Beach Code Enforcement
FY 2016 Activity Report Narrative
The Walton County Beach Code Enforcement Dept. is tasked with enforcing the beach related codes
contained in Chapter 22 – Waterways and Beaches of the Walton County Municipal Code. The Beach
Code Enforcement dept. is managed under the Beach Operations Dept. and has 1 Lead Code
Enforcement Officer, 4 Code Enforcement officers, and a shared administrative assistant. Beach
Code Enforcement patrols 26 miles of beach 12 – 18 hours per day, seven days per week.
FY 2016 included the usual challenges of beach code enforcement as well as some new challenges.
Typical compliance issues included un-permitted dogs, glass, bonfires, Leave No Trace items, and
beach vendor violations. New challenges included an increase in beach congestion, and adoption of
ordinance section 22-55 – Prohibition of signs and fences on the beach..
Beach vendor related issues had a slight increase in the type, frequency, and violator. Vendor issues
associated with the delineation of the beach vendor zones at the neighborhood beach accesses
became problematic as the gulf front property owners adjacent to public beach exercised their right
to prohibit vending on the public beach seaward of their property per code section 22-60(d)(8).
This exercise of rights caused the relocation and omission of some of the vendor zones, and
ultimately, confusion amongst the delivery vendors on where they could place rental equipment.
Complaints about beach related issues increased from FY2015 by approx. 84%. The increase is
attributable to an improved data collection system, and increase in congestion on the beaches.
Enforcement of the Wildlife Lighting Ordinance remained the same as FY 2015 with no significant
increase in complaints and no significant change in cases opened and closed.
Overall the beach code enforcement efforts produced the expected results, the beaches of Walton
County were relatively harmonious, and visitors to the beaches of South Walton enjoyed the
experience.

FY 2016 Activity Report Summary
The data collected during FY 2016 for the Beach Code Enforcement efforts indicates that people
visiting the beaches of South Walton generally understand and respect the beach related municipal
codes. The main beach related codes we enforce have a favorable (greater than 50%) compliance to
total contact ratio that indicates locals and visitors have a high probability of recognizing,
understanding, and complying with the beach related municipal codes.
Glass, dogs, and beach vendor related violations continue to be the main activities beach code
Enforcement encounters with compliance issues. Glass violations, with an inherent “0%”
compliance/contact ratio, continue to be a problem on the beach. However, when compared to the
number of beach visitors the new comparative ratio is very small. Dog related violations carried an
approx. 50% compliance to contact ratio. The dog related non-compliant contacts were an equal
mix of un-knowing visitors and entitled locals. Beach vendor related violations were mainly
associated with the vendor zones (50% rule), delivery vendor speculative sets, setting equipment
up too early, and upland property owner written authorization requirements. The rest of the code
sections enforced by Beach Code Enforcement officers had no significant activity and were a very
small portion of our enforcement efforts. Overall the beach vendors, visitors to the beach, and locals
that live here generally respected and complied with the beach related municipal codes.

Beach Code Enforcement
FY 2016 Complaint Log Narrative/ Summary
The FY 2016 Beach Code Enforcement Complaint Log tabulated 196 complaints for alleged
violations of beach related codes. The 196 complaints included 15 different complaint types and
were made by 146 different complainants. The total number of complaints is an 84% increase over
2015’s 106 complaints.
A breakdown in the complaints indicates 50% +/_ of the complaints were associated with vendor
related issues. This total quantity of vendor related complaints is an increase of 17% over 2015’s
vendor related complaints.
The graph indicates a significant increase in overall complaints and a small increase in vendor
related complaints from 2015 to 2016. Factors that influenced the increase in complaints include
more visitors, more beach vending permits, more congested beach, and an easier complaint
submission process. Beach visitors increased 1.5% from 2015 to 2016 and beach vendor permits

increased 18% from 2015 to 2016. The complaint submission/cataloguing process was made easier
through a fillable PDF form that was made available through our website, continued notices from
various media announcements, and a more efficient data input process with our case management
system.
The significant increase in overall complaints and small increase in vendor related complaints
indicates that the upward trend is attributable to an increase in general beach complaints. Typically
general beach complaints are associated with the general public and the cause can be tracked to
congestion on the beach due to erosion and private property issues. The increase in overall
complaints and recognition of the factors that cause the increase in overall complaints indicates
that the Beach Code Enforcement dept. needs additional resources to effectively manage the beach
related code issues in Walton County.

