STATE TIMES NEWS JAMMU: Justice M.K Hanjura ofJ&K High Court while quashingFIR registered by the VigilanceOrganisation against the thenAssistant Custodian Jammu(Former MLC PDP) Asgar Ali inthe year 1986 observed thatwrong/incorrect or even an illegal orperverse order cannot fall within thedefinition of an offence under theprovisions of the Prevention ofCorruption (PC) Act merely becausesome procedural irregularities arenoticed by the court.
After hearing Advocate AbhinavSharma appearing for Asgar Aliobserved that no finality is attachedto an order passed by the AssistantCustodian. "It can be challengedbefore the authority designatedunder the Act as has been done inthe instant case. The power to beexercised by the Assistant Custodianis a power vested with him under astatute and under the colour of hisoffice he exercises the power of acivil court. Therefore, the action ofthe petitioner in passing an orderunder Section 8 of the Act would notfall within the purview of Section5(1)(d) of Prevention of CorruptionAct. An order passed by the civilcourt which is bad or perverse wouldnot per-se mean that its maker canbe prosecuted under the provisionsof the Prevention of Corruption Act.In such a case the scheme as provid-
ed and postulated under the Act hasto be followed by the aggrieved per-son", the court observed.
According to the case in whichpetitioner Asgar Ali has soughtquashment of FIR, Abdul Majid,son of Abdul Aziz, resident of ChakMohammad Yar Tehsil R.S Pura,Jammu filed an application underSection 8 of the Evacuees'(Administration of Property) Act,2006, on February 20, 1981 beforethe then Tehsildar (AssistantCustodian), Jammu namely,Mohammad Aslam, seeking restora-tion of the land situated at villageDeeli, Tehsil Jammu, comprisingSurvey Nos. 285, 286/1, 287 and372 measuring 47 Kanals 14 Marlasand under Khasra Nos. 283, 284,286/2 and 373 measuring 47 Kanals4 Marlas belonging to one AllahDitta, son of Noor Mohd andKaramfllahi, son of Fazal Din, onthe ground that he is their sole heir.Since the application was filed aftera period of 35 years approximatelyfrom the date, the evacuees had leftthe place, therefore, the AssistantCustodian made an endorsement onthe aforesaid application to thateffect. However, the then Custodianproceeded ahead and issued a noticeinviting objections from the generalpublic which was published in anewspaper and, thereafter, theCourt recorded the statements of thewitnesses produced by the applicant
in support of his application seekingrestoration of the land. The afore-said application came to be dis-missed for non-prosecution and wasconsigned to records. Subsequently,the same was restored to its originalnumber by the then Custodiannamely Meharban Singh posted asTehsildar, Agrarian Reforms,Jammu, at that moment. In the year1983, the petitioner came to be post-ed as Tehsildar (AssistantCustodian) Jammu, and the saidapplication was ripe for final deter-mination at that juncture. The peti-tioner decided the aforesaid applica-tion vide order dated November 25,1983 which directed that the land berestored in favour of the applicantnamely, Abdul Majid, inasmuch asno one else had opposed the afore-said application or laid any claimover the aforementioned property.The petitioner passed the said orderon the basis of the material availableon the record. However, the Policeauthorities of Police StationVigilance Organisation, Jammu reg-istered an FIR bearing No.9 of theyear 1986 for the commission of anoffence under Section 5(1)(d) of thePrevention of Corruption Act alleg-ing therein that the petitioner hadhatched a criminal conspiracy withthe applicant namely, Abdul Majid,despite the fact that at a time whenthe application under Section 8 wasfiled, the petitioner was posted at
Poonch and not in Jammu. The FIRwas registered against the petition-er, the then Assistant Custodian-Mohammad Aslam Qureshi and theapplicant namely, Abdul Majid. It isfurther contended that the orderpassed by the petitioner in the appli-cation of Abdul Majid was chal-lenged by one Siraj-ud-Din beforethe Custodian General, J&KGovernment in a revision petitionand during the pendency of the revi-sion petition, the petitioner Siraj-ud-Din died and his daughter, name-ly, Sharifa Bibi was brought onrecord as his legal heir. However,fate had it for her that she too diedduring the pendency of the revisionpetition and despite that theCustodian General allowed the revi-sion petition and quashed the orderdated November 25, 1983 vide hisjudgment dated April 23, 2008.Abdul Majid preferred a revisionbefore the Special Tribunal, Jammuin which he challenged the vires ofthe order dated April 23, 2008 of theCustodian General and the SpecialTribunal Jammu stayed the opera-tion of the order passed by theCustodian General.
The petitioner has proceeded toState that the respondent contem-plated to produce the Challanagainst the petitioner and AbdulMajid as well and MohammadAslam has been dropped from thelist of the accused.

The agitated protestorstorched the effigy of BJPamidst the slogans.
"The BJP has played thebiggest fraud upon people ofJammu region. It hasditched us all. It promisedmoon to the people ofJammu but divested us of allthat we had including ourself pride and honour.
