RE: Biological Resources for the Eagle Mountain Megasite

IntroductionIn September 2019, CV Properties, LC. contracted with CRS Engineers (CRS) to provide environmental resource database research, field evaluation, and technical reporting for a potential 490-acre development site in Eagle Mountain, Utah. CRS conducted both a desktop evaluation and on-site evaluation (performed on October 7–9, 2019) evaluating the 490-acre survey area for biological resources. Desktop evaluations included a literature search of potential Threatened and Endangered (T&E), and Candidate species from:

• The US Fish and Wildlife Service (USFWS) Information, Planning, and Conservation (IPaC) System; and • the Utah Division of Wildlife Resources (UDWR) Conservation and Wildlife database.

Study Area ConditionsThe study area is an operational sod farm consisting of three pivots, each with a diameter of one-half mile (see Figure 1). The study area measures 490 acres and is comprised of three half-mile squares on which the three pivots operate. The study area is located in Section 26, Township 6 South, Range 2 West (see Figure 2). Soils in the study areaa have been disturbed by sod farming activities. The sod farm grows Kentucky bluegrass (Poa pratensis). Soils in the study area that are not cultivated are routinely disced to prevent weed growth and limit the spread of weeds into the sod (see Photos 1–2). Soils are heavily disturbed; the study area is made up of Cheebe silty clay loam.

Literature SearchEndangered Species Act (ESA) Listed Species Using data obtained from the United States Fish and Wildlife Service (USFWS) Information Planning and Conservation (IPaC) System database, CRS evaluated threatened and endangered species that may be present within the study area. Species that warrant ESA consideration include Canada lynx (Lynx canadensis), June sucker (Chasmistes liorus), and Ute Ladies’-tresses (Spiranthes diluvialis) (see Table 1). No critical habitat was identified within the study area.

RE: Biological Resources for the Eagle Mountain Megasite

IntroductionIn September 2019, CV Properties, LC. contracted with CRS Engineers (CRS) to provide environmental resource database research, field evaluation, and technical reporting for a potential 490-acre development site in Eagle Mountain, Utah. CRS conducted both a desktop evaluation and on-site evaluation (performed on October 7–9, 2019) evaluating the 490-acre survey area for biological resources. Desktop evaluations included a literature search of potential Threatened and Endangered (T&E), and Candidate species from:

• The US Fish and Wildlife Service (USFWS) Information, Planning, and Conservation (IPaC) System; and • the Utah Division of Wildlife Resources (UDWR) Conservation and Wildlife database.

Study Area ConditionsThe study area is an operational sod farm consisting of three pivots, each with a diameter of one-half mile (see Figure 1). The study area measures 490 acres and is comprised of three half-mile squares on which the three pivots operate. The study area is located in Section 26, Township 6 South, Range 2 West (see Figure 2). Soils in the study areaa have been disturbed by sod farming activities. The sod farm grows Kentucky bluegrass (Poa pratensis). Soils in the study area that are not cultivated are routinely disced to prevent weed growth and limit the spread of weeds into the sod (see Photos 1–2). Soils are heavily disturbed; the study area is made up of Cheebe silty clay loam.

Literature SearchEndangered Species Act (ESA) Listed Species Using data obtained from the United States Fish and Wildlife Service (USFWS) Information Planning and Conservation (IPaC) System database, CRS evaluated threatened and endangered species that may be present within the study area. Species that warrant ESA consideration include Canada lynx (Lynx canadensis), June sucker (Chasmistes liorus), and Ute Ladies’-tresses (Spiranthes diluvialis) (see Table 1). No critical habitat was identified within the study area.

IntroductionIn September 2019, CV Properties, LC. contracted with CRS Engineers (CRS) to provide environmental resource database research, field evaluation, and technical reporting for a potential 490-acre development site in Eagle Mountain, Utah. This memorandum includes a summary of CRS’s findings regarding on-site water resources.

Study Area ConditionsThe study area is an operational sod farm consisting of three pivots, each with a diameter of one-half mile (see Figure 1). The study area measures 490 acres and is comprised of three half-mile squares on which the three pivots operate. The study area is located in Section 26, Township 6 South, Range 2 West (see Figure 2). Soils in the study area have been disturbed by sod farming activities. The sod farm grows Kentucky bluegrass (Poa pratensis). Soils in the study area that are not cultivated are routinely disced to prevent weed growth and limit the spread of weeds into the sod (see Photos 1–2). Soils are heavily disturbed; the study area is made up of Cheebe silty clay loam.

Waters of the United StatesCRS performed a site evaluation of the study area on October 7–9, 2019. No water resources were located on site. According to the United States Geological Survey (USGS) Information System Mapper, one inactive and one active groundwater well are located on the west side of the study area (see Figure 3 and Photo 3). A search of the US Forest Service National Wetland Inventory showed a riverine feature running through the middle of the study area. This riverine feature is classified as an intermittent stream (see Figure 3). However, no stream bed was identified during the site visit, nor was it identified during an examination of historic aerial photographs or historical topographic maps.

FloodplainsWhile no flood map has been created for the study area, a flood map within 0.5 miles is available and indicates that the area is nearby the Federal Emergency Management Agency (FEMA)-designated “Area of Minimal Disturbance, Zone X.”