Subject was very argumentative and persistant that the materials were stolen from a public beach by our staff.
CV-2016-0001925 6/30/2016 Vendor Violation 22-60 Received call from beach goer of chairs outside vendor zone. Determined by site visit that Rent Gear Here was in violation of the vendor zone. Made contact with Destin who stated they had another individual set up and made a mistake. Worker removed chairs upon my arrival and stated sorry, the guy messed up. During conversation with Destin he stated if I did not write a ticket he would not set up here any more. Destin also stated that they had not had a citation this summer. Further investigation determined that Rent gear Here had been cited by Officer Goodman in May 2016 for the same offense.

FY 2016 Wildlife Lighting Ordinance
Narrative/Summary
Walton County Beach Code Enforcement Dept. is tasked with enforcing the Wildlife Lighting
Ordinance in addition to the other beach related codes. The WLO cases are administrated
differently than most of the other enforcement actions in that the WLO are property based code
violations and typically require a written notice of violation accompanied by a period of time for
correction. Beach Code Enforcement dept. uses both complaints and active surveillance for
identifying and acting on possible WLO violations.
Beach Code Enforcement dept. logged 73 complaint/cases for FY 2016 and closed 56 of the cases.
Most of the cases were handled through courtesy notices, a few required formal notices of violation,
and none required Notices to Appear before the Walton County Code Review Board. The remainder
of the cases are still open and are actively being pursued for resolution.
WLO violation investigations require a large amount of code enforcement officer time and can be
burdensome to identify, determine compliance status, identify proper property owner(s), serve
proper notice, and follow up to determine compliance status. We are further developing the
interface with the ARC/GIS based system that works with Walton County’s GIS Mapping dept. and
Walton County’s Property Appraiser’s database. The integration of the ARC/GIS system with our
customized MS Office Access database has proven to be difficult and has not yielded the efficiency
in property location and information collection we were expecting by this time. However, we are
committed to the automation of the process and will continue to develop the data management
systems to work together to aid us in identifying and resolving WLO cases.
FY 2016 did not see much change from FY 2015 in Wildlife Lighting Ordinance complaints/cases.
FY 2017 is expected to be a better year for WLO complaint case resolution due to the more efficient
information collection system and additional staff that will be able to devote more time to the WLO
compliance effort.

FY 2016 Beach Vending Code Update
FY 2017 Beach Vending Code Revision Recommendations
History
Overall the beach vending code revisions adopted in 2015 continued to help minimize
beach vending issues in the 2016 vending season, but did not eliminate vending issues
altogether, and in some cases (the NBA public beach associated vendor zones) actually
created more issues. The Walton Co. Board of County Commissioners decided to not make
any revisions to the beach vending code for FY16 due to the success of the FY15 revisions.
However, The BCC did recognize that revisions may be required for the FY17 vending
season. The main beach vendor related issues identified for consideration for FY16
included:
1. Sec. 22-60(a) – Beach vendor management program
2. Sec 22-60 (b)(1) – Storage of equipment at the toe of the dune
3. Sec. 22-60(d)(8 & 10) – Vendor zones on public beaches associated with
neighborhood beach accesses and the conflict with upland property owner written
authorization.
Beach Vending Season Start
Beach Code Enforcement in conjunction with the Walton County Sheriff’s Office (WCSO)
and South Walton Fire District (SWFD) conducted the pre-season vending workshop in
January. The workshop is mandatory for all beach permitted vendors and is used to orient
new vendors with the rules and regulations of vending, and remind existing vendors of the
rules and regulations. In March the beach vending activity increased with the start of
Spring Break. However, Beach Code Enforcement did not receive many complaints or
initiate much enforcement action during this period. As the season progressed into May
more people visited the beaches of South Walton and Beach Code Enforcement experienced
an increase in beach vending related complaints and an increase in enforcement action.
Non compliant behavior included:

