1.0 That, Hon'ble Commission have made CERC (Terms and Conditions of Tariff) Regulations, 2014 and issued vide notification dated 21.02.2014. These regulations shall remain in force for a period of 5 years w.e.f. 01.04.2014, unless reviewed earlier or extended by the Hon'ble Commission.

2.0 The Petitioner herein, Power Grid Corporation of lndia Ltd. Is a Government Company within the meaning of Companies Act, 1956. In exercise of powers under sub-section (1) of section 38(1) the Electricity Act 2003, the Government of lndia has declared the Petitioner herein as the Central Transmission Utility (CTU). The petitioner being CTU is deemed to be a transmission licensee under section 14 of the Electricity Act' 2003.

3.0 That the instant petition covers approval of SIC Solapur-Pune TL and LlLO of 400kV

associated bays and equipments, 2x1500 MVA, 7651400kV ICT 1 &2 at Pune (GIS) and 240 MVAR, 765kV Bus Reactor and 765kV, 240 MVAr Switchable Line Reactor at Pune (GIS) SIS with associated bays Asset-ll: LlLO of 400kV DIC Aurangabad-Pune TL at Pune GIS SS with associated bays and 4.00kV, 50 MVAr Line Reactor under "Krishnapatnam UMPP- Part" in Western Region which are anticipated to be put under commercial operation w.e.f. 01 .01.2015 & 01.04.201 5 respectively.

4.0 Approval of the Scheme

4.1-That the petitioner has been entrusted with the implementation of "Transmission System associated with Krishnapatnam LIMPP-Part-B". The i~vestment approval of the nroiect P J iA!ar accorded by Board of Directors ~f POWERGRID vide the Memorandum Ref.: CICPIKUNIPP-B dated 09.02.2012, at an estimated cost of Rs. 1927.16 Crores including IDC of Rs 88.13 Crores, price level -4th Qtr, 201 1, a copy whereof is attached hereto as Encl.-l, page.(.%to&\.k that the scope of the scheme was discussed and agreed in the 24th and 3Yd SCM of Southern Region Constituents. (i) Raichur-Sholapur 765 kV SIC line.

(ii) Sholapur-Pune 765 kV SIC line

(iii) LlLO of Parli-Pune 400 kV DIC and Pune-Aurangabad 400 kV DIC line at Pune (GIS) SIS (including MIC)

(iv) I-ILO of existing Raichur-Gooty 400 kV Quad DIC line at Raichur (New) SIS.

Sub Station

(i) Establishment of new 7651400 kV SIS at Raichur with 2x1500 MVA ICTs.

(ii) Establishment of new 7651400 kV SIS at Sholapl~r with 2x1500 MVA I CTs .

(iii) Establishment of new 7651400 kV substation at Pune (GIS) with 2x1 500 MVA ICTs.

Line Reactors (i) 1x240 MVAR switchable line reactors at each end of Raichur -

Sholapur 765 kV SIC and Sholapur-Pune 765 kV SIC lines.

5.0 Implementation Schedule As per the approval, the transmission scheme was scheduled to be commissioned in 32 months from the date of investment approval. The date of lnvestment Approval is 09.02.2012. Hence the

to 09.10.2014 against which the subject asset is anticipated to be commissioned and put under commercial operation w.e.f. 01.01.2015. Hence there is marginal delay of 03 and 06 months respectively in commissioning of the subject assets. Balance Assets under the project has been commissioned within schedule

Reasons for delay

GIS PUNE SLIBSTATION

a) Delay land - There is delay in land acquisition of Pune (GIS) S/S due to ROW problems encountered at site.

TIL : Construction of the following transmission lines . . delayed:

There are severe ROW problems in the construction of 765kV SIC Solapur- Pune line and LlLO of 400kV D/C Pune- Parli and LlLO of 400kV Aurangabad - Pune at Pune (GIS) S/s which were beyond the control of the petitioner, therefore Hon'ble Commission may kindly condone the delay in commissioning of these lines and allow full cost and tariff as being claimed under the instant application.

