TITLE 13. DEPARTMENT OFMOTOR VEHICLES

NOTICE IS HEREBY GIVENThe Department of Motor Vehicles (the department)

proposes to amend Sections 25.15, 25.18, 25.19,25.21, and 25.22 in Chapter 1, Division 1, Article 2.1of Title 13, California Code of Regulations, EmployerTesting Program.

PUBLIC HEARINGA public hearing regarding this proposed regulatory

action is not scheduled. However, a public hearing willbe held if any interested person or his or her dulyauthorized representative requests a public hearing tobe held relevant to the proposed action by submittinga written request to the contact person identified in thisnotice no later than 5:00 P.M., fifteen (15) days priorto the close of the written comment period.

DEADLINE FOR WRITTEN COMMENTSAny interested person or his or her duly authorized

representative may submit written comments relevantto the proposed regulations to the contact personidentified in this notice. All written comments must bereceived at the department no later than 5:00 P.M.,SEPTEMBER 19, 2005, the final day of the writtencomment period, in order for them to be consideredby the department before it adopts the proposedregulation.

AUTHORITY AND REFERENCEThe department proposes to adopt this regulation

under the authority granted by section 1651 of theVehicle Code, in order to implement, interpret or makespecific sections 12804.9 and 15250 of the VehicleCode.

INFORMATIVE DIGEST/POLICYSTATEMENT OVERVIEW

The department is authorized in Part 383 of Title 49of the Code of Federal Regulations (CFR) and VehicleCode Section 12804.9 and 15250 to use third partytesters to conduct the commercial behind the wheeldriving test, under specified conditions. Includedamong these conditions are the requirements that thetests administered by the third party are the same as

those that would otherwise be given by the depart-ment, and the third party examiners meet thesame qualification and training standards as Stateexaminers.

The Employer Testing Program is a voluntaryfederal and state regulated program that allows Statesto utilize a third-party tester to conduct the drive testportion of the commercial driver license test forClass A, Class B, and the non-commercial Class A andB firefighter restricted licenses. The departmentdefines third-party testers as ‘‘Employers,’’ requiringan employer-employee relationship between the com-pany and the drivers that they intend to certify at thetime of training, testing, and certification.

The amendment of the existing regulations willprovide the department with a mechanism for ensuringthat all examiners who conduct driving tests in theEmployer Testing Program maintain the evaluationskills necessary for adequately assessing the drivingability of the drivers taking the drive test. This ensuresthat only proficient drivers are granted class A and Bdriver licenses based on their party testing.

Emergency regulations were adopted by the depart-ment and approved by the Office of AdministrativeLaw on March 30, 2005, to amend sections 25.15,25.18, 25.19, 25.21, and 25.22, Title 13, Division 1,Chapter 1, Article 2.1, California Code of Regulations.The regulations establish testing minimums for thirdparty examiners and increase the examiner trainingclass fee. This proposal will make the emergencyregulations permanent.

FISCAL IMPACT STATEMENT

• Cost or Savings To Any State Agency: Minimalimpact to state agencies because of low participa-tion in the program.

• Other Non-Discretionary Cost or Savings to LocalAgencies: None.

• Costs or Savings in Federal Funding to the State:None.

• Cost Impact on Representative Private Persons orBusinesses: The proposed regulatory action mayaffect small businesses and entities with little or nocertification activity on a yearly basis. Examinersworking exclusively for these entities would berequired to attend refresher training in order toresume their ability to conduct driver testing.Examiner refresher courses may be held in geo-graphic locations that would require travel expensesthat may include overnight hotel stays, airfare andrental car and other expenses.

• Effect on Housing Costs: None.

DETERMINATIONSThe department has made the following initial

determinations concerning the proposed regulatoryaction:• The proposed regulatory action will not have a

significant statewide adverse economic impactdirectly affecting businesses, including the ability ofCalifornia businesses to compete with businesses inother states

• The adoption of this regulation is not expected tocreate or eliminate jobs or businesses in the state ofCalifornia or reduce or expand businesses currentlydoing business in the state of California.

• The proposed regulatory action will not impose amandate on local agencies or school districts, or amandate that requires reimbursement pursuant topart 7 (commencing with Section 17500) ofDivision 4 of the Government Code.

