• Submit an organizational chart displaying lines of authorities and assigned responsibilities within the Contractor's organization relative to the performance and administration of this contract. The Organization Chart shall include names, position/job titles, contact information for both business and non-business hours, and a description of each person's responsibilities under this contract.

The Contractor shall submit the above information to the Contract Manager by e-mail and regular mail. During the contract period, including any optional performance periods, the Contract Manager shall be notified immediately, by email and regular mail, of any changes with the Contractor’s designated liaisons or in the Contractor’s Organization Chart.

Emergency Response Planning and Operations Beginning on the date of award of the contract, the Contractor shall:

• Return the Division’s emergency phone calls within four (4) hours of initial notification.

• If requested by the Division, provide management level personnel at the State Emergency Operations Center (SEOC) in Tallahassee, FL and/or to the State Logistics Response Center (SLRC) in Orlando, FL within 24 hours to collaborate with Division personnel.

• Participate on scheduled conference calls, as requested by the Division, to review mission priorities, potential roles, services, and personnel resources.

• Annually confirm and report their available personnel resources to the Contract Manager by email and regular mail no later than 1 May of each Contract year.

• Provide an updated available personnel resources report within 24 hours upon initial notification by the Division of accelerated preparedness measures due to an impending public health emergency or public emergency event.

• Respond to, manage, and provide daily updates on State Emergency Response Team (SERT) WebEOC tasked missions.

• Request and receive the Division’s written approval prior to the deployment of Contractor personnel resources.

Emergency Medical Personnel The Contractor shall:

• Provide sufficiently skilled and experienced temporary medical personnel resources including comprehensive management of personnel.

• Ensure personnel are clearly identifiable while on a worksite location by wearing Contractor-issued identification.

• Ensure that personnel conform in all respects with physical safety, security, and fire regulations while on the worksite location designated by the Division.

• Ensure personnel operate in a timely, professional, and safe manner consistent with standards in the healthcare trade, profession, or industry.

• Provide all Personal Protective Equipment (PPE), uniforms, identification, worksite credentialing, necessary transportation and support for deployed personnel.

• Bill the Division on an hourly basis for each personnel position with rates inclusive of Contractor markup and personnel travel, lodging and per diem unless otherwise authorized in writing by the Division.

• Possess the professional and technical personnel necessary to allocate, outsource, and manage qualified medical personnel to perform the services requested by the Division.

• Meet the professional standards and quality that prevails among health officials in the same discipline and of similar knowledge and skill engaged in related work throughout Florida under the same or similar circumstances for all medical personnel to be furnished by the Contractor under the Contract.

• Provide training necessary for keeping Contractor’s personnel abreast of industry advances and for maintaining proficiency in equipment and systems that are available on the commercial market.

• Be responsible for the administration and maintenance of all employment and payroll records, payroll processing, remittance of payroll and taxes, and all administrative tasks required by local, state, and federal law associated with payment of Contractor’s personnel.

• Be responsible for adhering to the Contract background screening requirements, testing, evaluations, advertising, recruitment, and disciplinary actions of Contractor’s personnel.

• Notify the Division of any human resource issues raised by Contractor personnel that may affect the Division, such as threats of violence, harassment, discrimination, or retaliation within four (4) hours of discovery.

• Maintain, during the term of the Contract, all licenses, permits, qualifications, insurance, and approvals of whatever nature that are legally required to perform the medical personnel services.

• Inform personnel in writing that they are employed by the Contractor, not the Division. • Notify personnel in writing that the only benefits they will receive will be from the

Contractor and that Contractor personnel are not entitled to any benefits from the Division.

• Notify personnel in writing that job-related illness/injury reports are to be made to the Contractor.

• Notify the Division within 24-hours of receipt of any job-related personnel illness/injury reports made to the Contractor.

• Ensure their personnel’s compliance with all state and federal confidentiality requirements of the Division, including any requirements pertaining to Protected Health Information (PHI), as defined in the Health Insurance Portability and Accountability Act of 1996 (HIPAA), if applicable.

• Accommodate the Division’s requests for additional specialty/subspecialty personnel as required in response to a specified public health emergency or public emergency event.

• Provide personnel supervision, work plans, clearly defined roles, tracking, and accountability.

• Provide on-site or off-site training on an as-needed basis in response to a specific public health emergency or public emergency event.

Primary-care physicians that treat both common and complex illnesses. Advanced training in a host of subspecialties, like heart disease, cancer, or adolescent or sleep medicine. With additional training (called a fellowship), internists can specialize in cardiology, gastroenterology, endocrinology, nephrology, pulmonology, and other medical sub-specialties.

