Method: On-duty Baltimore City Plainclothes Police Officers,operating an unmarked police vehicle. Officers involved inan exchange of gun fire, only one officer sustained agunshot wound to his right arm, one individual sustainedfatal gunshot wounds to the torso and the suspectsustained a gunshot injury to the left shoulder.

Officer sustained two gunshot wounds to the right arm.

Notification:

On Thursday 4 February 2010, at about 1904 hours, Dispatcher#80 telephoned the Homicide Section and advised DetectiveMartin Young of a police involved shooting at 3722 Oakmont Ave.The above listed investigators responded to the scene and arrivedat about 1930 hours.

" Summary:

Preliminary investigation reveals that Detective Funk and Ryckman who aremembers of the Violent Crimes Impact Section were in the area of the 3700 block ofOakmont Ave. At this time they were involved in an exchange of gunfire with a subjectwho was on the front porch of 3722 Oakmont Ave. Detective Funk sustained two gunshotwounds to the right ann and Detective RycklT'.andid not sustain any injuries. Anindividual later identified as Dennis Gregory sustained multiple gunshot wounds to thetorso and collapsed on the front porch. Suspect Brooks sustained a gunshot wound to theleft shoulder, was able to run into this dwelling, was pursued and arrested in thebasement.

Detective Funk was transported to Shock Trauma, treated and released. DennisGregory was transported to Sinai Hospital and succumbed to his injuries at 1920hours.Suspect Brooks was also transported to Sinai Hospital by medic staff and was treated andthen released. Seven .40 caliber spent casings and numerous spent projectiles werelocated on the scene.

After suspect Brook's arrest, the address of 3722 Oakmont Ave was securedand Homicide Detectives returned with a search and seizure warrant signed by theHonorable Judge Audrey Carrion. During the search of the dwelling, the following wasdiscovered: .

A fully loaded (six shot) .38 caliber Taurus revolverTwo boxes .38 caliber ammoA bullet proof vest

And personal letters in the name of Glenn Brooks

After waiving his rights, Brooks admittedthe following: The .38 caliberhandgunwas his, he attempted to conceal the weapon in the basement after dischargingsame at the officers and the weaponwas for protectionafter his friend had been recentlyshot in the neighborhood.

Officer Involved #1: Detective Chris Funk

Detective Funk was transported to University Hospital, Shock Trauma forgunshot injuries.

On the March 24, 2010, Detective Funk submitted the following statementthrough his attorney:

On February 4, 2010, I was working 1600-2400hours. and assigned to theVCIS and working out of the Northwest District. I was wearing plain clotbes whichconsisted of cargo pants and a dark t-shirt over a white thermal shirt. My vest wasunder my shirt. I was wearing my badge in plain view on the right side of my belt. Iwas working with Officer Mathew Ryckman who was also in plain clothes.

At approximately 1900 houn, I was contacted by Sgt Elliott who advisedme that a confidential informant (CI) was going to be calling Officer Ryckman withinformation about a penon with a gun. Officer Ryckman was immediatelycontacted by the CI who advised us that "Glen" was out on his front porch and wascarrying a gun. We knew "Glen" as Glen Brooks. Brooks is someone we had spokento in the pa.st regarding criminal activity in the area. We responded to Brook'saddress on Oakmont Ave. As we arrived at the residence we did not observe anyoneon the front porch or area of the home. We drove our covert vehicle into the blockwhere we observed the CI. Officer Ryckman contacted the CI and advised himlherthat no one was on the porch and that we did not observe Brooks in the area. The CIadvised that helshe would call back. We parked our vehicle in the rear alley behindBrook's house. We exited our vehicle and were re-contacted by the CI. The CIadvised that Brooks was now back on the front porch of his house with a gun.

advised that Brooks was now back on the front porch of his housewith a gun.Brook's house is an end unit at the exit of the rear alley. We exited the alley andobserved a subject on the front porch. As I turned the corner out of the alleyI yelled upolice" to identify ourselves. A subject immediately began to discharge atus. I was struck in my right arm by the gunfire coming from the porch. In fear ofmy life and Officer Ryckman's life, I began to discharge my service weapon at thesubject. I observed a subject fall to the ground. I advised Officer Ryckman that Ihad been shot. I maintained cover on the front porch while Officer Ryckmanapproached the porch. At that time additional police units arrived on the scene.

KGA was notified of the policeinvolvedshootingand a medicunit wasrequestedfor both subjectswhowere shot and myselfwhowasalsoshot.

40 Caliber Glock 22 Semi-Automatic PistolSerial II US KKZ374

Detective Funk's weapon was recovered by Crime laboratory TechnicianMontgomery, who photographed and retained the weapon after inspection by HomicideDetective Joshua Ellsworth. Upon inspection, the weapon contained (9) live rounds, samehad been dismantled by Technician Montgomery prior to Detective Ellsworth arrival andinspection. All ammunition appeared to be departmental issued.

