treatment system for drinking water supply at very nominal price/rate of about 30 paise per litre. It is proposed to install four Water Purification Plants. The source of water for these plants would be groundwater or piped water supply system of PHEO. The treated drinking water to be generated from the four Purification Plants shall be disbursed through forty Water Dispensing Units (Water ATMs) to be installed. From the Water ATMs people can avail drinking water at a cost of about 30 paise per litre compared to the market rate of Rs.1.00 for 300ml polythene water pouch. The locations for installation of these facilities shall be decided by BMC based on land availability and consumer need/demand. Each Purification Plant would supply treated water to ten ATMS. The ATMS shall be provided with Smart Card optional facility for easy, instantaneous and long term payment by the consumers. This would be a pilot project and shall be first of its kind in BBSR City. Further such projects shall be implemented based on outcome of this project. The scope of work and cost includes the following components. (i) Construction of civil structure

(ii) Electrification works with earthing arrangement

(iii) Water supply and drainage plumbing works

(iv) Installation of drinking water Purification Plants and Water ATMs

(v) Five year maintenence for the Plants & ATMs including one year (Ist

year) free maintenance during the initial guarantee period

(vi) Civil work maintenance for four years after the initial/Ist year

guarantee period. It includes painting, damage repair works, etc.

(vii) Payment of water tax and energy charges for five years

(viii) Watch and ward, operation & maintenance, cleaning and daily

maintenance works for five years

(ix) Procurement of Vehicle Mounted Water Tankers Sets for transport of

treated water from Purification Plants to Water ATMs with 5 years O &

M cost including driver, helper, POL & repair of vehicles with tankers,

pump sets, etc.

6. CONCLUSION:

The time required for construction, testing and trial run work

may be a year subject to availability of funds, materials and labour in time.

However, this time period of one year does not include force majure

conditions and other unforeseen and unavoidable circumstances due to which

the work might be delayed. It is also placed on record that the locations for

the proposed facilities shall depend on availability of litigation free land and

consumer demand to sustain the O&M expenditure.

RFP PART-I

SECTION-IV (BRIEF/INDICATIVE TECHNICAL SPECIFICATIONS

OF THE PROPOSED PROJECT)

1. Objective of the Proposal

It is intended to provide potable drinking water conforming to IS:

10500 quality at affordable price, specially, for the slum dwellers. The area to be

covered under this project is to be selected and the locations for installation of

these facilities are to be finalized. The process of transcending this service for the

intended slum dwellers and others shall be the following.

a. Selection of area/population to be served & location for installation of the

facilities: The selection criteria shall depend upon the demand for the

intended facility due to non-availability/ partial availability of city drinking

water supply system in the respective areas. In addition to this, location for

installation of the intended facilities shall also depend upon availability of

suitable land and other supporting infrastructure. The achieve these two

objectives, joint survey and consultation shall be done by BMC & the agency

to be selected through this RFP, here-in-after mentioned as „Agency‟.

b. Construction and installation of facility and then testing & trial run so as to

achieve the desired quality of the output drinking water (as per IS:10500).

c. Maintaining the desired quality throughout the contract period of 5 years of

this RFP and making the service (purified drinking water) available for the

intended beneficiaries at a very nominal /affordable price round the clock.

d. Maintaining the data log of the water input/output, wastewater, power

consumption, consumers, revenue/user charge generation, daily operation

period of the facilities, etc. In addition to the above, the objective of this

proposal is to explore the feasibility for operation of these installations beyond

the contract period for 5 years. This proposal, being the first of its kind in

Bhubaneswar city, shall be implemented as a Pilot Project. Subject to

successful outcome of the project, BMC may consider for replication/scale-up.

To achieve the aforesaid objectives, BMC shall provide access to input

water source for the purification plants. In addition to this electric power supply

to the installation sites shall also be facilitated by BMC. These two facilities shall

be provided by BMC within a radial distance of 100m from the respective water

purification plant and ATM installation site, henceforth mentioned as „Limit of

Contract‟. But availing these two services from (input water source & electric

power supply) with necessary arrangement and initial as well as recurring

expenditures shall be the responsibility of the Agency. Initially, it is intended to

install four Purification Plants with forty water ATMS at different locations of the

city. Each plant is to be designed to supply purified water to minimum ten ATMs

in hub & spoke model.