Neurosurgeon

Addresses surgical emergencies, such as bleeding within the brain and sudden compression of the spinal cord, brain tumors, intracranial aneurysms, head injuries, and disorders affecting the spin including spinal canal stenosis, herniated discs, tumors, fractures, and spinal deformities.

Obstetrician/Gynecologist (OB/GYN)

Focus on women's health, including pregnancy and childbirth. Addresses pap smears, pelvic exams, and pregnancy checkups.

Orthopedic Surgeon

Treats patients through surgical procedures, as well as with braces, casts, splints, and physical therapy. Addresses congenital deformities, trauma, infections, tumors, degenerative conditions, and metabolic disturbances. May also treat secondary muscular issues in patients with central or peripheral nervous system lesions like cerebral palsy, paraplegia, or stroke.

Pediatrician

Manages the physical, behavioral, and mental care for children from birth until age 18. Diagnoses and treats a broad range of childhood illnesses, from minor health problems to serious diseases.

Pediatric Surgeon

Collaborates with other neonatologists, pediatricians, obstetricians and gynecologists, and family physicians to determine if surgery is the best treatment option for the child. Addresses birth defects, fetal

PHYSICIAN OFFICE/MSO Certified Medical Assistant Obtains clinical, financial, and demographic patient data. Performs

office tasks. Assists physician with patient exams, procedures, and treatments. Certification required.

Office LPN Performs all duties as directed by a RN in the physician office setting. Florida licensure required.

Office RN Serves as general duty and specialty RN in the physician office setting. Florida license required.

Electrophysiology Procedure Technologist

Performs functions related to electrophysiology procedures including but not limited to mapping, ablations, pacemakers, and loop insertions. State license required.

Electrophysiology RN RN with special expertise/training in electrophysiology procedures. State license required.

Magnetic Resonance Imaging Technician

Operates resonance imaging equipment to obtain diagnostic information. Requires American Registry of Radiologic Technologists (AART) registration.

Mammography Technologist Operates mammography equipment. Positions and adjusts patient for procedure. AA degree and proper certification required.

Medical Physicist Assures radiation safety. Collaborates with treatment team in designing treatment plans, and monitoring equipment and procedures. Master’s degree and Florida license required.

Neuro Interventional Technologist Assists in diagnostic, highly complex invasive neuro, and peripheral interventions as well as assists in neuro-interventional surgical procedures. Requires ARRT registration and Florida license.

Radiation Therapy Technologist Applies ionization radiation as prescribed to patients with malignant disease. Operates radiation equipment. Prepares the treatment room, explains the treatment to the patient, positions patients, and monitors patients during the procedure. Requires AA degree and Florida license.

Radiologic Technologist (Registered) Operates conventional, fluoroscopic, or portable radiology equipment. Positions and adjusts the patient for the procedure and may assist physicians in other radiologic examination. Requires AART registration and Florida license.

Radiologic Technologist - Picture Archiving and Communication System (PACS)

Performs functions related to picture archiving and communication system (PACS).

Radiology Supervisor Supervises day-to-day operation of personnel in radiology and/or ultrasound and/or special procedures and/or Computer Tomography (CT).

Special Procedures Technologist Performs advanced radiologic examinations and other special procedures. Requires AART registration and Florida license.

Ultrasound Technician (Certified) Performs and records ultrasound diagnostic tests. Registered Diagnostic Medical Sonographer (RDMS) certification required.

RESPIRATORY THERAPY Respiratory Therapist (Eligible) Performs therapeutic modalities for patients with respiratory

problems. May perform diagnostic tests. Must be eligible to take the Registered Respiratory Therapist (RRT) registration examination from the National Board of Respiratory Care (NBRC).

Respiratory Therapist (Registered) Performs therapeutic modalities for patients with respiratory problems. Performs artificial ventilation and provides emergency treatment of acute problems. Requires RRT registration from the NBRC and Florida licensure.

Certified Respiratory Therapy Technician (CRTT)

Administers oxygen and performs respiratory care treatments. Is responsible for the functioning of equipment. Requires CRTT certification from the NBRC and Florida licensure.

SKILLED NURSING UNIT/FACILITY Certified Nurse Aide-SNU Under supervision, performs routine non-professional care; bathes,

dresses, and feeds patients; collects specimens and performs related patient care tasks in the SNU setting. State certification required.

LPN-SNU Performs all duties as directed by a RN in the SNU setting. Florida license required.

RN-SNU Serves as general duty and specialty RN in the SNU setting. Florida license required.

