The legal ramifications of usinga mobile phone whilst driving

YOUR RIGHTS

In 2007 using a mobilephone whilst drivingbecame a criminal offencethat carried points ordisqualification. As a resultthe Police are ready to pulldrivers over any time theybelieve that they are usinga mobile phone or otherdevice.

So what is illegal?You must not:� Use your mobile

phone whilst driving.� Cause or permit a

driver to use a mobilephone.

� Use any otherdevice that transmits datawhilst driving.

� Use a mobilephone whilst supervising aprovisional driver.

Penalties for usingyour phone while driving

If you’re caught usinga hand-held phone whilstdriving or riding, you canget an automatic fixedpenalty notice.

You’ll get threepenalty points on yourlicence and a fine of £60.

Your case could also

go to court and you couldbe disqualified from drivingor riding and get amaximum fine of £1,000.Drivers of buses or goodsvehicles could get amaximum fine of £2,500.

If you already havenine or more points on yourlicence then you will ‘totup’ to 12 points and theMagistrates will considerdisqualifying you fromdriving for a minimumperiod of six months. Thiswill happen unless there arespecial reasons not toimpose the points or unlessa disqualification wouldcause exceptional hardship.

New driversIf you get six or more

penalty points within twoyears of passing your test,you’ll lose your licence.What does ‘using’ a mobile

phone, mean?Holding it in order to

make or receive a phonecall or to perform any otherfunction, such as send atext message.

The law also applies toall handheld devices that

transmit or receive datasuch as a TomTom orIPod/Ipad.

So investing in a handsfree kit may be helpful tokeep within the law. Justdon’t pick up the mobilehandset to operate it.When you can use a phone

in your vehicleIf you’re the driver,

you can only use yourphone in a vehicle if you:

� Need to call 999or 112 in an emergency andit's unsafe or impractical tostop; or are safely parked

Using hands-free deviceswhen driving

You can use hands-free phones, sat-navs andtwo-way radios whenyou’re driving or riding. Butif the police think you’redistracted and not incontrol of your vehicle youcould still get stopped andpenalised.I have received a summonsfor using a mobile phonewhile driving but I did not

do this, what can I do?Sometimes people are

falsely or wrongly accused

of using a mobile phonewhile driving. However inevery case before the UKcourts the prosecutionmust prove that you areguilty beyond reasonabledoubt.

If you believe that youhave been wrongly accusedyou should do thefollowing:

1. Return therelevant part of thesummons clearly indicatingthat you are going to plead‘not guilty’.

2. Contact yourmobile phone provider andask them to provide youwith confirmation that youwere not on the phone atthe time that you areaccused of being so.

3. Collate any otherevidence that you have(such as a witnessstatement from apassenger).

Over the past few months I have received lots of queries viawww.youandyourrights.co.uk regarding what the law is in relation to driving whilst using a mobile phone.

The match ball from the1912 FA Cup final, theonly time Barnsley wonthe cup, will be broughtback to town to takepride of place in the newExperience Barnsleymuseum.

Barnsley'sfootballing heritage willbe united for the firsttime when the £4.3mvisitor attraction opensat the Town Hall on June27.

Until now, many ofthe proud footballingobjects have been inprivate collections or atother museums acrossthe country.

Among thememorabilia going onshow is an England shirtworn by Tommy Taylor,the Barnsley-bornManchester Unitedplayer who was killed inthe Munich air crash in1958.

Taylor scored anincredible 16 goals injust 19 Englandappearances and hisEngland shirt still bearsthe grass stains.

It has been broughtback to Barnsley on loanwith the support of theNational FootballMuseum.

The ManchesterUnited FC Museum hasalso loaned objects thatbelonged to Mark Jones,another of the BusbyBabes who hailed fromthe town.

Arthur Bower,Barnsley FC’s officialhistorian, has donateda rattle he used as aschoolboy and isdelighted the club'shistory is beingbrought alive underone roof.

“I’m thrilled to seeBarnsley FootballClub’s history beingcelebrated,” said 79-year-old Arthur.

