INSTRUCTIONS TO TENDERERS
1. Bank of India invites tenders from the Authorized dealers/Companies of CARRIER (excluding MIDEA), HITACHI (Excluding LOGICOOL), DAIKIN, mitsubishi Air Conditioners having sound technical and financial capacity for Proposed air-conditioning Works for B/O JODHPUR (M) BRANCH, JODHPUR (RAJ.) The tenderers should enclosed Valid authorization letter from the company.
2. The tender documents may be purchased from Bank of India, Zonal office, Jasoda Tower, Akhliya Choraha, Jodhpur against a DD of Rs. 500/- payable at Jodhpur in favour of BANK OF INDIA payable at Jodhpur.
3. The Tenderer should study all the tender documents, specifications, drawing carefully and understand the same before quoting their rates. In case of any doubts he / they should get it clarified from the Architects M/S Design Desk, 59-C, Ganesh Colony, Mahesh Nagar,80 Ft. Road, Opp. Talwariya Garden, JAIPUR – 302019 Phone No. 9024996047 . but this shall not be a justification for late submission of tender or extension of opening date.
4. The Tenderer should visit the site and get himself acquainted with the site conditions before quoting. He is also expected to know about the availability of electric supply, space for working/ storing material and any other ancillary facilities since these are to be provided by him. (Unless otherwise specified) at his own cost.
5. The tender to be submitted in a sealed envelope containing a Bank DD/Bankers Cheque of Rs. 16000/- (Rupees Sixteen Thousand only) payable at Jodhpur in favour of Bank of India. Envelope shall be superscribed as "AIR CONDITIONING OF BRANCH AT BOI B/O JODHPUR (M) BRANCH, JODHPUR Tenderers have to return all the documents and drawings issued to them while submission of tender, duly stamped and signed as per instructions.
6. Sealed tenders as above will be received by the office of Zonal Manager, Bank of India, Zonal office, Jasoda Tower, Akhliya Choraha, Jodhpur up to 05:00 PM on 23-04-2018 and will be opened on 24-04-2018 at 04:00 PM or as per Bank’s convenient time.
7. Mode of submission of Tender:-
The tender shall be submitted in accordance with the procedure detailed herein. Specified documents shall be submitted in sealed envelope of appropriate size, each of which shall contain the followings
i) Envelope marked No.1: shall contain Tender Cost, E.M.D. and
Commercial term & condition, Brochure of proposed machines –of tender
furnished in the specified form signed & stamped on each pages, including
authorization of dealership.
ii) Envelope marked no.2: shall contain only the priced tender with covering
Letter and the price should be valid for three calendar month.
ii) Envelop marked no 3: Envelope marked nos. 1&2 shall be put in a large envelope of adequate size marked no 3, which shall be properly sealed. This envelope shall be endorsed on the outside face
8. Tenders received late on account of any reasons whatsoever and telegraphic tenders will not be entertained.
9. The earnest money deposited by demand draft/banker cheque must accompany each tender and the tenders not accompanied by the same are liable to be rejected NON RESPONSIVE.
10. The tender shall be valid for a period of not less than 100 days after the date of opening. If any tenderer withdraws his tender within the said period, the Bank shall be at a liberty to forfeit Earnest Money paid along with the tender.
11. The Bank will not be bound to accept the lowest tender and reserves the right to accept or reject any or all tenders without assigning any reasons whatsoever.
12. The Bank reserves the right to accept the tender in full or in parts and that the tenderer shall have no claim for revision of rates or other conditions if the tender is accepted in part.
13. The Tenderer is requested to sign and put his seal on each page of the tender document in token of acceptance of the conditions.
14. The time for completion of the work is 15 days from the 1st day of issue of work order including co-ordination with Furnishing work by other agency. If work is not completed to the satisfaction of the Employer/Architect within the above stipulated period, the contractor shall be bound to pay to the employer a sum of 1% of tendered amount shown in the tender per day subject to sealing of 10% of the accepted contracted sum by way of liquidated damages and not as penalty during which the work remains uncommenced or unfinished after the expiry of the completion date.
15. The tender should quote all items in the tender schedule. The rates should be expressed both in figures and
in words. In case of discrepancy between the two, the rates expressed in words will prevail. Similarly if there
is any discrepancy between the unit rate and the amount, the unit rate will prevail. 16. The rates quoted should be INCLUSIVE of all material, labour, water, electricity, power equipment, tools,
tackles, lifts, leads, scaffolding, FULL RATE OF EXCISE,CUSTOM, OCTROI,SALES/WORKS CONTRACT /VAT TAX, INCOME TAX, ROYALTIES etc. (but exclusive of GST) All Taxes/duties/ statutory levies in respect of this contract, prevailing at the time of tender or during execution of the work shall be totally payable by the contractor. NO claim in this respect shall be entertained by the owner. GST will be payable extra as per prevailing rate.