INTRODUCTION The project site is in Fairfield, Utah which currently has no existing rail access to the area. A new railroad

industrial lead will need to be established to service the Fairfield Megasite and consequently allow for future rail

access in neighboring regions. The three nearest rail lines where a connection could be established are the Provo

Subdivision (Sub) located 12.5 miles northeast of the project, Lynndyl Sub located 19 miles west of the project,

and the Tintic Industrial Lead historically located 20 miles south of the project.

EXISTING CONDITIONS Provo Subdivision (UP owned w/ BNSF trackage rights)

The Provo Sub is located northeast of the project area and is located within a heavily urbanized area which

extends 5-8 miles around the rail line. The shortest route from the Provo Sub to Fairfield would begin in Lehi,

Utah and would bisect other communities which exist between the Provo Sub and the project location. The

advantage of the Provo Sub is dual access by UP and BNSF would allow for more competitive rail service to

industries located along the proposed Industrial Lead. On the other hand, the change in elevation between

Nephi and Fairfield would cause the most aggressive grades to be located along this route. The cost of

relocating families, buildings, and industries to provide a desirable route from Lehi is considered prohibitive and

no cost estimate was made for this alternative.

Lynndyl Subdivision (UP owned)

The Lynndyl Sub stretches from Milford, Utah and passes through the Tooele Valley where it then heads east

along Interstate 80 to Salt Lake City, Utah. The track parallels Highway 36 where the anticipated rail connection

would occur.

Union Pacific is the only railroad which operates on this line. The proposed rail connection would be located

between mileposts (MP) 720 and 734. The existing rail weight through this corridor is either 133# or 136# rail

(based on UP condensed profiles). Within this corridor the prevailing turnout type and size is a powered No. 14

turnout which is operated remotely (based on UP condensed profiles). Other turnouts located on the track vary

between powered No. 10s, No. 15s, & No. 20s. The largest bridge along the main is a precast concrete beam

bridge located at MP 734.1 with a span of roughly 40 feet where it bridges a drainage. Small culverts are spaced

at irregular intervals under the mainline. Trains speeds through this area are typically between 60 and 79 miles

per hour. There are no existing communities located between the mainline connection and Fairfield which

would be benefited by a new rail line in this area, although this alternative provides for future growth along a

new industrial lead.

Tintic Industrial Lead (UP owned w/ BNSF trackage rights)

The Tintic Industrial Lead connects to the Provo Subdivision in Springville, Utah and has been abandoned along

a portion of the line. Historically the tracks extended through and west of Elberta, Utah which is of a similar

geographic and demographic nature as the region surrounding Fairfield. The historic location of the tracks is

NAAQS can be evaluated according to regional concentrations (a county) and residential areas (individual cities) so as to monitor large sources of pollutants. A majority of standards within the state of Utah are evaluated according to county. In locations where large populations exist (i.e., Provo, Salt Lake City, Logan), additional status results may apply. Because the project is located within a rural location, only county status results are available to determine the non-attainment/maintenance status of the project area.

Non-attainment StatusAs of October 21, 2019, the proposed project is located within a non-attainment area for the criteria pollutant PM10. All other criteria pollutants including particulate matter 2.5 microns or less (PM2.5), carbon monoxide (CO), and ozone (O3) are in compliance with NAAQS. NAAQS for PM10 are violated if an area exceeds 150 μg/m3 more than once per year on an average over three years for 24 hours or longer. In other words, four exceedances within a three-year period would constitute a violation. NAAQS for PM10 were last evaluated by the government on January 15, 2013 (78 CFR 3085). Active monitoring stations for PM10 are located in Lindon and North Provo.

PM10Particulate matter includes dust, dirt, soot, smoke, and liquid droplets directly emitted into the air by sources such as factories, power plants, cars, construction activity, fires, and natural windblown dust. PM10 consists of particles between 2.5 and 10 microns in diameter. Major adverse effects on human health are caused by particulate matter. Adverse effects include aggravation of existing respiratory and cardiovascular disease, alterations in the body’s defense systems against foreign materials, damage to lung tissue, carcinogenesis, and premature death.

Outside of springtime high wind events and wildfires, the Wasatch Front experiences high 24-hour PM10 concentrations under stable conditions during the wintertime (e.g., temperature inversion) (DEQ, 2015).

PM10 Maintenance Plan for Utah CountyOn December 2, 2015, the Utah Department of Environmental Quality (UDEQ) Air Quality Board adopted revisions to a state improvement plan (SIP) in the form of maintenance plans for Utah County non-attainment areas. This plan demonstrated attainment through the year 2030. The plan has been submitted to the EPA and the state is currently waiting for their approval. An EPA-approved maintenance plan will allow the EPA to re-designate Utah County as an attainment area. The development of this plan also signifies the state’s intentions to focus on PM2.5 in the future.

According to the Utah Division of Air Quality (DAQ) 2015 Annual Report, Utah County was officially designated as a PM10 non-attainment area because of past difficulty with the 24-hour standard. Control strategies contained in the Utah SIP promulgated in 1991 are responsible for the marked decrease in concentrations observed in the early 1990s (DAQ, 2019). High values of monitored PM10 sometimes result from exceptional events such as high winds from dust storms and wildfires, as was the case in 2010, when Utah experienced an exceptional dust storm on March 30th, resulting in very high PM10 values across the network (DEQ, 2015). The DAQ has flagged data collected during exceptional events incurred between 2008–2011 and in 2015, and is currently under review for exclusion per the EPA Exceptional Event Rule. There were no exceptional events for high-wind or fire in 2012, 2013, or 2014.