2. Pre-Proposal Meeting: A pre-proposal submission meeting will be held on

dt.07.11.15 (11.00 am) in BMC. In an effort to bring all terms and conditions and

specifications of the project to a common platform before submission of the

proposal(s) by the agencies and for any explanation sought for on this RFP the

aforesaid meeting shall be held. Any modification to this RFP with

corrigenda/addenda, which might become necessary as a result of the pre-

proposal meeting, shall be posted in the websites mentioned in the Notice

inviting RFP. Individual correspondence/communication with the agency(s) will

not be made on this aspect.

3. Brief Scope and Technical Features of the Deliverables

A. Preparatory Works

a. Survey & data collection to assess the feasibility for the project: To be jointly

done by BMC and the Agency.

b. Preparation of feasibility report with finalization of the locations for installation of

the purification plants and ATMs: To be jointly done by BMC and the Agency.

c. Selection of water sources and location of the intake/inlet for the purification

plants within the „Limit of Contract‟: To be jointly done by BMC and the Agency. The

source of input water shall either be ground water and/or state PHEO piped drinking

water supply network.

d. If ground water is selected as the source, then BMC shall undertake sinking and

installation of bore wells in consultation with the Agency. No claim and/or dispute

regarding the quality of water obtained from the source shall be entertained by BMC.

In case, piped drinking water supply network of state PHEO is selected as the

source, then BMC shall facilitate to provide water connection from this source. But

the Agency has to reassure himself/herself/themselves regarding the quantity,

quality and timing of water supply from this source for the entire project duration

period. No claim/reason/explanation in this regard by the Agency shall be

entertained and sustained by BMC. In either case, the Agency will have to adopt

suitable purification technology so that the desired purified water output quality and

quantity are maintained incessantly not only for the initial contract period of five

years, but also beyond the same, preferably up to ten years.

e. BMC shall ensure that electric power supply is made available from the city power

supply network of CESU in consultation with the Agency. No claim/reason/

explanation from the Agency shall be entertained or sustained by BMC towards

timing and rating of power supply.

f. Required measure of land for installation of the facilities (purification plants &

water ATMs) shall be provided by BMC for the stated project. Neither any property

title transfer, lease, mortgage of those lands shall be made by BMC in favour of the

Agency nor the Agency shall be entitled to undertake any other activity over the said

lands.

For the aforesaid deliverables no payment shall be made by BMC and no

additional responsibility shall be assumed by it other than those mentioned above in

Sl.3 (A) (a) to (e).

B. Deliverables by the Agency.

a. In case, ground water is selected as the source, installation of pump set fitted

with motor, pipings, Valves, power supply to the pump-motor shall have to be done

by the Agency. Selection and rating of the pump-motor, head-discharge, timing and

duration of pumping, availability of power supply to the pump-motor shall be the

responsibility of the Agency.

b. In case, state PHEO piped drinking water supply network is chosen as the source

of input water to the plant, then drawl of water of required/available quantity from

this system with necessary piping, valves, etc., shall be the responsibility of the

Agency.

c. Electric power supply service connection from the available city distribution

network shall be done by the Agency.

d. Arrangement for adequate auxiliary power supply source to sustain the

purification plant and water ATMs shall be the responsibility of the Agency.

e. Construction of the building to accommodate the RO plants is to be done by the

Agency in accordance with the schematic details provided in Section-IV of this RFP.

The cost of the building to be quoted in the Financial Proposal should cover all the

expenses required to be made for the aforesaid items at Sl. at (B), (a) to (d).

f. Supply & installation of water purification plant having total average purified water

output rating of 2000 lph (liters per hour) and equipped with RO+UV (treatment +

disinfection) system with latest technological improvisation for trouble free operation

and maintenance and average life of about 10 years need to be installed. The

proposal to be submitted by the intending agencies such that necessary sale-service-

spares support should be made available at a reasonable price and duration for

about 10 years from the date of operation of the plant. A few more

indicative/tentative details of the purifier are given in Section-III of this RFP for

reference.