17. Minor modifications/changes may occur to the repairing process, material etc. to suit the conditions, functioning etc. for which no extra charges will be paid.

GENERAL CONDITIONS OF CONTRACT
1 The work carried out shall be open for inspection to the Architect, their representatives, Owner or their
representatives at any time.
2 All the items / material shall be got approved before finally commissioning of the Air-Conditioning Work.
3 The work shall be executed strictly according to the specifications and the directions from the Architect
from time to time. If there is any discrepancy between the specifications and the instructions the same
shall be pointed out to the Architect well in advance. Any claim in this regard shall not be entertained.
4 Unless otherwise specified, all materials required for the work shall have to be arranged by the contractor
well in advance. Delay on part of non availability of any particular material shall be to the contractor’s
account.
5 Contractor shall not sub let the work entrusted to him without the prior permission of the Architect and
Bank. He will co- operate with other agencies appointed by the Bank and shall give prior markings,
recesses, openings etc. required for other agencies. The order in which the work shall be carried out shall
be decided by the Architect; however the same shall not be the reason for delaying the work.
6 Samples of all the materials brought by the contractor at site shall be got approved with endorsement tag
by the Architect and shall remain in safe custody at site till the completion of the job and shall be made
available to the Architect or their representatives whenever required. Any change of material, brand other
than what is specified in the specifications, conditions shall not be done without the written approval
from the Architect/Bank, If violated, Architect can reject the items and no payment shall be made for the
same, or otherwise the material deviated from the specifications is acceptable for one or the other reason.
Necessary cost adjustment shall be made for which contractor shall not have any objection.
7 The quantities mentioned in schedule are approximate and may vary to any extent or even be omitted thus
altering the aggregate value of the contract. No claim in this regard shall be entertained.
8 During the execution of work, if any damage occurs to the property, structure etc. the same shall be made
good by the contractor at his own cost.
9 Contractor has to arrange water & electricity of his cost.
10 Contractor shall arrange to protect their tools, tackles, materials, equipment and the work carried out till
handing over the entire completed work from any theft, damage and the owner shall not be responsible for
the same..
11 The rates quoted shall be firm and final during the currency of contract. No upward revision in rates shall
be permitted on account of hike in material prices, labour charges, taxation etc. The rates quoted shall
be for finished work and shall be inclusive of labour, material, wastage, transport, loading, unloading,
tools, tackles, scaffolding if necessary, profit, all taxes inclusive of sales tax, works contract tax,
Professional Tax. ESIS, Octori, levy, Service Tax, overheads of the contractor etc.(but exclusive of GST).
GST will be payable separately.
12 During the execution of work, if any item is required to complete the work, but not specified in schedule of
quantities and no rates are available for the same, then the rate for such item shall be derived based on the
actual cost of material and labour involved plus 20 % for overheads, profit plus taxes. However it is the
responsibility of the contractor to complete the entire work and there cannot be any excuse that the
particular item is not included in schedule.
13 No labour below the age of 18 years shall be employed on the work site.
14 The contractor shall not be entitled to any compensation for any loss of life, injury or accident happened
during the currency of contract, till completion of the entire work and handing over to the owner, the
contractor shall be responsible for any accident, injury, loss of life, fire, theft of material etc. and he shall
indemnify the owner from any such losses. He may insure his material, workmen etc.
15. Contractor shall protect the work by covering / taping all the lose / live wire openings etc. if necessary to
avoid any mishap during the progress of work. It will be the total responsibility of the contractor in case of
any accident. The contractor shall indemnify the owner and the Architect from any such loss, damage etc.
16. Contractor shall follow all the safety measures like, using safety belts helmets etc. while carrying out the
work.
17. Contractor shall engage sufficient expert labor required to carry out the work on the site and follow the rules, regulations, bye laws etc. Laid down by the Local Civic Authority and indemnify the owner and the Architect from any such cause, loss suffered on this account. The Labors working on site would take due care to avoid any hazardous incident and follow all the safety measures.
18. The Earnest Money of Rs. 16000.00 deposited with the Bank shall be converted in the form of Security
Deposit once the work is entrusted to the contractor and shall be refunded after the completion of the
work on the basis of Virtual Completion Certificate by the Project Architects. The Earnest money and
Security Deposit shall bear no Interest.
19. The Retention money at 10 % of the value of the work done shall be deducted from the bills of the
contractor. 50 % of the retention amount shall be refunded after Architect issues the Virtual Completion
Certificate. The balance 50 % retention amount shall be refunded after 12 months from the date of
completion on receipt of the No Defect Certificate from the Architect during the defects liability period. The
retention money so held shall not bear any interest.