On the 24d1March 2010, Detective Ryckman submitted the followiDg

statemeDt through his attorney:

On February 4,2010, I was working 1600-2400hours. and assigned to the

VCIS and working out of the Northwest District. I was wearing plain clothes which

consisted of blue jeans, blue hooded sweatshirt with my vest on the outside. I was

wearing my badge in plain view around my neck. I was working with Officer Chris

Funk who was also iDplain clothes.

At approximately 1900 hours, I was CODtactedby a cODfideDtial informant

(CI) who advised me that "Glen" was out ODhis front porch and was carrying a

gun. We knew "GleD" as Glen Brooks. Brooks is someone we had spoken to in the

past regarding criminal activity in the area. We responded to Brooks address on

OakmoDt Ave. as we arrived at the residence we did not observe anyone ODthe front

porch or area of the home. We drove our covert vehicle into the block where we

observed the (CI). I contacted the CI and advised himlher tbat no ODewas on the

porch and that we did not observe Brooks in the area. The CI advised that he/she

would call me back. We parked our vehicle in the rear alley behind Brook's house.

We exited out vehicle and were re-contacted by the CI. The CI advised that Brooks

was now back out on the front porch of his house with a gun. Brook's house is an

end unit at the exit ofthe rear alley. We exited the alley and observed a subject onthe front porch. Officer Funk yelled "Police" to identify ourselves. A subject

immediately began to discharge at us. Officer Funk was struck by the gunfire

comingfrom the porch. In fear of mylifeand OfficerFunk's life,I beganto

dischargemy service weapon at the subject. Whiledischargingmy serviceweapon,I

was able to determine that there was a secondsubject on the front porch. I observed

the subject fall to the ground. I then lost sight of the other subject and did not see

him on the porch. I maintained cover on the front porch and approached. I

observed the second subject lying on the porch and he appeared to have been shot. I

handcuffed the second subject. It was apparent that the other subject entered the

house. Additional officers arrived on the scene.

I responded back to my vehicle and retrieved a body bunker. I entered the

house with other officers in an attempt to locate the other subject. Myself and other

officers entered the basement where Brooks was located hiding under a pile of

clothes. Brooks had also received a gunshot wound. Brooks was handcuffed.

KGA was notified of the police involved shooting and a medic unit was

requested for both subjects who were shot and Officer Funk who was also shot.

Detective Rvckman's Weapon:

On the 4thFebruary 20 t 0, at about 2006 hours, Detective Ryckman arrived at theHomicide Unit office from 3722 Oakmont Ave, Detective Sergeant Darryl Massey andDetective Steven Matchett inspected Detective Ryckman's service weapon and thefollowing infonnation was revealed:

Medics responded to the scene where paramedic transported the victim to SinaiHospital. The victim sustained multiple gunshot wounds to the torso and died from same.

Medical Examiners Conclusions:

On the 51hFebruary 2010, Doctor Vincenti of the O.C.M.E conducted the post-mortemexamination of Dennis Gregory, witnessed by Detectives Sydnor and Landsman. TheDoctor concluded that Gregory had sustained gunshot injuries to the abdomen, chest andleft hand. The death was ruled a Homicide/Shooting. Two projectiles were recoveredalong with a set of handcuffs that were locked to Gregory's right wrist. Although havingbeen requested by Detective Josh Ellsworth, GSR or bagging of Gregory's hands werenot completed prior to autopsy. Two projectiles were removed from the victims body andsubmitted to ECU.

Next of Kin Notified:

On 51hFebruary 2010, after Dennis Gregory had been positively identified viaMs Hicklin, Identification Section, Detective Sydnor and Landsman responded to 3610Sequoia Ave, the listed residence of Dennis Gregory. Ms Lorraine Johnson, 410".. Gregory's sister was notified of her brother's death and information known aboutthe death at that time.

Medics responded to the scene where Paramedics transported suspect Brooks toSinai Hospital where he was treated and released. The suspect sustained a gunshot woundto the left shoulder. He felt the same people who had shot his friend, Kevin Ebb, AKA, Zock onthe 2ndFebruary 2010 on the 3700 blk. Oakmont Ave. were coming after him.

He armed himself for protection

Gregory came to his house tonight

He was on the porch with Gregory and he believed Gregory didn't know hewas armed

He had gun in his pocket of his vest and the pocket was large enough so hishand was on the gun while inside the pocket

He was closer to the front door and Gregory was to the left of him

He was pacing and looking down the alley, looking for anyone "creepingdown the alley"

He was shot at first and he shot back at the same time running into the house

He emptied his gun and dropped the shells in the house

He ran to the basement to retrieve more bullets

He was going "lay" at the bottom of the basement steps

Then he heard "them" announce "police"

He put the gun up and ran back downstairs and told Tarsh to hide

As Brooks ran through the front door he closed it behind him leavingGregory on the outside

He heard Gregory say, "what y'all doing, I just sitting here"

He got six more bullets from under the basement bed

He further describe the police as creeping down the alley and when he got a"visual", Brooks spooked the police

Lastly, Brooks indicated no one announced police and he felt the police wasspooked and were not expecting anyone to be on the porch.

