Enterprise under single point registration scheme are exempted from bid cost and EMD up to

the amount equal to their monetory limit.

cost of the work during each of the preceding 2 financial years i.e. 16-17 & 17-18.This

certificate to be issued by a charted Accountant/Auditor. Audited & Certified profit &Loss

account for the last 2 years i.e. (16-17 & 17-18) are Compulsorily attached

4. Xerox Copy of the EPF&ESI registration certificates

5. Copy of the registration certificate with Labour Commissioner (central)

6. Copy of Registration certificate of GST.

7. PAN card Xerox copy

8. Bank mandatory form for arranging payment through ECS/ RTGS / NEFT as per

Section – I

NATURE AND SCOPE OF WORK

1 Scope of the Work where persons required: This contract is for performing House keeping for

Administrative bldgs & stores for BSNL VISAKHAPATNAM District. mentioned above at page – 5 of

the schedule in any one of the shifts or in all the three shifts @ 8 hours per shift in a day assigned by

concerned Officer in-Charge. The House keeping Men shall check up the assets as soon as they attend

the work place and report to the SDE/JTO/In-charge that every thing is normal or otherwise. They should

discharge any works as entrusted to them by the Officer Incharge at the Exchanges/Offices where they

are engaged.

The personal shall keep the controlling officers informed about the developments in the

stations, answer the telephones and ensure the safety of BSNL’s properties.

The successful tenderer who is awarded with the work shall be responsible for

timely payment of monthly salary to the persons irrespective of the payments made by BSNL to

the contractor. The contractor shall be responsible for proper and prompt submission of bills

through controlling officer. The bills pertaining to a particular month should be submitted to

SDEs concerned within 15 days of the following month.

2 Period of Contract: The contract is initially for 1 year which may be extended to another 1 year

on the same rates and Terms and conditions subject to the satisfactory performance of the

contractor during the current contract period

3 Place of Work: The works are required at the places mentioned on page at Annexure-A of this

schedule. However the BSNL reserves right to add / delete some Offices from the list at any time subject

to the requirement.

4 Requirement: The Tenderer should arrange his workmen, material and other requirements. The

requirement is listed at Annexure-A may however vary by 25% either way. The contractor has to arrange

the additional requirement immediately under the same terms and conditions of the tender. The BSNL

will pay the approved quoted rate only as per Agreement.

5 Character and conduct of personal engaged by the Contractor: The persons so engaged should

possess good conduct/character, integrity and shall not involve in any criminal cases. The persons so

engaged for the works, if absconds or absents without valid reason, the approved tenderer shall make

alternate arrangement immediately under intimation to In-Charge Officer. The persons shall be obedient

and implement the instructions of the In-Charge officers or any authorised officers without any delay.

Any delay in this regard or refusal amounts to unsatisfactory performance and proportionate amount will

be deducted from the bills.

6 The persons so engaged are to be given special badges, photo identity cards, and distinctive uniforms by

the Tenderer himself at his cost for their proper identification. The chart and the details of the persons so

engaged for various maintenance works are to be intimated to the In-Charge officer of the concerned

Telecom Building. Read, under stood & complied Signature of the bidder

7 A log book towards the house keeping and general maintenance of Administrative bldgs & stores for

BSNL VISAKHAPATNAM District as suggested by the In-Charge officers is to be maintained by the

successful contractor and the entries are to be got attested by the In-Charge officer regularly.

Section – II

TERMS AND CONDITIONS

Submission of bid:

Only Original copies of Bid cost DD, EMD DD kept in a cover to be super scribed “Tender

for providing HOUSE KEEPING OF ADMINISTRATIVE BUILDINGS AND STORES

OF BSNL VISAKHPATNAM SSA for the year 2018-19” and are to be sent to AGM(NWP),

BSNL Bhavan, o/o General Manager Telecom District, BSNL VISAKHAPATNAM 530020

either by post or can be deposited in the Tender box kept for this purpose in the chamber of

AGM (NWP), Second Floor o/o G.M.T.D VISAKHAPATNAM on or before 10.55 hours on

11-01-2019. Any bid received after the due date / time for submission of this tender shall be

rejected. If the opening day falls on Holiday, Opening will takes place on the next working

day.

