Hello, I would first like to thank you all for allowing me the honor of serving as President of TWUA. Being elected to serve as President of this prestigious association is a remarkable privilege that I am thrilled to undertake.

I first became involved in TWUA in 1984 when the Permian Basin Regional School was formed in Odessa, and have served on various TWUA committees during my time with the association.As I contemplated embarking upon my first year as Presi-dent, I wanted to know more about the history of TWUA. I learned that in the early 1900’s in Texas, there were more than 12,000 cases of typhoid fever, a waterborne disease, and approximately 38,000 people annually suffered from other waterborne illnesses. In 1918, Victor M. Ehlers saw a need to train water and wastewater plant operators and was instrumental in forming the Texas Water and Sewage Works Association, which later became known as the Texas Water Utilities Association. Many individuals have been involved in serving the association throughout the past 94 years, and this association continues to provide quality training and technical publications to those employed or interested in the water utilities industry. Today, Texas is recognized as having one of the best systems for operator training in the United States. We, as an organization, have a lot to be proud of. None of this would have been possible without people who were, and continue to be, willing to give their time and talents to make TWUA a success.

Water, or a lack thereof, has been in the news a lot in the past few years due to declining water sources and the need for conservation. However, unlike the early 1900’s, the Unit-ed States has one of the safest water supplies in the world due to the knowledge, expertise and dedication of water utili-ties professionals. While we may no longer take for granted that there will be water when we turn on a faucet, we do take for granted that the water that comes from that faucet will be safe to consume. That is due to the excellent service that water utility professionals provide to citizens, which most of-ten goes unrecognized.

TWUA has a program set up to recognize TWUA members that provide exemplary service in the areas of education/training, public education, association leadership, commu-nity improvement, community service, and heroism. Nomi-nations for these awards continue to decline each year. Although we know that there are people deserving of these

awards, it is impossible for TWUA staff to know the achieve-ments of the members throughout the state. Please help us recognize those achievements by nominating a deserving per-son. A nomination form is available at www.twua.org by click-ing on “Membership” and then “Awards.” Let’s make this the year that every category has a deserving person nominated for an award.

In closing, I would like to reiterate the comments of Cece White in the March issue of the Journal. If you are not currently in-volved in TWUA, there are many areas for you to become involved at the district, regional, and state level. We want and need your assistance in continuing to grow and improve TWUA. After having been involved in TWUA for 28 years, I can tell you it is an extremely enjoyable and rewarding experi-ence with which we should all be proud to be involved.

TWUA PRESIDENT: Get to Know Your New President Norma Clark, President

I hope this finds all well. The Austin area is receiving some much needed rainfall. There has not been enough rainfall for significant runoff, or at least in the right watershed, so area lakes remain low, but yards and landscapes are receiving a much needed soaking. Lake Travis is still sitting at about 39% capacity and Lake Buchanan came up slightly, to about 45%. We are seeing some improvement but many lake levels are below their intakes. We thank God for what we have received and ask that he keep supplying not only to our area, but statewide.We have been diligently working to make improvements to the membership renewal process. TWUA is built on tradition and for some, this electronic renewal process has been met with resistance. We understand that some do not have access to computers. We understand some do not consider themselves computer savvy. Central Office will always provide a means of renewal whereby you can call in and give renewal information along with payment information. We do not want to create stress for anyone if you receive a postcard indicating that your membership is expiring and using a computer is a challenge please contact Central Office at (888)367-8982 and staff will be happy to assist you.For those who prefer the electronic option, we now have an additional alternative for those who have multiple employ-ees and that is to provide an online security level where a designated person from an entity can renew all employees. For example, entity X has 10 employees. A department head, or any designee, can call Central Office and request to be set up as a “payor”. With this status, the designated person can login and see all members associated with Entity X. This person can review the list and click on the ones needing to be renewed or add new members. These membership renewals are placed into a “cart” and the payor can provide a purchase order number, check number, or credit card information for payment. The payor does not need the individual employees login or password information. Receipts can be printed and emailed to the payor. This same "payor" designation will also allow the designated person to sign up staff for training using the same method. For example you have three staff members who need to attend a 20-hour training class in your immediate area. You login to the training calendar through a very similar process and sign them up for the training. Payment options are the same as for membership renewals and again, the payor does not have to know all the employees login or password informa-tion.