1. Non-compliance with vendor zones at NBA’s (Sec. 22-60(d)(8))
2. Un-used beach equipment set-ups (speculative sets aka ghost sets) (Sec. 22-
60(b)(1)
3. Storage of beach equipment at the toe of the dune (Sec. 22-60(b)(1))
4. Beach vendor equipment early set up prior to clearance by the Turtle Monitoring
Program (Sec 22-60(d)(4))
5. General public early set up prior to the Turtle Monitoring program (Sec 22-54(g))
6. Special event non-compliance with permit (Sec 22-59)
Post Season Beach Vending Workshop
Beach Code Enforcement dept. conducted a post summer season beach vending workshop
to discuss the 2016 summer season and receive input on how the beach vending ordinance
and enforcement practices could be improved. The public workshops were held on Sept 6
and Sept. 13, 2016 and were well attended by beach vendors, HOA/COA representatives,
and concerned citizens. Topics of discussion included:
1. The 50% rule associated with Neighborhood Beach Accesses
a. Conflict with upland property written authorization
i. Blanket no vending notice property owners upland of vendor zones
ii. Upland property owner that wants vending but no vendor zone
b. Storage of vendor beach equipment at the toe of the dune
i. Conflict w/ LNT
ii. Verification of being rented the next day
2. 50% rule associated with Regional Beach Accesses
a. Grayton Dunes
i. Should be included with RBA’s
ii. Vendor driving
1. Allow or not allow
2. Hours allowed
iii. More than 1 vendor zone
1. Coordinate w/ charter boat launch zone that is dynamic
2. Allow for location adjacent to CDL outfall

Summary
Overall the beach vending code season of 2016 saw some of the same issues experienced in
the 2015 vending season. The beach vending post season meeting combined with post
season assessment of the beach code enforcement efforts have revealed areas for
improvement in the ordinance and enforcement of the ordinance. Additional code revisions
and reconsideration for previous recommendations should be considered in order to help
make the beach vending code easier to understand by beach vendors and easier to enforce
by code enforcement officers.
Recommendations
The TDC Beach Code Enforcement dept. recommends the following beach vending
ordinance revisions be considered:
1. Sec. 22-60(a) – Policy. Implement a Public Beach Vendor Management program. The
vendor management program could be as simple as a property lease agreement or

as complex as a contract for services agreement. The program could also be a
combination or variation of the two types. The selected/awarded beach vendor
would, through either program model, have to adhere to a performance
specification that would regulate how the vendor uses/services the public beach.
Please reference Exhibit A – Public Beach Vendor Management Plan Performance
Specification.
i. Regional Beach Accesses
a. 1 beach vendor for each of the seven Regional Beach
Accesses. Or…
b. 1 – 3 beach vendors for each of the seven Regional
Beach Accesses.
ii. Neighborhood Beach Accesses – (Program model would require
omitting 22-60(d)(8) – Upland property owner authorization
requirement)
a. 1 - 5 Beach vendor(s) for all Walton Co. Public Beaches.
Public beaches assigned to particular vendor(s). Or…
b. 5 – 10 Beach vendors for all Walton County Public
Beaches. Public beaches assigned to particular
vendor(s)
2. Sec 22-60(b)(1) – Storage of vendor beach equipment at the toe of the dune.
a. Remove or omit verbiage that allows for delivery vendors to store equipment
at the toe of the dune. Beach equipment used on public beach must be
removed from the public beach each day.
3. Sec 22-60(d)(3) – Beach equipment set up standards
a. Change ambiguous verbiage of “reasonable distance from water’s edge” to
specific verbiage of “15’ from water’s edge” for minimum distance beach
equipment is allowed next to water’s edge.
b. Add verbiage to allow for a 15’ clear corridor at the toe of the dune or most
seaward point of dune walkover to allow for emergency/maintenance
vehicles to traverse the beach unobstructed.
c. Change verbiage referring to public access aisles to more specific verbiage of
“allow for 6’ wide public access aisle to water every 4th chair/umbrella
setup”.
d. Add verbiage to prohibit vending of tents greater than 6’x6’x6’

