PROFORMA – I

GENERAL CONDITIONS OF THE TENDER

TENDER NO. BPCL/WR/LPG/HR-MAH & GOA/07/09-10 DATED 11.09.09

TENDER FOR HOT REPAIR OF LPG CYLINDERS EX LPG PLANTS IN MAHARASHTRA & GOA STATES IN WESTERN REGION

CLOSING DATE / TIME: 01.10.2009 at 1400 HRS

OPENING DATE / TIME: 01.10.2009 at 1500 HRS

1. Offers are invited in a sealed envelope separately for Hot Repairing and Transportation of our 5 kg, 14.2 kg, 19 kg, 35 kg and 47.5 kg LPG cylinders ex all the Bottling Plants in LPG Western Region the names and addresses of which are enclosed as a separate annexure (Annexure XIII) with names of Territory Manager and their telephones numbers. The said jobs are to be carried out as per our scope of work, General Conditions of Tender, General Terms and Conditions of tender etc., as detailed in this tender.

2. This tender should be submitted in two parts namely - Technical Bid & Price Bid.

3. The Technical Bid has to be filled and submitted back to us together with all drawings, in a separate cover after signing on all the pages including the drawing, by authorised signatory after fixing their rubber stamp.

4. The tender form will be available at the office of Regional LPG Manager, the address of which is detailed below, during office hours only on any working day between 29.06.09 to 20.07.09 from 1000 hours to 1700 upon request on your Letter Head with payment of Rs 2500/- (non-refundable) by way of Demand Draft drawn on any Nationalized / Schedule Bank in favour of “Bharat Petroleum Corporation Ltd.,” payable at Mumbai.

5. The tender documents are also available on our website www.bharatpetroleum.in The same can be downloaded and submitted along with a DD of Rs. 2500/- (non-refundable) as pointed our in item no. 7) above. However, in that case the job drawing is to be collected from the office address given below and to be attached with the tender documents before submitting the same.

6. The non-refundable tender form fees of Rs. 2500/- has to be submitted with the “TECHNICAL BID” only.

7. Non submission of tender form fees of Rs. 2500/- with Technical Bid or enclosing it with Price Bid will make the tender liable for rejection at the discretion of the Corporation.

8. The tender of Hot Repair of cylinder is inclusive of transportation. Please note that the tender received without quotation for transportation rate even for a single plant, shall not be considered in any respect at all.

9. Please quote your lowest rate per cylinder for the job items in the “Schedule of Rates” in the Price bid attached.

10. The PRICE BID should be put in a separate cover. The tenderer not interested in doing the Hot Repair job ex a particular bottling plant shall cancel the transportation rate against that bottling plant in which he is not interested to do the job and should sign against the cancellation.

11. The two covers containing the Technical Bid and the Price Bids should then be put in a separate cover and sent to the office address as indicated in this tender. Rate of VAT applicable should be separately mentioned in the format. Please let have your Maharashtra VAT TIN Numbers along with a copy of registration

certificate. All the invoices raised should be TAX INVOICE and should be in the manner set out

under section 86 of the ACT, so as to ensure that Input tax credit could be availed by BPCL on purchase from you.

Please mention clearly the method adopted to derive at the material component of the works contract for applying the VAT rate i.e a) composite scheme b) standard deduction method or c) actual non material value method.

12. All the pages of the Technical Bid and the Price Bid should be duly signed by the authorized signatory only and affixed with rubber stamp on each page so as to reach this office before the due closing date of the tender. The tenders without separate technical & price bid will not be accepted. Quotations received after due date and time of tender will not be accepted.

13. The authorized signatory shall be:

a) Proprietor in case of proprietary concern.b) All the partners in case of partnership firm.c) Director, in case of a limited Company, duly authorized by its board of Directors to sign.

If for any reason, the proprietor or all the partners or director as the case may be are unable to sign the document, the said document should be signed by the constituted attorney having full authority to sign the tender document and copy of such authority letter as also the power of attorney, in original, duly signed in the presence of a Notary public should be submitted with the tender.

14. The rates should be firm which should be inclusive of cost of all the materials, steel, paint, labour, Foot Ring, V.P.Ring, electricity, fuel, water, power equipments, tools/tackles, excise, customs, work contract tax etc. & all taxes levied by Local Bodies, State/Central Govt., duties, octroi, octroi surcharge, road tax, service tax, loading, unloading at both ends etc. including everything. No revision will be allowed during the tenure of the contract.

15. The said jobs are to be carried out as per Scope of Work, General Conditions of the tender, General Terms and Conditions of the Tender, General Instructions for Hot Repair of Cylinders etc. detailed in this tender.

16. The Contract will be valid for one year from the date of awarding the contract. The contract can be extended for a further period of one year, on the same rates & terms and conditions at the discretion of the Corporation.

17. The approx. number of cylinders to be Hot Repaired during tenure of one year from various LPG Bottling Plants is as given hereinafter. The numbers of cylinders mentioned purely based on estimation and are only indicative and the quantity of each type may increase or decrease.

18. An EMD should be in the form of Demand Draft in favor of “Bharat Petroleum Corpn. Ltd.“ payable at Mumbai for Rs 1, 00,000/- or a Bank Guarantee of Rs. 1, 00,000/- valid for six months as per format enclosed (Annexure - XIV) is to be submitted along with the Technical Bid. The Demand Draft / Bank Guarantee should be drawn on a Nationalized/Scheduled Banks only. Quotations received without EMD or with less EMD will not be considered.

19. Please ensure that your name or any other identification mark does not appear on the envelope as otherwise your Tender may be disqualified.

20. We request you to go through all Tender documents carefully before submitting your quotations. Any clarifications regarding the work can be sought from our Regional Office on any working day during normal working hours.

21. “The Corporation may decide, at its sole discretion to distribute the quantities amongst the technically and commercially acceptable vendors. In such situations the following distribution pattern will be adhered to :

a) Where the quantity / job is distributed among 3 vendors the percentage allocation among them would be L1 : 70%, L2 : 20% and L3 : 10%

b) Where the quantity / job is distributed among 2 vendors the percentage allocation among them would be L1 : 80% and L2 : 20%

22. The company also reserves the right to accept / ignore any quotation in part or full or withdraw this tender altogether, without assigning any reason.

23. The Quotation/Price Bid and all the tender documents being sent to you should be returned to us duly signed on each page by an authorised signatory with official seal so as to reach the office of the undersigned before 1400 hrs of 01.10.2009.

24. The tenderer / authorized signatory shall have to sign all the pages of the Integrity Pact which is enclosed as Annexure XV

25. Performa of Integrity Pact (IP) shall be returned by the Bidder/s along with the Technical Bid duly signed by the same signatory who is authorized to sign the bid documents. All the pages of the Integrity Pact shall be duly signed. Bidder’s failure to return the IP duly signed along with the Technical Bid documents shall result in the bid not being considered for further evaluation & deemed to be rejected.

26. The tenders should reach the following address before due date and time of the closing date of

the tender mentioned herein before. Tenders/Quotations received after due date and time of tender will not be accepted.

ANNEXURE I

SPECIAL TERMS AND CONDITIONS OF TENDER

1) Tenderer should furnish evidence that the party is a approved by CCOE/BIS for carrying out the Hot Repair job of the cylinders and has facilities for Hot Repair/ Statutory Pressure Testing Approved by Chief Controller of Explosives, (CCOE) Nagpur and should hold valid approvals/license from CCOE/Bureau of Indian Standard (BIS) for carrying out Hot Repairs of cylinder as required under the Statutory requirements.