If there are only one or two employees this option might not be that beneficial but if you are managing a larger staff then this may be something that you will want to call Central Office and speak with David or other staff members about. It takes about 10 minutes to get a person set up and walk them through the process. Feedback has been very positive from those who have been setup and have used the process.We are making progress on the online training project. We have all the computer and server upgrades in place. The video confer-ences equipment is also in place; it has been wired, mounted, and tested. The next phase is having the computer code written that will combine of all the individual programs into one seamless product. We anticipate delivering a working model to TCEQ for approval very soon. We cannot advertise or promote the online training until it has been approved, so please check the website, the journal and be watching your mail as we will be distributing information regarding this training opportunity in the very near future. We appreciate your patience and understanding during this process.I will have a review of TWUA Annual School next month but I am happy to say that the numbers increased significantly from last year. Exhibitor booths almost sold out. The association exceed-ed the room block at the Omni. (So for staff and management stress levels are down.) We fully understand that Corpus Christi is not centrally located. We understand that for some, attendance in Corpus is simply not an option. Contractually the association is obligated to Corpus through 2017. The facilities are a good match for TWUA and we have worked through the obstacles to where we have few issues. If you have not been to Corpus, we encourage you to give it a try. If you have participated in Annual School in Corpus, we appreci-ate your support and sincerely hope you had a great experience. Beginning the last week of April, the regional training events kick off in full force. The Southeast Texas (Beaumont) Region is April 26th. The Central West Texas (Abilene) Region is May 6th. The North Central Texas (Arlington) Region is May 16th. All these regional boards do a fantastic job in providing training opportuni-ties for the operators and managers. If one of these events is in your area, I highly encourage you to register and take advantage of this TWUA training opportunity.On a different note. In ancient Greece, Socrates was believed to hold extraordinary knowledge and wisdom. PES NEWS: The National (Federal) Pretreatment Program & Streamlining By, Alphonse Newton, City of Fort Worth

The Clean Water Act (CWA): On October 18, 1972, the Federal Water Pollution Control Act Amendments of 1972 became law, proclaiming the restoration and maintenance of the chemical, physical, and biological integrity of the nation’s water a national goal.

The CWA instituted a water quality approach along with EPA-promulgated, industry-specific, technology-based effluent limita-tions. The NPDES (National Pollution Discharge Elimination System) permit program was established under the CWA to con-trol the discharge of pollutants from point sources and served as a means to implement the industrial technology-based stan-dards for direct dischargers and to implement the categorical pretreatment standards for indirect dischargers under the POTW (Publicly Owned Treatment Works) pretreatment program. To implement pretreatment standards and requirements, EPA promulgated 40 CFR Part 128 in late 1973, establishing general prohibitions against treatment plant interference and pass through and setting pretreatment standards for the discharge of incompatible pollutants from specific industrial categories.

In 1975, several environmental groups filed suit against EPA, challenging the agency’s criteria for identifying toxic pollutants, its failure to promulgate effluent standards for numerous indus-trial categories. As a result of the litigation, EPA promulgated the General Pretreatment Regulations at 40 CFR Part 403 on June 26, 1978, replacing the 40 CFR Part 128 requirements. Also, as a result of the suit, EPA agreed to regulate the discharge of 65 categories of pollutants comprising the 126 priority pollut-ants from 21 industrial categories. The list of priority pollutants remains in effect today; the list of regulated industrial categories has grown to more than 50 distinct industries. A discussion of industry specific requirements will be provided in the near future.

The General Pretreatment Regulations establish responsibilities among federal, state, and local government industry and the public to implement pretreatment standards to control pollutants that pass through or interfere with POTW treatment processes or that can contaminate sewage sludge. The regulations, which have been revised numerous times since originally published in 1978, consist of 20 sections and 7 appendices. The most recent revision of the General Pretreatment Regulations was promul-gated under the pretreatment Streamlining Rule, which became effective in November 2005. (A copy of that rule is on EPA’s website at http://cfpub.epa.gov/npdes/pretreatment/streamlin-ing.cfm /) The Streamlining Rule addresses requirements for, and oversight of, IUs (Industrial Users) that introduce pollutants into POTWs, and it is different from other major amendments to the General Pretreatment Regulations in that it increased POTW flexibility in program implementation.

