BE IT ORDAINED, by the President and Board of Trustees of the Village of Mendon, Illinois, as follows: Section 1. (3) Mobile Home Park: "Mobile Home Park" shall mean and include an area of land on which two or more occupied mobile homes are situated, either free of charge or for revenue, together with any building, structure or enclosure used as part of the equipment of such park. (4) Mobile Home Stand: "Mobile Home Stand" shall mean that part of an individual mobile home lot which has been reserved for the placement of the mobile home, and which is covered by the mobile home. BE IT ORDAINED, by the President and Board of Trustees of the Village of Mendon,Illinois, as follows:

Section 1. Definitions --~ As used in this article, the following terms shall have themeaning indicated below:

"Mobile Home" shall not include prefabricated or manufactured single family housingcommonly known as "modular" housing provided said unit is designed to and constructed on apermanent concrete foundation and further provided that it does not have the characteristics asused in the above definition of "mobile home. "

(2) Enforcing Officer: The President of the Village Board of the Village of Mendonshall serve as the enforcing officer under this ordinance.

(3) Mobile Home Park: "Mobile Home Park" shall mean and include an area of landon which two or more occupied mobile homes are situated, either free of charge or for revenue,together with any building, structure or enclosure used as part of the equipment of such park.

(4) Mobile Home Stand: "Mobile Home Stand" shall mean that part of an individualmobile home lot which has been reserved for the placement of the mobile home, and which iscovered by the mobile home.

(5) Existing Mobile Home Park: "Existing Mobile 'Home Park" shall mean and includea contiguous area of land under common ownership on which five or more occupied mobilehomes are situated on the effective date of this ordinance. i( -5AS

(6) Existing Mobile Home Stand: "Existing Mobile Home Stand" shall mean a mobilehome stand which is in existence on the effective date of this ordinance.

Section 2A. License required for mobile home park --- It shall be unlawful Jor anyperson, partnership, corporation or other entity to construct or operate a mobile home park

within the corporate limits of the Village of Mendon, without first obtaining from the Villageof Mendon a license to operate a mobile home park, and, if the mobile home park is not inexistence at the time of adoption of this ordinance, a license to construct, except as provided inSection 2B. No mobile home may be situated in, parked in, moved to, constructed, replacedor enlarged in the corporate limits of the Village of Mendon except in a licensed mobile homepark, except as provided in Section 2C.

Section 2B. Grandfather provisions for existing mobile home park --- It is the intentionof this ordinance to allow existing mobile home parks provided they are brought into conformitywith this ordinance as hereinafter provided:

(1) Existing mobile home parks shall obtain a license to operate a mobile home park asprovided in Section 2A, Section 3 and those parts of Section 4 applicable to obtaining a licenseto operate a mobile home park. Existing mobile home.parks shall also comply witp Section

.. 15(4), and Sectio~s 16 through 28 in~lusively of this ordinance.

(2) Existing mobile home parks are exempt as to Sections 5 through 7 and are exemptas to Sections 9 through Section 15(1), 15(2), 15(3) and 15(5) inclusively of this ordinance.

(3) Any mobile home placed or replaced in an existing mobile home park must be witha mobile home that is no older than 10 years of age.

(4) Anytime a mobile home is placed or replaced on an existing mobile home stand, themobile home stand must comply with Section 8 of this ordinance.

(5) Any expansion of an existing mobile home park and/or addition of mobile homestands to an existing mobile home park must comply with this ordinance.

Section 2C. Grandfather of existing mobile homes. Section 2A notwithstanding, amobile home situated in the Village of Mendon on the effective date of this ordinance may bereplaced with another mobile home provided said replacement mobile home is no older than 10years of age, and further provided the replacement mobile home is occupied within one yearafter the replaced mobile home becomes unoccupied. Any mobile home situated in the Villageof Mendon on the effective date of this ordinance which remains unoccupied for a continuousperiod of one year cannot thereafter be occupied and must be removed from the premises. Inall other respects, this ordinance shall apply to mobile homes situated irUhe Village of Mendonon the effective date of this ordinance.