6.0 Completion Cost:

6.1 That the application for determination of tariff is filed in line with provision 7 (2) of Tariff Regulation' 2014 applicable for 2014- 19 period. Further, that the present petition covers approval of tariff based on estimated expenditure to be incurred up to anticipated DOCO and additional capitalization projected to be incurred from anticipated DOCO to 31.03.2017 in respect of the subject asset as per detail given below. That the capital cost incurred upto anticipated DOCO and projected to be incurred during 2014-15 and 2015-16 and 2016-2017 is duly certified by auditors in auditor certificate; copy whereof in respect of the assets covered in this petition is enclosed herewith as Encl.- 6 (page% tto73).

Against the total apportioned approved cost of Rs 114491.95 lakhs, the estimated completion cost is Rs 106098.61 lakhs, hence, there is no cost overrun in comparison to FR cost.

The reasons for item wise cost variation between approved cost (FR) and actual cost are explained in detail in Form- 5. Therefore, the Hon'ble Commission may kindly approve the capital cost of the elements covered under instant petition & allow tariff as claimed.

Initial spares: The Initial spares for the sub-station and Transmission Line are within the specified limit under Regulation 13, Chapter: 4, of the CERC Regulations, 2014. Therefore, Hon'ble Commission may kindly allow 'the spares as zlaiiiied iii the Petitioii.

6.2 The details of underlying assumptions for additional capitalization for these assets is summarized below:

The admissibility of additional capital expenditure (Add. Cap.) incurred after DOCO and up to cut off date is to be dealt in accordance with the provisions of Regulation: 14, the extract of Regulation: 14 of the Regulations, 2014 is reproduced as follows:

"Additional Capitalization"

(1) The capital expenditure incurred or projected to be incurred, on the following counts within the original scope of work, after the date of commercial operation and upto the cut-off date may be admitted by the Cornrr~issio~i, subject to prudence check:

(i) Undischargedliabilitiesrecognizedtobepayableatafuturedate; (ii) Works deferred for execution; (iii) Procurement of initial capital spares within the original scope of work,

in accordance with the provisions of Regulation: 13; (iv) Liabilities to meet award of arbitration or for compliance of the order

or decree of a court of law; and

(v) Change in law or compliance of any existing law: Provided that the details of works asset wise/ work wise included in the original scope of work along with estimates of expenditure, liabilities recognized to be payable at a future date and the works deferred for execution shall be submitted along with the application for determination of tariff.

6.3 The Additional Capitalization projected to be incurred in the contextual asset is mainly on account of Balance1 Retention payments and hence the same may be allowed by Hon'ble Commission. The details of capitalization for Asset-l:765kV SIC Solapur-Pune TL

7.0 Additional ROE @a 0.5%: Asset-l as per Investment Approval dated 09.02.2012 and CERC time line of 36 months the asset is anticipated to be commissioiied on 0!.0:.20:5 ivhich is within CERC time line specified for claiming additional ROE of 0.5 %, the provision of 24 (i) of CERC (Terms and Conditions of Tariff) Regulations, 2014 may be invoked. Hon'ble Commission may kindly allow the additional ROE as claimed in the Petition.

8.0 TRANSMISSION TARIFF for 2014 - 19 BLOCK: 8.1 The tariff for block 2014 - 2019 has been worked out as per CERC (Terms and

Conditions of Tariff) Regulations, 2014. In the present petition the transmission tariff has been calculated taking estimated Expenditure up to anticipated DOCO and estimated additional expenditure from anticipated DOCO to 31.03.2017. Calculations for working out the tariff supporting documentation are attached hereto as Encl.-7 (Page 7q.. to

8.3 That, it is submitted that the petitioner being liable to pay income tax at MAT rate, the ROE has been calculated @ 20.243 % after grossing up the ROE with MAT rate of 20.961% based on the rate prescribed by the Hon'ble Commission as per illustration under Regulation: 25 (2) (i) of the Central Electricity Regulatory Commission (Terms and Conditions of Tariff) Regulations, 2014. Any under-recovery or over-recovery of grossed up rate on ROE after truing up shall be recovered or refunded to beneficiaries on year to year basis. It is further submitted that adjustment due to any additional tax demand including interest duly adjusted for any refund of tax including interest received from IT authorities shall be recoverable1 adjustable during1 after completion of income tax assessment of the financial year.