2) Tenderer should also provide a xerox copy of all valid/current licenses/approvals from CCOE/BIS etc to the effect that the tender’s facilities for Hot Repairs of LPG Cylinders are recognized by CCOE/BIS.

3) Tenderer should submit proof/zerox copies of required certificates that they have a qualified Mechanical Engineer in their permanent employment for certifying the Hot Repaired / Pressure Tested cylinders.

4) Tenderer should have past experience in the job of Hot Repair & should submit the proof of past experience to this effect. If the party is not having any experience in the said job, the technical bid and the tender submitted shall not be considered for award of job.

5) This tender should be submitted in two parts namely - Technical Bid & Price Bid.

6) The Technical Bid has to be filled and submitted back to us together with all drawings, in a separate cover after signing on all the pages including the drawing & the Integrity Pact, by authorized signatory after fixing their rubber stamp.

7) The tenderer of Hot Repair of cylinder is not exclusive but inclusive of transportation. Hence, a tenderer willing to do the Hot Repair job ex any particular Bottling Plant must also do the transportation job for that particular plant.

8) In case the tender is not willing to do the job of Hot Repair ex a particular bottling plant, then the tender should cancel the transportation rate ex that bottling plant in which he is not interested to do the job and should sign against the cancellation.

9) Quoting the transportation rate ex any bottling plant will be construed as the tender is willing to do the job ex that bottling plant for which he has quoted the transportation rate. Once the transportation rate against a plant has been quoted, the tenderer cannot at a latter stage withdraw for doing the transportation. In that case, the EMD submitted by the tenderer shall be forfeited and tender stands to be black listed from quoting in all the tenders issued by BPCL.

10) Please quote your lowest rates for the job of Hot Repair per cylinder in the Price Bid. Please note that no change and/or addition in the format of the Schedule of Rate is to be made. Changes and/or additions of any nature made will not be considered.

11) The rates should be firm which should be inclusive of cost of all the materials, steel, paint, labour, Foot Ring, V.P.Ring, electricity, water, power equipments, tools/tackles, excise, customs, Sales Tax, but excluding VAT, tax, service tax, loading, unloading at both ends etc. & including everything applicable & also including BIS Inspection/Certification charges etc. which shall remain firm throughout the period of the contract. All materials are to be supplied by the tenderer unless otherwise advised. Revision in rates on account of increase in material cost including steel or increase in cost of any nature etc. and /or increase in any of the taxes, service tax etc. will be not be allowed during the tenure of contract.

Rate of VAT applicable should be separately mentioned in the price bid format. Please let have your Maharashtra VAT TIN Numbers along with a copy of registration

12) The rates quoted for transportation should be inclusive of fuel charges, Octroi, Octroi Surcharge, Octroi service charge, all taxes levied by Local Bodies, State/Central Govt., duties and other levies applicable en-route, separately, between each LPG Bottling Plant and your works as well as loading/unloading of cylinders at both the ends. Revision in rates on account of any of these or levy of any new tax/octroi etc. of any nature will not be allowed during the tenure of contract.

13) The rates quoted shall be valid for a period of 180 days. Once the quotation is accepted, the rates quoted shall be firm till the entire work is completed in all respects.

14) The PRICE BID should be put in a separate cover. As explained earlier, the tenderer not interested in doing the Hot Repair job ex a particular bottling plant shall cancel the transportation rate against that bottling plant in which he is not interested to do the job and then should sign against the cancellation.

15) The two covers containing the Technical Bid and the Price Bids should then be put in a separate cover and sent to the office address as indicated in this tender.

16) All the pages of the Technical Bid including the drawings and the Price Bid should be duly signed by the authorized signatory only and affixed with rubber stamp on each page so as to reach this office before the due closing date of the tender. The tenders without separate technical & price bid will not be accepted. Quotations received after due date and time of tender will not be accepted.

17) Tenderer should submit correct address of the work site and also the office address and name and the designation of the Contact person at Work Site and at Office, who are responsible for the job of Hot Repair / painting and transportation of the cylinders.

18) Tenderer have to furnish the permanent income tax account number & also income clearance certificate for the previous financial year or Income Tax Return filed for the last financial year.

19) Tenderer should submit the proof of past experience in the job of Hot Repair of the cylinders.

20) Tenderers should fill in all the information pertaining to them in the format given in Annexure – IV, V & VI

21) Tenderer should give the correct details with proofs wherever required regarding the capacity of their plant viz. Production capacity (Cylinders) / month; Number of Shifts Operated for the Job; Capacity already being utilised (Cylinders/month), Spare Capacity available of the job proposed under this tender (Cylinders / month) & future plans to increase the capacity etc.

22) The quantity of cylinders to be hot repaired during the year shown against each location is purely based on estimation and BPCL does not guarantee any minimum number of cylinders to be hot repaired from any of the plant/s/locations. BPCL reserves the right to award the job to one or multiple parties from one or from all location mentioned in the tender at it sole discretion.

24) The tenderer will submit the spare capacity of their plant indicating the number of cylinders that will be Hot Repaired by them. Please note that spare capacity of the plant is the essence of the contract and hence please quote realistic spare capacity considering present and future commitments.

25) The yearly estimated quantity for Hot Repairs cylinders ex various LPG Plants as indicated below is expected to be approx. 200 nos. of 5 kg cylinders 89900 nos. of 14.2 kg cylinders, 17350 nos. of 19 Kg cylinders,200 nos. of 35 kg cylinders and 200 nos. of 47.5 kg cylinders.

26) However, BPCL does not guarantee any minimum number of cylinders that will be given for Hot Repair from any of the above plant.

27) The rates quoted will remain firm during the tenure of the contract. No escalation of any nature shall be reimbursed. Any new levies, which are not applicable as on date but may be levied in future, shall be borne by the tenderer.

28) The contract shall be valid for a period of one year from the date of award of the job and can be extended for one more year on same rates, terms and conditions if the performance is found satisfactory and at the sole discretion of BPCL.

29) All entries in the Tender Documents should be in ink/typed. Corrections, if any, should be attested by full signature of the Tenderer.

30) Tenderer should duly fill in all the required information asked for in the Annexures IV, V, VI & VII and sign on all the pages including the drawings and affix the Company’s Seal on the Schedule of Rates page, and affix official seal on all the other pages and arrange to submit the same on due date & time herein before mentioned.

31) Please ensure that your name or any other identification mark does not appear on the envelope, else, your Tender is likely to be disqualified. The tender documents should reach us before 1400 hrs. of 01.10.2009. Quotation received after the Due Date and Due Time will not be accepted.

32) The Tender should be strictly inline with our terms and conditions. Any Tender not confirming to the terms and conditions prescribed in the Tender Documents shall be rejected. Counter terms and conditions will not be accepted. Over-writing should be avoided. Corrections if any should be initialed by the tenderer.

33) The tenderer should quote for all items in the tender schedule. The rates should be expressed both in figures and in words; where discrepancy exists between the two, the rates expressed in words shall prevail.

34) The Corporation reserves the right to accept or reject the tender in whole or in part and/or to divide the work amongst Tenderer’s in the manner considered suitable and/or to negotiate with the tender (s) in the manner the Corporation considers suitable, without assigning any reason thereof.

