Dr. Shannon Large gave a report on the current level of participants in the program. The Annual DOH site visit was completed to ensure IPN is meeting requirements of the contract. Education initiatives have also been implemented and conducted around the state at different conferences and facilities. There is an upcoming training for all providers and evaluators around the state as well.

Ms. Whitson would like to thank the staff for their fantastic job in processing the applications.

B. Board Members

Dr. Paschall would like to thank PSU for moving cases and keeping the Board on target. She has been working on the Alarm Fatigue Committee where they are discussing how to address the issue around nurses and the issue of fatigue in this area. Dr. Glymph presented at to the APRNs at FIU about what we do as a Board concerning regulation and it was well received. He would like to thank Mr. Baker for the assistance on the presentation. Dr. Glymph will be attending the CRNA Annual Congress Meeting in Chicago. Ms. Desmond has been doing presentations to residency groups about professionalism as viewed by the Board. Ms. Forst will be attending the NCSBN Annual Meeting in Chicago this month and she would like to thank the Board for the opportunity to attend.

Rule 64B9-15.007: Consideration being made for catastrophic events, sudden unexpected medical issue or death. The school would be responsible to show proof of students who have tested but have applied as a challenger instead of checking the box for course completion.

A motion was made by Whitson to delegate to her, review language drafted by Mr. Fricke for the two rules discussed. Motion passed unanimously. A motion was made by McKeen to allow Ms. Whitson to review annual report information provided by Mrs. Loucks. Motion passed unanimously.

2. Litigation Update- The hearing was held June 19th to address the accreditation of

schools and the ALS ruled against the petitioner seeking an emergency injunction. There is also a DOAH hearing on an application that is pending denial.

D. Prosecution Services Unit

1. August 2019 Prosecutor’s Report- Mr. Witters gave a brief prosecution report for the

2. Florida Center for Nursing (FCN)- A Review of Florida Nurse Education Program Graduate Passage Rates on the NCLEX: CY 2018- FYI

Mr. Baker gave a verbal update of the following items: He attended an informative Executive Officer Summit in June; Mrs. Sutton-Johnson and he worked w/ CSU on complaints for citations for programs which didn't comply w/ FCN survey; He is working on NLC Policy Committee; He gave an update on the phone migration project; Nicole Benson was congratulated on earning RPI Facilitator certification; Melissa Greenfield and her new baby are doing well and we look forward to having her back in the office in early October; He and Ms. Benson will attend the NLC Commission and NCSBN meetings this month; He will be attending FNPN education conference 8/16-17 and giving a BON update; Ms. Benson is attending the Tri-Regulator Symposium in September; He advised that Willie Edwards, CRNA, former chair, passed away last month; The Department is working with the Governor’s Office on board appointments and hope to have additional information soon; An update on 2020 meeting locations was also provided.

A. Rules for Review

1. Rule 64B9-4.002, FAC- Requirements for Licensure- Paragraph number three specifying the specialty boards, should (3)(e)- identifying standards or scope of practice for the specialty remain in the rule? It was agreed this will stay in the rule.

2. Rule 64B9-8.005, FAC- Unprofessional Conduct A. Addition of Violation for Restraining Patients Without Order- This situation is

covered well in other areas and was is agreed that this will not be added.

3. Rule 64B9-8.006, FAC- Disciplinary Guidelines; Range of Penalties; Aggravating and Mitigating Circumstances

A. Reformatting the Disciplinary Guidelines- Florida discipline following discipline in another jurisdiction guideline changed to impose the same penalty as if the crime had occurred in Florida. The guidelines will be revised by Mr. Witters, Mr. Fricke and Ms. Loucks.

B. Discussion regarding Addition of CNA Standards- Because they are not

nurses they should not be included in the nursing standards and currently do not have their own.

4. Rule 64B9-3.008(4)- Licensure by Endorsement A. Discussion regarding Inclusion of Graduation from an Approved Program to

Satisfy Remedial Course Requirement- Someone who would be looking for approval to do this would need to apply for a variance or waiver.