“This rattle usedto belong to my uncleand was used in theSecond World Warduring the air raids as awarning that someonehad left a light on. Itmakes a tremendoussound.

“I took it toOakwell a few times asa lad but can clearlyremember when it

made its debut – it wasduring the Barnsleyversus Blackpool FACup third round matchin 1949.

“It was the first allticket game so Iremember it clearly. Idon’t think it helpedmuch though becausewe lost 1-0.”

Terry Sykes, chairof the museum steeringgroup, added:“Experience Barnsleywill be great fun for thewhole family. Whetheryou're interested infootball, fashion, ourindustrial story or howour stone-ageancestors lived, therewill be something foreveryone.

“It really is amuseum for the peopleby the people.”

Barry Woods is certain he can drive a hard bargainand laughingly claims he has never paid the askingprice for furniture in his life.

But the good news for his customers atDiscount Furnishings based in Wombwell, is thatBarry is more than happy to pass the savings hemakes onto them.

A former supervisor of Barnsley’s HMV store isrealising a lifelong dream by setting up his ownrecord shop.

Stuart Sheard, 29, of Bretton Road, Darton,was made redundant from HMV when it closed inMarch. He is using his redundancy money to helpfund his new business, Debut Records, which willbe in The Arcade in the town centre.

He said: “I have always wanted to do thissince I was a kid, just like I always wanted to workin HMV — which I did for five years.

“I loved working there and wanted to carry onsomething similar. I chose the name ‘Debut’ as itrolls off the tongue like other famous record storenames such as Jumbo or Crash.”

Stuart, originally from New Lodge, saidincreasing numbers of bands were now putting outmaterial on vinyl, a format that is gaining groundagain.

“The idea is that I will have a small shopselling vinyl, DVDs and some clothing. I will betrying to appeal to a niche market,” he said.

Stuart, who is also a DJ at Rotherham barTryst, plans to open his shop at the beginning ofJuly and will be preparing stock and decorating upto then.

He likes all kinds of music from rock to indieand metal but tends to play R&B when he does hisDJ spots.

He paid tribute to the famed 1980s recordstore Casa Disco, fondly remembered by manyBarnsley music fans.

“They had a collage of album covers on thewall in Casa Disco and I may go for something likethat,” he added.

Work has finally begun on essentialwork to enable Locke Park tower toopen to the public for the first time inmore than 20 years.

The initial work, costing £80,000,will concentrate on tackling health andsafety issues and ensuring safe accessfor the public to the first-floor balconyof the stone tower.

The money for the first phase hasbeen raised by ‘tireless fund-raising’over the past ten years by the Friendsof Locke Park group.

David Allen from the Friends’group says the hope is that when thebalcony part of the tower is safe localswill once again enjoy its borough-wideviews and so be more likely to getinvolved in further fund-raising.

The Grade II listed Locke Parktower, which is 70 feet high, was builtin 1877 as a memorial to JosephLocke’s wife, Phoebe.

It is the highest point in the townbut was shut in the early 1990sbecause of its dangerous state.

Barbara Sabin, 73,of Barrow Hill,Wentworth, waspresented with the BEMrecently at the SalvationArmy in HoylandCommon, in front ofmore than 200 people.

She was awardedthe medal by the ViceLord Lieutenant Dr GilesBloomer for her worktowards helping openthe Hoyland CommonSalvation Army hall in

2007. She also receiveda citation from theQueen.

Barbara said: “I’venot come down to Earthyet, I’m full of gratitude.It was an absolutelylovely presentation andI’d just like to thankeveryone who wasthere.”

She is currently anofficer for Rawmarshand will retire nextmonth, but worked forthe Hoyland Commonbranch for 11 years from1998 to 2009 afterstarting out as an officerin 1993.

She and herhusband Peter, 77,visited BuckinghamPalace in 2008 after theopening of the hall.

A bunch of good-natureddonors have all rolledtheir sleeves up to helpsave lives.