The tendering Authority shall not be responsible if the bids are delivered elsewhere. The bidder

shall furnish a declaration under his digital signature that no addition / deletion / corrections

have been made in the downloaded tender document being submitted and it is identical to the

tender document appearing on E-tender Portal https://apbsnl.etenders.in

1. This tender is two bid system.

The tender should be in Two bid format. One Super scribing Technical Bid and Second

Financial Bid. And both the bids should be submitted on online at e tender site

https://apbsnl.etenders.in

Tender will be opened on online at the due date of opening i.e. 1100hrs on 11-01-2019. The

sealed envelope containing BID COST & EMD will be kept in BSNL custody. The Time, Date of

the opening of FINANCIAL BIDS will be intimated only to those Bidders, whose Technical Bid is

accepted after evaluation of details and documents furnished below at para 2. No correspondence in

this regard will be entertained. Incomplete Tender is liable to be rejected. All Columns should be

furnished with relevant details and no column should be left blank. Scanned copies of bid cost &

EMD should be submitted on online. Financial Bid of the selected bidders only will be opened.

2 Documents required to be submitted on online along with Tender Schedule:

EMD/ Bid cost or Scanned copy of EMD/Bid cost DD.

3 EMD :

The tenderer should pay the sum of Rs 64,200/- (Rupees sixty four thousand and two hundred

only) for the areas vide annexure-A towards earnest money deposit in the form of DD drawn on

any Scheduled Bank in favour of The AO (Cash), o/o General Manager Telecom District,

BSNL VISAKHAPATNAM 530020. The Demand Draft in original should be enclosed to the

Tender application Form.Tenders received without EMD or received after due date are liable

for rejection. In case of successful tenderer, the EMD can be converted as part of Security

Deposit. No further correspondence shall be entertained in this regard.

4 Bid Opening: The tenders will be opened at 11.00 hrs of 11-01-2019 in the presence of such tenderers

or authorised representatives of the tenderer who are present.

5 Evaluation: The BSNL shall evaluate the bids to determine whether they are complete, whether any

computational errors have been made, whether documents have been properly signed and whether

generally in order. If there is a discrepancy between words and figures, the amount in words shall

prevail prior to detailed evaluation.

6 Rejection of the Tender: Any conditional clauses specified by the Tenderer in the submitted tender

shall result in the rejection of the tender. Any attempt to negotiate directly or indirectly on the part of

tenderer with concerned authority or endeavor to influence through any means for acceptance of the

tender is strictly prohibited. No further correspondence shall be entertained in this regard.

7 Security Deposit: Successful tender should pay an amount equal to 10% of total contract value towards

the Security deposit, within 10 (Ten) days from the date of receipt of communication from this office.

. The EMD paid by the successful tenderer can be adjusted from the above amount and the tenderer only

can pay balance amount. The security deposit can also be paid in the form of Bank Guarantee, it

should be valid for the period of 18 months that would be specified in the letter of communication.

No interest will be paid on security deposit or the EMD converted as SD. The successful tenderer is

required to pay the security deposit as intimated above

8 Agreement: The successful bidder is required to enter into agreement with BSNL within 10 (Ten) days

time after payment of requisite security deposit amount on a Rs.100/- Non-Judicial Stamp paper at his

own cost. Further the tenderer is required to arrange persons for House keeping men at the places of

requirement immediately after the work order by him from this office.

9 Forfeiture of EMD: The EMD shall be forfeited

(i) If the bidder withdraws his bid during the period of bid validity period of 150 days from the

date of opening of the tender.

(ii) If the successful Tenderer fails to remit the security deposit within Ten days of receipt of

communication.

(iii) If the successful Tenderer fails to sign the contract Agreement.

The EMD of unsuccessful Tenderers shall be refunded after finalization of the Tender. EMD will not

carry any interest

10 Forfeiture of Security Deposit: The Security Deposit paid by the tenderer shall be liable for forfeiture if the Successful bidder

(i) Withdraws his bid offer after entering into Agreement with the BSNL

(ii) Withdraws his offer in the middle of the Contract Period.