• The proposed regulatory action may affect smallbusinesses and entities with little or no certificationactivity on a yearly basis. Examiners workingexclusively for these entities would be required toattend refresher training in order to resume theirability to conduct driver testing. Examiner refreshercourses may be held in geographic locations thatwould require travel expenses that may includeovernight hotel stays, airfare and rental car andother expenses.

PUBLIC DISCUSSIONS OFPROPOSED REGULATIONS

A pre-notice workshop, pursuant to GovernmentCode section 11346.45, is not required because theissues addressed in the proposal are not so complex orlarge in number that they cannot easily be reviewedduring the comment period.

ALTERNATIVES CONSIDEREDThe department must determine that no reasonable

alternative considered by the department or that hasotherwise been identified and brought to the attentionof the department would be more effective in carryingout the purpose for which the action is proposed, orwould be as effective and less burdensome to affectedprivate persons than the proposed action.

TITLE 17. CALIFORNIA INSTITUTEFOR REGENERATIVE MEDICINE

NOTICE OF INTENTION TO ADOPT THECONFLICT OF INTEREST CODE OFTHE CALIFORNIA INSTITUTE FOR

REGENERATIVE MEDICINENOTICE IS HEREBY GIVEN that the California

Institute for Regenerative Medicine (‘‘CIRM’’), pur-suant to the authority vested in it by section 87300 ofthe Government Code, proposes to adopt its Conflictof Interest Code. The purpose of the code is toimplement the requirements of sections 87300through 87302.

CIRM proposes to adopt a Conflict of Interest Codeto include positions that involve the making orparticipation in the making of decisions that mayforeseeably have a material effect on any financialinterest, as set forth in subdivision (a) of section 87302of the Government Code.

Copies of the proposed code are available andmay be requested from the contact person set forthbelow or downloaded from the CIRM website atwww.cirm.ca.gov.

Any interested person may submit written state-ments, arguments, or comments relating to theproposed code by submitting them in writing no laterthan Monday, September 19, 2005 (last day of the45-day period), or at the conclusion of the publichearing, if any, whichever comes later, to the contactperson set forth below. The text of the proposed codealong with instructions on how to submit writtenstatements, arguments, or comments in response to theproposed code will be accessible through the agency’swebsite www.cirm.ca.gov under the heading Laws/Regulations.

At this time, no public hearing has been scheduledconcerning the proposed code. If any interested personor the person’s representative requests a publichearing, he or she must do so in writing no later thanSunday, September 4th, 2005 (15 days before theclose of the written comment period), to the contactperson set forth below.

CIRM has prepared a written explanation of thereasons for the proposed code and has available theinformation on which the code is based. 4. Will not result in any nondiscretionary costs orsavings to local agencies.

5. Will not result in any costs or savings in federalfunding to the state.

6. Will not have any potential cost impact on privatepersons, business or small businesses.

In making this proposed code, the CaliforniaInstitute for Regenerative Medicine must determinethat no alternative considered by the agency would be

more effective in carrying out the purposes of theproposed code and less burdensome to affectedpersons than this proposed code.

TITLE 20. PUBLIC UTILITIESAND ENERGY

NOTICE OF PROPOSED REGULATORY ACTIONThe California Public Utilities Commission (Com-

mission) proposes to amend regulations describedbelow after considering all comments, objections, orrecommendations regarding the proposal.

At a duly noticed regularly scheduled meeting notearlier than October 27, 2005, at 10:00 a.m., in theCommission Auditorium, 505 Van Ness Avenue,San Francisco, the Commission will consider aproposal to amend Rules 79 and 80, contained inArticle 19 of the Commission’s Rules of Practice andProcedure, and set forth in Division 1, Chapter 1 ofTitle 20 of the California Code of Regulations. Theproposed amended regulations will reflect the publi-cation and availability of Commission documents onthe Commission’s Internet site, and limit hard copyservice of the Commission’s meeting agenda andagenda item materials.

AUTHORITY TO ADOPT RULESArticle XII, Section 2 of the California Constitution

and Section 1701 of the Public Utilities Codeauthorize the Commission to adopt Rules of Practiceand Procedure.

