COMMENTS BY THE EU AND ITS MEMBER STATES ON LOW PERSISTENT ORGANIC POLLUTANT CONTENT VALUES

The European Union and its Member States would like to respond to the request contained in paragraph 10 of decision BC-13/4. The concentration limits in the table below are contained in Regulation (EC) No 850/2004 of 29 April 2004 on persistent organic pollutants1 and are applied within the EU (cf. paragraph 10(b) of decision BC-13/4). With regard to PCP and its salts and esters, a value of 100 mg/kg has been agreed within the EU, but is not yet contained in the POP Regulation. Whether it is applied in the Member States or not depends on the competent authorities of the Member States.

With regard to paragraph 10(a) of decision BC-13/4, we would like to indicate that a study commissioned by the European Commission is ongoing, including on decaBDE, and is foreseen to be finalized by the end of 2018.

Dear Mr Payet,

The thirteenth meeting of the Conference of the Parties to the Basel Convention on the Control of

Transboundary Movements of Hazardous Wastes and their Disposal (24 April- 5 May 2017, Geneva, Switzerland)

adopted technical guidelines on the environmentally sound management of wastes consisting of, containing or

contaminated with persistent organic pollutants (decision BC-13/4).

The technical guidelines, in line with the requirements of provision 1 (d) (ii) of the article 6 of the

Stockholm Convention, sets, on the interim basis, the level of low content of POPs in wastes, which in accordance

with the provision 10 of the decision BC-13/4, needs to be considered by the Conference of the Parties for its possible

adoption.

In order to undertake a full and complete assessment of the proposed level of the low POPs content by

the relevant authorities of the Russian Federation which are responsible for meeting obligations under the Basel and

Stockholm Conventions, we kindly ask the Secretariat to provide the following information:

- Scientific methods and methodologies, which can be used to determine the low content of POPs and their

correspondence to the international standards;

- Other aspects which are significant from the Secretariat’s point of view to support the validation of level of

low content of POPs.

The Ministry of Natural Resources and Ecology confirms the assurances of my highest consideration.