35) Acceptance of the offer shall be valid only when advised by the Corporation in writing to the successful Tenderer(s).

36) No unsolicited correspondence/queries will be entertained while award of the contract is under review. Corporation regrets its inability to answer individual queries.

37) Hot Repair of cylinders has to be carried out as per IS 13258:1991 and any other relevant IS Code/Specifications as published by BIS and in accordance with the requirements of Gas Cylinder Rules - 1981, The Static & Mobile Pressure Vessels (Unfired) Rules - 1981 and all the latest amendments issued from time to time by Chief Controller of Explosives, Nagpur, BIS authorities or any committee approved by the Government concerning LPG cylinder handling/repairs etc. in addition to the details provided in the SCOPE OF WORK (Annexure – II ) and as per specifications in the drawing attached. The bung threads to be inspected with L-1 & L-9 gauges as per IS 1921 - 1972 (latest revisions). In case of any overlapping instructions or job specifications, the tenderer will bring the same to our notice immediately.

38) However, the job shall be carried out as per IS:13258-1991 with all latest Revisions / Amendments etc. and as per our specification of drawings attached with the scope of work.

39) As per directives of CCOE and present practice, BIS representatives will supervise and inspect the job carried out at your factory prior to the commencement and during the Hot Repairs.

40) Pressure testing has to be carried out in accordance with the requirements of Gas Cylinder Rules, 1981 & Static and Mobile Pressure Vessels (unfired) Rules, 1981 & all the latest amendments issued from time to time by Chief Controller of Explosives, Nagpur. Segregation, rejection, pressure testing and painting will have to be carried out by you as per IS: 13258 - 1991 AND GENERAL INSTRUCTIONS ON HOT REPAIRS OF LPG CYLINDERS (Annexure - III) as well as per all latest amendments/ revisions issued from time to time by CCOE / BIS / Govt. approved committees etc.

41) Cylinders after Hot Repairs will not be accepted back by us unless they are accompanied by Test Certificates (Annexure – VIII) duly certified by your Mechanical Engineer and BIS officials.

42) If the cylinders are rejected, you should inform Territory Manager of the respective plant in writing. Our Territory Manager will arrange to depute one of the officers for inspection of these rejected cylinders. Rejected cylinders will have to be sent accompanied by a list as per format enclosed (Annexure – IX) duly certified by BIS officials.

43) Cylinders rejected on visual inspection or during course of hot repair/hydro-testing or for any other reason MUST NOT BE DESHAPED BY THE PARTY

44) A monthly reconciliation statement should be sent to each LPG Plant detailing stocks of cylinders, valves lying with you as per enclosed format (Annexure - X). This statement should reach us/plant by the 5th of every month or else your bills will be held up for want of these statements. The cylinders/valves delivered to other plants should also be mentioned. The details of cylinders received and despatched has to be furnished in enclosed format (Annexure – XI).

45) Cylinders given for Hot Repairs should be returned after completion of the Hot Repairs, Pressure testing Painting and fixing the valve using approved jointing material within a period of 2 weeks from the date of despatch from the plant. For delays in completion of the job, penalty @ Rs. 1/- per cylinder per week or part thereof will be charged .

46) The tenderer will procure all the materials required for the job. During the time of Hot Repair / Pressure testing of cylinder, if any SC valve fails, the same will be replaced with the new SC Valve. We shall arrange to provide only necessary number of new SC Valves (with safety caps and thread protection cap) for fitting on the cylinders after Hot Repair, whenever required.

47) Tenderer will render a detailed account to the TM of the respective Territory, on a monthly basis, as to the number of valves received by you, number of valves fixed on the cylinders & no. of valves sent back to the plant and balance valves lying with you on account of that plant. At the end of the contractual period you will arrange to return to the respective LPG Plant all unused new/old valves, cylinders etc., failing which Corporation shall recover the cost of these inventories at the prevailing penal rates, from your bills & at the rates as may be decided by the Corporation from time to time.

48) The old replaced valves should be covered with old safety cap and thread protection cap recovered from new SC valves sent to you. While returning the cylinders after hot repair & painting etc. the contractor should return the equivalent number of old valves removed from these cylinders to avoid accumulation of the same at his end. The Contractor shall keep an account of the old replaced valves and return back to the plant all the balance old valves, if any, at the end of the contractual period, failing which Corporation will recover the cost of these valves from the Contractor's’ bills at the prevalent penal rates, as may be decided by the Corporation.

49) However, the contractor SHOULD NOT have a stock of more than 900 number of SC valves (inclusive of both New & Old) with him at any point of time.

50) After the award of contract, the successful tenderer shall not be permitted to sub-contract or assign any of the work in respect of hot repair of cylinders to any person/ party, without prior written consent from the TM of the respective plant or the Regional Office at Sewree.

51) You are required to furnish an EMD of Rs.1,00,000/- while submitting this tender. The EMD should be in the form of a Demand Draft in favour of “Bharat Petroleum Corporation Ltd” and payable at Mumbai or a Bank Guarantee for a like sum as per the format enclosed (Annexure - XIV) valid for 6 months. The Demand Draft/Bank Guarantee should be from a Nationalized/Scheduled Bank only. Tenders received without the requisite EMD as stated above shall be summarily rejected.

52) Cheques and/or request for adjustment against any pending dues/bills will not be accepted as EMD. Any tender with such cheques/requests shall be treated to have been received without EMD and shall be rejected.

53) EMD/Bank Guarantee will be forfeited if the tenderer :-

A) Modifies/withdraws the offer during the validity period of 180 days from the due date of the tender.

B) Refuses to sign the agreement after award of the work by the Corporation.

C) In case the successful tenderer, after the issue of the contract, fails to carry out qualitative hot repairs and/or if the job of hot repair and/or transportation is not performed within the specified time frame mentioned herein above, the Corporation reserves the right to foreclose the contract and/or get the same work done from any other source and if the cost incurred therefore is more than the party’s rate accepted by the Corporation mentioned in the agreement, the contractor will be liable to pay the said difference in the cost suffered by the Corporation at the defaulting tenderer’s risk, responsibility and cost. In such cases Corporation reserves the right to forfeit the Security Deposit/Bank Guarantee provided by the tenderer and/or recover the amount from the bills submitted by contractor, and/or by lodging claims on the contractor for balance amount as necessary. The above is without prejudice to the right of the Corporation to take any other penal action against the contractor, as it may deem fit.

54) The Corporation shall have full right to terminate the contract any time during the tenure of the contract if the services and/or the job performed are not found satisfactory without giving any notice in writing thereof and no compensation for damages can be claimed by the contractor.

55) The Corporation shall also has a full right to foreclose / terminate the contract anytime during the tenure of the contract without giving any reasons/notice in writing thereof. The tenderer cannot claim compensation for damages nor the tenderer can be exempted from the penalty levied on them for not carrying out timely Hot Repair of cylinders and/or if the services &/or the quality of the job/s performed are not found to be satisfactory.

In such cases Corporation also reserves the right to forfeit the Security Deposit/Bank Guarantee provided by the tenderer and/or recover the amount from the bills submitted by the contractor, and/or by lodging claims on the contractor for balance amount as necessary.

Above is without prejudice to the right of the Corporation to take any other legal / penal action at its sole discretion, as it may deem fit, against the contractor and the contractor shall have no right to dispute the action taken or sum so recovered.