INFORMATIVE DIGESTThe California Public Utilities Commission pro-

poses an amendment to its Rules of Practice andProcedure reflecting certain procedures enacted byChapter 886 of the 1998 statutes (Calderon). Thislegislation amended Section 311.5 of the PublicUtilities Code to require the Commission to publishthe agenda and agenda item documents, as well asother Commission documents, on the Commission’sInternet site. The Commission seeks to amendRules 79 and 80 to reflect the Internet availability ofthe agenda and agenda item materials and eliminatehard copy service of agenda item documents, limithard copy service of the agenda to persons who have

not consented to e-mail service in a proceedingpursuant to Rule 2.3, and eliminate the provision forwaiver of fees for subscription to the agenda andagenda item documents.

TITLE 22. EMPLOYMENTTRAINING PANEL

NOTICE OF PROPOSED RULEMAKINGNOTICE IS HEREBY GIVEN that the Employ-

ment Training Panel (Panel) proposes to amendSection 4416 in Title 22 of the California Code ofRegulations. This regulation sets forth the Panel’sprocedures and standards for determining Out-of-StateCompetition. The Initial Statement of Reasons andExpress Text of the proposed amendment are accessi-ble through the What’s New page linked to the Homepage on the ETP website (www.etp.ca.gov).

AUTHORITY AND REFERENCEThe Panel’s rulemaking authority is set forth at

Section 10205(m) of the Unemployment Insurance(U.I.) Code. In general, the proposed regulatory actionwill implement, interpret and make specific U.I. CodeSections 10200(a), 10200(b)(i) and 10201(b).

INFORMATIVE DIGESTExisting law requires the Panel to foster the

retention of jobs in manufacturing and other industriesthat are ‘‘threatened by out-of-state competition.’’(Unemployment Insurance Code section 10200.) Ascurrently worded, Section 4416 sets forth the Panel’sprocedures and standards for determining whetheran employer is eligible for training funds in lightof this statutory requirement for out-of-state statecompetition.

The proposed amendment is summarized below bysubject matter. A detailed explanation of the changesto each subsection is provided in the Initial Statementof Reasons.

Change from SIC to NAICS

Currently, Section 4416 (b) designates manufactur-ing industries, and certain other industries, that meetthe out-of-state competition requirement based on theStandard Industrial Classifications (SIC). That systemwas developed by the federal government to standard-ize the collection and analysis of North Americaneconomies. It was revised and expanded in 1997 and isnow titled the North American Industrial Classifica-tion System (NAICS). The new classification systemestablishes 20 different industry sectors based on theirprimary activities.

By this amendment, the Panel would substituteNAICS for SIC and expand the list of industries thatare deemed to meet the out-of-state competitionrequirement. As expanded, the list would includenewly-identified industries in Engineering Services,Testing Laboratories and Research & Development.These new industries were identified by NAICS aspart of Sector 54 ‘‘Physical, Engineering and LifeSciences.’’

Sector 54 also includes Custom Computer Program-ming and Computer System Design services, whichhad been identified by SIC as part of the oldclassification for ‘‘Prepackaged Software.‘‘ This is nota substantive change, but reflects a clarification madeby the NAICS coding structure.

Currently, the Panel may exercise discretion inmaking an out-of-state competition determination forindustries that have not been classified under SIC,using the SIC Manual as a guideline. This practiceimplicitly results in the incorporation-by-reference ofthe SIC Manual. Rather than continue this practice,new Section 4416(i) would bind the Panel to accept

the ‘‘status conferred’’ by the Employment Develop-ment Department when it assigns a classificationunder NAICS.

For the purpose of readability, the NAICS listingwould be moved to the end of this regulation, at newSection 4416(i).

New ProvisionsCurrently, there is no explanation of why the Panel

requires out-of-state competition. This amendmentwould add such an explanation at new Section 4416(a)based directly on the ETP program mandate atUnemployment Insurance Code section 10200.

Currently, the criteria for an out-of-state competi-tion determination are binding on the Panel, except forthe industries listed under SIC. New Section 4416(b)would set forth the Panel’s authority to exercisediscretion in making determinations on a case-by-casebasis.

Currently, the entity requesting training funds isreferred to as a ‘‘company.’’ However, this term couldbe confused with ‘‘facility, functional group or unit’’each of which has a specific regulatory meaning atproposed Section 4416(d) and 4416(e). Accordingly,the term ‘‘employer’’ would replace ‘‘company’’ undernew Section 4416(c).

Threshold AnalysisCurrently, the criteria for making out-of-state

competition determinations are binding, and are notset forth in any particular order. The proposedamendment would establish a discretionary ‘‘thresholdanalysis’’ at new Section 4416(d) and clarify thesequence of analysis based on actual practice.