Indicative Features Required for the Purification Plant

i. 5-stage state of the art purification machine (RO+UV)

ii. Remote sensing tool for real time on-line monitoring of water quality,

quantity (input, output for drinking & waste water) and machine

process.

g. Vehicle mounted water tanker with loading and discharging arrangement for

transportation of purified drinking water from the plant to the ATM sites is to be

provided. The design, capacity, material, make/brand of the vehicle, water tanker,

piping, valve & loading/discharging arrangements should be suitable for handling

drinking water (without imparting any toxicity) and capable to move easily form the

plant site to the corresponding water ATMs.

h. The water ATM proposed for installation should be equipped with UV treatment

facility and preferably, be a ring structured ATM with adequate storage facility.

Average output capacity of the water ATM should be 500 lph. Other features to be

equipped with each ATM are given below.

i. Sanitation & cleanliness of the purification plant and ATM sites are to be done by

the Agency at it‟s own cost and as per direction of BMC. No payment is to be

made by BMC for this part of the work.

j. The Agency will be required to set up a toll free help line telephone number to

receive and address customer complaints.

k. Required IEC to achieve community participation should be done by BMC & the

Agency for successful outcome of this project.

4. Operation and Maintenance

a. In case of regular & periodic maintenance, the Agency is required to undertake

the same during non-peak consumption hours, preferably from 8.00 pm in

evening to 4.30 am of next day.

b. In case of occasional trouble shooting or break-down, the system should be

repaired and made functional within 3 hours of such occurrence.

c. For quick response to troubleshooting of the system and reboot the same within

a reasonable time period, the Agency is required to establish a local O&M centre

within BMC area and should keep sufficient tools, spares, consumables and

manpower to make the system functional immediately. Reasonable time to be

allowed to reboot the system or any of its component/sub-component shall be as

per instruction of BMC to the Agency. Frequent failure at an interval of fifteen

days to one month of any component/sub-component shall be treated as a

breach of contract which would attract economic penalty as decided by BMC. In

any case, the economic penalty for non-functional of any plant/ATM with respect

to the required output quantity and quality by more than four hours during the

peak operation period of any day (7.00 am to 6.00 pm) shall be

recovered/payable from/by the Agency to BMC at the rate of five times the

average value of water sold to consumers per day during five functional days

preceding to the break-down incident day of the respective ATM/plant/water

tanker, as applicable.

5. Other Important Instructions for the Agency(s) Intending to

Participate in this RFP

a. BMC shall bear the capital expenditure related to the project

establishment at all the selected sites vide Financial Proposal (RFP

Part-II) Sl. A & B. For Sl. C of the Financial Proposal (O&M), please

refer the details therein at * and at Sl. b below.

b. Agencies intending to participate in this RFP are required to submit

alternate proposal in respect of the O&M component of the Financial

Proposal vide Sl. C of the RFP Part-II. The alternate proposal should

feature the rate/price of the output water from the ATM, which the

respective agency would charge in lieu of payment of O&M Cost at Sl.

„C‟ by BMC. In addition to this the intending agency(s) should also

submit detailed break-up of the rate/cost as required for the item at Sl.

„C‟ * of the Financial Proposal (RFP Part-II). Without these two

proposals, the documents to be submitted by intending agencies shall

be treated as incomplete and hence would be liable for rejection. The

tentative water tariff calculated by BMC to break-even the O&M cost is

Rs.0.30 per litre or part thereof subject to revision on expiry of every

year from the date of operation of each system (one purification plant

coupled with 10 water ATMs).

c. The intending agency(s) should submit a detailed proposal on quantity & quality

of wastewater to be generated at the purification plant sites and suggest

appropriate measure to handle and dispose the wastewater safely., If necessary,

the selected Agency may be required to share a part of the expenditure to be

incurred for disposal of the wastewater.

d. The agency will be required to display the rate/price/user fee chargeable to the

consumers as approved by BMC for the purified drinking water at the plant and

ATM sites. This display should also be maintained from time to time for legible,

easy & trouble free attention of the consumers.