20 The Defects Liability Period for the work shall be 12 months. Any defects arising during this period due to bad workmanship, substandard material etc. shall be made good by the contractor free of cost. In case the contractor fails to rectify the defects within the reasonable period the owner shall be free to get the same rectified through other agency and the cost involved shall be recovered from the amount due to the contractor.
21 The work carried out by the contractor shall jointly be measured. In case the contractor or his
representative fails to remain present at the time of joint measurement then the measurements taken by
the Architect shall be final and binding on the contractor.
22. During the progress of work there may be minor changes in the material / brand specified for electrification
works etc. the contractor shall carry out the same, however the difference in cost of material as certified by
the Architect shall be to the owner’s account.
23. While the work is in progress, if use of any sub standard material is observed or in case of bad
workmanship and if the Architect instructs to dismantle and to redo the same the contractor shall do the
same at his own cost and the Architect’s decision in this regard shall be final and binding.
24. The full and final payment shall be considered only on satisfactory completion of work and after due
certification of the bill by the Architect.
25. The owner shall deduct the income tax (T. D. S.) as per prevailing rules and rate from the payments due to
the contractors and certificate having deducted the TDS shall be issued to the contractor.
26. If for any reason the work is required to abandon or the overall value of the contract gets reduced, the
contractor shall be paid for the actual work carried out by him at the quoted rates subject to that the work
is found satisfactory. No claim or compensation in this regard shall be entertained.
27. The date of commencement shall be the 1st day of receipt of work order and the contractor shall
commence the work immediately in consultation with the owner. The unreasonable delay to commence
the work shall be liable to cancellation of contract after due notice. If the commencement of the work is
delayed by the owner for one or the other reason the contractor shall carry out the work at the same
quoted rates if the delay is within the reasonable period.
28. The period of completion for the entire work shall be 15 days which shall be measured from the 1st day of receipt of work order or the commencement day which ever is earlier.
29. The owner shall be free to terminate the contract by giving proper notice to the contractor if :
a ) Contractor fails to commence the work within the reasonable period when asked to do so
b ) Fails to show desired progress within the reasonable period despite being instructed to gear up
the work
c ) Does not follow the instructions given by the Architect.
d) The contractor fails to complete the work within the a specified period including the extension in
time limit if any (either with liquidated damages or without liquidated damages).
30 The contractor can terminate the contract by giving proper notice to the owner if,
a ) The owner fails to instruct the contractor within the reasonable time to commence the work after
the work order is issued and contract has been entered in to.
b ) The owner stops the work for more than 3 months for the reasons not attributing to the
contractor’s default.
c ) The owner fails to make the payment to the contractor within a period of one Month from the date
of certification of the bill by the Architect without any justifiable grounds.
31. In case the owner terminates the contract for the reasons mentioned above then and in that event the
contractor shall be paid for the actual work carried out by him at the rates quoted in the tender /agreed
during the negotiations and certified by the Architect, provided the work is found satisfactory. However the
Retention money so deducted shall be forfeited.
32. In case the contract is terminated by the contractor for the reasons mentioned in clause 30 then and
in that event the contractor shall be paid for the actual work carried out by him at the quoted/ agreed
rates and as certified by the Architect. However the retention amount shall be refunded as per clause
No19. In such case the Defect’s liability period shall be counted from the date of termination.
33. The Contractors are required to assist the Project Architects in obtaining any permission/s from the
Municipal/Local Authority and/or Liaison with the Authorities. Any out of pocket expenses etc. in
this regard shall not be reimbursed to the contractor.

SECTION
SPECIAL CONDITIONS OF CONTRACT
AIR-CONDITIONING WORK
1.0) Work shall be done as per CPWD and ISI Specifications for air-conditioning1977 amended up to date.
i) In the event of any discrepancy between the Specifications as mentioned under Technical Specifications and as given in the specifications as mentioned above. The specifications under Technical specifications shall prevail. ii) The relevant latest IS Specifications, Codes of Practice shall be followed if the Specifications for the item is not available in the Specifications as mentioned above or in Technical Specifications in the agreement. iii)In case of any discrepancy, the decision of the Architect /Consultant DESIGNS DESK, shall be final for binding.
1.1) SHOP DRAWINGS The successful bidder shall have to submit all shop drawings within 5 days in stages from the date of issue of letter of intent to the Consultant for approval. i) Route of the pipes /cabling& drainpipes proposed as per site condition based on location of AC machine proposed by architect.
1.2) The owner do not bind themselves to accept the lowest or any tender and reserve the right with themselves to accept or reject any or all the tenders in whole or in part without assigning any reason for doings.