Products or ServicesCurrently, Section 4416(a) requires a ‘‘products or

services’’ analysis. The focus is on whether thecompany produces a product or provides a serviceout-of-state, thus facing competition from out-of-statebusiness. The proposed amendment would clarify thecurrent criteria, and add a substantive standard at newSection 4416(d)(4). This standard would require that atleast 25 percent of gross annual revenue is derivedfrom out-of-state customers.

Significant Business PresenceHistorically, the Panel has used a measurement of

20 percent to gauge the scope of out-of-state productsor services under a ‘‘significant business presence’’analysis designed to determine whether the companycould readily move its operations away from Califor-nia. This amendment would implement that measure-ment, and raise its level to 25 percent.

As a result, the current three-part analysis would bereformatted and clarified to require: a) 25 percent ofgross annual revenue must be directly derived from

out-of-state operations; or, b) 25 percent of the offices,divisions, branches, stores or franchises must belocated out-of-state; or, c) 25 percent of permanentfull-time employees must work out-of-state. It is notanticipated that this revision would diminish thenumber of eligible project applicants.

Mortgage Banking

Currently, Section 4416(d)(2) sets three out-of-statecompetition criteria for the mortgage banking industry.These standards would be clarified and reformattedunder new Section 4416(f). They would not bechanged in substance, but would be made morespecific. In addition, the proposed amendment woulddefine the term ‘‘mortgage banking’’ as a lender or abusiness that services mortgage loans or packages/sells mortgage loans.

Destination Resorts

Currently, Section 4416(d)(3) recognizes a ‘‘desti-nation resort, convention/conference center orconvention/conference hotel’’ as a type of employerfor the purpose of making out-of-state competitiondeterminations. The current regulation sets two criteriafor determining whether a destination resort competesfor national or international customers.

The current regulation sets a ‘‘25 percent of grossannual revenue’’ standard for destination resorts andconvention/conference hotels. It also defines eachtype of employer (destination resort, convention/conference center and convention/conference hotel).Finally, the current regulation sets an additional sixcriteria, of which three must be satisfied, relating tothe employer’s out-of-state marketing efforts.

The proposed amendment would clarify the defini-tion of each type of employer based on the commonEnglish meaning of the terms ‘‘destination’’ and‘‘resort’’ and on the commonly understood purpose ofconvention/conference centers and convention/conference hotels. The 25 percent of gross annualrevenue standard would be carried over to convention/conference centers. Finally, the proposed amend-ment would clarify the ‘‘three of six’’ criteria to moreaccurately reflect actual out-of-state marketingpractices.

Call Centers

Currently, Section 4416 does not include ‘‘callcenters’’ as a type of employer. The proposedamendment would establish a Call Center category atnew Section 4416(h) using two criteria: 1) theemployer must have over 50 percent of call volumeoriginating from outside California, and 2) theemployer must not provide telemarketing services.

FISCAL DISCLOSURESThe Panel has made the following initial determi-

nations regarding fiscal disclosures required bySection 11346.2 of the Government Code.

A. Fiscal Impact. The Panel has made an initialdetermination that the proposed amendment does notimpose costs or savings requiring reimbursementunder Section 17500 et seq. of the Government Code.Furthermore, this action does not impose non-discretionary costs or savings to any local agency; nordoes it impact federal funding for the State.

The Panel has made an initial determination that theproposed amendment does not impose costs or savingsto any State agency pursuant to Section 11346.1(b) or11346.5(a)(6) of the Government Code. Furthermore,there are no fiscal impact disclosures required by StateAdministrative Manual sections 6600–6670.

B. Cost Impacts. The Panel is not aware of anycost impacts that a representative private person orbusiness would necessarily incur in reasonable com-pliance with the proposed amendment. The samedetermination applies to housing costs. This actionwould clarify the Panel’s standards for reviewing andfunding training proposals. Thus, the costs incurred insubmitting such proposals should be reduced, ifanything.

C. Adverse Impact on Business. The Panel hasmade an initial determination that the proposedamendment does not have any significant, statewideadverse economic impact directly affecting business,including the ability to compete. Indeed, the overallpurpose of the Panel’s program is to enhance theability of California businesses to meet the challengeof competition from other states.