8.4 That as provided in clause: 49 of the Tariff Regulations 2014, the deferred tax liability before 01.04.2009 shall be recovered from the beneficiaries or the long term customers/ DlCs as and when the same gets materialized.

8.6 In the tariff calculation for 2014-1 9 period lnterest on Loan has been calculated on the basis of rate prevailing as on 01.04.2014. The change in lnterest rate due to floating rate of interest applicable, if any, during 201-4-19 period-for-the project needs to be claimed / adjusted over the tariff block of 05 years directly from the beneficiaries.

8.7 The transmission charges at para-8.2 above is inclusive of O&M expenses for the project derived based on the norms for O&M expenditure for Tra~isrrlission System as specified under regulation 29 (3) (a) of the tariff regulations for block 2014-19. It is the understanding of the petitioner that these norms for O&M expenditure been arrived by the Hon'ble Corrlmission after considering (i) normalized actual O&M expenses of the petitioner on its various projects in various regions during the year 2008-09, 2009-10, 2010-1 1, 201 1-12 and 2012- 13. It is submitted that the wage revision of the employees of the petitioner company is due during 2014-19 and actual impact of wage hike which will be effective from a future date has also not been factored in fixation of the normative O&M rates prescribed for the tariff block 2014-19. The scheme of wage revision applicable to CPSUs being binding on the petitioner, the petitioner reserves the right to approach the Hon'ble Commission for suitable revision in the norms for O&M expenditure for claiming the impact of wage hike, if any,during 2014-1 9.

8.8 The application filing fee, expenses incurred on publication of Notices in News papers and License fee may be allowed to be respondents in terms of Regulation 52

Commission (Terms and Conditions of Tariff) Regulations, 2014. The fees and charges to be paid by the petitioner as ISTS licensee (deemed ISTS licensee) under CERC (Fees and Charges of RLDC and other matters) Regulations as amended from time to time shall also be recoverable from the DICs as provided under clause 52(2) (a).

8.9 The Transmission Charges and other related Charges indicated at para 8.2 above, is exclusive of incentive, late payment surcharge, FERV, any statutory taxes, levies, duties, cess, filing fees, license fee, RLDC fees and charges or any other kind of imposition (S) and/ or other surcharges etc. whatsoever imposed 1 charged by any Government (CentralIState) and / or any other local bodies/authorities/regulatory authorities in relation to transmission of electricity, environmentai protection, an&'"r iii "f of its iiistaiiatiori associated

with the Transmission System and the same shall be borne and additionally paid by the respondent(s) to the petitioner and the same shall be charged, billed separately by the petitioner on the respondents.

9.0 Sharing of Transmission Charges The Tariff for Transmission of Electricity (Annual Fixed Cost) as per para 8.2 of petition shall be shared as per Regulation-43 of CERC (Terms and Conditions of Tariff) Regulations, 2014. These charges shall be recovered on monthly basis and the billing collection and disbursement of Transmission Charges shall be governed by provision of CERC (sharing of interstate Transmission Charges and Losses) Regulations, 201 0.

In the circumstances mentioned above it will be just and proper that the transmission tariff for the assets covered under this petition be allowed to be charged from the Respondents on the basis set out above. The Petitioner submits that Encl.-l to Encl.-7 may please be treated as integral part of this petition.

PRAYER

It is respectfully prayed that the Hon'ble Comrrrission may be pleased to

1) Approve the Transmission Tariff for the tariff block 2014-19 block for the assets covered under this petition, as per para -8 above.