56) In case of unsuccessful tenderer, the EMD will be refunded to the party after finalization of the tender. In the case of successful tenderer(s), the EMD will be refunded only after completion of all the formalities i.e. submission of the Security Deposit and signing the Agreement.

57) No interest is payable on EMD / Security Deposit lying with the Corporation.

58) On our issuing the letter of intent, the successful tenderer(s), before signing the Agreement, will have to furnish us a Demand Draft of Rs. 1, 00,000/- per plant from a Nationalized Bank as Cash Security deposit for performance of the Contract. Also in addition to above, the successful tenderer will have to furnish a Bank Guarantee for Rs 3,00,000/- per plant from a Nationalized Bank for each of the other plants / territories except BPCR, URAN & PUNE.

59) In addition to the Security Deposit by way of Demand Draft of Rs. 1,00,000/- as aforesaid, the Security Deposit by way of Bank Guarantee for BPCR, URAN & PUNE will be as follows:

60) The Bank Guarantees to be submitted for each of the above Plant /Territory shall be valid for 18 months from the date of issuing of the Bank Guarantee on account of security for inventory lying with the tenderer.

61) You will be required to compensate us at the prevailing penal rate, which presently is Rs. 700/- (Rupees Seven Hundred only), per 5 Kg cylinder, Rs. 2000/- (Rupees Two Thousand only), per 14.2 Kg cylinder, Rs. 2,500/- (Rupees Two Thousand Five Hundred only) per 19.0 Kg. cylinder, Rs. 4500/- (Rupees Four Thousand Five Hundred only), per 35 Kg cylinder, Rs. 6000/- (Rupees Six Thousand only), per 47.5 Kg cylinder and Rs. 172/- (Rupees One Hundred Seventy Two only) for valve on account of loss or damage of cylinder/valve, or if the cylinder returned to us is found to be spurious & Rs. 2/- (Rs. Two only) per safety cap. The rates may be decided/revised by the Corporation, from time to time.

62) In respect of Other Marketing Company (OMC) cylinders the Tender/Contractor to ensure that no OMC cylinder due for hot repair is uplifted by him.

63) If any OMC/Spurious cylinder is hot repaired and/or returned by the party under this contract, it will be dealt with as under :-A) No charges for hot repair, change of Foot Ring/V.P. Ring etc. will be paid by the

Corporation for such OMC/ Spurious cylinder hot repaired by the contractor.

B) Two ways transportation cost will not be paid in case the transportation is being done by the contractor.

C) Corporation at its sole discretion will also recover the prevalent cost of the cylinder/s, valve, caps etc at penal tariff rates which presently is Rs. 700/- (Rupees Seven Hundred only), per 5 Kg cylinder, Rs. 2000/- (Rupees Two Thousand only), per 14.2 Kg cylinder, Rs. 2,500/- (Rupees Two Thousand Five Hundred only) per 19.0 Kg. cylinder, Rs. 4500/- (Rupees Four Thousand Five Hundred only), per 35 Kg cylinder, Rs. 6000/- (Rupees Six Thousand only), per 47.5 Kg cylinder and Rs. 170/- (Rupees One Hundred Seventy Two only) for valve on account of loss or damage of cylinder/valve, or if the cylinder returned to us is found to be spurious & Rs. 2/- (Rs. Two only) per safety cap. The rates may be decided/revised by the Corporation, from time to time.

64) It will be the tenderer/contractor’s responsibility to ensure that the cylinders handed over to you are kept safe in your premises free from theft, fire, accident or any damage. To safeguard against such loss or damage you will be required to provide per plant an appropriate insurance cover preferably from a Nationalized Insurance Company valid for one year from the date of entering into contract for 100 nos. of 5 Kg. cylinders @ Rs. 700/- per cylinder, 600 nos. of 14.2 Kg. cylinders @ Rs. 2000/- per cylinder, 150 nos. of 19.0 Kg. cylinders @ Rs. 2500/- per cylinder, 50 nos. of 35 Kg. cylinders @ Rs. 4500/- per cylinder, 50 nos. of 47.5 Kg. cylinders @ Rs. 6000/- per cylinder and 900 valves @ Rs. 172/- per valve. The policy should be taken in favour of BPCL a/c the contractor.

65) In case of excess inventory per plant or non renewal of the said Insurance policies in time, the safe keeping of Company’s Assets will be tenderer/contractor’s sole responsibility.

66) The factory premises should be open to BPCL officials for on the spot surprise inspections at any time during the day.

67) If careless handling or rough handling of cylinders by the contractor’s labour is established, the Corporation shall be free to recover the cost of damages/loss from the contractor at a penal rate.

68) The hot repair cylinder, if found unfit at the time of first filling after hot repair is established or quality of job performed or painting is found to be improper/unsatisfactory, the cylinder will be sent back to the contractor for rectification/repainting at contractor’s cost and the additional transportation charges incurred on these cylinders will be deducted from the contractor’s running bills.

69) Bills should be submitted to the respective Plant/Territory within one month after the hot repaired cylinders are received by the plant, failing which the bills will be passed only at Corporation’s discretion.

70) The contractor(s) shall submit the bills to the Corporation in accordance with the agreement and at the rates specified in the schedule of the agreement in such a format as accepted by the Corporation.

71) The payment for the job performed shall be released by the respective Territory for the actual work done on monthly basis after satisfactory completion of the job and after submission of the bills/certificates etc. It will be the contractor’s responsibility to ensure that the bills/certificates reach the respective plant. Corporation will not be responsible for the bills lost in transit.

72) While making the payments against the bills, Income Tax, Work Contract Tax etc at the prevailing rates/applicable from time to time will be deducted by the Corporation and the TDS certificates will be issued subsequently.

73) Any deductions/dues to be recovered from the contractor(s) will be directly deducted by the Corporation from the contractor’s pending/running bills and all the balance dues will be deducted from the Contractor’s final bill.

74) The Corporation shall have right to deduct and/or realize the amount due to the Corporation from the Contractor’s EMD/SD/BG/pending bills or any money due to the Contractor or out of any money payable to the contractor or the amount may be recovered by any other means the Corporation may deem fit or as liquidated damage/s. The decision of the Corporation will be final and binding on the contractor in this regard.

75) On awarding the contract, the contractor may immediately nominate/authorize representative with the representative’s specimen signature for collection of letters, submission of monthly statements, etc.

76) The contractor undertakes to ensure due and complete compliance with all laws, regulations, rules etc. whether of the Central or State Government or of any other competent authority applicable to the workmen employed or whose services are otherwise availed of by the contractor.

77) The Corporation shall have the right to inspect the records maintained by the contractor concerning such workman from time to time and the contractor shall whenever required by the Corporation, produce such records as the Corporation may call upon the contractor to produce for the Corporation’s inspection in order to ascertain whether or not the requirements of all such laws, regulations, rules etc. have been complied with by the contractor. In the event of any contravention of such laws, regulations, rules etc. coming to light, whether as a result of such inspection or otherwise, the Corporation shall have the right to enquire the contractor to effect such compliance within such time as the Corporation may prescribe in that behalf and in the event of the contractor failing to effect such compliance within the time prescribed by the Corporation, then the Corporation shall without prejudice to its rights be entitled to withhold from the amount payable to the contractor any amount payable to the workmen under any such laws, regulations or rules and to make payment thereof to the workmen. However, the Corporation shall not be held responsible for violation of any statutory norms by the contractor while carrying out the job of Hot Repair for the Corporation.