The six long-termblood donors from theBarnsley area werehonoured by NHS Bloodand Transplant forreaching 75 blood

donations each.Only around four per

cent of the eligiblepopulation give blood,and of those only two percent ever reach 75donations. Each donationcan help save up to threelives, and between themthe Barnsley donors may

have contributed tokeeping more than athousand patients alive inlocal hospitals over theyears.

The Barnsley donorspresented withcommemorative crystalawards were: Brian Reed,66; Stuart Hudson, 54;

Laurence Mace, 50; FrankMellor, 65; CliffordWoffinden, 66 and 44-year-old Suzanne Dunn.

Spokesperson forNHS Blood andTransplant, Donna Batty,said: “It is wonderful wecan call on people whohave dedicated

themselves to givingblood over so many years,performing a life-savingrole for no reward, otherthan the knowledge thatthey are helping others.

“However, every yearmany existing donors inour region have to stopgiving blood due to

factors like ill-health andmedication, so in order tomaintain blood stocks, weconstantly need newdonors.”

Robert Blackburn,31, of Guest Street, PlattsCommon, swam 21 milesover 21 days betweenApril and May, theequivalent of 1,344lengths. Robert, who is aswimming teacher andlifeguard, swam thelengths at theMetrodome and HoylandLeisure Centre. He did itto raise money for hisfriend Dave Smith, whodied from cancer lastmonth, and successfullyraised £713 in total.

His colleagueschipped in to help him byswimming a further 888lengths to bump the totalup to 2,232 lengths.

Robert said: “Iwould just like to thankeveryone involved.”

No term orcondition that conflicts with them is binding on the Companyor the Advertiser unless it is in writing and signed by or onbehalf of both parties by an authorised signatory. These termsand conditions shall be governed by and construed in accor-dance with the laws of England and Wales. If any provision inthese terms and conditions is held to be invalid or unenforce-able in whole or in part the remainder of them shall continueto apply. The Company reserves the right at any time tochange in whole or in part these terms and conditions.