2) Admit the capital cost as claimed in the Petition and approve the Additional Capitalisation projected to be incurred.

3) Tariff may be allowed on the estimated completion cost.

4) Approve the Additional ROE as claimed in the Petition.

5) Allow the Petitioner to approach Hon'ble Commission for 15

norms for O&M expenditure for claiming the impact of wage hike, if any, during period 201 4-1 9.

6) Allow the petitioner to recover the shortfall or refund the excess Annual Fixed Charges, on account of Return on Equity due to change in applicable Minimum AlternateICorporate Income Tax rate as per the Income Tax Act, 1961 (as amended from time to time) of the respective financial year directly without making any application before the Commission as provided under clause 25 of the Tariff regulations 2014.

7j Approve the reimbursement of expenaiiure by the beneficiaries towarcis petition filing fee, and expenditure on publishing of notices in newspapers in terms of Regulation 52 Central Electricity Regulatory Commission (Terms and Conditions of Tariff) Regulations, 2014, and other expenditure ( if any) in relation to the filing of petition.

8) Allow the petitioner to bill and recover Licensee fee and RLDC fees and charges, separately from the respondents in terms of Regulation 52 Central Electricity Regulatory Commission (Terms and Conditions of Tariff) Regulations, 2014.

9) Allow the petitioner to bill and adjust impact on lnterest on Loan due to change in lnterest rate on account of floating rate of interest applicable during 2014-19 period, if any, from the respondents.

10) Allow the petitioner to recover FERV on the foreign loans deployed as provided under clause 50 of the Tariff Regulations, 2014.

11) Allow the Petitioner to bill and recover Service tax on Transmission Charges separately from the respondents, if at any time service tax on transmission is withdrawn from negative list at any time in future. Further, any taxes and duties including cess etc. imposed by any statutory1Govt~municipal authorities shall be allowed to be recovered from the beneficiaries.

requirement corrzsponding to a given time frame and likely load-generation scenario in that time frame. This planned system is then programmed for implementation under various schemes. A major part of the KUMPP transmission system was also planned for looking into requirement of the Southern grid though programmed to be implemented as part of KUMPP ATS. Now, if there .is delayluncertalnty of the ~-UlvfFTgmem&n -7 should identify the transmission system that would otherwise also be required for development of the Southem grid. -

DGM, PGCIL stated that due to likely delay of generation project, it has become necessary to review the ATS of KUMPP looking into the overall grid development, as the Part-B primarily consists of elements which establish synchronous interconnections between SR & WR through 765kV Raichur - Sholapur SIC lines. Here it may be pertinent to mention that the other 765kV Raichur - Sholapur S/c line has already been awarded through tariff based competitive bidding. The synchronous interconnection between SR & WR is of urgent nature as the existing interregional capacity is inadequate to cater to the interregional transfer requirement, as were observed during this summer when there was a large variation in the prices of electricity in SR & NEW Grid. Further, synchronization of SR with NEW grid shall be a major milestone in Indian Power system development thereby establishing nationwide synchronous grid. The synchronization of SR with WR grids have been planned through Raichur - Sholapur 765 kV 2xSlc lines. Upon receipt of the approval of the Commissioner, Pune, in respect of the Rate of the land, POWERGRID is required to co-ordinate with the Dy.Collector (Tenancy) for calculating the Nazarana as per the Rules:

On receipt of the Application from the office of the Collector, Pune, the Dy. Collector (Tenancy) office scrutinized the file completely and accordingly Nazraana amount has been calculated. A note for approval of the Commissioner was sent t o the office of the Commissioner for approval. On scrutiny of the case, the office of the Dy. Commissioner observed that individual applications of the land occupants together with affidavits and other relevant documents in respect of their lands, need to be submitted for approval.