(iii) Fails to comply with any of the tender conditions or the work done by the workmen is not

satisfactory or the Tenderer is unable to supply required number of workmen on requisition by o/o

GMTD,VM

The final decision regarding any dispute that arises between the Tenderer and BSNL

VISAKHAPATNAM shall rest with GMTD Visakhapatnam

11 Payment: The quoted amount for Housekeeping men shall be paid after Completion of every calendar

month after duly deducting the applicable taxes, subject to the work being certified by controlling officers

of the buildings & countersigned by the DE concerned. The contractors should correctly and promptly

pay the monthly wages to the persons engaged by them without linking to the settlement of bills by

BSNL, VISAKHAPATNAM district. The contractor is responsible for timely (say within two weeks)

submission of bills after completion of a calendar month with dated signatures.

12 The successful Tenderer should deploy his own persons for the works specified. If, any lapse on the

part of such deployed service personal effect the agreement, may result in termination of the contract and

imposition of suitable penalty at the discretion of the General Manager Telecom District, Visakhapatnam.

13a Quoting of rate: The contract value quoted by the approved Tenderer should be inclusive of all

duties and levies except GST. The Tenderer shall quote the rate only in terms of the service charges

including any administrative charges payable. The monthly wages payable to individual person employed by the tenderer is indicated in ANNEXURE – B.

13b The BSNL reserves the rights to counter offer price(s)against price(s) quoted by any bidder.

13c BSNL also reserves the right to award the work amongst more than one bidder.

13d If there are more than one bidder at L1 rates ,all L1 bidders will be allotted work equally.

However the decision of GMTD,VM in this regard is final and binding on all the bidders.

13e All present, future and additional levies/taxes/duties etc, that may be levied by the GOVT/LOCAL

authorities will be born by the contractors.

13f The contractor’s representatives shall comply with all applicable laws, bye Laws, rules,

regulations, orders, directions, notifications etc of the Govt. / Court/Tribunals and shall also comply with all directions issued by BSNL and provide BSNL with all information and cooperation that BSNL may reasonably require from time to time. 13g The contractor shall ensure provision of necessary safety devices tools/ kits etc required for discharge of services at his own cost and shall recoup the same from time to time. 13h Contractor shall be liable for all payments of wages, Salary etc to its employees & shall Comply with all statutory laws, rules, relating to employment, wages, PF, ID, act etc.

13i The Contractor agrees to protect, defend, indemnify and hold harmless BSNL and its employees, officers, directors, agents or representatives from and against any and all liabilities, damages, fines, penalties and costs (including legal costs and disbursements) arising from or relating to any breach of any statute, regulation, direction, orders or standards from any governmental body, agency, telecommunications operator or regulator applicable 14 Right to reject the tender: The General Manager Telecom District, VISAKHAPATNAM reserves the

right to reject any or all tenders without assigning any reasons at any stage and is not bound to accept the

lowest tender. The decision of GMTD, BSNL will be final and binding on all the bidders. 15 Penalty: Any lapse on the part of the successful tender shall attract the imposition of penalty as listed

hereunder and the equitable amount shall be recovered from the amount due to the successful tenderer or

from the security deposit available with the BSNL. If the successful tenderer fails: (i) To arrange persons services a penalty of Rs.20 per service per day in addition to the amount

incurred by the BSNL for making alternative arrangements will be levied.

(ii) Similarly if the person’s service is rendered unsatisfactory and if the officer in-charge is not

satisfied with the services, a penalty of Rs 20/- per service per day in addition to the amount

incurred by the BSNL for making alternative arrangements will be levied.

16 Cancellation of Tender: During the currency of the contract if the services provided are

found to be unsatisfactory or for any other reasons the competent authority reserves the right to

terminate/cancel the contract and in that event the tenderer will be held liable for payment of all

monitory losses / damages that may arise /caused thereof. Acceptance of the tenderer rests with

the GMTD BSNL VISAKHAPATNAM and his decision in this regard is final. The General

Manager Telecom District, VISAKHAPATNAM reserves the right to terminate the services of

any or all workmen supplied by the tenderer by giving a notice of 15 days.

The tenderer is advised to make necessary preparation arrangements immediately after reaching

an agreement in this connection start providing services from the stipulated date without fail and

the said date shall not be extended under any circumstances.

The failure of tenderer to start providing the services on the above stipulated dates will be

treated as breach of contract and liable for cancellation of tender.