Section 3. Plan --- Each application for a license under this article shall be accompaniedby a plat or sketch showing the size and location of all buildings and structures.

Section 4. Application procedure --- In order to obtain a permit to construct, or anoriginal license to operate a mobile home park, the application shall file with the enforcingofficer a written application setting forth:

(1) The full name and address of the applicant or applicants, or names and addresses of ~the partners if the applicant is a partnership, or the names and addresses of the officers if theapplicant is a corporation, and the present or last occupation of the applicant at the time of thefiling of the applicant.

(2) The location and legal description of the trace of land upon which it proposes tooperate and maintain the mobile home park.

(3) The proposed and existing facilities in the mobile home park for water supply,sewage, garbage and waste disposal, fire protection and for a community building which willinclude a description of toilets, urinals, sinks, wash basins, slop sinks, showers, drains andlaundry facilities, the proposed alterations therein and the maintenance thereof.

(4) The proposed method of lighting the structures and land upon which the mobile homepark is to be located.

(5) The site plans of the mobile home park, the plans and specifications for newbuildings and facilities, all as may be required by the rules and regulations of the Village underthe provisions of this ordinance.

An affidavit of the applicant as :to' the truth of the matters contained in the application',shall be attached thereto. Where a permit to construct is sought in addition to a license tooperate, request therefore shall be made in the same application.

Each application shall be accompanied by an application fee in the amount of $100.00for each one acre of land or fraction thereof proposed to be used as a mobile home park. Eachapplication fee shall be paid to the Village by cash, check or U.S. money order in the amountof the application fee and such fee once paid to the Village shall not be refunded.

Upon receipt of an application for a permit to construct a mobile home park, or in anapplication for a license to operate and maintain the same, the enforcing officer shall, if the parkis, or the proposed park will be, in conformity with this ordinance and the rules and regulationsadopted by the enforcing officer pursuant thereto, issue a permit to construct or an originallicense, as the case may be. If the application for a permit to construct or an original licenseis declined, the enforcing officer shall give the reasons therefore in writing to the applicant; andif the objection can be corrected, the applicant may amend his application and re-submit it forapproval.

If a permit to construct a mobile home park has been issued, the applicant uponcompletion thereof shall notify the enforcing officer. The enforcing officer shall then inspectthe mobile home park and if completed in accordance with the accepted application, theenforcing officer shall then issue a license.

No change in any sanitary facilities, methods of water supply, sewer drainage, garbageor waste disposal, and no change in the plot plan shall be made without first making a writtenpermit therefor. Such application shall be made in the way and manner hereinbefore set forth;such change or changes shall comply with such safety and sanitary code, codes, rules andregulations as are applicable thereto.

Such permit does not relieve the applicant from securing building permits or fromcomplying with any other ordinances applicable thereto. In addition to the application feeprovided for herein, the licensee shall pay to the Village Clerk on or before May 1st of eachyear an annual license fee which shall be $50.00 per year.

Each license fee shall be paid to the Village by a separate certified check or U.S. moneyorder in the amount of the license fee only and any license fee or any part thereof, once paidto and accepted by the Village shall not be refunded.

Any license granted hereunder shall be subject to revocation or suspension by the Village.However, the enforcing office shall first serve or cause to be served upon the licensee a writtennotice on which shall be specified the way or ways in which such licensee has failed to complywith the ordinance or any rules or regulations promulgated by the Village pertaining thereto.Said notice shall require the licensee to remove or abate such nuisance, insanitary orobjectionable condition specified in such notice within five days or within a longer period oftime as may be allowed by the enforting officer. If the licensee fails to comply with the termsand conditions of said notice, within the time specified or such extended period of time, theenforcing officer may revoke or suspend such license.

alterations therein shall be prominently displayed in the office of the mobile home park.Licenses issued under this ordinance shall be transferable only upon written consent of thelicensor, provided, however, that the licensor may not withhold such consent where theprovisions of this ordinance have been complied with in all other respects.

