Deputy Richard Hammock #349

October 14, 1982 - April 2, 2016

On April 2, 2016 a HERO was taken from his family, friends and this community in a tragic motorcycle acci-dent. Deputy Ham-mock is survived by his wife Melissa Hammock, daughter Jessica (13) and two sons Ethan (8) and Travis (3).

Deputy Richard Hammock most re-cently saved many lives by grabbing the barrel of a rifle as a suspect was shooting at him and other officers. Due to his swift actions, Deputy Hammock was awarded the Medal of Valor and Officer of the Year at the 2015 CLEAT Convention.

To some of us he was still Sergeant Hammock, to others he was a father, a son, a husband, a friend, a fellow brother in blue.

Deputy Hammock has been a member of the Political Action Committee for over three years . He stepped it up when oth-ers couldn't. In his 12 years at the Bexar County Sheriff’s Office, he made many friends while assigned to Detention and Patrol.

Melissa, Jessica, Ethan and Travis, DSABC can ensure you that Deputy Ham-mock will not be forgotten.

Texas Peace Officers’ Memorial-

In 1987, the leadership of the Combined Law Enforcement Associ-ations of Texas sought to have the memorial built. The Peace Officers Memorial Foundation, a 501(c)(3) charitable organization, was founded to help raise money for that purpose. In June 1998, after convincing the legislature to authorize the Me-morial and after 10 years of arduous fund raising, construction began.

Finally on May 10, 1999, law enforcement officers and the families of officers traveled to Austin for the Memorial dedication. The Memorial is located on the northeast grounds of the Texas Capi-tol, easily accessible from where Congress Avenue and 15th Street intersect. Every year, CLEAT organizes and leads a solemn observance at the Monument to pay tribute to those who made the ultimate sacrifice on behalf of their fellow Texans during the preceding 12 months.

1- A person is eligible to have the person’s name on the memori-al if the person was killed in the line of duty and was: 2- A law enforcement officer or peace officer for this state or a political subdivision of this state under Article 2.12, Code of Criminal Procedure, or other law;

3- A federal law enforcement officer or special agent performing duties in this state, including those officers under Article 2.122, Code of Criminal Procedure; or 4- A corrections or detention officer or county or municipal jailer employed or appointed by a municipal, county, or state penal institution in this state.

Here are the eligibility requirements for a Texas peace officer’s name to be added to the monument:

with useful information for its members. Attend the DSABC monthly meetings. Until further notice, all monthly meetings are held on the last Wednesday of each

Know Your Rights…..

Making a Statement The application of Garrity warnings pro-vides that an employee can be ordered to cooperate in an internal or administrative investigation and be compelled to truthfully answer questions that are specifically, di-rectly, and narrowly related to the employ-ee’s official conduct. Any statements made pursuant to an order to cooperate in such an investigation—and any evidence derived from that statement—may not be used against the employee in a criminal proceed-ing. For Garrity to apply, the statement must be compelled and not voluntary.

Administrative Investigative Statement— If generating a Facility Incident Report because you were asked by your supervisor to explain a situation or event, provide Garrity protection by starting report:

I was ordered to submit this report by…….. I was ordered to give this statement

by…….. I am submitting statement involuntarily

and only because I was ordered by….. I understand that this report will be used

solely for administrative purposes….. If ordered to generate a report you are required to otherwise by not cooperating you have violated policy. You must answer questions, give statements, and submit re ports at the order of an investigating officer, or become subject to disciplinary action for refusal to obey. That said, you cannot be held against your

will. Criminal Investigative Statement- DO NOT MAKE A STATEMENT WITH OUT AN ATTORNEY PRESENT. Voluntary statement that cannot be co erced, no termination threats, admissible in criminal and administrative case.

GET AN ATTORNEY. Criminal Investigation Procedure Must be advised that the investigation is criminal, the nature of the allegations, that you can refuse to answer questions and not be punished, and that the statements can be used against you in any criminal pro- ceeding. On Scene Statement- Immediately notify Attorney before making

any written statement.

Common Mistakes-

Officer’s often feel they have nothing to hide and make verbal or written statements without an attorney. Always request your attorney before making any type of state-ment. Your career depends on it.

