1. Upgradation: In the context of this policy, pay scale

will mean placernent of the non-executive employee from his

non-executive pay scdle to the next higher non-executive IDA

Ct. Qualifying Service Conditions:-

il.1 A11 the four upgradations frorn existing non executive IDA pa;g scale to the

next higher non-executive IDA pay scale of individual Non-Execut.ive employee

rviil tre considered on completion of 8 (Eight) years of Qualifying Service in the

current non-executive IDA pay scales. The Pay-fixation methodologr wili be

gloverned by the provision of Para 6.1 below.

il.z Such non-Executives who have been recruited by DoT prior to

01/10 I2OOO will, as a concession, be considered forTime Bound IDA pay scale

up-gradations in the followi.ng manner:-

a. First Time Borund iDA pay scale up-gradation to the next

higher non-executive, IDA pay sca-le will be considered after 4 years

of service in the IDA pay scale held by the employee as on

OIIIOI2OOO. This pay upgr:adation wil l be notional i f the <late of

upgradation is befo.re OIl04l2OO8. The actual benefits of pay

fixation wil l be paid only from 0Il04l2OO8.

b. Second Time llound IDA pay scale up-gradation to the next

higher IDA pay sca-L: will be considered after 7 years of service in

first upgraded non-e.xecutive IDA pay scale.

i3.3 Service rendered by a Non-Executive employee in BSNL in a Non-

Executive IDA pay scale only will be counted as Qualifying Service.

3.4 The qualifying service conditirons indicated above will only enable the Non-

Executive for "consideration" for up-gradation to the existing next higher non-

cxecutive IDA scale. Completion of such period alone shall not entitle any Non-

lDxecutive for automatic up-gradation to the next higher IDA scale.

r$. Up-gradation Criteria:-

,+.1 Review: The review lor upgradation to the next higher non-executive IDA

pay scale in case of all Non-Executive employees meeting the above qualifying

service conditions will be rlone every year with reference to review date i.e. on

1st October. On being found fit, the upgradation will be effective from the due

date.

+.2 The fitness for up-gradation to the next higher non-execul.ive IDA scale of

the eligible Non-Executives will be judged by the prescribed Screening

Committee on the basis of performance rating of ACRs/APARs of previous 5

(five) years as per the criteria laid down in para 4.3 and subject to the condition

that the Non-Executive is free from disciplinary/ vigilance angle and no

punishment is in currency, The screening Committee shall consist of ;

1. One officer, just below the level of SSA Head but not belo.w the rank of

SDE as Chairman

(ln circle Offrce and in SSAs headed by GM anci above levr:l officer, thechairman of the Screening committee will be of the level of DG.M)

2. Two officers, one level below the level of the Chairman

15. Option to Continue in erstwhile time bound promotion schemes:

r5.1 All the Non-Executi.ve employees will automatically and uniformly be,:overed by this promotion policy. Existing OTBP/BCR/Grade-iV'/ ACp policy'will cease to exist from the date ol'notification of this Non-Executive promoLion.Policy, as a general measure. An individual non-executive ennployee ffi&y,.however, opt to remain out of the purview of this scheme to continue in his,erstwhile time bound promotion scheme. Such option to remain out of thepurview of this poiicy will have to be exercised within one month .[rom the datethe circle authority/ SSiA Hea<1 asks for such option at the time of:implementation of the policy with reference to the Iirst review date. if option is.not exercised within the stipulated time period, it would be constned as if the,3oncerned Non-Executive has opted for this Non-Executive Promotion policyiand accordingly he/she will be gov'erned by the provisions of the l{on-Executive.Promotion Policy. !i.2 The promotion of sur:h person who opts to continue in his/.her erstwhiletime bound promotion schLeme viz., OTBP/ BCR/ Grade-lV/ ACP etc. wili be6loverned by the provisionsi of suctr schemes as existed on 01.10.:2000 i.e. thedate on which BSNL was ,formed, unless any change is specifically ordered oragreed to by the BSNL Management a-fter issue of this ponicy. All theconcessions given by BSNL to Non-Executives in relation to OTBP/BCR/ Grade-N I ACP etc. after O1.10.2000 stands withdrawn with immediate effect.l{owever, the cases settled prior to the issue of this order, need not be reopenedunless the employee himsel.f opts for this Non-Executive Promotion Folicy.

li. General Principles:-

6.1 In the pre-revised pay scales, the pay frxation of Non-Executives, on Timebound IDA pay scale upgradation as per this order, will be done in the nextnon-executive IDA pay sca.Le at the stage next above the notional pray arrived atby increasing his pay - in the lower pay scale held by him prior to up-gradation- by an amount equa-l to one increment, or Rupees one hundred only, whicheveris more. On switchover to revised pay sca-les after l/ll2OO7, pay fi:xation will ber:arried out as per pay fixa,tion principles enunciated in the pay revision order,,"vhich is yet to be issued.