However, the Talati intimated that it is the responsibility of POWERGRID to obtain 1 the documents sought by the Addl. Collector t o finalize the Nazaraana. Visited Village Shikrapur and met the villagers and obtained information regarding land occupants. Simultaneously, some villagers , staying at Mumbai and Pune city, visited Collector Office. We met them in the Collector Office and requested them t o submit the applications. The villagers assured us t o extend necessary co- operation in this regard. However, they insisted for a meeting with Collector, Pune to have a clear understanding of the matter. They are yet t o meet the Collector, Pune.

During the discussions with the viiiagers, it came t o itnow that about iG iaiid owners have since been died, 1 land owner is abroad and 1 land owner is missing i for the last 2 vears . Some land owners have settled at IVlumbai. 1 Some land owners of gut no. 629 & 631 visited our office. I t was intimated by them they will not compromise on the court cases at any cost.

In the afternoon, we met Dy. Commissioner, Pune and apprised him of the aforesaid problems and informed them that the Revenue Authorities at Shirur Tehsil Office are not co-operating. Dy. Commissioner, Pune advised us that this is the responsibility of POWERGRID t o obtain all the documents sought by the Addl. Collector and Revenue Authorities have no role t o play since i t is a case of Direct Purchase between POWERGRID and the Land Owners. Then Dy. Commissioner suggested us t o go for Land Acquisition, in which case the responsibility lies with the Revenue Authorities t o obtain necessary documents. He further advised us t o meet Commissioner, Pune and apprise him of the problems.

We met Commissioner, Pune who also advised us t o go for Land Acquisition. For the purpose, he advised us t o meet the Collector, Pune.

RHQ was also apprised of all the above developments. We tried t o meet the Collector, Pune. However, we were informed that Collector is out of station and he will be in the office on 07.01.2013.

GM (Projects) along with DGM (Law) reached Pune and met collector, Pune. Collector intimated that we can go ahead for land acquisition under urgency clause and district Administration will provide full support in early acquisition of the land. The application for land acquisition under urgency clause has been submitted in the Collector Office.

'Dear Sir,

Power Grid Corporation of India Limited, a public sector undertaking under Ministry of Power and the Central Transmission Utility, is transmitting about 51% of the Power, generated acrcss the country through its transmission network. POWERGRID is establishing 4001220 KV substation near Village Navlakh UmbresTaluka Mava1,District Pune, which has been commissioned very recently.

Pune being an important load centre in Western Maharashtra, it has been planned to establish one more substation of capacity 7651400 KV in addition to the ongoing 4001220 KV station. The proposed 765 KV substation will be constructed by POWERGRTD to match with the commissioning of Krishnapattailam Ultra Mega Power Project (KUMPP), to facilitate evacuation of Power to Maharashtra State.

Considering technical suitability and feasibility reports, it is proposed to establish a 765/400 KV GIS substation, at Village Shikrapur Taluka Shirur, Distt Pune. As the government land was not available, private land admeasuring approx. 40 Acres, which is mostly a barren non-cultivable, land has been identified in the Village Shikrapur, Taluka Shirur, Dist. Pune.

An application, in this regard, was submitted to your good of ice vide letter dtd. 1 1.10.1 1 for procurement of this land through tripartite negotiation basis comprising members from Distt. Collectorate, POWERGRID and land owners, for finalization of the rates in line with the MS State GR dated 04/08/2010. For further action in the matter, Special Land Acquisition Oficencf26 has been identified accordingly.

Again, next tripartite meeting was held on 27.3.12, chaired by Collector Pune, wherein Dy. Collecror (LA, St., no. 26), Asst Director (Town Planning), POWERGRID Coni~nittee nie~nbers, POWERGRID officials and land occupants were present. A rate of Rs. 70 lacs per licctare was offered to the land occupants by Collector Purie. Also, the cost of transferring the ownership rights to land occupants or "Nazraana" shall be borne by POWERGRID and shall be deposited to State Government. Further, Collector, Pune advised to carry out the land nieasi~renien[ ininlediately by revenue authorities to assess the total area of the land. (MOM Copy enclosed as Annexure-111).