17 Damages to the BSNL property: Any damages to the BSNL property during the tenure of the

contract period should be made good by the tenderer at his cost. Responsibility is to be taken by the

contractor in case of loss of stores during Security performed by the persons engaged by the contractor.

Similarly any loss or damage occurring to the BSNL property by negligence or willful acts of the

persons engaged by the contractor or thefts by whatever causes has to be made good by the contractor.

18 .1 Statutory wages: The tenderer has to pay the wages as shown in ANNEXURE-B directly into

the bank account of labour. No wages should be paid in cash. The remittance in respect of EPF

and ESI made into the account of the labour should be submitted along with first month bill. The

individual account of EPF and ESI is to be submitted to the work issuing authority.

18 .2 Statutory laws and EPF / ESI: Tender is liable to follow the applicable statutory laws and observe

all other rules framed by the State Government / Central Govt. from time to time in respect of providing

the service. The tenderer should produce EPF code number within one month from the date of the

entering into the agreement.

19 Payment of Taxes: The tenderer is also advised to submit the aqcuittance of the wage bills

every month. Any taxes payable (Income tax, WCT etc.,) will be recovered from the bill.

20 Electricity and water shall not be wasted by the persons engaged by the contractor. Whenever /

wherever necessary the persons arranged by the successful tenderer shall switch off / switch on the

engine alternator provided in the telephone exchanges / offices. 21 Payment of compensation: In case of loss of life or any injuries caused to the persons during the

course of execution of his services, the BSNL is not liable for payment of any compensation. The

contractor is only responsible to pay the required compensation to such workmen. 22 Employees of BSNL, relative of BSNL employees and family members of BSNL employees shall not

participate in the Tender.

23 Right to engage one or more than one contractor: The BSNL reserves right to award tender for

placement of full tendered quantity of workmen to a single Tenderer (lowest tenderer) or may decide to

award tender to more than one Tenderers at the lowest approved rates. 24 Period of validity of Bids: The bid shall remain valid for 150 days after the date of opening of bids.

25 Force Majeure:- If any time, during the continuance of this contract, the performance in

whole or in part by either party of any obligation under this contract is prevented by reason of

any war, or hostility, acts of the public enemy, civil commotion, sabotage, fires, floods,

explosions, epidemics, quarantine restrictions, strikes, lockouts or act of God ( Herein after

referred to as events) provided notice of happenings, of any such eventuality is given bye either

party to the other within 21 days from the date of occurrence thereof, neither party shall by

reason of such events be entitled to terminate this contract nor shall either party have claim for

damages against the other in respect of such on performance or delay in performance under the

contract shall be resumed as soon as practicable after such an event may come to an end or cease

to exist, and the decision of BSNL as to whether the supplies have been so resumed or not shall

be final and conclusive, provided further that if the performance in whole or part of any

obligation under this contract is prevented or delayed by reason of any such events for a period

exceeding 60 days either party may at his option terminate the contract.

26. Arbitration: In the event of any dispute arising out of the contract, the same will be referred

to the arbitration of Chief General Manager Telecom A.P. Circle, Vijayawada or some other

officer nominated by him. The award of the arbitrator shall be final and binding on the parties to

the contract

26. Set Off:-Any sum of money due and payable to the contractor(including security deposit

refunded to him) under this contract may be appropriated by BSNL and set off the same against

any claim of BSNL for payment of a sum of money arising out of this contract or under any other

contract made by contractor with BSNL.

04. The security deposit shall be released after six months after

successful completion of the work at the end of the contract

period. The security deposit does not carry any interest.

05.The Security Deposit is to be forfeited to the Bharat Sanchar

Nigam Ltd. or his successors without any prejudice to any other

rights and remedies of BSNL, in case the contractor fails to

undertake the contract work, as per the work orders and as per the

terms and conditions given in tender schedule during the currency

of the contract.

06.That all disputes arising out of this contract will be referred

to the arbitration of the C.G.M.Telecom, A.P.Circle, Vijayawada, or

some other officer appointed by him. The award of arbitrator shall

be final and binding on the parties to this contract and provisions of

the Indian Arbitration Act 1940 and any statutory modification/

enactments thereto and the rules made there under from time to time

shall apply to such arbitration.

07. That the tender schedule and terms and conditions shall also

form part of the agreement.