78) The Corporation shall also have in that event the right to terminate the contract with immediate effect and to exercise powers reserved to the Corporation under the contract as a result of termination.

79) The Corporation further reserves its right to allow to the Public enterprises “Price Preference” (facilities as admissible under the existing policy) as may be decided by the Corporation.

80) The successful tender shall coordinate with bottling plants / locations for upliftment of Hot Repairable cylinders lying with various LPG Plants / different locations and shall arrange to uplift these cylinders to avoid accumulation of inventory at locations and shall be fully responsible for quality/period of execution of work.

81) It will be tenderers responsibility to get the works approved and obtain all necessary certificates in connection with above job from municipal, government or any required authority and ensure that all works/certificates are approved / valid till the period of the contract.

82) Quotations should be submitted only in the prescribed tender schedule form supplied by the Corporation along with all documents together with drawings, General conditions of tender duly signed by the authorized signatory.

83) The tenderer should visit the plant site to acquaint themselves of the site conditions etc.

84) All materials required for the execution of work and before put to use should conform to the standard ISI specifications. Use of substandard material shall be entirely at the risk and cost of the tenderer. No delay on account of non-availability of materials, tools, equipments etc. will be entertained by the Corporation.

85) The responsibility for the safety, security and accounting of materials and equipments brought or installed by the successful tenderer or handed over to them by the Corporation for completion of work shall remain with them at their responsibility. Any damage caused to the material/equipment during the execution of work will be made good by the successful tenderer at their cost. Loss on above account incurred will be recovered from the tenderer in the manner as deemed fit/decided by the Corporation.

86) The successful tenderer and his man/men shall abide by all the security/safety rules, regulations in force at location and the laws, bye-laws and statutes of Govt., semi govt. and other local authorities such as requirements/liability under enactment like the Workmen’s Compensation Act, Contract Labour Act etc. and the Corporation shall stand indemnified against any claims on these scores. The successful tenderer and his men shall strictly abide by “no smoking” and other petroleum regulations on the premises. The tenderer / contractor shall be solely responsible for the consequences arising out of any such violation of statutory norms.

87) The successful tenderer shall arrange for at least one competent supervisor to be present at the bottling plant during loading/unloading or progress of work, who shall be duly authorized to take instructions and execute them on his behalf.

88) The successful tenderer should ensure the safety of adjoining property and shall make good any loss to product/property resulting from his negligence.

89) Arbitration:

A) Any dispute or difference of any nature whatsoever, any claim, cross claim, counter claim or set off of the Corporation against the contractor or regarding any right, liability, act, omission or account of any of the parties hereto arising out of or in relation to this agreement shall be referred to the Sole arbitration of Director (Marketing) of the Corporation or of some officer of the Corporation who may be nominated by the Director (Marketing). The Contractor will not be entitled to raise any objection to any such arbitrator on the ground that the arbitrator is an officer of the Corporation or that he has dealt with the matters to which contract relates or that in course of his duties as an officer of said Corporation he had expressed views on all or any other matters in dispute or difference.

In the event of the Arbitrator to whom the matter is originally referred being transferred or vacating his office or being unable to act for any reason, the Director (Marketing) as aforesaid at the time of such transfer, vacation of office or inability to act may in the discretion of Director (Marketing) designate another person to act as Arbitrator in accordance with the terms of the agreement to the end and intent that the original Arbitrator shall be entitled to continue the arbitration proceedings notwithstanding his transfer or vacation of office as an officer of the Corporation if the Director (Marketing) does not designate another person to act as Arbitrator on such transfer, vacation of office or inability of original Arbitrator.

Such persons shall be entitled to proceed with the reference from the point at which it was left by his predecessor, it is also a term of this contract that no person other than the Director (Marketing) nominated by such Director (Marketing) of the Corporation as aforesaid shall act as Arbitrator hereunder. The award of the arbitrator so appointed shall be final, conclusive and binding on all parties to the agreement subject to the provision of The Arbitration Act - 1940 or any statutory modification or re-enactment thereof and the rules made there-under for the time being in force shall apply to the arbitration proceedings under this clause.

B) The award shall be made in writing and published by the arbitrator within 2 years after entering upon the reference or within such extended time not exceeding further twelve months as the Sole Arbitrator shall by writing under his own hands appoint. The parties hereto shall be deemed to have irrevocably given their consent to the Arbitrator to make and publish the award within the period referred to herein above and shall not be entitled to raise any objection or protest thereto under any circumstances whatsoever.

C) The Arbitrator shall have power to order and direct either of the parties to abide by, observe and perform all such directions as the arbitrator may think fit having regard to the matters in difference i.e. dispute before him. The arbitrator shall have all summary powers and may take such evidence oral and/or documentary, as the arbitrator in his absolute discretion thinks fit and shall be entitled to exercise all powers under The Arbitration Act -1940 including admission of any affidavit as evidence concerning the matter in difference i.e. dispute before him.

D) The parties against whom the arbitration proceedings have been initiated, that is to say, the Respondents in the proceedings, shall be entitled to prefer a cross-claim, counter-claim or set off before the Arbitrator in respect of any matter and issue arising out of or in relation to the Agreement without seeking a formal reference of arbitration to the Director (Marketing) for such counter-claim, cross-claim or set off and the Arbitrator shall be entitled to consider and deal with the same as if the matters arising therefore has been referred to him originally and deemed to form part of the reference made by the Director (Marketing).

E) The Arbitrator shall be at liberty to appoint, if necessary any accountant or engineer or other technical person to assist him, and to act by the opinion so taken.

F) The Arbitrator shall have power to make one or more awards whether interim or otherwise in respect of the dispute and difference and in particular will be entitled to make separate awards in respect of claim or cross-claim of the parties.

G) The Arbitrator shall be entitled to direct any one of the parties to pay the other party in such manner and to such extent as the arbitrator may in his discretion determine and shall also be entitled to require one or both the parties to deposit funds in such proportion to meet the arbitrators expenses whenever called upon to do so.

H) The parties hereby agree that the courts in the city of Mumbai also shall have jurisdiction to entertain any application or other proceedings in respect of anything arising under this agreement and any award or awards made by the Sole Arbitrator hereunder shall be filed in concerned courts in the city of Mumbai only.

ANNEXURE - II

SCOPE OF WORK FOR HOT REPAIR OF LPG CYLINDERS

Hot Repairing/Reconditioning of LPG cylinders shall be carried out in accordance with IS: 13258:1991.

VISUAL INSPECTION AND SEGREGATION AT LPG PLANT

The repairer shall depute his technical representative along with necessary labour to BPC (Refinery) / URAN / Nasik / Jalgaon / Solapur / Nagpur / Wai / Goa / Pune LPG Territory for inspection and segregation of cylinders as per IS : 13258 - 1991 along with LPG Plant officials before dispatching them to repairers location for hot repair.

PRELIMINARY INSPECTION

a) The cylinders should be inspected for corrosion, dents, cuts and any other damages as per the norms contained in latest edition of IS:5845 (Code of Practice for Visual Inspection of Low Pressure Gas Cylinders) or any other relevant IS Code/Specification as published by BIS. The bung threads should be inspected with L-1 and L-9 gauges as per IS:9121 – 1979.

