And real estate analyst Mike Orr, ofArizona State University’s W.P. CareySchool of Business, recently told me theValley’s housing market is finally back tonormal.

Normal is very good for the area’shousing market after the boom and dev-astating crash.

So what what does “normal” mean?» Almost 88 percent of all home sales

in June were for regular sales and nottied to foreclosure. Only three years ago,nearly half of all Valley home sales wereforeclosures, short sales and houses tak-en back by lenders and resold at bargainprices.

» The median price of a house is upabout 6 percent from a year ago. That’ssimilar to housing appreciation in the re-gion before the boom/bust and is consid-ered healthy.

» About half of all houses sold in Junewere priced from $200,000 to $500,000.Too many bargain-priced houses willpull down prices as they did in 2011.

Question: We havemade a significantamount of money sincewe began investing inthe stock market in theearly 1980s.

We are concerned about the recentvolatility of the stock market, howev-er, and we would like to “cash out” ourinvestments at their current higherprices. We would then use the saleproceeds to buy a small parcel of landin Payson to build our retirementhome.

Would this transaction be a tax-free exchange? Or would we have topay income tax on the capital gainsthat we have made on our invest-ments in the stock market?

Answer: A taxpayer is only eligi-ble for a tax-free exchange of invest-ment property under Section 1031 ofthe Internal Revenue Code if “likekind” investment property is beingexchanged.

Inasmuch as your investments inthe stock market are personal prop-erty, and the Payson land is real prop-erty, there is not an exchange of “likekind” investment property.

Therefore, you will probably haveto pay capital-gains tax when you sellyour investments in the stock mar-ket.

In general, the exchange of any in-vestment real estate is a tax-free ex-change under the Section 1031 rules.For example, exchanging a rentalhome for raw land, and exchangingan office building for a warehouse,both should be tax-free exchanges.

Glass tile continues to gain marketshare, with more sizes and styles avail-able. At the same time, the half-inchdeco and smaller linear tiles are be-coming less popular.

Because of its high-quality produc-tion, porcelain tile is being widely usedfor its beauty and because its low po-rosity makes it extremely practical forboth residential and commercial, Sut-ton said.

Wood

Hard surfaces for flooring, with arearugs rather than carpeting, have be-come prevalent, even in bedrooms.

“Wood flooring is gaining momen-tum as more aesthetic options and prac-tical cost-effective choices becomeavailable,” he said.

Reclaimed wood, harvested from oldbarns and farmhouses, for example,still is popular, and an engineered ver-sion is available from some manufac-turers. Engineered wood is real wood atthe top but has the crisscross pattern ofplywood below to keep it from warpingand cupping.

“It solves many problems in dura-bility and longevity,” Sutton said.

For room logistics, too: The slabheight does not have to accommodate

that extra layer of plywood. Sutton always checks the Janka

ratings for wood use, especially forfloors. This hardness test measures thedenting resistance of wood, from hard,such as ironwood, to soft, such as pine.

For example, there are many sub-species of wood recognized as walnutor oak that vary in Janka ratings.

“Wood density, which will identify itsdurability, helps a designer select notonly aesthetic choices but practicalones as well,” he said.

“The better quality can deceive evena veteran designer into believing it’s anatural stone without seeing the edgeof the material,” he said. “Huge sizesmake a very grand impression.”

Concrete

Concrete floors, often integrallycolored, polished and scored, are pop-ular again, and they’re being used notonly in contemporary desert design butalso for a modern cowboy-ranch style,which has shown renewed interest inthe Valley. Concrete tiles in great sizesare appearing, too, Sutton said.

Carpeting

“The carpet industry has respondedto health concerns with improved com-positions and performance,” Suttonsaid, explaining that many carpets nolonger have traditional jute backing,which is organic, absorbent and capa-ble of molding.

New synthetic backings are easier toclean, he said, and pads now have amoisture barrier to prevent holdingmoisture and odors. The best carpetcomposition also will not support dustmites, which can cause allergies.

Boivin said that before making afinal flooring selection, the first ques-tion you should ask is: “How do I wantto feel?

“Do I want a clean look? Do I want asoft, subtle look? Or a strong, bold andconfident look? Then choose a solid,confident color. Do I like to stand out inthe crowd? You can do that with a boldexplosion of pattern with high con-trast.”

Back to school time isfull of hope and energy.Here are some safety tipsfor protecting our kids.

Buddy system: If youare a parent in an apart-

ment community, look for other parentswho are sending their kids on the sameschool buses or public transportation.Create a buddy system so your kidsknow a couple of schoolmates as they

board the school bus. If your student isriding on public transit, this is especiallyimportant. Students riding alone shouldpractice the transit routes a couple oftimes with parents to gain confidence inthe system.

Practice the route: For children whoare able to walk to school, take the timeto show your student the best route andways to walk safely. Show your studentshow to use the sidewalks and crosswalks.

Bicycle safety: Be sure that your stu-dent wears a fitted helmet and knows therules of the road. Bike locks are a must.

Practice coming home: Be sure yourchildren know how to get into theirapartment and lock the door. Talk withyour manager and let them know yourstudents may be home in the afternoon.If there’s a common area for your stu-dents to study, and they are of an appro-priate age for the community room, re-

view the rules.As drivers, riders and neighbors, ev-

ery one of us must take responsibility toensure our kids get to school and homesafely. Be cautious of bicycle riders asthey get accustomed to their routes. Stopwhen you see school buses stopped inyour area. Slow down in school zones.

Question: I had a tenant who first had abreak in through the front door, and we replaced itat the landlord’s expense. Then, they had a brokenwindow. Is a broken window similar to when youlease a vehicle where windshield damage is alessee’s responsibility?

Also, when a tenant vacates at the end of the leaseterm, but doesn’t return the keys, can the landlordmake entry to the home?

Answer: The landlord would be responsiblefor repairing the broken front door and windowunless the landlord can show that the tenant causedthe damages. Otherwise, this is just consideredmaintenance for the property which is thelandlord’s responsibility. If the tenant did not causethe damage then they would not be responsible forthe repair costs.

Generally speaking, when a tenant vacates, butdoesn’t return the keys, they have not surrenderedpossession of the rental property to the owner. Ifyou go in you run the risk of the tenant claimingyou made an unlawful entry and they can ask forone month’s rent or actual damages, whichever isgreater. (missing jewelry, cash etc.) If you can getsomething in writing from the tenant that they havevacated and you can take possession, that would befine. Otherwise, you would probably want to eitherdo a notice of abandonment self help process oryou could file for an eviction because the tenant isessentially holding over by not returning the keys.It is always a good idea to photograph the propertyafter the tenant vacates, so there is no doubt aboutwhat was in the premises when it was returned tothe landlord.