D. Effect on Small Business. The Panel hasdetermined that the proposed amendment does notaffect small businesses unless they seek training funds.Since this action would clarify and simplify thePanel’s standards for reviewing and funding trainingproposals, this would be a positive effect.

E. Effect on Jobs and Business Expansion. ThePanel has made an initial determination that theproposed amendment would not create or eliminatejobs in California. Nor would it create new businessesor eliminate existing businesses in California. ThePanel has made an initial determination that this actionwould not directly affect the expansion of businessescurrently operating in California.

Nevertheless, the overall intent and purpose of theETP program is to foster job creation and the retentionof high-wage, high-skilled jobs that are threatened byout-of-state competition. (U.I. Code section 10200(a).)The Panel must give funding priority to projects thatwould train new employees of firms locating orexpanding in the state; train displaced workers, anddevelop workers with skills that prepare them for the

challenges of a high performance workplace of thefuture. (U.I. Code section 10200(b).) Thus, the Panelhas made an initial determination that the proposedamendment may encourage the retention of jobs andbusinesses in California, in the sense that it wouldenhance the Panel’s ability to implement the purposeof the ETP program.

F. Imposed Mandate. The Panel has made aninitial determination that the proposed amendmentaction does not impose a mandate on local agencies orschool districts.

REASONABLE ALTERNATIVESThe Panel must determine that no reasonable

alternative it considered or that has otherwise beenidentified and brought to its attention would be moreeffective in carrying out the purpose for which theaction is proposed or would be as effective and lessburdensome to affected private parties than theproposed action. INFORMATIVE DIGEST/POLICYSTATEMENT OVERVIEW

California Health and Safety code sections 1344 and1346 vest the Director with the power to administerand enforce the provisions of the Act.

California Health and Safety Code section 1344mandates that the Director have the ability to adopt,amend, and rescind such rules, forms, and orders asare necessary to carry out the provisions of thischapter, including rules governing applications andreports, and defining any terms, whether or not used inthis chapter, insofar as the definitions are notinconsistent with the provisions of the Act. Further-more, the Director may waive any requirement of anyrule or form in situations where in the Director’sdiscretion such requirement is not necessary in thepublic interest or for the protection of the public,subscribers, enrollees, or persons or plans subject tothis chapter. In addition, the Director mayhonor requests from interested parties for interpretiveopinions.

California Health and Safety Code section 1346vests in the Director the power to administer andenforce the Act, including but not limited to recom-mending and proposing the enactment of any legisla-tion necessary to protect and promote the interests ofplans, subscribers, enrollees, and the public.

Pursuant to Health and Safety Code section1346(a)(5), the Director may determine the need for apublic hearing on any topic pertaining to managedhealth care regulation, with or without a public requestfor a meeting. Government Code section 11346.8

PROJECT: Habitat Conservation Plan for MadRiver Diversion and Other WaterDistrict Operations

LOCATION: Mad River from Matthews Dam (RM[river mile] 85) through to the tidalzone (RM 4), Humboldt County

BACKGROUNDIn their ‘‘Habitat Conservation Plan’’ (HCP), the

Humboldt Bay Municipal Water District (District) hasasked for permitted coverage of current Mad Riveractivities that either occur on an ongoing basis oroccur only as needed. Proposed activities scheduled tooccur on a regular basis include releasing flows atMatthews Dam; diverting water in the Essex Reach;operating the direct diversion facility at Station 6including fish screens; dredging the ‘‘Forebay’’ atStation 6; as well as maintaining adequate watersurface elevation and flow at Station 6 by constructinga gravel berm and dredging the river channel upstreamof Station 6. Proposed activities scheduled to occuronly as needed include maintaining adequate capacityin tailrace and spillway pools below Mathews Dam;gaining access to and maintaining Ranney collectors;and repairing rock structures and revetments.

The proposed project has the potential for incidentaltake of coho salmon (Oncorhynchus kisutch), which isboth State- and federally-listed as threatened in theSouthern Oregon-Northern California Coast (SONCC)Evolutionary Significant Unit (ESU). Take of juvenilecoho salmon may occur during activities associatedwith flow diversion, such as fish screen operation andinstream construction/dredging activities includingconstruction of the gravel berm at Station 6. Inaddition, harmful effects to coho salmon may resultfrom project activities that cause substantial alterationin stream flows, contribute considerable amounts ofsediment or hazardous contaminants to the river, orcontribute to long-term reduction in habitat ormaintenance of low quality habitat.