6. Inspection

BMC may at any time, check the operation of the system or designate an

organization of its choice at the cost BMC of to carryout inspections of the

system, to satisfy itself that the Agency is performing its obligations with due

diligence. Any assistance at sites such as testing of water samples by field test

kits, providing records, etc., required for such inspection of the system shall be

provided by the Agency at its own cost.

7. Transfer of the Installations and Water Transport System to BMC

The handing over process of the asset shall be initiated at least one month prior

to the expiry of the tenure of operation. The Agency shall intimate in writing to

BMC and transfer possession of the project asset in full functional stage free of

cost for further maintenance. However, subsequent extension of the O&M

contract with the Agency at spells of one year after expiry of the initial contract

period may be considered at such physical & financial terms and conditions, the

Agency & BMC may mutually arrive at.

GENERAL CONDITIONS OF CONTRACT

1. The work is to be executed with due diligence and in integrated/synchronous manner. The materials to be used by the agency are to be of best quality, and in all cases, shall be subject to the approval of the Engineer-in-charge. Decision of BMC regarding progress achieved and quality of the work done by the Agency shall be final. 2. The executed quantity of work shall be measured by BMC in appropriate/applicable manner and at different stages. But stage/sequence of payment shall be the prerogative of BMC. Running account bill(s) shall not be preferred ordinarily. However, under exceptional circumstances or upon achievement of desired progress by the Agency, BMC may consider running account bill payment on written request of the Agency. The quantum of running account bill payment, unlike final bill payment, would in any case, shall be less than the corresponding proportionate value of work done and, shall be subject to the statutory deductions such as, income tax, service tax, etc.

3. BMC may put an end to this agreement at any time in case of bad/defective and/or it may remove/replace the defective work and while doing so, additional cost involved, if any, shall be realized from the Agency. No claim in this regard by the Agency shall be entertained.

SPECIAL CONDITIONS OF CONTRACT

1. The Agency shall not be entitled to any compensation on account of delay in

locating the sites by BMC or due to any natural calamity or labour unrest or

non-availability of labour, theft of materials or any kind of force majure

situation etc.

2. The decision of Commissioner/Mayor, BMC regarding the reasons for delay, if

any, in completion of the work shall be final and binding on the Agency.

3. If the Agency could not achieve proportionate progress with respect to time,

then BMC shall have the right to take any action deemed fit against the

Agency as per OPWD code including rescind of contract, levy of penalty, etc.

4. If the Commissioner/Mayor, BMC is not satisfied regarding the genuineness of

delay for progress and/or completion of the work, then he/she may impose

penalty @1/2% per day of delay subject to a maximum 10% of the

agreement amount.

5. BMC reserves the right, to make such increase of decrease in the quantities

and/or items of the work which are considered necessary during course of

execution, operation and maintenance. Such increase or decrease shall be at

the discretion of BMC and in no case, shall invalidate the contract except the

corresponding financial involvement.

6. Extra item of the work, if found essential for the project, shall be covered

under supplementary agreement to be drawn between the Agency & BMC.

The rate(s) for such item(s) shall be the prevailing Govt. of Odisha SOR-2014

with enhanced labour rates-2015 or average Indian market rate, as

applicable.

7. The Agency shall put his/her/their signature in the measurement book and bill

(before payment) as a token of acceptance of the quantities, specifications,

rates and amount of the bill and no further claim in this regard shall be

entertained by BMC.

8. The Agency shall remain responsible for sanitation, security and safety of all

labour/manpower to be engaged by him.

9. Performance Security shall be kept deducted at the rate 5% from every

running bill and final bill. Release of these security amounts along with EMD &

ISD shall be governed by the conditions laid down in OPWD code.

10. In case of any dispute in understanding the specifications, description of

items, rates, conditions of the RFP and subsequently, in the agreement/MOU

to be drawn with the Agency, decision of BMC shall be final and binding on

both the parties without prejudice to the rights and remedies available to

either parties under law of the Nation (India).