1.3) Each tender should be signed by the person having the power of attorney to sign. Bill of quantities should be signed and returned. If the tender is made by or on behalf of a Company incorporated under the Companies Act of 1956, it shall be signed by its Executive, authorized to sign or on their behalf shall bear the official seal of the Company and accompanied by a Photostat copy of Power of Attorney. If the tender is made by an individual, it shall be signed with his full name and address, if made by a Firm, it shall be signed under the partnership of the Company name by a Member of the Firm, who shall sign his own name and give the name and address of each Partner / Directors of the Firm and attach the copy of the Power of Attorney with the tender.
1.4. The contractor must acquaint / acquire themselves with the site conditions, means of access to the work, local conditions and all matters pertaining thereto. It shall be the contractor.
The quoted rates shall be on works contract basis and subject to statutory variation in sales tax on work contract or on rate of excise duty. In case assessable values are increased by the manufacturer during the currency of contract, the client shall not pay any increase in quantum of excise duty on account of change of accessible value. No foreign exchange and license shall be arranged by the owner in case of imported items, material or equipment..
1.5. Calculations made by the contractors should be based upon probable quantities of the several items of work, which are furnished for the their convenience in the `Bill of Quantities
1.6. All entries should be filled in English only made by hand clearly written in ink. All corrections should be initialed by bidders as many times as the corrections occur.
1.7. All rates should be filled in figures and sub-totals and grand-totals in figures and words both.
1.8. On tender scrutiny, if differences are found in rates given by the bidder in words and figures or in sub-total, grand-total amount is found, the procedure for deriving the final value shall be as follows: a) The item rates quoted by bidder shall be taken as correct in cases where amount worked out of any item
does not correspond to the rate written in figures or words. b) For items not quoted by the bidder, the highest rates quoted by other bidder shall be taken as correct
for such item for loading ur poses and lowest rates for execution purposes.
1.9. Bids not submitted on prescribed form are liable to be rejected. Bidders are advised to quote offer as per bill of quantities. No alternate offer is acceptable. Any alteration/ cutting/ additions made in the tender documents shall lead to disqualification of the bid without any prejudice.
1.10. Any comments on technical or commercial conditions should be done clause wise.
1.11. Bids can be sent by registered post at the risk and responsibility of the bidder. Any bids received after the time and date of Submission of bids shall not be entertained.
1.12. The acceptance of bid shall be intimated to the successful bidder through an award letter and thereafter formal agreement shall be entered within the time specified in the award letter.
1.13. PRICES AND UNITRATES
The prices and units rates quoted by the bidder in the bid shall be firm and deemed to be adequate to cover the entire responsibility involved in the execution and completion of work. Bidders shall be further deemed to have include all labour and material rates which shall be inclusive of cost of materials with taxes, octroy and other duties. Fees, royalty, unloading and loading, freight and forwarding, storage, insurance charges and other charges necessary for the completion of the work. Bidder shall take into account his risk day to day variations in the prices on all other accounts .No escalation would be allowed.
1.14. The owner shall deduct TDS at source as applicable or statutory deductions if any to be made at source and certificate against deductions shall be given to the contractor by the owner.
1.15. POWER AND WATER SUPPLY FOR ERECTIONPURPOSES
The owner shall provide power and water (if available at site ) required for erection, testing and commissioning purposes and one point at site and contractor shall make his own arrangements for extending to locations where power and water will be required By him
1.16. STORAGE AT SITE
Plant room/ AHU rooms, if available, can be used by the contractor for storage of equipment/ materials brought to site for Execution of the work. However, watch and ward of the same shall be at contractor.
SECTION
TECHNICAL SPECIFICATIONS 1 SCOPE
The scope of this Section comprises the re-installation, testing and commissioning of the air-conditioning machines confirming to these specifications and in accordance with the requirements given in Schedule of Equipments.
2. AIRCONDITIONING UNITS HI-WALLUNITS & their individual Remote controls to be installed on the location approved by the Architect / Consultant.
3. INSTALLATION
3.1 Condenser and Fans shall be enclosed in a powder coated housing .Refrigerant piping shall be of IMPORTED Copper tube confirming to JIS.

MODES OF MEASUREMENTS
1. PIPING WORK a) The lengths of piping shall be measured as per shortest distance between INDOOR & OUTDOOR
UNITS and accessories and fittings shall be measured along its center line in meters and no separate measurement for bends, elbows, tees etc. shall be made. As such fittings / accessories shall be treated as normal piping work.
b) All kind of supports, hangers etc. shall form part of the piping work and no extra measurements shall be made.

FACILITIES TO BE PROVIDEDBY THE BANK a) Main incoming power supply to Main Panel/ units, along with suitable size Switch fuse unit.
b) Any kind of exposed roof insulation work (if suggested by architect) . Provision of venetian blinds /glass films.
NOTE:
1 The Amount Quoted shall be inclusive of all applicable Taxes/duties/levies like WCT, VAT, and Service tax. Excise duties, Sales tax etc. but exclusive of GST, GST will be mentioned separately.