On June 9, 2005, the National Oceanic andAtmospheric Administration Fisheries Service(NOAA Fisheries) issued a ‘‘no jeopardy’’ biologicalopinion (BO)(151422SWR1999AR25) and incidentaltake permit (#1488) to the District for the above-referenced project. The NOAA Fisheries BO andincidental take permit described the project actionsand incorporated by reference all conservation mea-

sures listed in the HCP for take avoidance, minimiza-tion, and mitigation for impacts to threatened cohosalmon of the SONCC ESU as well as for otherfederally-listed salmonids.

On June 16, 2005, the Director of the Department ofFish and Game received a notice from the District,pursuant to Section 2080.1 of the Fish and GameCode, requesting a determination that the NOAAFisheries incidental take permit is consistent with theCalifornia Endangered Species Act (CESA).

DETERMINATIONThe Department has determined the NOAA Fisher-

ies incidental take permit #1488, which includes fullimplementation and compliance with the HCP, isconsistent with CESA. The Federal take permit isconsistent with CESA because the mitigation measuresdescribed in the HCP meet the conditions set forth inFish and Game Code Section 2081 (b) and (c) forauthorization of incidental take of listed species.Specifically, the Department finds that take of cohosalmon will be incidental to otherwise lawful activi-ties; the identified mitigation measures will avoid,minimize, and fully mitigate impacts of the authorizedtake of coho salmon; and the project will notjeopardize continued existence of the species. Themitigation measures contained within the incidentaltake permit and HCP include but are not limited to thefollowing:

1. Flow releases from Matthews Dam will be man-aged such that a 5 cfs minimum flow will bemaintained at all times below the dam. If theDistrict plans to reduce its releases at one time bymore than 25% during low-flow times of year, itwill do so in gradual increments over a 24-hourperiod to avoid stranding juvenile coho. Releaseswill also be managed to meet the instream flowrequirements below Essex in accordance withconditions in the District’s State Water RightsPermits.

2. In accordance with the HCP, the District hasretrofitted its existing fish screens at Station 6,installing new screen panels with 3/32-inch meshopenings to prevent entrainment of juvenile coho.Seals at the bottom and sides of the screen structurewere installed to ensure a minimum opening of lessthan 3/32 inch.

3. The District will continue to monitor take of listedspecies due to impingement at Station 6 fishscreens following screen retrofit to ensure take isminimized at the screens. Take associated with thescreens will not exceed 5% of the estimatedexposed juvenile population in any given year or3% of the estimated exposed juvenile populationover four consecutive years as determined from the

annual monitoring program. The estimated exposedjuvenile population is that portion of the estimatedjuvenile population of the Mad River (usingChinook salmon as the indicator species) that maymigrate downstream along the southern channeledge and could enter the forebay. Exceedance ofmonitoring thresholds will serve as a trigger forreinitiating consultation with NOAA Fisheries.

4. Fish relocation guidelines provided on pp. 58–59 ofthe NOAA Fisheries BO will be followed, ifnecessary, for minimizing take of fish during bermconstruction at Station 6. There will be annualpreconstruction meetings with NOAA Fisheriesand other agencies to assess preconstruction chan-nel and biological information and develop a planfor minimizing effects to listed species.

5. The District will undertake a feasibility study ofalternatives to berm construction and dredging forproviding the necessary water surface elevation andflow to Station 6 during the low flow periods. Thisstudy will be completed within 3 years of obtainingthe incidental take permit for the HCP from NOAAFisheries. The feasibility study will include biologi-cal considerations determined by the District,NOAA Fisheries, and the Department, and it willrecommend the preferred alternative.

6. The District will commit up to $15,000 on aone-time basis on or before December 31, 2006, tohelp fund qualified projects that will improveproduction of coho salmon in the lower Mad Riverwatershed. Qualified projects include those projectsapproved by the Department that would increaseaccess to previously inaccessible or partiallyaccessible habitat or improve existing streamhabitat. Examples of projects that may qualify forfunding include, but are not limited to, improvingfish passage at the Warren Creek culvert along WestEnd Road or improving fish passage or instreamhabitat rehabilitation on Noisy Creek.