During inspection, the cylinders shall be segregated in the following categories:-

(i) Repairable.(ii) Non-repairable

b) Make separate list of both the categories giving the following details :-

(i) Manufacturer’s name.(ii) Serial number.(iii) Month/Year of manufacture.

c) In case of any of the above markings as stated in (b) above are found missing, cylinders should not be taken for repairs and should be segregated separately.

d) The entire repair of the cylinders to be carried out under BIS supervision. The above segregation should be based on decision of inspecting authority (i.e. BIS representative, arranged by the contractor).

TRANSPORTATION OF CYLINDERS

The repairer shall collect LPG cylinders from BPC (Refinery), Uran, Nasik, Jalgaon, Solapur, Nagpur, Wai (Satara), Goa and Pune LPG Plant and transport the same to his premises with proper documents and return the cylinders to respective plant after carrying out hot repairs (Addresses & contact persons are indicated in Annexure - XIII). In case the Corporation desires to send the Hot Repaired cyls of one location to other location, the Tenderer/Contractor should deliver the same. However, proper records shall be maintained to avoid penal recovery for short delivery of cylinders/valves.

PRELIMINARY INSPECTION AT REPAIRER’S PREMISES

Criteria as specified in Clause 6, 10 and Clause 11 of IS: 13258 (Code of Practice for Inspection and Re-conditioning of Used LPG Cylinders) shall be used for segregation of cylinders into repairable and unserviceable categories. The bung threads shall be inspected with L-1 and L-9 gauges as per IS: 9121 (Latest revision).

(a) Separate list of both the categories are to be made. List of cylinders unserviceable shall be made as per clause 11.1 Annexure “A” of IS: 13258 and that of cylinders accepted shall be as per Clause 19, Annexure “B” of IS: 13258.

(b) The entire repairs of the cylinders to be carried out under BIS supervision. The above segregation should be based on decision of inspecting authority (i.e. BIS representative, arranged by the contractor).

HOT REPAIR PROCEDURE

A) REMOVING CYLINDER VALVE

All the valves should be removed and kept aside. Proper account of the valves should be maintained thereof. Old defective valves should be returned to LPG Plant as shall be advised to you on door delivery basis for further action.

B) TARE WEIGHT & MINIMUM THICKNESS VERIFICATION

After accounting for weight of the detachable (i.e. valve), the cylinder segregated as repairable is to be thoroughly degassed & cleaned internally and externally and checked for correct determination of the tare weight.

Each cylinder shall be cleaned externally by wire brushing, water jet, abrasive cleaning, approved chemical cleaning or any other suitable approved method.

Where interior of the cylinder is affected by rust or other foreign materials, it shall be cleaned by one of the following methods:-

Approved blasting/rotary: Air jet to be applied inside the cylinder to force out the dust particles/other foreign materials from the cylinder. Magnet is also used to remove shots and any other magnetic material trapped inside the cylinder.

Burn out treatment: It is carried out in furnace at a temperature not exceeding 3000 C for a period not exceeding one hour after which all rust and any other foreign material shall be removed by steam cleaning or washing with approved solvent. Any cylinder having lost its tare weight by over 5% of its original tare weight shall be rejected and set aside. Only those cylinders which pass the tare weight test shall be processed further for repairs as necessary.

Affected portions of the body of the cylinders segregated during inspection under Section 1 of IS: 13258 shall be ground to achieve a defect free surface. Cylinder wall thickness so achieved shall not be less than 90% of the designed wall thickness.

The details of the cylinders rejected subsequent to tare weight & minimum thickness verifications shall be incorporated in the Performa for rejected cylinders.

C) DE-DENTING OF LPG CYLINDER:

De-denting of cylinders, if required, is to be done by cold process and in a manner that does not impair in any manner the quality of the cylinders as per provision of IS: 3196.

D) REMOVAL OF OLD DAMAGED FOOT RING & FIXING OF NEW FOOT RING:

The old foot ring, if damaged/defective, is to be removed by cold method only without damaging the body of the cylinder. The welded spots shall be ground and cleaned thoroughly for checking the surface for line corrosion, pits, etc. and wall thickness. No cut or chisel marks shall be permitted on the cylinder body. The new foot ring to be welded is as shown in our standard drawing (enclosed). The need for replacing the old foot ring shall be decided by the Inspecting Authority. You will be allowed to retain the old damaged foot ring.

E) REMOVAL OF OLD DAMAGED VP RING/STAY PLATE & FIXING OF NEW VP RING/STAY PLATE:

The old VP Ring and Stay Plate, if damaged/defective, is to be removed by cold method only without damaging the body of the cylinder. The welded spots shall be ground and cleaned thoroughly for checking the surface for line corrosion, pits, etc and wall thickness. No cut or chisel mark shall be permitted on the cylinder body. The new VP Ring and Stay Plate to be welded is as shown in our standard drawing. The need for replacing the old VP Ring shall be decided by the Inspecting Authority. You will be allowed to retain the old damaged VP Ring assembly.

F) HEAT TREATMENT

After hot repairs and de-denting, stress relieving or normalizing according to the process adopted at the time of manufacture shall be carried out. After the heat treatment the loose rust/foreign material inside the cylinder should be completely removed before further processing.

G) HYDROSTATIC TEST

1. Every cylinder shall be subjected to hydrostatic test as required by BIS code. The hydrostatic test of cylinders should be carried out at the pressure of 25.35 Kg/cm2 and shall be retained for a period not less than 30 seconds after drying the cylinder. Any reduction in pressure noticed during the test, any leakage, visible bulge or deformation shall be treated as case of failure and all such cylinders shall be rejected, segregated and sent to us along with details in the format as per Annexure – VI.

2. For cylinders passing this test the internal surface should be dried by blowing hot air after emptying out the cylinder.

3. The details of the cylinders rejected subsequent to Hydrostatic Test shall be incorporated in the Performa for rejected cylinders.

H) MARKING

As soon as the hydrostatic test is completed the cylinder shall be dried internally and following original markings to be reproduced (wherever foot ring/VP ring has been changed) as per details given in the standard drawing on the vertical stays of VP ring/foot ring as the case may be.

iv. New tare weight and maximum gross weight of the cylinder in “Kg”.v. The maximum working pressure and test pressure in “Kgf/cm2”.vi. Water capacity in “Litres”.vii.Any loss in original tare weight observed as per clause 10.4 of IS: 13258 shall be punched at

the foot ring. Example; if the loss in tare weight is 200gms, it shall be punched as LTW 200.)

viii. The letter “R” shall be conspicuously stamped on the vertical stay of the valve protecting ring as close to certification mark as practicable for identification that the cylinder is reconditioned. The letter ‘R’ shall be stamped on the foot-ring also.

In addition, any other markings as stipulated in the Code of Practice for Hot Repairing/Reconditioning of LPG Cylinders (IS : 12358) or any other revisions/modifications of the markings are to be punched/stamped. If there is any loss of original tare weight, the party should indicate the same on foot ring incorporating the word “LTW----- gms.”

I) SHOT BLASTING/ METALLIZING

Entire surface of cylinder, including valve protection collar should be shot blasted and given the following treatment in sequence indicated below:-

Spraying with zinc metal to give a zinc layer of minimum 40 microns thickness. Zinc wire used shall conform to IS: 12447 – 1988 (Specifications for Zinc Wire for Sprayed Zinc Coatings).

J) PAINTING

Entire surface of the cylinder shall be primer coated and painted as per the anti- corrosive specifications given below:-

(a) One coat of Red Oxide Zinc Chromate primer as per latest IS: 2704 shall be applied on cylinder surface and allowed to dry.