The statement began at OI40hrs.and ended on 0234hrs., on the SibFebruary 200 I.

After the interview, Brooks was subsequentlytransported to Central Booking andcharged with the following criminal offenses:

Two counts attempt marder

Two counts rll'Stdegree assault

Handgun violation

Felonyin possessionof a handgun

Primarv Officer's reDOrt:

On the 411IFebruary 2010, at about 190I, Officer Jazmin Nunez from theNorthwestern District reported she responded to the area of Reisterstown Road andOakmont Avenue for a "signal 13", officer in distress call. At that location, shediscovered a shooting scene. Dennis Gregory was found on the front porch of 3722Oakmont Ave. having sustained apparent gunshot wounds to the upper body. Medic 14transported Gregory to Sinai Hospital where death was pronounced at approximately1920hrs., by Doctor Zuberi. Responding officers also located Glenn Brooks in thebasement of 3722 Oakmont Ave., and observed that he had sustained gunshot injuries tothe left shoulder. He was subsequently transported to Sinai Hospital by Medic 8.

In addition to the aforementioned subjects, responding officers found DetectiveFunk at the scene having sustained gunshot injuries to the right arm and he wastransported to Shock Trauma by Medic personnel. Detective Ryckman was also located.Mobile Crime Lab Technicians Silbaugh, Layne and Rivera processed the scene.

Officer Jonathan Mackensen, H947, submitted the followingtyped statementtoMajor John Hess on the 411IFebruary2010:

Sir,I respectfully report the following: While conducting crime suppression in

the 3700 Block of Garrison Blvd., a shoots rll'ed call came out for the 3700 block ofOakmout. I responded to 3700 block of Oakmount Ave. as a 10.16 unit. Uponarrival I observed Det. Funk standing in front of 3712 Oakmonnt holding his rightarm, suffering from a gun shot wound. Det. Ryckman was on the front porch of3722 Oakmount Ave. placing an unknown male in handcuffs. Det(s) Funk andRyckman advised myself that another suspect ran inside of 3722 Oakmount Ave. Ithen went to the rear of 3722Oakmont to securethe rear of thehouse...

Officer Mackenson further reported that he responded to Shock Trauma andrecovered Detective Funk's pants and departmental vest and submitted both items to theECU, property number 10006485. He also returned the following items to Detective Funkprior to the Homicide detective's inspection:

then madeentry through the front roomwindowusinga crutch to break the glassand openedthe door for other respondingofficen.Det.Dipaolausinga bunkeralongwithmyselfcleared the upstairs rooms.At that point we then respondedto thebasementlocationwherewehelpedclear the basement.The secondsuspectwaslocatedand then placed under arrest."

Officer Witness Statement#3:

Detective Momodu Gondo, H832, submittedthe following typed statement toMajor John Hess on the 41hFebruary2010:

"Sir,I respectfully report the following: While conducting crime suppression in

the 3700 Block of Garrison Blvd, a shots fired call came out for the 3700 Blk ofOakmount.1 responded to the 3700 Blk ofOakmont Ave as a 10-16unit. Uponarrival I observed Det. Funk standing in front of 3722 Oakmount holding his rightarm, suffering from a gunshot wound. Det. Ryckman was on the front porch of 3722Oakmount Ave. placing an unknown male in handcuffs. Det(s) Funk and Ryckmanadvised me of another suspect who was inside of 3722 Oakmount Ave. I gainedentry into the dwelling and located the second suspect in the basement, who wasplaced under arrest."

Officer Witness Statement#4:

Detective Dave Moynihan reported the following on the 4thFebruary 2010:

On 4thFebruary 2010, at about 1910 hours, he arrived on the scene at 3722Oakmont Ave. for a report of a shooting. He observed medics working on an unknownblack male on the porch. A second male was leaning against the wall, DetectiveMoynihan verbally advised this person later identified as Glenn Brooks, of his rights.Detective Moynihan asked Brooks what happened and Brooks replied, "I was on theporch with DeMis, I saw people come out of the alley shooting. I saw Dennis shooting."

Officer Witness Statement#S:

Detective Sergeant Parker Elliott, submittedthe following typed statement toDetective Marvin Sydnor on the 91hFebruary2010 after conferring with him on the 81hFebruary2010:

"Sir,I respectfully report that in reference to the police involved shooting that

occurred on February 4th,2010 at the location of 3722 Oakmont Ave this Sergeant isreporting events that took place in which this Sergeant was involved in prior to theabove mentioned shooting which was reported under CC#10681695.