Pursuant to Section 2080.1 of the Fish and GameCode, incidental take authorization under CESA willnot be required for incidental take of coho salmonduring the project as it is described in the NOAAFisheries incidental take permit, the HCP and theimplementation agreement, provided the District com-plies with the mitigation measures and other condi-tions described in these documents. If there are anysubstantive changes to the project including changes tothe mitigation measures, the District will be requiredto obtain a new consistency determination or CESAincidental take authorization from the Department.

The Department of Fish and Game (Department)received notice on July 22, 2005 that the LamontPublic Utilities District (PUD) proposes to rely on itsconsultation with the U.S. Fish and Wildlife Service(Service) to carry out a project that may adverselyaffect species protected by the California EndangeredSpecies Act (CESA). The project is the construction ofan effluent disposal site expansion on a 160 acre sitesouth of Lamont, Kern County, California. The Projectwill impact approximately 19 acres of habitat forTipton kangaroo rats and 160 acres of habitat forSan Joaquin kit fox.

On July 6, 2005, the Service issued Lamont PUD anIncidental Take Permit (TE106826-0) which autho-rizes incidental take of the federally endangered andstate threatened San Joaquin kit fox (Vulpes macrotismutica) and Federally and state endangered Tiptonkangaroo rat (Dipodomys nitratoides nitratoides). TheIncidental Take Permit requires Lamont PUD toimplement a Habitat Conservation Plan that theService approved in November 2004.

Pursuant to California Fish and Game Code Section2080.1, Lamont PUD is requesting a determinationthat Incidental Take Permit TE106826-0, whichrequires Lamont PUD to fully implement the HabitatConservation Plan, is consistent with the requirementsof CESA. If the Department determines that theIncidental Take Permit is consistent with CESA,Lamont PUD will not be required to obtain a separatepermit under CESA (Fish and Game Code Section2081(b)) for the proposed project.

Pursuant to Government Code Section 11340.7, theDepartment of Motor Vehicles (department) herebyresponds to the June 22, 2005, petition of Ace Ashley,which was received on June 24, 2005. The Petitionerrequests the amendment of a regulation pursuant toSections 11340.6 and 11340.7 of the GovernmentCode. The Petitioner requests that the departmentamend Sections 15.06 and 20.04, in Article 2,Division 1, Title 13, California Code of Regulations(CCR), to recognize common law name changes forCalifornia driver licenses and identification cards.

The Petitioner states that California Code of CivilProcedure, Part 3, Title 8, Section 1279.5(a) upholdsthe common law right to change one’s name in thisjurisdiction and that the department’s practice of notrecognizing one’s right to common law name changeconflicts with explicit statutory law, and is thereforeinvalid as statutory law always takes precedence overregulations.

The Petitioner states a belief that the denial ofrequests to use common law names on driver licensesand identification cards by the department constitutesan underground regulation and that the Social SecurityAdministration name change on a social security cardqualifies under Title 13, Section 20.04(d)(3) and (4) asa name change document issued by a competentjurisdiction.

In support of his position, the Petitioner states thatthe department cross-references and verifies all namechanges with the Social Security Administration. ThePetitioner believes this procedure implies that thedepartment should recognize the legal validity ofname changes processed by the Social SecurityAdministration.

The Petitioner proposes the following amendmentto be included ‘‘following the relevant section(s) inTitle 13’’:

The above requirements for name change shall notabrogate the common law right to change one’sname if such change is so duly substantiatedthrough consistent usage.

THE DEPARTMENT’S RESPONSE

The California driver license and identification cardhave become the commonly accepted forms ofidentification in California. These state-issued docu-ments have even surpassed the birth certificate as theprima facie evidence of identification. It is a reason-able presumption on the part of the public to assumethat the name appearing on the driver license oridentification card is the true full name of the personpresenting the identification.

Prior to June 1999, the department allowed anindividual to use any name as long as the intent wasnot to defraud when making an application for anoriginal driver license or identification card, or whenrequesting a name change on an existing license orcard. That policy resulted in widespread use ofnicknames, stage names or fictitious names. Thedepartment subsequently determined that this policyjeopardized the success of the department’s mission tomaintain accurate and secure information regardingindividual identification.

Vehicle Code section 12800 requires that anapplicant for a California driver license provide his orher true full name on the application. Vehicle Codesection 12800.7 authorizes the department to require aperson applying for an original or duplicate driverlicense to produce any identification that the depart-ment determines is necessary to ensure that the nameon the application is the applicant’s true full name.Vehicle Code section 13000 authorizes the departmentto issue an identification card to any person attesting tospecified identifying data, including the applicant’strue full name, and requires every identification cardapplication to be supported by such bona fidedocumentary evidence of identity as the departmentmay require.

