We have heard the learned counsel appearing for the applicant in all

these applications and the learned counsel appearing for the respondents

including the Additional Advocate General of Telengana, at length. These

applications stood transferred from High Court of Andhra Pradesh which

were originally filed as Writ Petitions under Article 32 of the Constitution of

India before the Hon’ble Apex Court for the following reliefs:

a) To direct the respondents 1 & 2 to provide wholesome clean

drinking water to the people living in the villages being affected by

Chemical, Industrial Pollution in Patancheru – Bollaram aras in

District Medak (A.P.)

b) To direct the respondents 1 & 2 to immediately send teams of

medical Doctors from different specialities and veterinarians to the

pollution affected areas for providing free treatment to the suffering

people and their live stock;

c) To direct the respondents to take immediate measures to avert

pollution from further spreading in surface and ground water

sources and periodically collect water samples and inform people

about the quality of water through media or other means of

providing information;

d) To direct the respondents 1 & 2 to immediately close down the

hazardous industries creating Air and Water pollution and thereby

flouting pollution control measures and environmental laws.

e) To direct the respondents 1 & 2 to immediately pay adequate

compensation to all the victims of pollution and to those who lost

their livestock, crops, vegetation, trees, agricultural land, wells and

are facing severe hardship due to irresponsible and negligent act of

polluting industries/polluters. The amount to be paid in

compensation to the affected people be recovered by the

respondent Nos.1 & 2 from the polluting industries/polluters or as

this Hon’ble Court may deem fit and proper in the circumstances of

the case;

f) To direct the respondents 1 & 2 to take serious action against the

polluting industries flouting environmental laws and showing utter

disregard to the safety and welfare of the people, flora and fauna;

g) To direct the respondent no.3 to immediately control pollution

failing which it may be closed down;

h) To constitute a team of eminent environmental experts and

economists for on the spot survey and study of the water and air

pollution and losses incurred on account of pollution and submit a

report to this Hon’ble Court.

i) Any other directions as this Hon’ble Court may deem fit and proper.

It is brought to our notice that in the meantime, Dr.A.Kishan Rao has

moved to the Principal Bench of the National Green Tribunal by filing

application No.100 of 2014 with the following prayer:

a) Prohibit lifting of moratorium issued by MOEF & CC vide O.M.

dated 17.09.2013

b) Direct the respondents to close down the industries which are

violating pollution control norms

c) Prohibit the industries and CETPs from discharging the treated

effluents into water bodies.

d) To provide drinking water free of cost to the affected people in the

affected area.

e) Direct the respondents to pay adequate compensation to the

applicants and affected people for loss of their crops from 2002 to

till date.

The issues that are to be decided in these cases, even though most

of them are covered in the prayer of Dr.A.Kishan Rao before the Principal

Bench of the National Green Tribunal, it is the contention of

Mr.M.C.Mehta, learned Senior Counsel appearing for the applicant in

Application No.90 of 2013 and Mrs.D.Nagasaila, learned counsel

appearing for the applicant in other applications that there are yet lot of

other issues which are to be decided and actually not covered in the

prayer before the Principal Bench of The National Green Tribunal.

Mr.Mehta would submit that in fact the Principal Bench has also appointed

a Joint Inspection Team consisting of

and the report has also been filed before the Principal Bench and the

Principal Bench has posted the matter on 28.04.2016 and a request will be

made before the Principal Bench about the pendency of these cases

before this Tribunal and inform the result of the same on the next date of

hearing.

Accordingly, post these applications on 24.05.2016.

As per the earlier direction of this Tribunal, the Central Pollution

Control Board has also filed the Inspection report, the copies of which

have been given to the learned counsel appearing for the other side who

shall be entitled to file reply in respect of the said report.