Each mobile home park licensed or to be constructed under the provisions of thisordinance shall provide a responsible attendant, caretaker or agent at all times, whose duty itshall be to maintain the park, its facilities and equipment in a clean, orderly and sanitarycondition.

Section 5. Minimum area --- The minimum area for each mobile home park shall be two(2) acres. The minimum number of spaces completed and ready for occupancy before firstoccupancy is permitted shall be ten (10) spaces.

Section 6. Maximum density of units per acre --- The total density of any mobile homepark shall not exceed seven (7) mobile homes per acre.

Section 7. Minimum lot size --- The minimum lot area for an individual mobile homeshall be 3,300 square feet. A mobile home and its appurtenant structure may not occupy morethan thirty percent (30 %) of the individual mobile home lot.

Section 8. Mobile home stand --- All mobile homes which are not situated onfoundations or piers shall be located on a mobile home stand which shall conform to thefollowing standards:

(1) Size: The size of the mobile home stand shall be at least equal to the length andwidth of the mobile home and its appurtenant structures located thereon.

(2) Location: The location of each mobile home stand shall be at such elevation andangle in relation to the access street and the mobile home access way that placement and removalof the mobile home is practical. More specifically, the minimum elevation above the adjoiningprivate or public street or streets shall be six (6) inches.

(3) Construction: Appropriate material, properly graded, placed and compacted so asto be durable and adequate for the support of the maximum anticipated loads during all seasons,and protected against the action of frost and freezing ..

(4) Gradient: There shall be a minimum of two (2) percent longitudinal and adequatecrown or cross-gradient for surface drainage.

(5) Base enclosure: All mobile homes which are placed on foundations or piers shallhave the entire perimeter enclosed.

Section 9. Minimum width of mobile home lots --- The minimum width of eachindividual mobile home lot shall be forty (40) feet as measured from one side lot line along aline perpendicular to said side lot line, to the opposite side lot line. Said measurement shall bemade at the front set back line as established herein.

,. .Secti'oil 10.' Minimum distan'ce between mobile homes --- No mobile home shall be

placed within fifteen (15) feet of another mobile home, and in no case shall the mobile home belocated closer than seven and one-half (7'/2) feet of the side or rear lot lines excepting a carport.

Section 11. Yards abutting common areas --- The distance from that part of a mobilehome closest to a common private access drive, a common parking area, a common sidewalkor other common area to said common private access drive, a common parking area, commonsidewalk or other common area shall be fifteen (15) feet minimum.

Section 12. Yards abutting mobile home park boundary or public street --- In no caseshall a mobile home be located less than fifteen (15) feet from the mobile home park boundary.The distance from that part of a mobile home closest to a public street shall be twenty-five (25)feet minimum.

Section 13. Yards on intersecting streets --- On mobile home lots fronting intersectingstreets, whether one or both of said streets are public or private, the set-back lines requiredherein must be provided on both streets.

(1) Lot number: There shall be posted and maintained in a conspicuous place on eachlot a number corresponding to the number of each lot as shown on the plat plan submitted sothat each lot may be easily identified.

(2) Patio: Each mobile home lot may provide an appropriate outdoor living space tosupplement the interior space of a mobile home.

1) Any subgrading shall be well drained, uniformly graded andcompacted.

2) Construction shall provide a useful outdoor surface constructed orformed either monolithically or in movable units with weather resistant materialsplaced sufficiently close together to create a paved area.

(3) Tenant storage: Storage facilities may be provided on or conveniently near eachmobile home lot (1) for the active storage of outdoor equipment, furniture or tools, (2) for theinactive storage of such other materials as is used only seasonally or infrequently by the typicaltenant and cannot be conveniently stored in the typical mobile home.

(a) Size: There shall be a minimum of ninety (90) cubic feet provided forgeneral storage for each mobile home lot.

