Planning Obligations

• ‘not appropriate’ to use planning conditions to address the impact of a proposed development

• Uses of Section 106 Agreements:

• Improve air quality• Make other environmental improvements before a development

goes ahead or offset the subsequent environmental impact of a proposed development

• In particular – ‘the purchase, installation, operation and maintenance of air quality monitoring equipment or provision of other assistance or support to enable authorities to implement any necessary monitoring or other actions in pursuit of an Air Quality Action Plan’.

How effective are LES measures in reducing

emissions, improving health and what is the cost/benefit?

Difficult to assess risks and benefits of mitigation or compensating/offsetting measures

due to lack of robust data

Assessment of Benefits Project

Background

• New developments can increase the risk of exposure to key pollutants and emissions of greenhouse gases due to changed transport flows or new activity.

• Opportunity during the planning process to mitigate these risks – i.e. AQAPs, S.106 Agreements, SPD contributions.

• Evidence based approach to developing and implementing planning policy, the LES-AoB project will quantify the impact that LES measures can have in minimising and mitigating the impacts related to development.

• Robust quantitative conclusions will assist LAs in assessing the benefits of LES as part of the AQAP

Low Emission Strategy ToolKit

Two components:

1. Assessment of Benefits

2.Vehicle Emission Toolkit

Aim 1 – Development control

• Establish - a LES Toolkit for LAs in association with developers, to appraise emission reduction options

• Goal - is to quantify baseline emissions of NOX, PMs and CO2 associated locally with developments and total emissions from vehicles associated with the developments

• Produce - emissions data with lower emitting vehicles and options substituted.

• Quantification - of health benefits and damage costs• Inform - further development of planning obligations and

S.106 contribution formulae

Aim 2 – LA Fleets

• Data and tools assist LAs to develop LES to reduce emissions from their own fleets and activities.

• Achieve emission reductions and National Indicator targets

• Build on existing work • Enable LAs to confidently develop LES, with

evaluated knowledge of their impacts and allow for standardisation