08. That the contractor acknowledges that he is himself fully

acquainted with all the conditions of the contract and he shall not

plead ignorance of any of them.

Obtaining a Digital Certificate and its Usage: On eTendering System the bids should be

Encrypted and Signed electronically with a Digital Signature Certificate (DSC) to establish

keys i.e. Public Key and Private Key with two distinct certificate viz. Signing & Encryption

The Bid (Online Offer) for a particular eTender may be submitted only using the

Digital Signature Certificate (DSC). In case, during the process of a particular

eTender, the user loses his Digital Certificate (i.e. due to virus attack, hardware

problem, operating system problem), he may not be able to submit the bid online.

Hence, the users are advised to keep their Digital Signature Certificates in safe

custody.

In case of online Electronic Tendering, if the Digital Certificate issued to the

authorized user of a firm is used for signing and submitting an online bid, it will be

considered equivalent to a no-objection certificate/power of attorney to that User. The

firm has to authorize a specific individual via an authorization certificate signed by all

partners to use the Digital Certificate as per Indian Information Technology Act 2000

and its amendments. The Digital Signature of this authorized user will be binding on

the firm. It shall be the responsibility of management / partners of the registered firms

to inform the certifying authority or Sub Certifying Authority; in case of change of

authorized user and that a fresh digital certificate is procured and issued an

“Authorization Certificate‟ for the new user. The procedure for application of a

Digital Certificate will remain the same for the new user.

The same procedure holds true for the authorized users in a private/Public limited

company. In this case, the authorization certificate will have to be signed by the

directors of the company.

Bidders participating in e-tendering shall check his/her validity of Digital Signature

Certificate before bidding in the specific work floated online at the eProcurement

Portal (website) through https://apbsnl.etenders.in.

Techno-commercial Bid shall accompany interest-free EMD through Demand Draft.

The details of EMD can be obtained from Tender document of respective Tender OR

from above eProcurement Portal through https://apbsnl.etenders.in.

Refund of Earnest Money Deposit to the unsuccessful/successful bidders will be made

as per the conditions given in the tender document.

A scanned copy of DD against EMD should be uploaded mandatory while Bid

Preparation stage (as per the Schedule mentioned in online eTender) and original D.D.

should be submitted to the designated BSNL office in the sealed envelope on or

before the due date mentioned in Schedule of respective eTender.

Submission of Tender Document Fees:

The Contractors/Suppliers/Vendors have to submit the Tender Document fees as

mentioned in Tender Document (if applicable). If the bidders are exempted from

Tender document fees then they have to upload copy of exemption certificate during

bidding process.

Tender Download: The Eligible Bidders can download the Tender Document online from

above eProcurement Portal https://apbsnl.etenders.in on or before the Schedule Dates

mentioned in the eTender floated.

Submission of online bids: The bidders are required to prepare their bids on online

eProcurement Portal as mentioned above. During bid preparation the bidders have to Map the

Key of DSC hence they are advised to procure DSCs at earliest to participate in the eTender.

They are required to upload the scan copies of Demand Draft for Tender Document Fees and

Earnest Money Deposit. Also bidders are required scan and upload any other documents

related to their credentials and submit wherever asked online. The bidders have to prepare

their commercial bid online during in this stage only and seal (Encrypt) the online bid with

their Digital Signature Certificates. The Bidders should take note of any corrigendum being

issued on the web portal on a regular basis. The bidders will not be able to change their

technical details and offer (rates) after expiry of due date and time on online portal.

Opening of Tender (Electronic offers): The authority receiving the tenders or his duly

authorized officer shall first open the "EMD Envelope" (if applicable) of all the

contractors/bidders and check for the validity of EMD and other Pre-Qualification

Documents ( if any) submitted in the “EMD/Technical Envelope”, if any, as required by

apbsnl.etenders.in In case, the requirements are incomplete, the Technical Bid/Commercial

(whichever is applicable) of the concerned contractor received shall not be opened.

The authority shall then open the tenders submitted by the contractors online through the

apbsnl eTendering Portal (website).

Shortlisting of Bids (Electronic Offers): After the evaluation (online/manual) of a specific

Envelope (i.e. EMD or Technical) and offers submitted by contractors, the shortlisting

process will be executed on online eProcurement Portal only.