On the date of 2//4/10 this Sergeant began a secondary employment shiftwhich the hours were 1600 hrs to OOOOhrs.This Secondary employment assignmentwas located at the Guilford Ave bomeless shelter located at 210 Guilford Ave.

While working this secondary employment this Sergeant received a phone callvia my Departmental Cell phone ( in which registered confidentialinformant Dennis Gregory called me on a phone number that was not recognized by

t~s serlant~The phone number used by Gregory to contact tbis Sergeant was( .This phonecall occurredat approximately1849hrs.Gregory immediately informed me that he has knowledge of a person

carrying a handgun and inquired if units were available to make an arrest. ThisSergeant informed Gregory that Detectives Ryckman and Funk were believed to beworking and should be available to investigate.

Ryckman and Funk are somewhat familiar with Gregory just as Gregorywas somewhat familiar with these two Detectivesdue to a prior investigation thattook place several month earlier, Ryckman registered Gregory as a confidentialinformant though Gregory was handled by this Sergeant with Ryckman assisting intbe handling on several occasions.

This Sergeant immediately instructed Gregory to contact Ryckman and givehim this information. Gregory informed me that he did not have Ryckman's phonenumber. Tbis Sergeant quickly provided Gregory with Ryckman's phone number( , not a departmental cell)and instructedGregoryto immediatelycontact Ryckman and give him tbis information. Gregory agreed and tbe cell wasterminated. Immediately after hanging the phone up with Gregory tbis Sergeantcontacted Detective Funk on bis cell phone ( not a departmental cell)at approximately 1850 brs and informed Funk that Dennis Gregory will be callingRyckman witb Information regarding an armed person.

Tbis Sergeant contacted Funk to insure tbat Ryckman was avaoable to takeGregory's call. While on the phone with Funk this Sergeant overheard Funk informRyckman that "0" is going to call In a few seconds with a guy witb a gun." ThisSergeant overbeard Ryckman state "I think tbis Ishim rigbt now." I asked Funk ifthe call Ryckman was receiving was Gregory and Funk responded by saying "yaSarg its him we got it." I instructed Funk to contact me after they investigatedGregory's information and let me know how it turned out.

At approximately 1900 hrs Lt Tim Devine, who is my VCIS supervisor,called on my Departmental cell phone. It was at this time that This Sergeant learnedthat Funk had been shot in a police involved shooting which took place at Oakmontand Reisterstown Rd.

At this time this Sergeant immediately left my secondary employment andplaced myself on duty and responded to the scene to ensure crime scenepreservation and officer well being. Once it was learned that all crime scene

His sister Latasha Bradshaw, BIF, 11 was downstairs In the Uvingroom

Heard multipleshots

Looked out his bedroom window saw uniformed officer pointing his gun

Didn't see this officer fire his weapon

Latasha ran upstairs, yelling she was afraid

Heard police banging on the front door and smashing windows

Police ran upstairs, checked all rooms

Was ordered by police to put up his hands and lie on the floor

All three were ordered outside

Crime Scene

The neighborhood is located in the Northwestern area of Baltimore City, in thefront and alley adjacent to 3722 Oakmont Ave., an end row house brick dwelling. On thesouthwest side of 3722 Oakmont Ave. seven .40 caliber casings were recovered. On thegrass lot southwest of 3722 Oakmont Ave. a .45 caliber casing was also recovered. (It isto be noted in reference to non-fatal shooting, 2 February 2010, five .45 caliber casingswere also recovered, IOB00645).Suspected blood was observed on the pavement andsteps leading up to 3722 Oakmont Ave. On the front porch of this location, a red shirt,broken cell phone, a hat and a projectile in the shirt were recovered. One metal crutchwas observed on the front porch leaning in a broken first floor window closest to the frontdoor, another crutch was on the pavement leading to 3722 Oakmont Ave. Suspectedbullet damage was observed on the front door and the underside of the roof of 3722Oakmont Ave. and 3720 Oakmont Ave. Three fragments were recovered from thisunderside of the roof to 3722 Oakmont Ave.

After a search warrant had been secured the interior of 3722 Oakmont Ave was

processed. Concealed in the wall leading to the basement was .38 caliber Taurushandgun, serial 1689547. Under a bed, two boxes of .38 cartridges were also seized,along with personal papers in GlelU1Brook's name. Two metal fragments were recoveredfrom the living room and a projectile was recovered from the basement floor. Suspectedblood was also recovered from the wall at the bottom of the basement stairs. A bullet

proof vest was recovered from the dilU1ingroom table. The scene was processed byMobile Crime Technicians Layne (T491), Riveria (S756) and Silbaugh. The weather wasclear and cold.