(b) Design and location of storage facilities: Storage facilities shall be providedon the lot, or in compounds located within a reasonabl~. di$tance, not more than five hundred(500) feet frQm each stano locate4 not closer ~1?private streets and public streets than the mobilehome unit itself." Storage facilities shall be designed in a manner that wiil'enhance theappearance of the court and shall be constructed of suitable weather resistant materialsappropriate under the uses and maintenance contemplated.

(1) Public streets: All publicly dedicated streets shall conform to the requirements ofthe subdivision regulations of the Village.

(2) Private streets: Where private streets are provided within the mobile home park theminimum private street on which an individual mobile home lot fronts shall be thirty (30) feetin width, and shall be located approximately in the center of a parcel of property equal to thewidth of right-of-way for a local residential street of fifty (50) feet. All streets shall beconstructed in accordance with the requirements of the subdivision regulations of the Village.All private streets shall be unobstructed access to a public street or highway. All future privateand public streets constructed in connection with a mobile home park shall be designed and laidout in accordance with the subdivision regulations of the Village.

(3) One-way streets: One-way streets may be provided in a mobile home park providedthe one-way street serves less than twenty (20) lots and provided no parking is allowed on theone-way street. One-way streets must be fourteen (14) feet minimum width.

(a) Walks shall be provided for safe, convenient, all-season pedestrian access ofadequate width for intended use, durable and convenient to maintain. There shall be:

1) Individual walks to each mobile home stand from a paved street orfrom a paved driveway or parking space connecting to a paved street.

(b) Walks shall be constructed of approved material in accordance withspecifications made by the Village for the various types now in use or approved at a later date

and shall be generally at least three (3) feet in width. Sudden changes in alignment and gradientshall be avoided. Required walks are not to be used as drainage ways. Additional sidewalksmay be provided in other areas as determined by the owners.

(5) Parking spaces: Parking spaces shall be provided for not less than one and one-half(11/2) cars per mobile home lot. Required car parking spaces may include one (1) car space oneach mobile home lot and in addition shall include a sufficient number of car spaces inconveniently located parkway bays to bring the total number of parking spaces up to the requiredone and one-half (11/2) car spaces per mobile home lot. :Each parking space shall not be lessthan nine (9) feet wide and twenty (20) feet deep, shall be surfaced for its entire area withdurable, hard material, suitable for all weather use.

Section 16. Water supply --- An adequate supply of potable water shall be furnished from thepublic water supply system.

Section 17'; Se~~r·s and sewage' --- I~ each mobile home park all waste or waste water(including such waste or waste water from mobile homes) from a faucet, toilet, or tub, shower,sink, slop sink drain, washing machine, garbage disposal unit, or laundry shall empty into anapproved sewer system installed in accordance with Village specifications. Surface water shallnot be discharged into a public sanitary sewer.

Section 18. Service building --- Each mobile home park may provide service buildings as arehereinafter more particularly prescribed.

(1) All service buildings shall be permanent structures complying with all applicable lawsand ordinances regulating the construction of buildings.

(2) All service buildings and the grounds of the park shall be maintained in a cleancondition and kept free of any condition that will menace the health of any occupant or thepublic or constitute a nuisance or fire hazard.

Section 19. Laundry facilities --- When laundry facilities are provided all facilities shall conformto the following standards:

(1) Hot and cold water outlets shall equal not less than the number of laundry trays andwashing machines.

(2) An ample number of electrical outlets shall be provided supplying current sufficientto operate each such machine.

(3) The laundry facilities shall be in a separate service building or, if in the samebuilding where sanitation facilities are housed, shall be separate from the area housing sanitationfacilities by a soundproof wall.

Section 20. Garbage and trash disposal --- Corrosion resistive metal garbage cans or other non-combustible containers, with tight fitting covers shall be provided in quantities adequate topermit disposal of all garbage and rubbish. Each mobile home lot shall have at least one (1)garbage can within one hundred (100) feet of it. The cans shall be kept in sanitary conditionas determined by inspection of the health inspector. Garbage and rubbish shall be collected and

disposed of as frequently as may be necessary but not less than weekly to insure that the garbagecans shall not overflow.