11. If any dispute(s) could not be resolved through mutual negotiation between

BMC & the Agency then for legal intervention, the present jurisdiction of

Bhubaneswar Municipal Corporation shall be treated as the area of occurrence

of the dispute(s).

Response to the queries raised and suggestions made in the pre-proposal

submission meeting held on dt. 28.9.15 for the project, “Construction of

Decentralised Modern Drinking Water Purification Plants with Water Dispensing

Units (WATER ATMS) Coupled with Smart Card Facility at Various Locations of

Bhubaneswar City” on Design-Built-Operate-Maintain-Transfer (DBOMT) Basis

vide RFP Reference No.BMC-09/2015-16/18020/Dt.3.9.15

Query 1:

The capacity of purification plant is stated as 1000 LPH on Page 26 (Technical Specification) and 2000 LPH on Page 45 (Schedule

of Quantities). What plant capacity shall be considered for the purpose of bidding?

Clarification: The average capacity of each purification plant should be is 2000 LPH. It may also be

in combination of two units @1000 LPH capacity for each location.

Query 2:

It is stated that output capacity of the water ATM shall be 500 LPH. Is it intended that the storage capacity of the Water

ATM is 500 liters? Kindly conform.

Clarification: The storage volume of each water ATM (prior to UV Treatment at ATM)

should be adequate considering intermediate filling duration and peak consumption hour.

Each ATM should have an average output capacity of 500 LPH.

Query 3:

It is stated that the Water ATM should have a UV treatment facility. However, the purification plant shall already have a UV

treatment module. Is the UV module supposed to turn on for every user transaction? In our opinion, UV module on a Water ATM is

not necessary.

Clarification: UV disinfection facility is essential at each ATM. It should be an integral part of the

water out flow system. The suggestion for installation of integrated RO plant with ATM is discarded

due to the problems associated with availability of source of water and drainage system at each site.

Query 4:

Which party, BMC or the bidding agency, shall retain the water revenues collected through sale of drinking water as specified by

the tender?

Clarification: BMC shall retain the water revenue to be generated/collected. The bidder should

deposit the amounts in BMC on daily basis. For further details, Sl. No.7 below may be referred. No

alternate Financial Proposal, as mentioned in Sl. No.5(b) of the RFP, Part-I, Section-IV, is required to

be submitted by any bidder.

Query 5:

It is stated that the system should be repaired within 3 hours of occurrence of break-down. Can it be revised to 12

hours for Water ATM unit and 24 hours for Water Purification Plant, as trouble-shooting and part replacement would

take longer depending upon the reason for break-down.

Clarification: It should be as per RFP.

Query 6:

“Frequent failure at an interval of fifteen days to one month of any component/sub-component shall be treated as a breach of

contract which would attract economic penalty as decided by BMC.” Could you define the term “frequent” as stated in the

sentence above? What would the ideal “penalty” be under such circumstances?

Clarification: It is clarified that for all practical purpose, failure of the system shall be

counted upon/referred to each ATM because the supply-sale of water is restricted through

ATMs only. It is further clarified that the term ‘failure’ would mean failure of each ATM to

provide rated out flow (quantity) and specified quality of water at any time. But for adequate

check and balance of the whole system, quantity and quality monitoring with data log

(manual /automatic) should also be maintained by the successful bidder at each RO plant for

input, output, consumption by the plant operating personnel, wastewater, etc. These details

shall be checked by BMC as and when required and corrective measures required, if any,

should be adopted by the successful bidder within a reasonable time as allowed/instructed by

BMC in each case failing which, it would be treated as a breach of contract and would attract

penalty/punitive action, as decided by BMC against the successful bidder. The frequency of

failure (save as defined above) as specified in the RFP, shall be referred to each ATM and

penalty shall be as per RFP.