In response to these statutory provisions, thedepartment adopted Section 15.06 in Title 13 of theCCR, to define ‘‘true, full name’’ as the name specifiedon one of the documents listed in Section 15.00 ofTitle 13 of the CCR necessary to establish legalpresence, birth verification, or a name change, that issubmitted at the time of application. The true full name

is the name that appears on the driver license oridentification card and is recorded on the drivingrecord. Further, the department adopted Section 20.04in Title 13 of the CCR to specify the informationrequired for a name change on a driver license oridentification card. The purpose of Section 20.04 is tospecify acceptable documents which must be pre-sented to the department as evidence of true full namewhen a person applies for an original driver license oridentification card and the name provided on theapplication conflicts with the name on the identifica-tion document, or when applying for a name changeon an existing driver license or identification card.

Section 20.04 provides that the department willaccept as documentation to establish the applicant’strue full name any document specified in Section15.00 of Title 13 of the CCR. The departmentspecified the documents in Section 15.00 becausemost of the documents are issued by the federalgovernment and contain an identifying number thatcan be verified with the issuing agency. The depart-ment determined that these documents are verifiable asproof of a person’s legal presence in the United Statesand, therefore, valid to establish a person’s true, fullname. Section 20.04 also provides that the departmentwill accept specific documents issued by a competentjurisdiction, as defined, which include an adoptiondocument; name change document; marriage certifi-cate; dissolution of marriage certificate; or a certifi-cate, declaration or registration document verifyingthe formation of a domestic partnership. Common lawdocuments are not listed among the documents inSection 20.04 of Title 13 of the CCR as documentslegally sufficient to prove ‘‘true, full name.’’

The Social Security Administration does not issuesocial security cards in common law names withoutlegal documentation. The Social Security Administra-tion states that name changes require additional legaldocumentation, and that common law name changesare not accepted. (See website, www.ssa.gov and SSAPublication No. 05-10642, dated September 2000,copy attached.) A call to the toll free number printedon the publication verified that a legal document isrequired to provide adequate confirmation of anapplicant’s identity.

CONCLUSION

After careful consideration of Mr. Ashley’s petition,the department hereby denies the petition. Thedepartment finds that the regulation is consistent withCalifornia law and should not be amended.

Act of 1986 (commonly known as Proposition 65),codified at Health and Safety Code section 25249.5et seq., provides two primary mechanisms for admin-istratively listing chemicals that are known to the Stateto cause cancer or reproductive toxicity (Health andSafety Code section 25249.8(b)). A chemical may belisted under Proposition 65 when a body considered tobe authoritative by the state’s qualified experts hasformally identified the chemical as causing cancer orreproductive toxicity. The following entities areidentified as authoritative bodies for purposes ofProposition 65, as it pertains to chemicals known tocause cancer: the U.S. Environmental ProtectionAgency, the International Agency for Research onCancer, the U.S. Food and Drug Administration, theNational Institute for Occupational Safety and Health,and the National Toxicology Program. The criteria forlisting chemicals through the authoritative bodiesmechanism are set forth in Title 22, California Code ofRegulations, section 12306.

As the lead agency for the implementation ofProposition 65, the Office of Environmental HealthHazard Assessment (OEHHA), within the CaliforniaEnvironmental Protection Agency intends to list thechemical identified in the table below as known to theState to cause cancer, pursuant to this administrativemechanism as provided in Health and Safety Codesection 25249.8(b) and Title 22, Cal. Code of Regs.,section 12306.

Relevant information related to the possible listingof nitrapyrin was requested in a notice published in theCalifornia Regulatory Notice Register on April 29,2005 (Register 05, No. 17-Z). The opportunity torequest a public forum was provided, but no such

request was received and no forum was held. Nocomments on nitrapyrin were received. The April 29notice also included a request for related informationfor the possible listing of iprovalicarb and propoxur.Each of those chemicals received one comment.Iprovalicarb and propoxur will be the subject of aseparate future notice. OEHHA has determined thatnitrapyrin meets the criteria for listing underTitle 22, Cal. Code of Regs., section 12306, andtherefore OEHHA is issuing this notice of intent to listthis chemical under Proposition 65.