In certain instances, that flexibility can allow for a reduction in minimum program requirements. Throughout this document, wherever the Streamlining Rule is addressed, POTW staff must remember that approved programs in existence at the time of the Streamlining Rule are likely based on the older, more restric-tive requirements. To ensure that sufficient legal authority exists and that approved program and NPDES permit requirements are not violated, POTWs will, in most cases need to modify their approved pretreatment programs before implementing the Streamlining Rule. EPA encourages POTWs to discuss that and all program modifications with their approval authority. In Texas, you must contact TCEQ (Texas Commission of Environmental Quality).

The General Pretreatment Regulations apply to all nondomestic sources that introduce pollutants into a POTW. These sources of indirect discharges are more commonly referred to as IUs. Because an IU can be as simple as an automated, coin-operated car wash or as complex as an automobile manufacturing plant or a synthetic organic chemical producer, EPA developed four criteria that define a significant IU (SIU). Many of the General Pretreatment Regulations apply to SIUs as opposed to IUs; the distinction is based on the presumption that control of SIUs will, in most cases, provide adequate protection of the POTW. Where a smaller IU has the potential to adversely affect the POTW, the POTW would be expected to designate the facility as an SIU.

An SIU is defined in 40 CFR 403.3(v) as any of the following:

• An IU subject to federal categorical pretreat-ment standards

• An IU that discharges an average of 25,000 gallons per day (gpd) of processed wastewa-ter to the POTW

• An IU that contributes a process wastestream making up 5 percent or more of the average dry-weather hydraulic or organic capacity of the POTW treatment plant

• An IU designated by the POTW as such be-cause of its reasonable potential to adversely affect the POTW’s operation or violate any pretreatment standard or requirement.

With the Streamlining Rule, EPA amended the pretreatment regulations so that the POTW may (although it is not required to) modify its approved pretreatment program to consider determin-ing that a categorical industrial user (CIU) is a non significant categorical industrial user (NSCIU). To do that, the POTW must


make a finding that the CIU never discharges more than 100 gpd of total categorical wastewater (excluding sanitary, noncon-tact cooling, and boiler blowdown wastewater, unless specifi-cally included in the pretreatment standard) and the CIU meets all the following conditions as stated in 40 CFR 404.3(v)(2):

• The IU, before the POTW’s finding, has consistently complied with all applicable categorical pretreatment standards and requirements.

• The IU annually submits the certification statement required in section 403.12(q), together with any additional information nec-essary to support the certification statement.

• The IU never discharges any untreated concentrated wastewater.

Designation as an NSCIU results in reduced reporting require-ments for the NSCIU and reduced oversight requirements for the POTW. It does not in any way, however, relieve the industry of the need to comply with the categorical standards.

With the Streamlining Rule, EPA also amended the pretreat-ment regulations so that the POTW may (although it is not re-quired to) modify its approved pretreatment program to classify a CIU as a middle-tier categorical industrial user (MTCIU) as described in 40 CFR 403.12(e)(3). The POTW may apply this classification to a CIU if its discharge of categorical wastewater does not exceed any of the following:

• 0.01 % of the design dry-weather hydraulic capacity of the POTW, or 5,000 gpd, whichever is smaller, as measured by a continuous effluent-flow-monitoring device unless the IU discharges in batches

• 0.01 % of the design dry-weather organic treatment capacity of the POTW

• 0.01 % of the maximum allowable headwork’s loading (MAHL) for any pollutant for which approved local limits were developed by a POTW.

The POTW may apply the middle-tier classification only if the CIU has not been in significant noncompliance (SNC) for any time in the past two years and if the CIU does not have daily flow rates, production levels, or pollutant levels that vary so significantly that decreasing the reporting requirement for this IU would result in data that are not representative of conditions

occurring during the reporting period.

Unlike other environmental programs that rely on federal or state governments to implement and enforce specific requirements, un-der the National Pretreatment Program most of the responsibility rests on local municipalities. Thus, section 403.8(a) of the General Pretreatment Regulations provides that any POTW (or combina-tion of treatment plants operated by the same authority ) with a total design flow greater than 5 million gallons per day (mgd) and smaller POTWs in defined circumstances must establish a local pretreatment program to prevent pass through and interference. As of early 2011, approximately 1,600 POTS are required to have local programs. Although that represents only 10 % of the total treatment plants nationwide, those POTW account for more than 80 % of the wastewater flow nationwide.

