Overview

In accordance with Texas Occupations Code §1701.304, the Texas Commission on Law Enforcement (TCOLE) administers three basic licensing examinations. The Basic Peace Officer, Basic County Corrections, and Telecommunicators Examinations are administered electronically by 63 exam sites throughout the state (including the Austin office). Section 1701.254 of the Texas Occupations Code requires TCOLE to evaluate training providers based on the scores from the basic licensing exams. TCOLE has implemented Rule 215.13 to be used to determine whether training providers conducting basic licensing courses are ‘at-risk’. These licensing exams are based on the current basic curriculum with a required first attempt pass rate of 80% or above for all students attempting the exam. A law enforcement academy may be found at risk and placed on at-risk probationary status if the passing rate is less than 80 percent of the students attempting the licensing exam for the first attempts for any three consecutive state fiscal years. This three year standard is calculated on a revolving basis. For fiscal year 2017, the three year pass rate will be based on all students attempting the exam from September 1, 2014 through August 31, 2017. Passing percentages for 120 training providers conducting either the basic peace officer/ basic county corrections officer/or telecommunicator training course(s) have been calculated and reported utilizing the rosters and exam dates during this evaluation period.

Basic Peace Officer Examinations

In the three state fiscal years (2015, 2016, and 2017), there were 13,776 individuals who passed on the first attempt among 83 training providers for the basic peace officer licensing exam. Of those providers all 83 met or exceeded the 80 percent average for first attempts during three fiscal years.

Jailer Examinations

In the three state fiscal years (2015, 2016, and 2017), there were 8,391 individuals who passed on the first attempt among 54 training providers for the Jailer licensing exam. Of those providers all 52 met or exceeded the 80 percent average for first attempts during three fiscal years.

Academic Alternative Basic Peace Officer Examinations

In the three state fiscal years (2015, 2016, and 2017), there were 101 individuals who passed on the first attempt among 1 training providers for the basic peace officer licensing exam. Both providers met or exceeded the 80 percent average for first attempts during three fiscal years.

Telecommunicator Examinations

In the three state fiscal years (2015, 2016, and 2017), there were 4,372 individuals who passed on the first attempt from 55 training providers for the Telecommunicator licensing exam. 52 providers met or exceeded the 80 percent average for first attempts during three fiscal years.

Distance Basic County Corrections Examinations

In the three state fiscal years (2015, 2016, and 2017), there were 3,976 individuals who passed on the first attempt from 1 training provider for the distance basic county corrections officer licensing exam.

Providers Not Meeting Requirements

Basic Peace Officer Examinations During fiscal years 2014 through 2017, all training providers met the 80 percent requirement for the basic peace officer first attempts.

Jailer Examinations

During fiscal years 2014 through 2017, 2 training providers did not meet the 80 percent requirement for the Jailer first attempts.

Basic Telecommunicator Examination

During the fiscal years 2014-2017, 3 training providers did not meet the 80 percent requirement for the Telecommunicator first attempts.

Results

TCOLE will seek administrative action against training providers based on the following statutory and/or rule requirements:

The Texas Occupations Code Section 1701.254(a) “The commission may visit a school conducting a training course for officers, county jailers, telecommunicators, or recruits, and make necessary evaluations to determine if the school complies with this chapter and commission rules.” The Texas Occupations Code Section 1701.251 (c)(1) states: "(c) The commission may: (1) issue or revoke the license of a school operated by or for this state or a political subdivision of this state specifically for training officers, county jailers, or recruits or telecommunicators."

Commission Rule 215.13(a) (1) states: A training provider may be found at risk and placed on at-risk probationary status if: (1) for those providing licensing courses, the passing rate on a licensing exam for first attempts for any three consecutive state fiscal years is less than 80 percent of the students attempting the licensing exam…

Commission Rule 215.13(f) states: The commission shall place providers found at-risk on probationary status for one year. If the provider remains at-risk after a 12-month probationary period, the commission shall begin the revocation process. If a provider requests a settlement agreement, the commission may enter into an agreement in lieu of revocation.
