Of the 20 professions least likely to have health insurance, 11 of them are in the construction industry, according to MarketWatch.
The average uninsured rate for fulltime workers in the U.S. is 12%, but the percentage of certain categories of construction workers without health insurance is much higher, including roofers (50.5%); drywall hangers, finishers and ceiling tile installers (49.5%); plasterers and stucco masons (49.1%); fence installers (45.7%); carpet, tile and floor installers (45.2%); painters and paperhangers (43.1%); construction trade helpers (42.8%); installation, maintenance and repair helpers (40.5%); cement ma‐sons, concrete finishers and terrazzo workers (38.7%); brick masons, block masons, stonemasons and reinforced iron and rebar workers (38.6%); and construction laborers (37.5%).
At least some of the workers who reported not having health insurance coverage could be classified as inde‐pendent contractors, which means that they are operating as a business and not entitle to benefits from another employer. In most states, companies are required to carry workers' compen‐sation insurance so that if a worker is injured on the job, medical bills, partial salary, rehabilitation costs and training for a new trade, if necessary, will be paid regardless of whether the injured person has health insurance.
However, is the worker is classified as an independent contractor or contract worker, then he or she is not covered by this benefit. And, according to the Workers Defense Project, the southern U.S. is the region most likely to have construction workers laboring as inde‐pendent contractors.
As part of its study, the Workers De‐fense Project reported that only 5% of the 1,435 workers it interviewed in six southern states said workers' compen‐sation would cover the cost of their work injuries, and 57% said they earned less than $15 an hour. In Hous‐ton, specifically, 40% of construction workers interviewed had no health insurance, retirement savings, paid vacations or sick leave. More than 30% said they did not have breaks during the day and that their employer did not provide drinking water on the jobsite.
The U.S. Department of Labor and Internal Revenue Service have require‐ments for independent contractors, and employers that misclassify employ‐ees as contract labor could face penal‐ties from both agencies. Generally, independent contractors offer their services to the public. In addition, in an independent contract relationship, the employer has a say in the end product but not how the independent contrac‐tor achieves it, for example, by dictat‐ing hours spent on the job. Construction Workers Least Likely to have Health Insurance, Report Finds
SpawGlass is the Construction Manager at Risk for the Highland Parking Garage located at the ACC Highland Campus. The project is a seven‐level open parking garage providing ap‐proximately 2,385 parking spaces adjacent to a new Austin Energy District Chiller Plant. The Chiller Plant will be constructed by others.
The garage will have 5 portal gates, two along Wilhelmina Delco Drive, two along Clayton Lane, and one serving Thomas Hatfield Way. The garage will incorporate 4 elevators in two towers at the North and South ends. There will be six sets of cast‐in‐place concrete stairs. The project will include an MDF room, electrical rooms, elevator controller rooms, a mechanical room for the rainwater collection system, and an occupied office space for a parking attendant. A below grade rainwater and condensate collection tank will be located at the North end of the project that will serve to irrigate this area of the Campus including the garage, Wilhelmina Delco streetscape, Phase II East plaza, as well as the future St. John’s Encampment Park.

These are anxious times for many current and prospec‐tive immigrant construction sector employees and their employers. As firms face big staffing gaps, renewed challenges to immigrant hiring could leave at least 1.5 million workers at risk. Political battles and litiga‐tion now extend to the states and into academia. While the administration ramps up anti‐immigration rhetoric, local govern‐ments, institutions, advo‐cates and trade groups are battling federal ac‐tions, pushing to keep temporary workers, visa‐holders and undocumented populations in place. Other potential policy changes, such as restrictions on new student and professional visas and guest‐worker programs, as well as changes in legal immigra‐tion rules, also hang in the balance. These could dis‐rupt industry projects and operations, and potentially
close firms, if they are unable to replace skilled immigrant workers. The exact number of immigrants in construction who could be affected by current and pending policy changes is difficult to track, with varying levels of reporting (see charts, at top). Studies identify about 41,000 DACA‐covered workers and some 37,000 TPS‐protected Salvadorans in construction. Notably, the University of Kansas Center for Migration Research study found that, among working men, 23% reported employment in construction or in paint‐ing—the number one source of work. More broadly, a 2017 Pew Re‐search Center study re‐ported that of roughly 10 million U.S. construction workers, 15% are undocu‐mented immigrants and 12% are legal. About 21% of adult undocumented work‐ers in California work in construction, according to
the University of Southern California Center for the Study of Immigrant Rights. In other estimates, the U.S. undocumented share is 24%, while Texas‐based economist and longtime immigration trends analyst M. Ray Perryman says that the state has a 30% propor‐tion. “The bottom line is that the U.S. needs the immigrant workforce,” he says, noting that in Texas, “there are more undocu‐mented individuals working than there are unemployed people,” and that their need in construction “is particularly acute.” Accord‐ing to Ray Perryman, Texas Economic Forecaster with an aging population, “immigrant workers are an important part of a multi‐faceted solution.” The state has been a front line of
immigration reform debate.
