MCNA Insurance Company e final awards are contingent upon the successful negotiation and execution of contracts between the MCOs and the State. e final contracts between the MCOs and the State should be signed by the first of September. TDA staff will continue working with HHSC and the MCOs to help assist in the transition for participating dentists and program enrollees. If you are interested in participating in the new Texas Dental Program, the first step is to contact the MCOs. Although, as of this writing, the MCOs have not finalized contracts with the State, or established fee schedules, you may wish to sign a Letter of Intent (LOI) to join each MCOs network. Signing a LOI does not obligate you to contract with an MCO. It is merely the first step in the MCOs credentialing process. HHSC Rolls Out the New “Your Texas Benefits” Medicaid Card e Texas Health and Human Services Commission (HHSC) is introducing a new system that uses digital technology to streamline the Medicaid eligibility verification process and provides access to Medicaid health history. e two main elements of the system are: e YourTexas Benefits Medicaid card, which replaces the paper Medicaid ID letter (Form 3087) that clients receive in the mail monthly. A website for Medicaid providers that supplies up-to-date information on a patient’s eligibility and history of services and treatments paid by Medicaid. During the first week of August 2011, HHSC began mailing the Your Texas Benefit Medicaid cards to 3.4 million Texans covered by Medicaid. Medicaid clients can begin using the cards immediately. e new plastic card will be the client’s everyday Medicaid card and will only be replaced if the client changes health plans or if the card is damaged or lost. e current paper Medicaid ID letter (Form 3087) will be mailed out to clients for the months of August and September. is paper Medicaid ID letter will discontinue after September 2011. Participating Medicaid providers can begin using yourtexasbenefitscard.com to verify a patient’s Medicaid eligibility. Providers can opt to purchase equipment, such as a card reader, to utilize the card’s magnetic stripe that contains the client’s Medicaid ID number. However, no equipment is required. Providers also can continue verifying eligibility through existing channels, which do not require the purchase of any additional equipment. Additional functionality for the YourTexas Benefits Medicaid card project will roll out in late 2011. New features will: Allow providers to view patients’ claims, prescription, and diagnosis history; immunization details and lab data; and allow e-prescribing. Give Medicaid clients the ability to view eligibility information, details about services received, and Explanation of Benefits (EOBs). Dentists Who Care Holds Conference Dentists Who Care held its 15th Annual Charity Dental Conference on August 5 and 6, 2011, at Isla Grand Beach Resort in South Padre Island, Texas. A record number of 450 people attended the event. TDA president Dr. J. Preston Coleman addressed the VIP luncheon attendees with a welcome address. Speakers at the conference touched on all areas of dentistry. Dentists Who Care is a grassroots movement of dentists working to stop childhood decay. Membership growth is vital to any thriving organization. The Texas Dental Association (TDA) Board is strongly committed to the Membership goal within the “TDA 2009” strategic plan, which addresses continued growth. I am proud to report that, as evidence of that commitment and for the second year in a row, the TDA received the following ADA awards in 2008:• Greatest Percentage Membership Net Gain: Texas had a net gain of 198 members in the year 2007.• Top Constituent Dental Society with Greatest Percentage of Non-Members to Membership: Represents a conversion of 4.7 percent of non-members into membership at end of year 2007.• Top Constituent Dental Society to Improve Retention Rate Percentage in 2007: Represents a 97 percent Association retention rate, which is an increase of 7 percent from the previous year.• Greatest Percentage of New Dentist Members: Represents a gain of 111 new dentist members (those dentists who are 1-9 years out of school).

Another example of the commitment to the growth of our Association is the TDA Externship Program, which builds student awareness of organized dentistry. This innovative program, created in 2007, offers students the opportunity to gain insight into the different components of organized dentistry including legislative and regulatory affairs, membership, governance, continuing education, and charitable dentistry and to gain a better understanding of their role as future leaders of the dental team. The program is open to dental students from each of the three dental schools in Texas. This year the externship program will take place June 20 – June 27 in Austin at the TDA central office. As an ongoing effort to enhance the value and benefits of the Association, the TDA Council on Membership developed a survey that was sent to all members in 2006. The results clearly showed that members have a high satisfaction rating with benefits such as the TEXAS Meeting, TDA publications, and the ability to participate philanthropically in the TDA Smiles Foundation. A great number of the discounted programs offered to members through the TDA Perks Program also received a high satisfaction rating. In accordance with the strategic plan, the Council on Membership, will survey members again in 2009. Participation from all members and a collaborative effort between the ADA, TDA, and local component societies are the keys to successful membership recruitment and retention. We encourage every member to get involved whether it is by attending local meetings, taking part in Give Kids a Smile! Day activities, volunteering at a Texas Mission of Mercy, or participating in TDA Legislative Day activities in Austin. Each member matters and is essential to the continued growth of our Association and of organized dentistry. This is the seventh and final in a series of articles focused on the TDA’s accomplishments guided by the strategic plan. Actively promote adherence to the Code of Ethics. e. Enhance communication with members and non-members. f. Build student awareness of and interest in organized dentistry and membership in TDA. g. Ensure ongoing contact with students throughout dental school. h. Work closely with dental school faculty. i. Evaluate number of nonmember dentists who attend and participate in TDA activities (TEXAS Meeting, TDA Smiles Foundation programs, etc.).Metrics1. Seventy percent of active licensed dentists in TX will be members of TDA by 2009 (baseline of 68.5% in January 2007); increase