Section 21. Electric lighting and outlets --- All entrances, exits and driveways shall be lightedat night.' Not less than a one hundred (100) watt electric light shall be provided for each twohundred (200) lineal feet of private street and at each entrance and exit to the mobile home park.At least one (1) receptacle outlet for each mobile home space shall be provided; this receptacleand other electric wiring shall conform to the requirements of the electric code of the Village.Street lighting on public streets shall conform to the requirements in the subdivision regulationsand electric code of the Village.

Section 22. Additions to mobile homes --- No permanent or semi-permanent structure shall beaffixed to any mobile home as an addition to such mobile home, nor shall any accessorystructure be permitted on any mobile home lot or in any mobile home park except thoseacces~.ory structu~es requireq by this. chapter and "~hose strtiqures designed for the use with amobile hb'me'such asa canopy; ·carport.orawning, or "any"expansion unit or accessory structurespecifically manufactured for mobile homes, If'an office structure is provided, its constructionshall comply with all applicable laws and ordinances,

Section 23. Permitted obstructions --- For the purpose of this ordinance, no obstructions willbe permitted on mobile home lots except the following obstructions will be permitted whenlocated in the yards indicated:

(1) In any yard: Chimneys, overhanging roof eaves, open terraces and awningsadjoining the mobile home; and ornamental light standards and flagpoles, fences, trees andshrubs, except that on corner lots, fences, trees and shrubs shall not be higher than thirty (30)inches above the centerline grade of the intersecting streets if located in that portion of arequired front or side yard situated within twenty (20) feet of the lot corner formed by theintersection of any two street lines.

(3) In side yards: Open accessory off-street parking spaces, except in a side yardabutting a street.

(4) In rear yards: Private garages or carports, if attached or structurally a part of themobile home, open accessory off-street parking spaces, accessory sheds, tool rooms, or othersimilar accessory buildings; private swimming pools in accordance with regulations of theVillage. Accessory buildings or structures may occupy not more than thirty (30) percent of arear yard.

Section 24. Screenin g --- Plan ting shall be hardy, appropriate for use and location, and plantedso as to thrive with normal maintenance. There shall be provided planting adequate to screenviews effectively. Views to be screened shall illclude laundry drying yards, garbage and trashcollection stations.

Section 25. Certificate of use occupancy required _n No mobile home park shall be occupieduntil a certificate of use and occupancy shall have been issued by the enforcing office to the

effect that the mobile home park or the portion thereof for which such certificate is requestedis in compliance with all applicable provisions of this ordinance.

Every mobile home occupied as a dwelling unit located in the Village after the date ofadoption of this ordinance shall meet the minimum standards for plumbing, heating, andelectrical systems as defined by the American Standards Association project All 9.1 approvedMarch 12, 1963 as revised periodically. Mobile homes that display the official seal and registernumber of the Mobile Home Manufacturers Association and the Trailer Coach Association willbe considered to comply with the American Standards Association Standard All 9.1. Mobilehomes that do not meet with these minimum standards for plumbing, heating and electricalsystems will not be issued a certificate of use and occupancy permit by the building inspector.

The minimum standards for plumbing, heating and electrical systems as defined by theAmerican Standards Association Project All 9.1 (1963), as amended and revised periodically,.are hereby. made a ~art of and. incprporated by reference into this ordinance.

Section 26. Penalty --- Any person, firm or corporation who violates any of the provisions ofthis title shall, in addition to such other relief as the law may afford, be punishable by fine ofup to $100.00 per offense and each day of violation of this ordinance shall be considered aseparate offense.

Section 27. This ordinance shall be in effect after its passage, approval and publication asrequired by law.

Section 28. All ordinances and parts of ordinances in conflict with the provisions of thisordinance, shall be, and the same are, to the extent of such conflict, hereby repealed .