Deployment After the Contractor has been contacted and briefed by the Division, notified of the deployment worksite, and given a notice to proceed/approval by the Division in writing (email, text, signed quote, purchase order), the Contractor must:

• Begin personnel mobilization within 12-hours of notice to proceed. • Provide the Division with date and timeline for arrival of personnel resources. • Be partially staffed on-site to support the impacted community within 24-hours of

notice to proceed. • Be fully staffed on-site to support the impacted community within 96-hours of notice

The Division reserves the right to increase or decrease the scale of Contractor deployed personnel based on the public health emergency, public emergency event, or worksite location needs within the Contractor’s capabilities (Contractor Capabilities – Attachment C). Travel, Lodging and Per Diem Contractor’s rates shall be inclusive of travel, lodging and per diem unless otherwise authorized in writing by the Division. Demobilization The Division may request demobilization of Contractor personnel resources at any date and time during Contractor deployment. When requested by the Division, demobilization of personnel resources must commence immediately or on the date and time scheduled by the Division. The Contractor’s hourly billing must cease to coincide with the Division’s demobilization request.

Time Keeping Contractor must utilize an electronic timekeeping system that tracks, at a minimum, the following:

• Personnel check-in/check-out dates and times at the designated worksite location. • Personnel credentials.

Recording and Reporting Contractor must utilize an electronic system for recording and reporting purposes which tracks at a minimum, the following:

• Operational hours per day per site (ex. 0800 – 1700 Operations; Bravo Site) • Number of personnel and licensure type per site • Total number of days each personnel member has been on site • Number of available personnel • Total number of daily hours worked by personnel on site • Total number of daily overtime hours worked by personnel on site • Total number of holiday hours worked by personnel on site • Operational issues

At a minimum, Contractor must provide weekly reports to the Contract Manager or a Division designee by email. The Division may also request reports as needed; Contractor must submit within 24-hours of the Division’s request. Global Positioning System (GPS) must be incorporated into the electronic timekeeping system. Contractor must submit personnel timekeeping reports monthly to coincide with monthly invoicing. However, the Division may request timekeeping reports at its discretion; Contractor must submit reports within five (5) business days when requested by the Division.

Invoicing and Closeout Contractors must submit an itemized invoice for payment. Invoices must, at a minimum, include the following information:

• Contractor Name and remit to address • Contractor billing contact phone number and/or email address • Contractor Tax Identification number • Purchase Order or Contract number • Billing Date • Deliverable with description • Payment amounts due • Incident Name • Mission Number • Timekeeping Reporting

Contractor must submit invoices through the Division’s web-based invoice processing system. Contractors must register for an account at the following link: https://www.fdemportal.com/vendors Once registered, the Contractor will receive an email confirmation and link to access the FDEM Salesforce site. All invoices and supporting documentation must be uploaded in Salesforce to begin the invoice review process. For questions regarding the registration process and/or status of invoices contact: [email protected] Contractor shall only submit invoices monthly. Invoices can only be submitted for the service period in which the Contractor has written authorization from the Division to provide services. Invoices submitted incorrectly or submitted in an improper method to what is required will not be paid until the invoice is corrected. The State of Florida cannot make deposits or pay for goods and/or services in advance unless approved under rules issued by the Comptroller of Florida. Therefore, payments by the Division covering goods and/or services will be due and payable within 40 days after the receipt of a proper invoice and actual receipt of goods and/or services per section 215.422(b), Florida Statutes. The Division is not authorized to pay the Contractor any deposit for personnel resources or services to be rendered in the future. Although the state’s standard timeline prescribes for Contractor payment within 40 days, under an Executive Order and due to the volume and nature of emergency activation response, Contractor payment may be delayed. Therefore, the Contractor must have sufficient funds on hand to cover all Contractor personnel and staff salaries for a minimum of 90 days. The Division is exempt from the payment of Florida sales and use tax on real property rented, transient rental property rented, tangible personal property purchased or rented, or services purchased.

Contractor is responsible for gathering and providing supporting documentation for any Federal Emergency Management Agency (FEMA) or Division reimbursement requests and for completing accurate and detailed documentation required to receive reimbursement. Financial Consequences If the Division determines that the performance of the Contractor is unsatisfactory, the Division will notify the Contractor in writing of the deficiency to be corrected, which correction shall be made within a timeframe specified by the Division. The Contractor shall, within the time specified in the contractual documents after notice from the Division, provide the Division with a written corrective action plan describing how the Contractor will address all issues of contract non-performance, unacceptable performance, and failure to meet the minimum performance levels, deliverable deficiencies, or contract non- compliance. If the corrective action plan is unacceptable to the Division, the Contractor will be assessed a non-performance retainage equivalent to 10% of the total invoice amount or as specified in the contractual documents. The retainage will be applied to the invoice for the then-current billing period. The retainage will be withheld until the Contractor resolves the deficiency. If the deficiency is subsequently resolved, the Contractor may bill the Division for the retained amount during the next billing period. If the Contractor is unable to resolve the deficiency, the funds retained may be forfeited at the end of final invoice period.
