The speakers in the meet- ing strongly condemned the unjustified , unwanted, dra- conian, arbitrary and arro- gant order issued by SDM Mahore authorising Patwari to inspect government schools and even teachers can be suspended on the report of Ex-Sarpanch. "It is very shocking and shameful on the part of Government as teaching community is being humiliat- ed in such a manner by low rank employees of other department who have noth- ing to do with the education department. It was also stressed upon the authorities to strengthen the internal mechanism by constituting inspections and monitoring department committees or to appoint nodal officers from education department if need arises to monitor and check the schools, speakers said. The forum appealed the Education Minister to inter- vene for withdrawal of such type of illogical, biased and draconian order which can dent the image, honour and dignity of teachers' fraterni- ty. STATE TIMES NEWS JAMMU: Justice M.K Hanjura of J&K High Court while quashing FIR registered by the Vigilance Organisation against the then Assistant Custodian Jammu (Former MLC PDP) Asgar Ali in the year 1986 observed that wrong/incorrect or even an illegal or perverse order cannot fall within the definition of an offence under the provisions of the Prevention of Corruption (PC) Act merely because some procedural irregularities are noticed by the court. After hearing Advocate Abhinav Sharma appearing for Asgar Ali observed that no finality is attached to an order passed by the Assistant Custodian. "It can be challenged before the authority designated under the Act as has been done in the instant case. The power to be exercised by the Assistant Custodian is a power vested with him under a statute and under the colour of his office he exercises the power of a civil court. Therefore, the action of the petitioner in passing an order under Section 8 of the Act would not fall within the purview of Section 5(1)(d) of Prevention of Corruption Act. An order passed by the civil court which is bad or perverse would not per-se mean that its maker can be prosecuted under the provisions of the Prevention of Corruption Act. In such a case the scheme as provid- ed and postulated under the Act has to be followed by the aggrieved per- son", the court observed. According to the case in which petitioner Asgar Ali has sought quashment of FIR, Abdul Majid, son of Abdul Aziz, resident of Chak Mohammad Yar Tehsil R.S Pura, Jammu filed an application under Section 8 of the Evacuees' (Administration of Property) Act, 2006, on February 20, 1981 before the then Tehsildar (Assistant Custodian), Jammu namely, Mohammad Aslam, seeking restora- tion of the land situated at village Deeli, Tehsil Jammu, comprising Survey Nos. 285, 286/1, 287 and 372 measuring 47 Kanals 14 Marlas and under Khasra Nos. 283, 284, 286/2 and 373 measuring 47 Kanals 4 Marlas belonging to one Allah Ditta, son of Noor Mohd and Karamfllahi, son of Fazal Din, on the ground that he is their sole heir. Since the application was filed after a period of 35 years approximately from the date, the evacuees had left the place, therefore, the Assistant Custodian made an endorsement on the aforesaid application to that effect. However, the then Custodian proceeded ahead and issued a notice inviting objections from the general public which was published in a newspaper and, thereafter, the Court recorded the statements of the witnesses produced by the applicant in support of his application seeking restoration of the land. The afore- said application came to be dis- missed for non-prosecution and was consigned to records. Subsequently, the same was restored to its original number by the then Custodian namely Meharban Singh posted as Tehsildar, Agrarian Reforms, Jammu, at that moment. In the year 1983, the petitioner came to be post- ed as Tehsildar (Assistant Custodian) Jammu, and the said application was ripe for final deter- mination at that juncture. The peti- tioner decided the aforesaid applica- tion vide order dated November 25, 1983 which directed that the land be restored in favour of the applicant namely, Abdul Majid, inasmuch as no one else had opposed the afore- said application or laid any claim over the aforementioned property. The petitioner passed the said order on the basis of the material available on the record. However, the Police authorities of Police Station Vigilance Organisation, Jammu reg- istered an FIR bearing No.9 of the year 1986 for the commission of an offence under Section 5(1)(d) of the Prevention of Corruption Act