membership retention rate to 97 percent by April 2007 (baseline 96% in 2006). a-d. Increase the number of dentists serving on component peer review and ethics and judicial affairs committees to attain a

participation rate of 2-5 percent relative to the total number of component society members by August 2009.2. Ninety percent of TX dental school graduates actively licensed in TX will be members of TDA five years after graduation (89%

dental student conversion from the graduating class of 2005 in Texas).3. Increase the number of member dentists actively participating in TDA by 1 percent a year (as measured by a variety of means

– participation at TX Meeting, TMOM, TXDDS, FSI programs, DENPAC participations, TDA legislative day) with annual report to TDA Board by the Council on Membership.

4. Establish baseline of nonmember participation at TDA activities (CAS, TDA Smiles Foundation, Membership) 5. Established baseline of members’ understanding of and satisfaction with the benefits of their TDA membership through Member

Benefits and Services Survey (completed Nov 2006), re-evaluate % increase at that time for 2009.6. Sixty-five percent of all full-time faculty will be TDA members by 2009 (2006 baseline = 63%).

Texas Medicaid Electronic Health Record (EHR) Incentive Program This is the ninth in a series of articles to keep you informed of the Texas Medicaid Electronic Health Record (EHR) Incentive Program and continuing efforts to implement health information exchange initiatives across Texas. The incentive program provides incentive payments to Medicaid providers for the adoption and meaningful use of certified EHR technology. Future articles will focus on helpful reference websites, health information exchange, meaningful use for dentists, certified EHR technology for dental practices, and other relevant topics of interest to dentists. Green Lights!

OrganizationalexcellenceisoneofthegoalsforTDA2014,coveringawiderangeofobjectivesfromincreasingthenon-duesrevenuestoenhancementoftheTDAfacilities.Iwillbrieflyfocusonobjectivefour:maximizetheeffectivenessofallTDAmanagementandgovernance. Lastyear,therewereconcernsthatourfinancialreportsneededreevaluating/redesigntosimplifytheinformation.Thisspring,anindependentauditingfirmpraisedourfinancialreportingsystem.ThefirmsuggestedthatadditionaltrainingmighthelptheBoardseethebigfinancialpicture.Asaresult,theAugustboardmeetingincludeda2-hourpresentationbyMr.MattKouri,presidentandexecutivedirectorofGreenlightsforNonprofitSuccess. Thepresentationcoveredrolesandresponsibilitiessharedbyallnon-profitboards,fundamentalboardrolesandresponsibilities,advancedboardpractices,andfinancialoversight.KourialsopresentedontheNon-ProfitandTexasBusinessOrganizationsCode.Healsoexplainedthatthemostimportantdutiesofadirectorareloyalty,care,andobedience.Loyaltyrequiresadirectortoperformhisorherdutiesingoodfaith,alwaysactinginthebestinterestoftheorganization.Carerequiresdirectorstousesoundjudgmentindecision-makingonbehalfoftheorganization,devotingareasonableamountoftimeandattention—“ordinarycare”—tounderstandthemattersbeforethem.Obediencerequiresadirectortoactinthebestinterestofthenon-profit,settingpolicyandmakingdecisionsthatareconsistentwiththemissionoftheorganization. KourialsopointedoutthatintheTDABylawsandBoardManual,BoardresponsibilitiesincludemonitoringthemanagementoftheAssociation’spropertyandpayingtaxes.Thedocumentsstate,“…duringthetermofofficeontheBoardofDirectors,eachmemberhasthedutyofconsideringnotonlytheinterestsofthemembersoftheirparticulardivisionorgeographicalarea,butalsothewelfareofthisAssociation,thedentalprofessionasawholeandthepublicweserve.”ThisisborneoutbythefactthatBoardmembersarenominatedbyoneofthefourdivisionsandarealsoelectedbyavoteoftheHouseofDelegates. TheTDABoardofDirectorsmustbestrategicallyengagedintheoperationoftheAssociation,walkingafinelinebetweenmicro-managementandhands-offneglect.Therearethreemodesofgovernance:fiduciary,strategic,andgenerative.WhentheBoardworkswellacrossallthreemodesofgovernance,leadershipistheresult. Financialoversightiseveryone’sjob,butthetreasurerismostoftentheleader.Effectiveoversightrequiresgoodreports,questions,andactions.TheTDABoardreceivesa16-pagefinancialreportateachmeeting.Onepageshowsthebigpictureofcashflow,budgetprogress(andcomparisonwiththepreviousyear)aswellasrevenueoverexpensesfortheyeartodate.Therearefivepagesofdetailsupportingthesummaryreportandfourreportstoexplainotherareasthatarenotapartofthesummary,butrequireoversight.ThreepageshaverecentlybeenaddedtoprovidetheBoardmemberswithgreaterdetailsoftransactionsintheTDAreservefunds. Ourbudgetingprocessisthoughtfulandrealistic,takingintoconsiderationthatadequateresourcesareneededtosupporttheprogrammaticandadministrativeplan.ThisprocessiscarriedoutbytheBudgetCommitteeundertheguidanceofthetreasurer. TheAuditCommitteeandthedirectoroffinanceworkdiligentlyeachyeartoprovideaccurateandcompleteinformationfortheannualauditofthefinancialstatements.Theresultsintheauditors’reportsandcommentshavealwaysreflectedpositivelyonourstaffandorganization. ReviewingthepointsofKouri’spresentation,IfeelthatwearefinanciallysoundbothinregardstoourfiscalconditionandtheBoard’sfunctionforfinancialoversight.Nevertheless,thereareimprovementstobemadetobettertierthefinancialrolesoftheTDA,allowingtheBoardtoconcentratemoreonthebigpictureandofwhatliesaheadinthefuture.