t6.2 Time bound IDA pay scale up-gradations are not linked with theavailability of posts and thus, the provisions relating to application of rostersare not applicable. However, as a concession to SC/ST employees, the gradingr:riteria have been relaxed for SC/ST employees in comparison to OC employees.

t6.3 Time Bound IDA pay scale upgradations are personal to 1on-executiveconcerned and no claim what-so-erv'er can be made by comparison on grounds ofrseniority, class, community, cadre, stream etc. Further, except as provided inthe instant guidelines, there will be no claim on account of any of the other;provisions of FRSR in the context of pay scale, pay fixation, substantive statusr:tc.

t6.4 Upgradation in Pay scale availed by a non-executive employee on thelbasis of existing orBp/BCR/Gnade-IV/ACp scheme etc. or by way ofr:onversion/restructuring/trlay scale upgradation etc. after OIllOl2O0O andlbefore notification of this new policy will be treated as the first upgradationrunder the new policy. The concerned employee ffi&y, however, opt for firstupgradation as per this policy by frrregoing the promotion already availed undertihe erstwhiie orBp/BCR/Grade-IV/ACp schemes etc. or by way ofconversion/restructuring/pay scale upgradation etc.

6.5 Upgradation in Pay scale availed by a Non-Executive employee on thebasis of any post based promotion on or after OL/LO/2OOO and before011 lo 12004 will be treaterl as first upgradation as per pa_ra 3.2 (a) above.

15.6 in case a Non-Executive employee has availed an Upgrarlation in payscale on the basis of any post ba.sed promotion a-fter OI/Iol2og4 and beforenotification of this policy, his second Time Bound IDA pay scale upgradationsunder this policy will be crrnsidered as per provision of para 3. 1 6r para 3.2(b),ir's per appiicability, by co,unting his eligibility from the date of the post basedpromotion, and by granting him Time Bound IDA pay scale upgradations overthe pay sca-le held by him a_fter the post based promotion.

6.7 Review is to be done on time bound basis at the SSA level for all SSAcadres and at Circle level for all Circle cad.res. For the non-executive staff ofcorporate ofhce, the revierv will be done by the corporate office.

6.8 Consequent to up-gr:adation of IDA pay scale as per this potricy, there wiilbe no change in the substerntive status of the Non-Executive.

U. Post Based Promotion Policy

(i) Post Based Promoti,cn will continue along with the Non-Executive Time'Bound Promotion Polic'y, in the cases where post based promotions already

exist. Such regular promotions will continue to be regulated as per theprovisions of the Recruitment Rules of the posts already notified/ to benotilted by BSNL. Management ieserves the right to review & revise thesanctioned strength based on workload, justification & new nolms in variousscales.

ii) Consequent to any post based promotion, where IDA pay scale on regularpromotion is same as that of IDA pay scale in which the Non-Executive isplaced under Non-Executive 'lime bound Promotion Policy, prior to his'regular

promotion, the pay of ttie Non-Executive will be fixed bir granting oneincrement in his existi:ng IDA pay scale. However, in cases where the non-executive pay sca-le, in rvhich he is placed before the post based promotion, ishigher than that of the promoted post, then no pay fixation will be ailowed.Further, except as proi,'ided in the instant guidelines, there will no claim onaccount of any of the olher provisions of FR SR in the context of pay scale's,pay fixation, substantive status etc. On regular post based promotion to the

. Non-Executive post carrying higher responsibility - in such caises where theIDA pay sca-le which the Non-Executive is carrying due to Non-ExecutivePromotion Policy is less than th.e pay scale of the post to which the employee

is being promoted - the pay in the promoted post will be fixed as per Para 6.1above.

Necessary action mag immediately be taken for implementation of Non-

Executiue Time Bound Pro;motion Policy on a time bound basls and aII out efforts

be rnade to complete the exercise within 4 months from the issue of this order in

respect of all eligible Non-Exectttiues with reference to reuieut clates 01/10/2004

to 01/10/2009. In so far as the implementation of the Post Based Promotion

Policg is concerrted, the same will be carried out as per the exisl.ing guidelines

perTaining to different cadres.

Kindly refer to this Office letter No. 27-7/2OOB-TE-II dated 23/03/2010, videwhich Non-Executive Promotion Policy (NEPP) for employees of IDA pay scales of NE- 1 toNE-10 of BSNL has been circulated. After issuance of the NEPP, this Section has receivedletters from various Non-Executive Unions as well as various Telecom Circles, seekingclarifications with regard to implementation of NEPP.

The matter has been examined in this Office and it has been decided to issueadditional clarifications with regard to the points raised by these Unions and TelecomCircles. Accordingly, the points raised and their clarifications are enclosed herewith asAnnexure. In the light of the clarifications given in the Annexure of this letter, it isrequested to accept fresh options from the Non-Executives covered under Non-ExecutivePromotion Policy (NEPP), as per Option Form-I and Option Form-II, if they want to changetheir earlier option, in accordance with the instructions contained in point no. B of theseclarifications.