CUSTOMER SERVICE NEWS: That's Just RUDE! Exploring the Rudeness Matrix By, Nancy Friedman, The Telephone Doctor

Paper or Plastic? Sound familiar? And do you know what else is familiar? How many of us have been at a checkout counter where the clerks are talking to each other and ignor-ing us, the customer? Rude, wasn’t it?

The fact is rudeness in our society is reaching epidemic proportions. We’ve all been on the receiving end of rude behavior. Somtimes, we may even be guilty of giving, rather than receiving. So what exactly constitutes rude behavior? Is it always intentional? Can you be rude by NOT taking action? Can it be an accident?

FACT: The offended party is the sole judge of whether something is RUDE or not. One person’s RUDE might be another person’s habit. Example - I might think it’s RUDE to constantly crack your knuckles, while you may feel great when doing it.

To get a clear under-standing of the term RUDE, let’s look at its definition:

a. Lacking the graces and refinement of civilized life; uncouth

b. Lacking education or knowledge

c. Ill-mannered; discourteous.

Not exactly words you’d want to be used when describing you, huh?

To make rudeness easier to identify, understand and (hope-fully) avoid, we’ve classified RUDES into the form of a matrix. On the X axis we’ve distinguished between whether the rudeness was passive or active, in other words, was it from something you did or from something you didn’t do? On the Y axis we’ve distinguished by whether the action was accidental or on purpose.

First, let’s begin with Type 1, Accidental Rudeness by Omission. This is inadvertent rudeness caused by a lack of action. Examples include:

1. Forgetting to RSVP to a function/meeting

2. Being so focused that you ignore others around you

In Type 2 rudeness we have Accidental Rudeness by Commission which is inadvertent rudeness caused by something you did. Examples include:

1. Inappropriate cell phone use

2. Sneezing into your hands and then offering to shake hands

Type 3 rudeness is Intentional Rudeness by Omission, purpose-ful rudeness caused by a lack of action. Examples might include:

1. Not returning voice mails/email or phone calls

2. Purposefully leaving a mess with the intention of having others

clean it up

And perhaps the worse offense of them all, Type 4 Intentional Rudeness by Commission. This is rudeness delivered on purpose and caused by an action you took. This is industrial strength rudeness with the intention of sending a message.

1. Being ‘nasty’ on purpose or using sarcastic humor

2. One-word answers (this is often thought of as cold and uncaring) As you can see, for such a little word... RUDE is a big topic. Let’s strive for a RUDE OUT - a day without any rude behavior.

TCEQ NEWS: Licensing Exam ProceduresBy, TCEQ Licensing Section


Effective January 1, 2012, the TCEQ Central Office located at 12100 Park 35 Circle in Austin, Texas, will no longer ac-cept walk-in applicants on the day of the exam.

In August, 2011, TCEQ Central Office implemented an online exam registration process for all applicants to pre-register for the exam sessions held at the Austin location. This was done to facilitate registration on exam day and to minimize the number of applicants turned away at each session due to over-crowding in the examination rooms.

The Central Office offers exams on the second Monday of each month. There is a morning session at 8:30 am and an afternoon session at 1:30 pm. Along with those sessions, there is an 8:30 am session for those applicants pre-ap-proved to sit for the Water and Wastewater ‘A’ exams.

Currently, walk-in applicants are allowed, on a first come-first served basis, as room allows. Since the implementation of the online registrations, however, this has become more difficult to maintain as staff must wait to make sure all pre-registered applicants are seated before walk-in applicants.

We encourage all applicants wishing to take their exam at the Austin Central Office to register online at http://www.tceq.texas.gov/licensing under the Exam Schedules and Registration page. The U.S. OSHA (Occupational Safety and Health Administra-tion) estimates that more than 1.5 million workers enter confined spaces per annum. OSHA has started to limit rights to these types of spaces with a new regulation that it expects to avoid 54 deaths and more than 10,000 injuries for every year.

The new rule governing workplace practices in confined spaces (29 CFR Part 1910.146), is estimated to influence more than 200,000 worksites, including foundries. The new standard creates safety necessities; that includes a permit system, for entry into potentially harmful spaces.

According to the rules, it is divided into types “permit-required” and “non-permit-required” spaces.