4. Sec. 22-60(d)(8 & 10) – Vendor authorization by upland property owner and vendor
zones on public beaches associated with neighborhood beach accesses (NBA’s).
i. Remove or omit the verbiage that requires the upland property
owner’s written authorization for commercial vending. Or…
ii. Discontinue the vendor zones on public beaches associated with
NBA’s. Or…
iii. Limit commercial vending on public beaches associated with NBA’s by
allowing door delivery of beach equipment only, no set up of
equipment on flat portion of beach.
5. Sec. 22-62- Penalties, fees, and fines.
a. Change cost of beach vending permits to $1,000 for initial delivery permit or
specific place permit. Change cost of any subsequent specific place permit to
$250.
6. Sec 22-59(a) – Special Event - Policy and objective
a. Add paragraph to define that all special events held on the beach must be
conducted by a permitted beach vendor and all required permits for
activities for a specific special event must be obtained by the same permitted
vendor.
b. Add paragraph to list special event permit fee amount for public beach
accesses to be $1,000.
7. Sec 22-59(c)(2) – Special Event permit application
a. Change verbiage for permit requirement based on quantity of people
from”50” to “30”
8. Sec 22-59(c)(3) – Special Event permit application
a. Add detailed list of items that are allowed for use on the beach and a list of
items that are restricted for use on the beach during special events.
b. Add verbiage to permit application required items to include
i. Detailed parking plan
ii. Detailed equipment list and layout to include quantity of tables,
chairs, lights, and misc. fixtures/equipment.
c. Add verbiage to include required distance for a special event from any active
turtle nests and how a turtle nest that becomes established after a special
event permit is issued for a particular public beach access may restrict or
prevent the special event from occurring on the particular public beach
access.

9. Sec 22-54(g) – Regulation of use and conduct on the beach and waterways
a. Add paragraph prohibiting/restricting use of generators on the beach.
b. Add paragraph prohibiting steel bladed shovels on the beach.
c. Add paragraph limiting tents to less than or equal to a 6’x6’x6’ size.
d. Add paragraph to allow for a 15 clear corridor at the toe of the dune or most
seaward portion of dune walkover to allow for emergency/maintenance
vehicles to be able to traverse the beach unobstructed.
e. Add paragraph to establish 15’ for minimum distance beach equipment is
allowed next to the water’s edge.
FY 2017
Beach Code Enforcement is preparing for a successful 2017 by building on the experiences
of the last few years. We hope that more revisions can be adopted this year to further our
efforts in making the beach related codes easier to understand and enforce.
The data we have collected on the different beach related codes we enforce is providing
valuable information on where and to what extent our efforts are working and/or are
needed. The two web based programs implemented last year allow us to more efficiently
process our field operations and more efficiently compile the associated collected data. The
MS Office Access based database we use as our primary case management system is
proving to be an efficient platform for case data input and informational retrieval. The
reporting function is being further refined for our specific use and can be sorted, filtered,
and/or searched to produce reports for periodic tabulation, review, and assessment. The
second program we use for supplementary data input and retrieval is an ARC/GIS based
program called Collect. The program is GPS driven, GIS based, and self populates property
related information based on the officer’s geographical proximity to a property. Both
systems allow us to quickly gather code violation information, process the information, and
move on to the next incident or case.
The FY 2017 Beach Code Enforcement year will see a much needed increase in resources
and a few administrative changes. The FY17 budget includes funds for new personnel,
equipment, and office space. New personnel include six new Beach Code Enforcement
officers, a new administrative clerk, and a new permit clerk. New equipment includes four
new trucks, two new all terrain vehicles, personnel equipment, and office equipment. New
office space will include a partial remodel of existing office space and construction of new

office space at the Beach Operations Maintenance Facility. Administrative changes will
include the Beach Code Enforcement dept. taking over the beach related permits
application/review processes.
In conclusion the FY 2016 produced some of the same challenges Beach Code Enforcement
experienced in previous years, but through revision of beach related codes and dedicated
efforts of the Beach Code Enforcement dept. we were able to maintain relative peace and
harmony on the beaches of South Walton. FY 2017 is shaping up to be even a better year
than previous for the tourism industry and the Beach Code Enforcement dept. will be ready
to meet the challenges.