(b) One coat of super synthetic enamel paint as per IS: 2932 – 1974 shall be applied. Color shall be of Signal red (shade 537 of IS: 5 – 1961). Coat thickness of primer and paint together shall be minimum of 30 microns.

(c) After painting, all 14.2 Kg & 19.0 Kg cylinders shall be screen printed with “Bharatgas” logo in golden yellow (Shade no: 356 as per IS: 5 – 1994) as the enclosed drawing at two places opposite to each other, one in English and other one in Hindi.

K) STENCILLING

(a) Every cylinder to be stenciled for due date of re-test as per standard drawing.(b) Tare weight/Maximum gross weight of the cylinder to be stenciled on body of the cylinder

as per standard drawing.(c) Tare weight of the cylinder is also to be stenciled on inner side of balance two stay plates

as per the drawing.

L) FIXING OF VALVE

Clean the bung internal taper thread to remove any foreign material. This should be done by using an appropriate tap to ensure the threads are of full form, clean and free from other imperfections (any foreign materials is to be removed from inside). The cylinder valve is to be fitted by uniformly applying Teflon tape of IS: 3465 having a width of ¾ ” and a minimum thickness of 40 microns for a minimum of two and a half rounds. Valves shall be fitted with a tightened torque of 145 +/- 15 ft.-lb.

M) PNEUMATIC TEST

After fixing the valve, cylinder shall be subjected to internal pneumatic pressure of not less than 10 Kg/cm2 for a period of one minute while immersed in water and the cylinder shall be checked for leakage from the body of the cylinder & at the joint between valve and bung. This test shall be carried out after fixing the safety cap on the valve. The test results must be included in the inspection certificate. Suitable test bath facilitating the rotation of cylinder in immersed condition shall be available with proper illumination. After testing air shall be evacuated till pressure inside the cylinder drops to atmospheric pressure.

The cylinders rejected while carrying out “Hot Repairs” at the contractor’s works are to be returned to respective LPG Plant in that condition, accompanied by a forwarding note, giving serial number, name of manufacturer etc. and the cause of rejection.

DESHAPING OF REJECTED CYLINDERS

The rejected/damaged cylinders shall be NOT deshaped at the repairer’s premises unless specifically told to do so by the Corporation in writing but should be transported back to the LPG Plant as per the requirement of BPCL.

FIRST FILL LEAK AFTER RECONDITIONING

The repaired cylinders, if found unfit at the time of first filling after repairs, shall be rectified again at repairer’s cost. The time limit for reporting the defect to the repairer will be thirty days from day of receipt of repaired cylinders. Such defective cylinders shall be returned to the repairer on freight to pay basis. Similarly repairer shall also bear the freight charges for return of such cylinders after rectification. All other incidental costs shall also be borne by the repairer.

ANNEXURE - III

GENERAL INSTRUCTIONS ON HOT REPAIR OF CYLINDERS

1) Record name of cylinder manufacturer, serial number of cylinder and date of last test.

a. Cylinders for which either name of manufacturer or serial number is not available should be rejected.

b. Cylinders which have round holes in the bottom ring and with HPC / IOC embossing should also be rejected.

c. Cylinders which have oblong cuts in the bottom ring and BPC embossing should also be rejected.

d. All such rejected cylinders should be sent back to us along with details in the format – Annexure V.

2) Clean external surface of the cylinder thoroughly with caustic soda soap solution and rinse with water. Cylinders bung should be plugged to prevent entry of caustic soda, etc. into the cylinders.

3) Segregate on the following basis, the cylinders after visual inspection as per IS 5845-1984 or any other specifications published by BIS authorities during execution of contract.

a) for rejectionb) For hot repairs, andc) For continuing further testing

4) The cylinders must be condemned if

i) It has a dent on the weld.ii) Flattening of the weld (due to wear) shall not be treated as a dent on the weld. However, if

the cylinder body adjacent to a flattened weld shows a sign of dent, the same shall be treated as a dent on the weld and the cylinder shall be rejected.

iii) The mean diameter of any dent on the body is greater than 80 mm, andiv) The depth of any body dent exceeds 10% of the mean diameter of the dent.

The cylinder must also be condemned when the measured circumference of the cylinder anywhere exceeds the measured circumference adjacent to the centre weld of the cylinder by 1%.

5) Further, the cylinders must also be rejected if any of the following conditions are present:

a) Burns: Cylinder must be condemned if it shows isolated heat affected sections of the cylinder wall caused by electric arc or high temperature flame impingement (for example : oxygen acetylene flame).

b) Fire Damage: Cylinder must be condemned if it has suffered damage due to fire and has either warped or distorted or shows excessive heat damage marks.

c) General Corrosion: Cylinders must be condemned when the minimum wall thickness remaining under an area of general corrosion is less than 90% of minimum allowable wall thickness.

d) Dig: Cylinder must also be condemned if a “Dig” (a sharp impression where the surface material has not been penetrated) is present.

- Dig on the cylinder is 75 mm or more in length and depth is more than 5% of the length.

- The remaining minimum wall thickness of the cylinder wall within the area of the Dig is less than 90% of the minimum allowable wall thickness.

e) Cut: Cylinder must be condemned if a “Cut” (sharp impression where the surface material has been penetrated) is present and if the remaining wall thickness within the area of the cut is less than 90% of the minimum allowable wall thickness is less than 1.5 mm.

f) Pit: Pit is a localised corrosion spot. Cylinder must be condemned if the remaining wall thickness under the “Pit” is less than 90% of the minimum allowable wall thickness is less than 1.5 mm.

g) Leaks: Cylinders must be condemned if it has a leak on any part of the body other than the weld.

Cylinders segregated for hot repairs should be sent back to us under a covering note along with the list of cylinders as per Annexure – V.

6) The interior of the cylinder should be examined by a low voltage inspection lamp of flame-proof type. If internal inspection reveals presence of foreign materials such as rust, dust, oil, etc., it should be suitably cleaned.

7) Hydrostatic test should be carried out on all the cylinders qualifying for further test after (4) above. The cylinder should be subjected to hydrostatic pressure of 25.35 kg/cm2 and the pressure retained for a minimum of 30 seconds.

Any reduction in the pressure noticed during the test, any leak, visible bulge or deformation should be treated as a case of failure and all such cylinders should be rejected, segregated and sent to us along with details in format – Annexure V.

For cylinders passing this test the internal surface should be dried by blowing hot air after emptying out the cylinder.

8) The old valves after cleaning and reconditioning should be fixed on the cylinders. The procedure to be followed is:

a) The bung thread should be cleaned by using ¾” NGT hand tap.

b) The loose rust particles which have fallen inside the cylinder while cleaning/reforming of the bung thread should be removed by using a magnet.

c) Valves are to be fitted immediately after cleaning of bung thread to avoid rusting of the bung thread.

d) Fixing of valves on the cylinders should be in accordance with IS 8737 (Part I).

e) While tightening the valve a torque of 20 +/- 2 Kg m must be applied by using a torque wrench.

9) After fixing of the valve, cylinder should be subjected to air pressure of 10 Kg./cm2 and the pressure maintained for 30 seconds. Cylinder should then be immersed in water and checked for leaks. Soap solution should be applied at valve bung joint to check for leaks. After this test, the cylinder should be depressurised and the external surface dried by blowing of air. Pressure gauges used for pneumatic and hydrostatic test should be calibrated once in 3 weeks and records maintained. The master gauges used for calibrating these pressure gauges should be calibrated once in 6 months.