ThisTSBDEUpdatewilladdressTexasStateBoardofDentalExaminers(TSBDE)Chapter110—22TAC§110.4—MinimalSedation(Level1)permit.TheTSBDEdefinesLevel1MinimalSedationas,“Nitrousplusoneenteraldrug .”(1) AdentistholdinganactiveEnteralSedationpermitbeforeJune1,2011,willautomaticallyhavehis/herpermitreclassifiedasaLevel1MinimalSedationpermitinaccordancewith§110.4(a)(3).ALevel1PermitautomaticallyqualifiesanapplicantforNitrousOxideandLevel1privileges(1). Asareminder,althoughChapter110becameeffectiveJune1st,theTSBDEwillnotstartenforcingrequirementsuntilJanuary 1, 2012.Thisdelayisintendedtoallowampletimefordentiststobecomecompliantwithallfacetsofthenewregulationssuchasstandardsofcareandmonitoring. TheTSBDEdefinesMinimalSedationas,“Aminimallydepressedlevelofconsciousness,producedbyapharmacologicalmethod,inwhichthepatientretainstheabilitytoindependentlyandcontinuouslymaintainanairwayandrespondsnormallytotactilestimulationandverbalcommand(2).” ThesummarybelowistakendirectlyfromChapter110—22TAC§110.4—MinimalSedation. AdentistapplyingforaMinimalSedationpermitmustmeetoneofthefollowingeducational/professionalcriteria: §110.4(a)(1):satisfactorycompletionoftrainingtothelevelofcompetencyinminimalsedationconsistentwiththatprescribedintheAmericanDentalAssociation(ADA)GuidelinesforTeachingPainControlandSedationtoDentistsandDentalStudents,oracomprehensivetrainingprograminMinimalSedationthatsatisfiestherequirementsdescribedintheADAGuidelinesforTeachingPainControlandSedationtoDentistsandDentalStudents.This

includesaminimumofsixteen(16)hoursofdidactictrainingandinstructioninwhichthecompetencyinenteraland/orcombinedinhalation-enteralminimalsedationtechniqueisdemonstrated;or §110.4(a)(2):satisfactorycompletionofanadvancededucationprogramaccreditedbytheADACommissiononDentalAccreditation(CODA)thataffordscomprehensivetrainingnecessarytoadministerandmanageminimalsedation,commensuratewiththeADA’sGuidelinesforTeachingPainControlandSedationtoDentistsandDentalStudents. Additionally,adentistperformingminimalsedationmustadheretostandardofcarerequirements(§110.4(b)(1-4))andclinicalrequirements(§110.4(c)(1-8)(d))includingmaintainingundercontinuousdirectsupervisionauxiliarypersonnelcapableofreasonablyassistinginprocedures,problems,andemergenciesincidenttotheuseofminimalsedationaswellasmaintainingcurrentcertificationinBasicLifeSupport(BLS)forHealthcareProvidersfortheassistantstaffbyhavingthempassacoursethatincludesawrittenexaminationandhands-ondemonstrationofskills. Thedentistisresponsibleforthesedativemanagement,adequacyofthefacilityandstaff,diagnosisandtreatmentofemergenciesrelatedtoadministrationofminimalsedation,andprovidingtheequipmentandprotocolsforpatientrescue. Inadditiontothedentist,atleastoneadditionalpersontrainedinBLSforHealthcareProvidersmustbepresent. Thepatient’sbaselinevitalsmustbeobtainedinaccordancewith§§108.7(MinimumStandardofCare,General)and108.8(RecordsoftheDentist).Afocusedphysicalevaluationmustbeperformedasdeemedappropriate,andpre-proceduredietaryrestrictionsmustbeconsideredbasedontheprescribedsedativetechnique.Pre-procedureverbalandwritteninstructionsmustbegiventothepatient,parent,escort,guardian,orcare-giver.