Spaces which are considered as non-permit-required spaces have been qualified by a knowledgeable professional and do not exhibit conditions that can reason serious injury. So, they may be entered without authorization.

Permit-required spaces posses serious safety hazards and before entry is to be approved there must be an entry-permit

agenda in place. Such as an agenda or program at a minimum that consist of training, hazards assessment, safety equip-ment, a designated entrant and comprehensive urgent situation plans.

The confined space must be marked with signs designating the necessity and the extent of danger. Permits should be specific in func-tions of occupants and listing names, present safety conditions, time and duration of entry, and apparatus to be used.

In addition, any entry should be monitored by a professional. A life-line has to be attached to the entrant and run back to a tripod, electrical retractor.

SAFETY NEWS: Confined Space


There has always been a sense of frustration for members and non-members trying to register for classes and renew memberships on the website, and rightfully so at times. In the past year there have been vast improvements in the website and these improvements are continuing.

The most practical for our members at this time, is the multi-payor option that is now available. The payor does not have to be a mem-ber of TWUA. Individuals in the finance department, the city secre-tary, or the department head can be setup to register employees for classes, renew memberships, and even enroll new members.

The payor is attached by employer and can see all employees that are members of TWUA that list their entity as their employer. The payor does not need to know everyone login and password this person does not see any personal information (unless adding a new member) and can renew as many members at one time as their credit card will allow.

Classes and memberships can be paid for by credit card, entering a check number, or using a purchase order number when paying for a class. There is still an occasional snag, such as members abbreviating their employers in a different way, but we have gotten very positive feedback from those enrolled as payors. The benefits to all involved are measurable:

1. Reduction of paperwork

2. Reduces the need to keep up with a long list of log ins and passwords

3. Immediate renewal or registration

4. Immediate receipt to the payor via email – no waiting on a fax or email from our processing

5. Convenience!

SECOND ANNUAL TWUA SKEET SHOOTING COMPETITION AND BBQ EVENT

Every year Ashbrook Simon-Hartley and EI2 works with our association to bring positive venues to the TWUA schools throughout the state. They have offered a competitive Skeet Shooting Event for the past two years. The event held at the Corpus Christi Pistol & Rifle Club is designed to bring our membership together in a relaxed setting for good food, drink, basic skeet, and competitive skeet shooting. All members of TWUA are invited regardless if you want to shoot or not. This year’s event had a fantastic turnout. Many members just came to visit with friends, watch the event, have some homemade BBQ, and watch the show unfold. Everyone had a good time and the event raised $220.00 in donations for the V.M. Ehlers Scholarship foundation. Regarding the competition; we had 20 plus who participated in the competitive portion this year. When the competition was drawing to an end only three were left. : First Place was George Glispin who received a $200 gift card to Academy, Second Place Izzy Parra who received a $150 gift card to Academy and third place was Andy Singer he received a $100 gift card to Academy.

Under the direct supervision of the Assistant Director/Operations, performs technical analysis neces-sary to support environmental and regulatory compliance as it relates to water and wastewater utilities. May assist Director of Operations and Water Resources on special water resource project development. Duties include, but not limited to, developing and planning technical phases of environmental projects, quality assurance reporting, In-dustrial Pretreatment, process and plant inspections, Emergency and Operations Response Program, and all related analysis and reporting. Required knowledge and experi-ence is normally obtained through the completion of four years of college resulting in a Bachelor’s degree in Biology, Environmental Sciences, Chemistry, Engineering, or related field, and three (3) years of similar work related experience working in State or Federal regulated environmental programs. A Master’s Degree in a related field and at least one (1) year of experience working in local government may substitute for minimum work experience re-quirements. Must possess good oral and written communication skills. Should be competent in the use of Microsoft Office computer software (Excel, Word & Power Point). Must possess knowledge regarding Water and Wastewater treatment, transmission, and col-lection. Must be able to read, interpret and understand industry specific permits, books, lab data, letters, manuals, instructions, and Federal, State and Local regula-tions, plans and specifications. Must be able to calculate percentages, ratios, proportions, areas, volumes, dosages and other applicable math-ematical calculations. Must possess good organizational and communi-cation skills, and have the ability to handle multiple tasks and projects. Must possess the equivalent of

at least a Texas Class C driver’s license. Possession of Class C or higher TCEQ Water and Wastewater License(s) is a plus.