While the employees of this office get humiliated and berated by the media and social media sites, we would like to clear the air for Deputy Ronald Bailey. On February 10, a Jury deliberated for less than an hour after reviewing all the facts.

Deputy Bailey was found not guilty of aggravated assault with a deadly weapon. He like many officers before him have returned to duty after being terminated. As written in the DSABC Constitution, Deputy Bailey will return as a DSABC BOD.

After it was known that Deten-tion Deputy, Corporal Walter Harlee got his leg amputated due to a un-foreseen medical condition, Deputies quickly jumped into action. Deputy J. Casarez set up a go fund me ac-

count to assist Cpl Harlee with his medical and livable finances. To date, over $6,000.00 have been raised through the gofundme account set up in his name. Many other Depu-ties also took action and raised mon-ey through a raffle and bake sale.

DSABC recently spoke with Cpl Harlee who stated that he is thankful for what everyone has done to assist him. He had three surgeries that have accumulated a large debt. He advised that if unusual pain is felt on anyone, to immediately seek medical attention, preferably a specialist.

To vote in Texas, you must be registered. Simply pick up a voter registration application, fill it out, and mail it at least 30 days before the election date. Remember all votes do count, otherwise how else would someone be elected and in office.

Dates To Remember:

April 25th- Last day to register for runoff election.

May 16-20th- Early Voting for Runoff Election

May 24th- Primary Runoff

Nov. 8th- 2016 General Election

The following officers are voter registrars: Jeremy Payne, Billy Blanco, Pete Gamboa, and Anthony Daggett. One of them will serve their duty as a Bex-ar County citizen and get your registered so that you can exercise your right to vote.

If a person did not vote during the primaries they are still eligible to vote during the primary run off.

If a person voted under one party for the primaries they cannot vote under another party during run off election.

During the general election a voter can choose to vote any straight party or pick and choose individual candidates from either of the parties.

We expect to agree on Article 11, Roll Call for Detention & Article 21, Promotions during our next meeting scheduled for April 14th. We are currently working on the following Articles: Article 9, Wages and Benefits: Their cur-rent counter proposal is 13.25% for Deten-tion and 10.75% for Law Enforce-ment. Both percentages are across the board for the remainder of this year and the next three years. Their theory is that a higher pay rate for Detention is going to fix the low attrition rate. Those percentage increases are with the understanding that

we will accept their other proposals. Addi-tionally the county has stated that we have one of the best insurance rates, therefore using those savings in the overall budg-et. We have proposed a Sick Leave buy back that they have denied. The practice for Holiday time has been that it gets accu-mulated year after year. The Sheriff's Office has proposed to enforce the current Civil Service rule that all holiday compen-satory time must be taken within one (1) year from the date of issue or else it will be voided. They stated that a uniformed em-ployee will not lose any holiday time that

they currently have. Article 14, Operational Issues: Currently negotiating county practices on FMLA provisions to return to duty, fitness for duty. Article 19, Discipline: With the advice and assistance of our local CLEAT attorneys, we are currently negotiating the procedures of discipline. Article 25, Transfers: They have denied proposal that members in Detention want-ing to transfer must pass Coopers test with a 60% as part of the selection process.

Collective Bargaining Negotiations:

Clearing the Air: There are a select few who feel that the Board of Directors and the Executive Board are taking actions that are for their self interest. Both boards were elected by the membership to represent them and make decisions when they cannot be pre-sent or choose not to deal with them. We can assure you that the decisions made for the association or during negotiations are made for the best interest of the majority

and those who make the effort to be heard by making phone calls, attending general assembly meetings and the collective bar-gaining negotiations. When the contract negotiating is completed, the membership will have a vote and decide when it is final-ized.

Organizations and outside interest are continuously making attempts to disrupt unions and DSABC. Do not let the influ-

ence of a selected few who start rumors and generate petty flyers change your point of view.

Now is the time to be united as the Deputies of the Deputy Sheriff’s Associa-tion of Bexar County no matter if your assigned to Detention or Law Enforce-ment. We are all represented the same in the eyes of DSABC and the public. If you hear a rumor, Seek the Truth.