Subsequently, the Hon'bleSupreme Court has granted stay on the saidordeis and as a result, those who already gotthe benefit are allowed to continue with thebenefit and those not yet got the benefit arenot given any further favourable orders by theCouits. Some officials got OTBP pay scale inTM cadre by counting RM and TM servicetogether before OI I 1O l2OOO, making themeligible for first upgradation under NEPP onOI I IO 12004 and some got the same OTBP payscale after 01lIOl200O, making them eligiblefor second upgradation under NEPP after

Since the matter is sub-judice, the cases of theseTelecom Mechanics of boththe categories may be keptpending. These cases may besettled after outcome of thecases pending in variouscourts of law.

3 Some officials, appointed as TelecomMechanics before Ol I 10 l2OOO, were promotedas TTA in the year 2008. Whether theseofficials may be granted first upgradation inthe scale of Telecom Mechanic fromor I ro l2oo4 ?

These officials may begrantecl first upgradation byplacing them in the nextimmediate higher Non-Executive IDA pay scale fromOI I lO l2OO4 notionally andactual benefit w.e.f.OIIO4/2OO8 and the postbased promotion got in theTTA cadre in the year 2008may be treated as theirsecond financial upgradationunder NEPP.

4 Whether the merger . of some posts withanother post of higher pay scales involvingupgrhdation in the pay scales is to be treatedas first upgradation under NBPP ?

Yes. As per the instructionscontained in Para 6.4 ofNEPP Order dated23 I 03 l2O1O, anyupgradation in the pay scaledue to any reason is to betreated as the firstupsradation under NEPP.

Wfuether the ACRs of the non-xecutives are to be considered

for the previous five years fromthe due date of promotion or fromthe date of DPC/ScreeningCommittee in the cases where ininancial upgradations were to be

nsidered from the back date ?

As per Para 4.2 of NEPP Order dated23lO3l2O1O, the ACRs of the non-executives are to be considered forthe previous five years from the duedate of financial upgradation underNEPP.

their option.

These officials may be allowed tochange their initial optiohs as aonetime measure within 30 days fromthe issuance of this letter.Accordingly, options may be called forfrom the employees. However, theoptions exercised in pursuance tothis clarification will be treated asfinal and cannot be changed underany circumstance. No furtherextension to furnish ,option exceptabove may be allowed.

In the case of some officials dueto court orders, the date of BCRGr. III promotion was preponedto the year 2OO2 on par withtheir immediate juniors and theywere placed in the PRC pay scaleof Ntr-g. Thereafter, oncompletion of 26 years of servicein the year 2005, they wereplaced in the higher RC payscale of NB- i0. In this case,which date is to be taken as firstfinancial upgradation underNEPP ?

In this case, since the payupgradation of the officials happenedprior to Ol I lO l2OA4, the date ofpreponment of BCR Gr. III promotioni.e. 2OO2 is to be treated as the firstfinancial upgradation under NEPP.Thereafter, since the placement of theofficials in the higher pay scale of RChappened after OI I lO l2OO4, the dateof actual completion of,.26 years ofservice i.e. 2005 is to be treated asthe second financial upgradationunder NEPP.

held during the earlier promotionmay be placed on record and

nsidered by the prescribedreening Committee for the

urpose of granting firstpgradation under NEPP.

Para 3.1 of the above mentioned Office order should be read as follows:

3'1 "Annual increment will be at the rate of 3o/oof the revised basic pay. ln case ofcalculation of increments under the revised pay structure, paise should be ignored,but any amount of rupee or more should be rounded off to next multiple of 10. Toillustrate, if the amount of increment comes to Rs. 1g00.70 paise, then the amountwill be rounded off to Rs. 1900; if the amount of increment works out to Rs. 1g01,then it will be rounded off to Rs. 1910."

Sir,References have been received from several field units seeking clarification on exercise of

option for fixation of pay from the date of promotion afret 1.'' .2007 in respect of Non-executives with

reference to Para 3.6 of this office order No.1-16/201o-PAT (BSNL) dated 7.5.2010.

2. The matter has been examined in consultation with BSNL Finance and accordingly, it is

clarified that the Non-executives, who got promotion/financial upgradation under ACP Scheme from

Non-executive grade to Executive grade between the period 1.1.2007 i.e. the date of revision of IDA

pay scales and 7.5.2010 i.e. the date of issuance of Ofiice Order No.1-16/201GPAT(BSNL) may be

altowed to exercise of option for fixation of pay in the revised pay from the date of theirpromotionffinancial up-gradation under ACP Scheme.

3. Regarding furnishing of option for revision of pay from the date of next increment, the non-

executive can opt from the DNI in the existing scale if the next increment falls subsequently to 1-1-

2007.

4 Any change of option as per this clarification shall be exercised in writing within one month

from the date of issue of this order.
