Enforcement

• Violations of Federal Fair Housing laws are investigated by HUD and/or the U.S. Attorney General.

• Penalties can range from $11,000 to $100,000, and are imposed by the Federal Courts.

• Civil Rights Act of 1866• Fair Housing Act of 1968 (Title VIII)• Housing and Community Development Act of

1974• Fair Housing Amendments Act of 1988• Equal Credit Opportunity Act of 1974 (Pertains

to lending)The acts of 1968, 1974, and 1988 together are

known as the Federal Fair Housing Law.

Prohibited Practices

• Blockbusting – the act of encouraging people to sell or rent their homes by claiming that the entry of a protected class of people into the neighborhood will have some sort of a negative impact.

Any message, however subtle, that the property should be sold or rented because the neighborhood is “changing” is considered blockbusting.

• Steering – the directing of home buyers to or away from particular neighborhoods.

Don’t make assumptions!

NO EXCEPTION to this rule is permitted, no matter how subtle the choice of words.