CONDITIONS OF ACCEPTANCE OFADVERTISEMENTS

1 Advertiser’s Warranty and Indemnity(i) The Advertiser warrants: (a) that the advertisement is legal,decent, honest and truthful and that it complies with theBritish Codes of Advertising and Sales Promotion, with anyrelevant codes of practice and with all requirements of currentlegislation; (b) that nothing in the advertisement is defamato-ry or constitutes a malicious falsehood; (c) that the publica-tion of the advertisement will not infringe copyright or anyother rights vested in a third party; and (d) that the Advertiserhas secured all necessary authorities and consents in respectof the use in the advertisement of any pictorial representa-tions or other representations of (or purporting to be of) liv-ing persons and of references to any words attributed to liv-ing persons. (ii) The Advertiser will indemnify the Companyin respect of all costs, damages or other charges arising as aresult of the publication of their advertisement or incurred inconnection with any actions or claims brought against theCompany arising from a breach by the Advertiser of the war-ranties in this paragraph 1 or otherwise from the publicationof the advertisement.2 Refusing or Amending Advertisements(i) The Company reserves the right to refuse to publish anyadvertisement whether or not the advertisement has beenaccepted or previously published. (ii) The Company mayrequire any alteration it considers necessary or desirable inan advertisement as a prior condition of its publication,whether or not such advertisement has been accepted or pre-viously published. (iii) The Company will permit only stan-dard abbreviations and no hyperlinks or metatags may beincluded in any advertisements save with the prior consent ofthe Company.3 Placement of Adverts(i) Whilst the Company will endeavour to comply with rea-sonable requests from Advertisers, the Company does notguarantee the publication of any advertisement or its publica-tion on any particular date or in any particular position. (ii)The Company has at its absolute discretion the right todecide the classification, if relevant, for any advertisement.4 Cancellation(i) The Company may cancel the Advertiser’s order at anytime and shall give notice of the cancellation before the nextdue date of publication of the advertisement if practicable.(ii) In no event can orders be cancelled once the Companyhas commenced to carry out the order in accordance with thefirst publication date requested by the Advertiser. In othercases notice of cancellation must be received by theCompany prior to the relevant current deadline.(iii) All cancellations must be notified in writing by post orfax. E-mail notice of cancellation is not acceptable.5 Copyright(i) Copyright of all artwork, copy or other material created,reworked or contributed to by the Company shall vest in theCompany.(ii) The Advertiser authorises the Company to record, repro-duce, publish, distribute and broadcast (or to permit thesame) all advertisements (including but not limited to text,artwork and photographs) and to include and make themavailable in any information service, electronic or otherwise.6 Advertiser’s PropertyAll artwork, photographs, leaflets, film or other propertydelivered by the Advertiser to the Company is held by theCompany at the Advertiser’s risk and the Advertiser shouldinsure all such property against loss or damage from what-soever cause. The Company reserves the right to destroywithout notice all such material after the date of its last use inconnection with the publication of an advertisement, unlessthe Advertiser has given written instructions to the contrary.7 Box Numbers(i) The Company will endeavour to forward all replies to a boxnumber, to the Advertiser, as soon as possible after receipt,but the Company accepts no liability in respect of any loss ordamage alleged to have arisen through delay in forwarding oromitting to forward such replies, howsoever caused. Boxaddresses must not be used for sending goods or materialsof any value. The Advertiser authorises the Company toexamine material passing through boxes and hereby autho-rises the Company to return to its originator or destroy anycommunication, which, in the opinion of the Company,should not be delivered to the Advertiser.(ii) Advertisements from dealers are not accepted under a boxnumber, nor may a box number be used for the distributionof trade canvassing material.8 Disclosing Information(i) All advertisements must be accompanied by theAdvertiser’s full name and address and the Company mayrequire evidence of authenticity of any advertisement. Alltrade advertisements must contain a trading name. (ii) TheCompany reserves the right to refuse an advertisement con-taining only a mobile telephone number unless the Advertiserdiscloses to them a BT land line number (or similar). (iii)The Company reserves the right to disclose the name andaddress of Advertisers if required by law or any regulatory orgovernment authority or to other third parties where theCompany, in its sole discretion, deems it reasonable.9 Limitation of Company’s Liability(i) The Advertiser shall check the advertisement and notify theCompany immediately in writing of any errors. The Companyassumes no responsibility and shall not be liable for the rep-etition of errors in a series of advertisements unless it hasreceived reasonable written notice from the Advertiser. (ii) Inthe event of any error, misprint or omission in the printing of

an advertisement or part of an advertisement (howevercaused) the Company will either re-insert the advertisementor relevant part thereof, or make a reasonable refund oradjustment to the cost. No re-insertion, refund or adjustmentwill be made where the error, misprint or omission does notmaterially detract from the advertisement. (iii) In no circum-stances shall the Company’s total liability (including conse-quential liability) in respect of any error, misprint or omissionexceed either the amount of a full refund of any price paid tothe Company for the advertisement in connection with whichliability arose, or the cost of a further or corrective advertise-ment of a type and standard reasonably comparable to that inconnection with which liability arose. (iv) Save as set out inthis paragraph 9, the Company accepts no liability in respectof any loss or damage occasioned directly or indirectly as aresult of the publication of any advertisement or any loss ordamage occasioned directly or indirectly by any total or par-tial failure (however caused) of the publication of any adver-tisement in any of the Company’s newspapers, other publica-tions or internet sites in which the advertisement is scheduledto appear.10 Assignment(i) The Company shall be entitled to assign its contract withthe Advertiser or any of its rights or benefits thereunder. (ii)The Advertiser may not assign, transfer, sub contract, chargeor in any other way deal with any of its rights or obligationsunder this Agreement without the Company’s prior writtenconsent.11 Data Protection Act(i) The Company will hold information it obtains in its deal-ings with customers to administer the Advertiser’s account,for statistical purposes, for debt collection and for fraud andcrime prevention. If the Advertiser does not wish its informa-tion to be used for marketing purposes, it should inform theCompany in writing. (ii) Telephone calls to the Companymay be monitored or recorded for staff training purposes.12 Advertising Agencies(i) An advertising agency, whether recognised or not, submit-ting an advertisement shall conform to the conditions laiddown by the Institute of Practitioners in Advertising regardingobservance of the provisions of the British Code ofAdvertising Practice and to the Standard Conditions fortransactions of business between newspapers and advertis-ing agencies as agreed between the Newspaper Society andthe Institute of Practitioners in Advertising. (ii) The terms ofthe Recognition Agreement between the Newspaper Societyor between the Newspaper Society and the NewspaperProprietors Association and recognised advertising agenciesare deemed to be incorporated in these conditions of accept-ance for the publication and transmission of all advertise-ments accepted from a recognised agency. Without prejudiceto the foregoing, these conditions of acceptance specificallyextend to any personal guarantee given by the directors of orany other person on behalf of a recognised agency in respectof any unsatisfied liabilities of the agency in the event of theagency’s liquidation or insolvency. Such guarantee is part ofthese conditions of acceptance.13 LeafletsFor the purpose of these terms and conditions, any leaflet orother publication or material distributed with any of theCompany’s newspapers or magazines is deemed to be an‘advertisement’, and references to the publication of suchadvertisements is deemed to be the distribution or insertionof such leaflet or other publication or material.