alleg- ing therein that the petitioner had hatched a criminal conspiracy with the applicant namely, Abdul Majid, despite the fact that at a time when the application under Section 8 was filed, the petitioner was posted at Poonch and not in Jammu. The FIR was registered against the petition- er, the then Assistant Custodian- Mohammad Aslam Qureshi and the applicant namely, Abdul Majid. It is further contended that the order passed by the petitioner in the appli- cation of Abdul Majid was chal- lenged by one Siraj-ud-Din before the Custodian General, J&K Government in a revision petition and during the pendency of the revi- sion petition, the petitioner Siraj- ud-Din died and his daughter, name- ly, Sharifa Bibi was brought on record as his legal heir. However, fate had it for her that she too died during the pendency of the revision petition and despite that the Custodian General allowed the revi- sion petition and quashed the order dated November 25, 1983 vide his judgment dated April 23, 2008. Abdul Majid preferred a revision before the Special Tribunal, Jammu in which he challenged the vires of the order dated April 23, 2008 of the Custodian General and the Special Tribunal Jammu stayed the opera- tion of the order passed by the Custodian General. The petitioner has proceeded to State that the respondent contem- plated to produce the Challan against the petitioner and Abdul Majid as well and Mohammad Aslam has been dropped from the list of the accused. A candlelight march was carried out from Leh Gate to Balkhang Chowk by Congress Party under the leadership of DCC President and former MLA Tsering Samphel on Saturday evening demanding action against the culprits and seek- ing justice for eight year old Rasana and 17 year of Unnao rape victims. Tsering Samphel accused BJP leaders at the Centre as well as at the State for their alleged attempts to shield the culprits of such heinous crimes. "The slogan 'Achhe Din' - the good days - as promised by BJP has now turned out to be the 'dark days' as under the incumbent regime, even women and little girls are not safe in the country today," Samphel observed. While condemning the cus- todial death of the victim's father in UP, the Congress leader questioned the long silence of Prime Minister Narendra Modi and UP Chief Minister Yogi Aditiyanath as they allegedly didn't take action on time against the UP MLA accused of raping a minor. STATE TIMES NEWS JAMMU: Accusing the BJP of facilitating the promotion of separatist agenda in the State in total disregard for the sentiments of people of Jammu region, the activists of JKNPP led by Harsh Dev Singh, JKNPP Chairman and former Minister, held a massive protest at Exhibition Ground, here on Sunday seeking the resignation of all BJP ministers. The agitated protestors torched the effigy of BJP amidst the slogans. "The BJP has played the biggest fraud upon people of Jammu region. It has ditched us all. It promised moon to the people of Jammu but divested us of all that we had including our self pride and honour. Do they have the right to repre- sent the Dogras who always valued their self esteem and honour as their most pre- cious treasure?" Harsh argued. STATE TIMES NEWS JAMMU: Deputy Chief Minister, Dr Nirmal Singh, on Sunday convened an offi- cers meeting to take stock of arrangements being put in place for upcoming visit of President of India, Ram Nath Kovind, to Jammu and Kashmir on 18th April at a high level meeting conveyed at Hari Singh Palace. Deputy Chief Minister exhorted upon the concerned departments to make sure that all necessary arrange- ments are made in time for this high profile visit to the state and called for a co ordi- nated effort to make the visit a success. He said that a fool- proof mechanism should be put in place to ensure that every aspect of providing the requisite protocol and facili- ties is ensured. In his condolence message Bukhari termed the deceased a pious and gentle lady who was known for her social and philanthropic activities in the area. "In this hour of grief I extend my heartfelt sympa- thies and solidarity with the bereaved family. STATE TIMES NEWS JAMMU: Justice M.K Hanjura ofJ&K High Court while quashingFIR registered by the VigilanceOrganisation against the thenAssistant Custodian Jammu(Former MLC PDP) Asgar Ali inthe year 1986 observed thatwrong/incorrect or even an illegal orperverse order cannot fall within thedefinition of an offence under theprovisions of the Prevention ofCorruption (PC) Act merely becausesome procedural irregularities arenoticed by the court.