Query 7: Pg 36 (Clause 4c)

“In any case, the economic penalty for non-functional of any plant/ATM with respect to the required output quantity and quality by

more than four hours during the peak operation period of any day .....” As the Water ATMs are cloud connected (as mentioned on

Page 35), the Water ATM may become non-functional if sufficient GSM/ GPRS is not available on any particular day. Will the afore-

mentioned penalty be waived-off under such circumstances?

Clarification: Each ATM should have facility for on-line and off-line function and data

transmission as well as storage facility. The off-line data should be transferred/transmitted as

soon as the network connectivity is available. Each ATM should also be equipped with

facilities to accept coins of one rupee (Indian) and user friendly programmable/variable water

dispensing facility in accordance with vending coin as well as Smart Card. Each transaction

should be recorded in the ATM and daily cumulative quantity out flow and amount generated

should also be recorded in the ATM for necessary action by BMC and the successful bidder.

The cut-off timing for each day and mode of collection and deposit of the amounts in BMC

shall be mutually settled between BMC and the successful bidder prior to drawl of

agreement.

Query 8: Pg 45 (Schedule of Quantities)

It is stated that minimum live capacity of tanker mounted vehicle shall be 2000 litres. However, based on our experience, at this

capacity the vehicle dimensions will be large enough to restrict the vehicle’s movement within low income communities. Can the

minimum capacity be reduced to 1000 litres?

Clarification: The capacity for bidding on this item is open to the bidders. However,

proportional cost shall be adopted for comparison in case of different capacities adopted by

different bidders. Capacity should be mentioned in the price bid.

Query 9: Refer Pg 32

“These two facilities shall be provided by BMC within a radial distance of 100m from the respective water purification plant and

ATM installation site, henceforth mentioned as “Limit of Contract”.” If the radial distance is more than 100 meters, will BMC

compensate the bidding agency? If the input water source is groundwater, and it runs dry during the project tenure, will BMC be

responsible for arranging an alternative source?

Clarification: The limit of contract would be adhered to as per RFP. It is furthered clarified

that if the source becomes inadequate/defunct in spite of the required rated and regulated

be provided by BMC free of cost.

Query 10: Refer Pg 1 and Pg 17

Pg-1 states the estimated cost of work to be INR 440 lakhs while pg-17 states the estimated cost of work to be INR 460 lakhs .

Which amount shall be considered as the estimated cost of work?

Clarification: The tentative estimated cost of the project for which RFP invited is Rs.440.00

lakhs.

Query 11: Refer Pg 32

“Each plant is to be designed to supply purified water to minimum ten ATMs in hub & spoke model”

What shall be the maximum possible distance between a purification plant and Water ATM?

Clarification: The location of purification plants and ATMs will be decided by BMC later. The

maximum travel distance/route distance from any RO plant to any ATM would depend upon so many

factors and hence cannot be predetermined.

Query 12:

Can the bidding agency supply drinking water in 20-litre jerry cans through door-step delivery in the same or neighbouring

communities?

Clarification: It is not allowed. Each customer/consumer should take water on payment from

the respective ATM only.

Query 13: Refer Pg 37 (Clause 5c)

Shall the cost of waste/ reject water disposal system be quoted along with Schedule of Quantities on Page 45 or shall it be quoted

separately?

Clarification: No. It is not to be quoted. Each intending agency should only submit a detailed

proposal for disposal of wastewater with or without dilution so as to maintain the wastewater

quality suitable for open drain discharge and disposal. The expected wastewater quality and

quantity with minimum and maximum rate of discharge should be submitted in this proposal.

BMC would provide an open drain within a radial distance of 50 m from each RO plant

building external wall outer surface. Wastewater storage, level of discharge and connectivity

of the wastewater discharge system from each RO plant to the aforesaid BMC drain with a

view to cause and maintain required velocity in BMC drain shall be the responsibility of the

successful bidder. No extra cost for this part of the project would be paid by BMC.

Query 14: Refer Pg 33 (Clause c)

In case groundwater shall be selected as source for input water, what is the estimated groundwater TDS (in ppm)? This shall

affect the cost of the purification plant.