PAYMENT TERMS FOR ADVERTISERSOrders for the insertion of advertisements are accepted sub-ject to the following payment terms:1 Rates(i) The Company reserves the right at any time to change thescale of advertising rates and to apply such rates to advertise-ments (series or otherwise) accepted and not wholly execut-ed at the time of any such change. (ii) It is the responsibili-ty of the Advertiser to bring to the Company’s attention at thetime of booking any discount, allowance or exemption fromValue Added Tax to which entitlement is claimed. (iii) Allgross advertising rates (except classified lineage and semidisplay) are subject to the Advertising Standards Board ofFinance levy from time to time (currently 0.1%) payable bythe Advertiser to help finance the self-regulatory system. (iv)All rates and prices quoted by the Company are exclusive ofValue Added Tax.2 Advertising Agencies(i) Commission will only be granted to agencies formallyrecognised by the Newspaper Society or the Company at thetime of placing the order. The rate of commission payable willbe determined by the Company and may be carried or with-drawn at the Company’s discretion at any time, subject to giv-ing the advertising agency seven days written notice thereof.(ii) All advertising agencies claiming commission must quoteorder numbers for every booking made.3 Time of Payment(i) Unless credit terms have been agreed, pre-payment forany advertisement must be made in full no later than the rel-evant deadline. (ii) In the event that credit terms areapproved, payment shall be made for each advertisement nolater than thirty days from the date of the invoice for suchadvertisement. Should the Advertiser be in breach of theseterms, or of any contract with the Company, then the fullamount in respect of all advertising published and all otheramounts accruing from the Advertiser shall become due andpayable. (iii) The Company reserves the right to withdrawcredit facilities from any Advertiser at the Company’s discre-tion. (iv) Payments by post must be by cheque or postalorder made payable to the Company and crossed. All pay-ments must be accompanied by the relevant invoice, state-ment or remittance advice issued by the Company. (v) Anyquery in respect of an invoice must be brought to the atten-tion of the Company within seven days of its issue. The exis-tence of a query on any individual item on an account shallnot affect the due date of payment of any balance of suchaccount.4 Late Payments(i) The Company shall be entitled to charge interest on allsums due at a rate of 5% above the base rate for the timebeing of Barclays Bank plc until payment is received, after aswell as before any judgment is obtained, together with com-pensation for late payment under the Late Payment ofCommercial Debts (Interest) Act 1998 and regulations madethereunder. (ii) The Company shall be entitled to add to anysums due any reasonable costs and expenses (includingadministrative costs) incurred by the Company in obtainingpayment thereof on an indemnity basis. (iii) The Companyshall be entitled to charge the Advertiser £15.00 in respect ofany cheque tendered which is not met upon presentation (andto vary this charge at any time without notice). (iv) TheCompany reserves the right to exercise a lien over any docu-ments or other property of the Advertiser in its possession ifthe Company’s charges are not paid in accordance with theseterms and the Company’s rate card from time to time.