Post-procedureverbalandwritteninstructionsmustalsobegiventothepatient,parent,escort,guardian,orcare-giver.Post-procedure,patientsshouldbeaccompaniedbyanadultcaregiverforanappropriateperiodofrecovery. Patientsconsideredforminimalsedationmustbesuitablyevaluatedpriortothestartofanysedativeprocedure.Inhealthyormedicallystableindividuals(ASAI,II),thismayincludeareviewoftheircurrentmedicalhistoryandmedicationuse.However,patientswithsignificantmedicalconsiderations(ASAIII,IV)mayrequireconsultationwiththepatient’sprimarycarephysicianorconsultingmedicalspecialist. The patient, parent, guardian, or care-giver must be advised regarding the procedure associated with the delivery of any sedative agents and must provide written, informed consent for the proposed sedation. Monitoringduringtheadministrationofsedationmustincludeoxygenationwhereinthecolorofmucosa,skin,orbloodmustbecontinuallyevaluated.Tothatend,oxygensaturationmonitoringbypulse-oximetryshouldbeusedwhenasingledrugminimalsedativeisused.The additional use of nitrous oxide has a greater potential to increase the patient’s level of sedation to moderate sedation, and a pulse oximeter must be used. Thedentist(orappropriatelyqualifiedindividual)mustobservechestexcursionsand must verify respirations continually.Bloodpressureandheartrateshouldbeevaluatedpre-procedurally,post-procedurallyandintra-procedurallyasnecessary. Documentation must be made in accordance with §§108.7 (Minimum Standard of Care, General) and 108.8 (Records of the Dentist) and must include the names and dosages of all drugs administered and the names of individuals present during administration of the drugs. Atime-orientedsedationrecordmaybeconsideredfordocumentationofallmonitoringincluding:pulse oximetry, heart rate, respiratory rate, and blood pressure may be documented at appropriate intervals of no more than 10 minutes. PermitteddentistsunderthissectionshallnotsuperviseaCertifiedRegisteredNurseAnesthetistperformingaminimalsedationprocedureunlessthedentistholdsaMinimalSedationpermitissuedbytheTSBDE. Thedentistshalldeterminethatanadequateoxygensupplyisavailableandevaluateequipmentforproperoperationanddeliveryofadequateoxygenunderpositivepressure.

Apositive–pressureoxygendeliverysystemsuitableforthepatientbeingtreatedmustbeimmediatelyavailable.Wheninhalationequipmentisused,itmusthaveafail-safesystemthatisappropriatelycheckedandcalibrated.Theequipmentmusthaveeitherafunctioningdevicethatprohibitsthedeliveryoflessthan30percentoxygen,or,anappropriatelycalibratedandfunctioningin-lineoxygenanalyzerwithaudiblealarm.Anappropriatescavengingsystemmustbeavailableifgasesotherthanoxygenorairareused. The dentist administering the sedation and must remain in the operatory room with the patient until the patient meets the criteria for discharge to the recovery area.Atthattime,thedentistmaydelegatemonitoringtoaqualifieddentalauxiliary.Oxygen and suction equipment must be immediately available in the recovery area if a separate recovery area is utilized. The dentist must determine and document that the patient’s level of consciousness, oxygenation, ventilation, and circulation are satisfactory prior to discharge. The dentist shall not leave the facility until the patient meets the discharge criteria and is discharged from the facility. AdentistholdingaMinimalSedationpermitshallnotintentionallyadministerModerateSedation,DeepSedation,orGeneralAnesthesia. Becausesedationisacontinuum,itisnotalwayspossibletopredicthowanindividualwillrespond.If a patient enters a deeper level of sedation than the dentist is qualified to provide, the dentist must stop the dental procedure until the patient returns to the intended level of sedation. Adentistmustbeabletorescuepatientswhoenteradeeperstateofsedationthanintended.Thedentist,personnel,andfacilitymustbepreparedtotreatemergenciesthatmayarisefromtheadministrationofminimalsedation. For children twelve (12) years of age or under, the dentist should observe the American Academy of Pediatrics/American Academy of Pediatric Dentists Guidelines for Monitoring and Management of Pediatric Patients During and After Sedation for Diagnostic and Therapeutic Procedures.