After hearing Advocate AbhinavSharma appearing for Asgar Aliobserved that no finality is attachedto an order passed by the AssistantCustodian. "It can be challengedbefore the authority designatedunder the Act as has been done inthe instant case. The power to beexercised by the Assistant Custodianis a power vested with him under astatute and under the colour of hisoffice he exercises the power of acivil court. Therefore, the action ofthe petitioner in passing an orderunder Section 8 of the Act would notfall within the purview of Section5(1)(d) of Prevention of CorruptionAct. An order passed by the civilcourt which is bad or perverse wouldnot per-se mean that its maker canbe prosecuted under the provisionsof the Prevention of Corruption Act.In such a case the scheme as provid-

ed and postulated under the Act hasto be followed by the aggrieved per-son", the court observed.

According to the case in whichpetitioner Asgar Ali has soughtquashment of FIR, Abdul Majid,son of Abdul Aziz, resident of ChakMohammad Yar Tehsil R.S Pura,Jammu filed an application underSection 8 of the Evacuees'(Administration of Property) Act,2006, on February 20, 1981 beforethe then Tehsildar (AssistantCustodian), Jammu namely,Mohammad Aslam, seeking restora-tion of the land situated at villageDeeli, Tehsil Jammu, comprisingSurvey Nos. 285, 286/1, 287 and372 measuring 47 Kanals 14 Marlasand under Khasra Nos. 283, 284,286/2 and 373 measuring 47 Kanals4 Marlas belonging to one AllahDitta, son of Noor Mohd andKaramfllahi, son of Fazal Din, onthe ground that he is their sole heir.Since the application was filed aftera period of 35 years approximatelyfrom the date, the evacuees had leftthe place, therefore, the AssistantCustodian made an endorsement onthe aforesaid application to thateffect. However, the then Custodianproceeded ahead and issued a noticeinviting objections from the generalpublic which was published in anewspaper and, thereafter, theCourt recorded the statements of thewitnesses produced by the applicant

in support of his application seekingrestoration of the land. The afore-said application came to be dis-missed for non-prosecution and wasconsigned to records. Subsequently,the same was restored to its originalnumber by the then Custodiannamely Meharban Singh posted asTehsildar, Agrarian Reforms,Jammu, at that moment. In the year1983, the petitioner came to be post-ed as Tehsildar (AssistantCustodian) Jammu, and the saidapplication was ripe for final deter-mination at that juncture. The peti-tioner decided the aforesaid applica-tion vide order dated November 25,1983 which directed that the land berestored in favour of the applicantnamely, Abdul Majid, inasmuch asno one else had opposed the afore-said application or laid any claimover the aforementioned property.The petitioner passed the said orderon the basis of the material availableon the record. However, the Policeauthorities of Police StationVigilance Organisation, Jammu reg-istered an FIR bearing No.9 of theyear 1986 for the commission of anoffence under Section 5(1)(d) of thePrevention of Corruption Act alleg-ing therein that the petitioner hadhatched a criminal conspiracy withthe applicant namely, Abdul Majid,despite the fact that at a time whenthe application under Section 8 wasfiled, the petitioner was posted at

Poonch and not in Jammu. The FIRwas registered against the petition-er, the then Assistant Custodian-Mohammad Aslam Qureshi and theapplicant namely, Abdul Majid. It isfurther contended that the orderpassed by the petitioner in the appli-cation of Abdul Majid was chal-lenged by one Siraj-ud-Din beforethe Custodian General, J&KGovernment in a revision petitionand during the pendency of the revi-sion petition, the petitioner Siraj-ud-Din died and his daughter, name-ly, Sharifa Bibi was brought onrecord as his legal heir. However,fate had it for her that she too diedduring the pendency of the revisionpetition and despite that theCustodian General allowed the revi-sion petition and quashed the orderdated November 25, 1983 vide hisjudgment dated April 23, 2008.Abdul Majid preferred a revisionbefore the Special Tribunal, Jammuin which he challenged the vires ofthe order dated April 23, 2008 of theCustodian General and the SpecialTribunal Jammu stayed the opera-tion of the order passed by theCustodian General.

The petitioner has proceeded toState that the respondent contem-plated to produce the Challanagainst the petitioner and AbdulMajid as well and MohammadAslam has been dropped from thelist of the accused.