10) Check tare weight of each cylinder. If observed tare weight is less than 95% of the original tare weight, the cylinder shall be rejected as unfit and kept segregated.

a) The weighing scale used shall have a least count of not more than 50 gms and the value of tare weight may be rounded to the nearest 100 gms as per IS :2 – 1960.

b) The tare weighing shall be carried out including the weight of valve and safety cap.c) The change in the tare weight within the permissible limit may be stencilled without

altering the original tare weight punching .

11) After satisfactory completion of periodic inspection and testing each cylinder found acceptable shall be marked with following on the vertical stays on cylinder:

a) The identification mark of the testing unit as registered with Chief Controller of Explosives, Nagpur.

b) The new test date retaining the previous test dates.

Above is to be punched on the stay as shown in the diagram below.

12) The paintings etc. have to be carried out as per specifications indicated in each of the drawing attached for each type of cylinder to be pressure tested. After painting, the following markings should be made on the cylinder:

a) New tare weight of the cylinder should be marked on top of the cylinder at 3 locations 120 degrees apart with black paint. Height of the letter should be 25 mm Thickness should be 6-7 mm

This new tare weight should also be painted on the inner side of two stay plates.13) To indicate the next quarter and year of the testing the inside of one of the stay plates should

be painted as described in the details of colour coding. If the cylinder has been tested in “A 07”, the marking on inside of the stay plate will be “A 12”.

14) For distinguishing the quarter and year, A, B, C and D should be used in capital letters followed by the last two digits of the testing year e. g for January – March 2007 – the punching will be “A 07”. If the cylinder has been tested in “D – 2007”, the marking on the inside of the stay plate will be “D – 07”.

15) All 5 kg, 14.2 Kg & 19 Kg, 35 kg and 47.5 kg cylinders passing the above test should be painted with zinc chromate primer and super synthetic enamel paint (the thickness of both primer & paint together shall be minimum of 30 microns) of the colour indicated and as per specifications given in the cylinder-wise drawing. The valve should be suitably covered to prevent ingress of paint in the valve. The top of the cylinder should be painted with yellow IS : 355 – from the bung end to the stay plates. On the shoulder of the cylinder the following should be painted bilingually with white as per IS: 127.

a) “ “CHECK SEAL ON DELIVERY”

For the above two instructions, the size of each letter and the colour coding should be as per the attached drawing in white colour shade – 127 as per IS : 5

This should be screen printed at 3 equispaced places in Black shade with 2.5 cm height as applicable.

In case of 19 kg cylinders, the cylinders should be painted as per specifications, colour coding mentioned in the attached drawing of each cylinder respectively.

16) After painting of cylinders the 'Bharat Gas Logo' as mentioned in the attached drawing has to be marked at two places opposite to each other in golden yellow colour (colour No. 356 as per IS 5 : 1994) in accordance with the enclosed drawings. One of the marking shall be in 'Hindi' and one will be in 'English'.

17) All details of the cylinders received & repaired should be submitted to us in the enclosed format – Annexure VII along with the retested / repainted cylinders. A test certificate in the format – Annexure – IV along with the cylinders returned to us after pressure testing/painting. This certificate should be signed by a Mechanical Engineer. For cylinders rejected at stages, a separate list as per format Annexure - V should be furnished detailing reasons for rejection. This list should also be signed by the person signing the Test Certificate.

ANNEXURE XII

SPECIFICATION OF TRUCKS.

The Trucks to be engaged for transportation of Cylinders should strictly confirm to the regulations stipulated in Petroleum Act, 1934 or any amendment or re-enactment thereof, from time to time & the Rules and Orders framed there under.

The Trucks engaged for transportation of LPG cylinders should also conform to the following requirements: -

1. There shall be no sharp projection inside the vehicle, on the platform and sides of the Lorry.

2. The exhaust from the engines should be re-routed under the Driver’s cabin & the exhaust pipe should be fitted with a Spark arrestor.

3. The Cab of the Vehicle shall be preferably of all metal construction and its rear window, if provided shall be fully covered with wired glass. The Cab and the engine shall be separated from the load by a fire-resisting shield, which shall fully cover the load.

4. The Truck should be fitted with a double pole wiring system with the Master switch in the Driver’s cabin.

5. The fuel Tank of every vehicle, if installed behind the cab of the vehicle/ fire screen shall be so designed, constructed, installed so as to present no unusual hazard, and shall be so arranged to permit drainage without removal from their mounting and the same should be protected, against blows by stout steel guards.

6. The truck should be fitted with the fixed body of adequate height so that the cylinders are not stacked beyond the side supports of the body.

7. The trucks must carry, a suitably ISI mark DCP fire extinguisher.

8. The voltage of the electric circuit should not exceed 24 volts.

9. The electrical wiring shall be heavily insulated and be adequate for maximum loads to be carried, also they shall be provided with suitable over-current protection in form of fuses or automatic circuit breakers and also with a master switch to cut off the current supply in an emergency.

certificate. All the invoices raised should be TAX INVOICE and should be in the manner set out

under section 86 of the ACT, so as to ensure that Input tax credit could be availed by BPCL on purchase from you.

Please mention clearly the method adopted to derive at the material component of the works contract for applying the VAT rate i.e a) composite scheme b) standard deduction method or c) actual non material value method.

The evaluation of the tender will be done based on the net cash flow method after availing the VAT credit.

NOTE: 1) Rates should be quoted both in words and figures. Wherever ambiguity is observed, rates in

2) The rates for items 3 & 4 should only include the cost of removal of Foot-ring/VP ring with stay plate and fixing/welding new foot-ring/VP ring with stay plate and cost of all materials & labour charges, & should not include other costs viz. Inspection, cleaning, painting, stenciling, punching the markings, transportation, testing etc. as they are covered under item no.1) & 2). You will be allowed to retain the old foot-ring/VP ring with stay plate & rate for these items should be based on that.

3) Repairer will be allowed to procure the foot-ring from existing approved cylinder manufacturing

units.

4) The rates should be firm which should be inclusive of cost of all the materials, steel, paint, labour, Foot Ring, V.P.Ring, electricity, fuel, water, power equipments, tools/tackles, excise, customs, Sales Tax, work contract tax etc. all taxes levied by Local Bodies, Municipality, State/Central Govt., duties, octroi, octroi surcharge, road tax, service tax, loading, unloading at both ends etc. & including everything applicable & also including BIS Inspection/Certification charges etc but excluding VAT which shall remain firm throughout the period of the contract. All materials are to be supplied by the tenderer unless otherwise advised. 6) In case of one way movement of cylinders between BPCL locations to your works, only 50 % to & fro transportation rates mentioned under item no. 6 above will be applicable

7) Job to be carried as per General Conditions, Special Terms & Conditions, Scope of Work, as per the Schedule of Rates as detailed in this tender.

8) Rates include screen printing of “BHARAT GAS “AS STENCILED IN NEW CYLINDERS in Hindi and English both as given in attached drawing.

9) Rates for all the above items should be quoted.

10) In case the tenderer is not willing to do the job of Hot Repair ex a particular bottling plant, then the tender should cancel the transportation rate ex that bottling plant in which he is not interested to do the job and should sign against the cancellation.

11) During the process at any time without assigning any reason ,at the discretion of the company tender for any of the plants may be withdrawn.
