15. Proced ure fo r export of Haza rd,.us wastes rro l11 lndia.-
( I) " n~· person intend ing to l'1C pon hazardous wastes ~ptei li eJ in Schedule-Il l shall apply inForm 7 and Fo rm H along with full cover insurance policy fo r consignm ent to the CentralGovern ment for the proposed trans boundery movement of th e hazardous wastes togetherwith the Prior Informed Co nsen t in writ ing from the importing country.
(2) 0 11 receipt of such applicat ion, the Ceurer Government may give a ' No ObjectionCe rtificate' for the proposed export within Q period o f sixty da ys from the date ofsubmi ssion o f the app1lcation and may impose conditions as it rna)' con sider necessary.
(3) 11Ie Centr al Gu \ cm ment. shall forward a copy of the 'No Objection Certifica te' grantedunder sub-rule (2), to lhc Central Po llution Control Board, the concerned Slate Po llut ionControl Board and the concerned Port and Customs authorities for ensuring compliance of thecondi tion s. i f any, o f tbe export and (0 take appropri ate steps lor the sa il: handling o f thewaste shipment.
( 4 ) The exporter shal l ensure th at no consignment is shipped before the ' No O bjectionCertificate " is received from the importi ng counnJ.
( 5 ) Th e exporter shall also ensure that the shipment is accompan ied w ith the MovementDocument in For m 9.

16. Proced ure for im port of Haz a rdous Waste-
( J ) A person inte nding to import or trans it lor trans-boundary movement of hazardouswastes specified in Schcdulc-l l! shall apply in Fo rm 7 and Fnrm 8 to the CentralGovernment o f the pro posed import wherever applicah le, together with the Prior InformedConsent, whic h eve r appfic ahle and shall send a copy of the application, sim ultane ously, 10the concerned State Po llut ion Control Hoard to ena ble them to se nd their com ments andobservat ion s, if an y, to the Ministry of Environment and Fo rests within ,I period of thirtydays.
(2 ) On receipt of the application in co mplete, the Ministry of Enviro nment and Forestsshall examine the application considering the co mments and obse rvations, if an y, receivedfro m the State Pollution Control Boards, and may grant the pe rm ission for import withi n it
period of sixty days subj ect to the cond ition that the importer has .
( i) the enviro nmentally so und recycling, reco very or reuse facilitie s:(ii) adequate facilities and arrangement for treatme nt and d i sNJ~a l of wa<,le,
generated: and(iii) a valid registration from the Ce ntral Po llutio n Cont rol Hoard and a proof of
being an actual user, if required under these rules .
(3) The Ministry of Environment and Forests shall for ward a copy ofthe permission grantedunder sub-r ule ( 2) to the Central Pollution Co ntrol Bo ard, the concerned State Pollut ionContro l Board an d the concerned Port and Customs author it ies for ensuring complianc e ofthe conditions o f imports and safe hand ling of the hazardous was te.
(4) The Ministry of Environment and Forests shall comm unicate the permission to theimporter.
( j ) The Port and Cu stoms authorities shall ensure that shipment is accompani ed by theMovement Docu ment in Form 9 and the test report of analysis of the hazardous wastecons ignment in que stion , from a labo rator y accredited by the ex porting cou ntry.

( 8 ) The importer shall also inform the concerned Slate Po llution Contro l Boa rd and theCentral Po llution Cor.trol Hoard. the date and lime of the arrival of the consignment o f urchazardous waste ten days in advance.
17. lIIegaITrame.-
(I) The export and import uf haza rdous wastes from and into India shall be deem ed illegali f·
( i ) it is without permiss ion of the Central Govermnem in accordance withthese rule s, or
( ii ) the permission has been obtai ned thro ugh ta lsific arion, mis-representationor fraud ; or
(iii) it doe s not co nform to the shippi ng details provided in the movementdocuments: or
(iv) it results in deliberate disposal [i.e.. d umping) of hazardous wastes incon cavemtion of the Base l Conve ntion and of general pr inciples o f Internationalor National Law.

(2) The labe ling and packaging shall be easily visible and he- abrc to withstandphysical conditions lind climatic factors.
20. Transportation o~ Il a7.udous "' '')(C.-
( I) The transport of the hazardous wastes Nil he in accordance with the provisions l. f
these rules and the rules made by the Ccnuel Government under the Motor v ehicles Act.
1988 and other guidelines issued from time to lime in this regard.
(2) Th e occupier shall prov ide the transporter with the relevant information in Form11, regarding the hazardous nature of the wastes and measures to be taken in case or'an
emergency and 511311 mark the hazardous wastes containers as per For m 12.
(3) In case of transport of hazardous wastes for final disposal to a facility lor
treatment, storage and disposal ex i"it ing in II State other than the State where the hazardouswaste is generated, the occu pier shall obtain ' No Ohject ion Certificate' from the Slate
Pollu tion Control Board of both the Slates.
(4) In case of transporta tion of hazardous wastes through a State other than the Stateof ori gin or dest ination. the occupier shal l intimate the concerned Stale Pullutlon Control

Where an accident occurs at the facility or on ahuvurdous waste s ite or during transportation of the hazardous waste, the occupier oro perator of the faci lity or the transponer. as the case may be, shall report immediatelyto the State Pollution Control Board about the acc ident ill Furml a.
