What is the SQE?

The Solicitors Qualifying Examination (SQE) is a single, national licensing examination that all aspiring solicitors must take before qualifying as English solicitors, regardless of their professional background and qualifications. This also includes qualified foreign lawyers who were previously required to pass the Qualified Lawyers Transfer Scheme (QLTS).

The SQE assessments replaced the QLTS as the qualification route for foreign lawyers, which is no longer in force. The QLTS has been successful in attracting many applicants from various jurisdictions, who are now dual-qualified English solicitors.

The SQE is administered by the Solicitors Regulation Authority (SRA), the independent regulatory body of the Law Society of England and Wales, ensuring candidate assessment is both rigorous and fair.

The purpose of the SQE assessments is to ensure that all candidates who qualify as solicitors have the knowledge, skills and ability necessary to perform their role competently and ethically.

The SQE aims to increase consumer protection by providing greater assurance that all qualifying solicitors meet consistent, high standards at the point of admission.

The SRA has published a competence statement which defines the continuing competences it requires from all solicitors. Foreign lawyers are required to demonstrate that they have the equivalent knowledge and understanding of law and practise in England and Wales in the same areas as that required of domestic candidates.

The SRA have developed the SQE Assessment Specification, which is based on the solicitor competence statement and forms the syllabus for the assessments.

How are you assessed on the SQE?

The full range of skills required to practise English law are tested on the SQE, including oral, written and professional. The SQE assessments are designed to test applicants on most of the solicitor competence statement and ensure they meet the threshold standard and legal knowledge expected of a solicitor on qualification.The assessments are divided into two stages:

SQE I: Functioning Legal Knowledge (FLK) This stage tests knowledge and understanding of professional conduct, solicitors’ accounts, financial regulation, land law, property practice, taxation, business law, contract, tort, dispute resolution, criminal law and criminal litigation, wills and probate, the English legal system, constitutional law, equity and trusts, human rights and EU law. SQE1 is a computer-based assessment which consists of 360 multiple choice questions, divided into two single assessments of 180 questions each (FLK1 & FLK2). The SQE1 assessments last 10 hours in total. Candidates must take the two parts of SQE1 all together.

SQE II: Practical Legal Skills AssessmentThis stage tests six skills: client interviewing and completion of an attendance note, advocacy, legal research, legal drafting, legal writing and case and matter analysis. The skills are assessed in the context of five legal practice areas: Business Law and Practice, Dispute Resolution, Criminal Litigation, Property Practice, and Wills and Administration of Estates.

The skills are assessed through 16 simulated legal environments known as ‘stations’, which sample across the skills and practice areas. Candidates cannot choose the practice area for their skills assessment. SQE2 is offered across five days.

Assessment Rules � SQE1 must be passed before SQE2 can be

attempted. � The two stages of the SQE must be passed

within six years. Candidates are allowed a maximum of three attempts at each assessment during the six-year period.

� The assessments are closed-book and candidates are not allowed to use any materials during the assessments.

The best analogy to the SQE is a driving test: whilst SQE1 is equivalent to the theory test element, SQE2 comprises the practical component, where you are expected to demonstrate your competence in the skills required.

Eligibility Criteria

Applicants who wish to qualify as English solicitors via the SQE must first ensure they meet the SRA eligibility criteria for admission.

Domestic Candidates

All domestic candidates must either: � have a degree in law � have a degree in a discipline that is not law � have completed an apprenticeships scheme

Paralegals and legal executives may also be eligible to apply. Domestic candidates must also complete a two-year qualifying work experience.

Foreign Qualified Lawyers

Foreign lawyers are exempt by the SRA and do not need to fulfil any internship or experience requirement, nor do they need to take any separate English language test.To be eligible to apply for admission, foreign lawyers must hold the correct professional qualification in a jurisdiction that the SRA recognises, and meet the requirements as to character and suitability. If you are a foreign lawyer and are aware of anything which might prevent you from meeting these requirements, you can apply to the SRA for an early check on any character and suitability issue prior to sitting the assessments.Foreign lawyers are able to apply for exemption from the SQE on the basis of their prior qualifications or experience. Exemptions can only be granted from a whole component of the SQE.

Taking the Assessments

The assessments are offered twice a year by a sole assessment provider, Kaplan, which has been appointed by the SRA.

The cost to sit the SQE1 assessment is £1,558 and SQE2 assessment is £2,422. Candidates do not have to pay VAT on SQE assessment fees. This does not include any cost of preparatory courses.

There are no formal requirements to comply with before taking the SQE assessments. You can simply contact Kaplan and register to sit the assessments at any time. SQE1 is delivered online in conjunction with Pearson VUE.

Following registration for the SQE assessments, each candidate will receive an examinee number, exact locations of the testing centres and a detailed schedule of the assessments.

Candidates with special needs should contact the assessment provider with a request for specific testing arrangements.

The results of the assessments are made available a few weeks after the date of each assessment.

Admission to the Roll of Solicitors

Once you have passed the SQE assessments and fulfilled any outstanding requirements set by the SRA, you may proceed to the next step and apply to the SRA for admission as an English solicitor.

If you do not intend to practise in England and Wales following successful completion of the assessments, you can still maintain your name on the Roll of Solicitors.

The assessment provider, Kaplan is not allowed to provide preparation courses for the SQE assessments.

The scope of the material, however, is comprehensive and covers nearly the entire corpus of English law. In fact, you can spend days just trying to understand what is covered by the syllabus.

In addition, current law degrees are not designed to prepare students for SQE1 and SQE2, which are practical in nature. The cost of sitting the SQE exams will run into thousands of pounds, with a limited number of attempts permitted per test.

It is, therefore, essential that you prepare for the assessments with a training provider that understands your needs and will provide you with the right guidance and advice from day one. While the SQE1 merely tests your knowledge of academic law, the SQE2 practical assessment aims to test higher level of knowledge, understanding and ability to accurately advise clients using a variety of legal skills.