Clarification: Available report is enclosed which should not be treated as exhaustive and

definite. However, each intending bidder is urged to undertake quality assessment at

his/her/their own cost/risk prior to bidding and accordingly quote for RO plant. No further

claim in this regard shall be accepted.

Query 15: Refer Pg 37 (Clause 5a)

What will the payment schedule for release of project cost, as entered in the financial bid, be?

Clarification: It would be as per RFP.

Query 16: Refer Pg 20 (Point vii)

Can you provide the details of “water tax” that shall be applicable within the purview of this project?

Clarification: BMC would provide source of water at free of cost and shall be limited to the

quantity/rate of drawl as per requirement of each RO plant. Excess drawl would be treated as

a breach of contract and would attract penalty/punitive measures, as decided by BMC. For

this, the data log mentioned as Sl.6 above shall be applicable.

Query 17: Refer Pg 34 (Clause B (f))

“The proposal to be submitted by the intending agencies such that necessary sale-service spares support should be made

available at a reasonable price and duration for about 10 years from the date of operation of the plant. “

The afore-mentioned clause mentions that spares and service support shall be available for a period of 10 years, whereas the

project tenure is for 5 years. Will the bidder be required to provide service-support and spares for a period of 10 years?

Clarification: Yes. It shall be on payment beyond 5 years of O&M as prescribed in the RFP.

However, such supply and/or O&M services shall be at such terms and conditions to be mutually

settled between BMC and the successful bidder followed by supplementary agreement(s) between

BMC and the Agency or through extension of the main/first agreement as stipulated in the RFP Part-I,

Section-IV, Cl.7, as applicable

Query 18: Refer Pg 42 (Pt. 4)

It is stated that penalty of @1/2% per day be applicable on entire project cost. In our opinion it should be on the particular portion

of the project (ex: capital expenditure or operational cost) for that particular year.

Clarification: Penalty should be @½% up to maximum 10% of the value of the work (supply,

construction & installation vide Part-A of the Financial Bid) lying unfinished during construction and

installation period of one year. Penalty for O&M is separate and shall be as per RFP and clarification

furnished above.

Query 19: Refer Pg 41 (Pt. 2)

“The quantum of running account bill payment, unlike final bill payment, would in any case, shall be less than the corresponding

proportionate value of work done and, shall be subject to the statutory deductions such as, income tax, service tax, etc.”

If BMC will deduct service tax from running account bill payment, will the bidding agency be provided with a proof for such

deduction?

Clarification: Payment terms shall be as per RFP. TDS certificates shall be provided as per rules.

The quantum of deductions from each Running Account Bill may be in the manner given below.

a. Odisha VAT: @4% of each Bill Amount

b. IT: @2% of each Bill Amount

c. Cess: @1% of each Bill Amount

d. Royalty: As per the material used in the work.

e. SD: @5% of each Bill Amount and would be subjected to release in accordance with fulfilment of

the conditions laid down in RFP Part-I, Section-V Cl.9.

The rate of aforesaid deductions may change from time to time as per instruction of Govt.

Query 20: As we have dealer in Odisha but we…………………….. Clarification: No consortium or joint venture is allowed. The conditions for VAT shall be as

mentioned in RFP Part-I, Section-II, Cl.1.

Query 21: Sketch is not clear pls. provide good resolution image Clarification: Clear sketch provided physically to the agencies participated in the pre-

proposal meeting.

Query 22: In this sketch you have mention 3 away of water distribution………………. Clarification: No home delivery is allowed. Pl. refer clarification at Sl. No.12 above.

Query 23: For water purification plant we have to construct the room but for 40 ATM………………….. Clarification: No room is intended for housing the ATMs with storage facilities. But the

financial bid/proposal of each agency should cover/include the requirements of each ATM

with respect to safety, required output quality and quantity of water, nuisance prevention,

protection against malfunctioning due to weathering action, protection against theft and

tamper, handling of wastewater due to spillages and repairs, etc. No extra cost an any

account, whatsoever, for this item shall be admissible by BMC.

With the above clarifications, all the queries received by BMC in connection to the

aforesaid RFP are hereby addressed.