What Will The Immigration Muddle Mean For Construction Employers?

The need to rebuild, repair, op‐erate and maintain our coun‐try’s infrastructure is, and al‐ways will be, an ongoing en‐deavor. The problem is that mi‐norities, women, veterans and other groups are seldom the contractors or high‐wage earn‐ers on infrastructure projects.
Historically, the primary funding source for the U.S. Dept. of Transportation and its infra‐structure projects is an 18.4¢‐per‐gallon gasoline tax and a 24.4¢‐per‐gallon tax on diesel fuel that millions of consumers pay at the pump. These taxes account for nearly $200 billion annually. In addition to the fed‐eral tax, states collect gasoline taxes that often are much higher, with some state rates adding as much as 57¢ per gal‐lon to a fuel purchase. Couple these taxes with airport fees, tolls and so on, and we see that much of America’s infrastruc‐ture is supported by consum‐ers—people who should have the right to participate in re‐building it. The inclusion of all Americans must be a top prior‐ity for local, state and federal representatives and the compa‐nies awarded these contracts. As financial models for these projects become more creative,
including the wider use of pub‐lic‐private partnerships (P3s), we need to ensure that funds are being used for their in‐tended purpose—to rebuild infrastructure—and that all Americans benefit from this funding. The U.S. DOT’s Disad‐vantaged Business Enterprise
(DBE) program was designed to include small business groups on federally assisted highway, tran‐sit, airport and transportation‐safety projects. The program embraces the concept of engag‐ing women, veterans and minor‐ity and small business owners in the transportation industry as
contractors and skilled workers. As such, the program provides a vehicle for increasing the partici‐ pation of DBEs in state and local procurements as well. The DBE program also ensures that small, disadvantaged business enter‐prises have access to federally funded transportation projects.
Therefore, DBE contracting op‐portunities must be preserved on P3s in addition to tradition‐ally funded public projects. States should also do their part in including small businesses by making provisions for emerging minority‐, women‐ and veteran‐owned businesses to participate
in their P3 and other projects. In 2017, according to U.S. DOT reports, 23 states and two U.S. territories that received federal tax dollars for their projects did not meet annual DBE program goals. P3s should continue to build quality projects while al‐lowing diversity to be an integral part of the investment, planning and execution of them. Commu‐nity Benefits Agreements—contracts often signed by com‐munity groups and developers that require the latter to pro‐vide specific amenities or miti‐gations to the local commu‐nity—should be utilized more often in the planning of projects that will greatly affect local com‐munities. Such amenities do not necessarily provide a monetary return to the developer but rep‐resent an investment in people and may offset any negative quality‐of‐life or environmental impacts caused by the project.
A federal standard for domestic‐ and international‐funding part‐ners must be established. In addition, the federal govern‐ment should determine fair lev‐els for tolls on P3 projects and precisely when the P3 return on investments will be satisfied.
Update – Important Changes to E-Verify Requirements for Prime Contractors and Subcontractors
Effective with all October 2017 let projects and thereafter, all prime contractors identified as the apparent low Bidder, and their subcon-tractors, on construction and maintenance projects must have an E-Verify Memorandum of Understanding for Employers (MOU) executed through the Department of Homeland Security's (DHS) E-Verify system. Noncompliance will lead to the following:
The low Bidder will be notified to comply within 5 business days from the date of notification.
Failure to comply or respond within the deadline will result in the low Bidder's proposal guaranty becoming the property of the State, and the Bidder forfeiting the proposal guaranty will not be considered in future proposals for the same work unless there has been a substantial change in the scope of work.
The Texas Department of Transportation (TxDOT) may recommend that the Texas Transportation Commission:
Reject all bids, or
Award the contract to the new apparent low Bidder if TxDOT is able to verify the Bidder’s participation in the DHS E-Verify system.
Subcontractors will not be approved to work on TxDOT projects until the information has been provided
Once a contractor or subcontractor has complied with these requirements, TxDOT will add the company name to the list of Contractors Confirmed as Participating in E-Verify to identify prime contractors and subcontractors who have provided the requested documen-tation to confirm participation in the E-Verify system.