5. Rule 64B9-3, FAC- Applications for Initial Licensure

A. Proposed Application Updates- A motion was made by Paschall to open rules 64B9-3.002, 64B9-3.008, 64B9-3.016 to make changes and change the effective date. Motion passed unanimously. A motion was made by Whitson to acknowledge that the proposed amendment would not have an adverse effect on small businesses or likely directly or indirectly increase regulatory costs to any entity, including government, in excess of $200,000 in the aggregate in Florida within one year after the implementation of the rule. Motion passed unanimously. A motion was made by Whitson that a violation of this rule would not constitute a minor violation. Motion passed unanimously.

B. Items for Discussion 1. Review of Board Meeting Documents

A. Review Summary of Discipline 1. V5F violation – suspend until compliant w/ prior board order

a. Requirement to Pay Costs for Current Case to Lift Suspension- A motion made by Desmond to include the costs with the V5F. Motion passed with Talmadge opposed.

B. Review Guidelines for Acceptable Disciplinary CE- Discussion to add a Topic

Area on professional conduct or language such as “focusing on”. NCSBN has a course on Ethics and Professional Conduct that could be added to the list. Sherri Sutton-Johnson will do research and report back to the Board in October.

2. English Competency Examinations A. Occupational English Test- Present. Gave a presentation on the OET for

proficiency of English for nurses specifically. This test is based on language used in the workplace rather than daily English language usage. Each skill receives a separate score without a cumulative end score. The cost would be approximately $400.00. They are meeting with NSCBN staff soon and we will get an update following that discussion.

B. International Test of English Proficiency (iTEP)- C. Michigan Language Assessment (formerly Michigan English Language

Assessment Battery)- Present. Gave a presentation on the changes to this organization. All skills are tested in one sitting with one cumulative score available. The cost would vary from $124.00 - $164.00. A motion was made by Paschall to open rule 64B9 3.002(4)(b) to change the score to overall score of 55 with a score of a minimum speaking score of 55 and the name to Michigan English Test (MET). Motion passed unanimously. A motion was made by Whitson to acknowledge that the proposed amendment would not have an adverse effect on small businesses or likely directly or indirectly increase regulatory costs to any entity, including government, in excess of $200,000 in the aggregate in Florida within one year after the implementation of the rule. Motion passed unanimously. A motion was made by Whitson that a violation of this rule would not constitute a minor violation. Motion passed unanimously.

3. Credentialing Agencies- Sherri Sutton-Johnson will compile a list for a topic of

discussion at the October meeting. 4. Education Evaluation Records Retention- Josef Silny maintains records for two years.

All other agencies retain information for five years. 5. Nursing Education Clinical Training and Curriculum- Clarification needed about

training sites that will be appropriate. 6. Discussion of Nurse Licensure Compact Specific CE Requirements- Florida and Laws

and Rules should cover this subject. 7. CNA Training Program Renewal Deadline Clarification- Outreach is already being

conducted. Sherri Sutton-Johnson will review federal guidelines to see if changing the renewal date would be possible.

Background Screening- Criminal History Matrix- Criminal History Matrix-A motion made by McKeen to add trespassing, resisting arrest without violence, and reckless driving and possession of alcohol by a person under the age of 21 to category 1. A motion made by McKeen to reconsider. The motion passed unanimously. A motion made by McKeen to have reckless driving with a qualifier as a category 2 and all others in a category 1. Motion passed unanimously.

9. Medical Marijuana Discussion

A. NCSBN National Nursing Guidelines for Medical Marijuana- Staff should use the information provided in these guidelines and continue to advise on existing disciplinary violations for unsafe practice.

10. The NCSBN 2019 Environmental Scan- FYI 11. Overview of Roles and Responsibilities for Probable Cause Panels- Mr. Witters gave a

brief overview.

A. Discussion regarding RN Programs which will be unable to meet Accreditation deadline- possible legislation to provide the Board rule making authority concerning this particular statute. The Board members supported this effort by consensus.
