A discussion ensued regarding the RFP process, the bids that were submitted, possible conflict ofinterest regarding the bid submitted by Genivar, the Town's Engineering services contract and scopeof project.

BEING A BY.LAW TO APPOINT A DEPUTY TREASURERFOR THE TOWN OF SHELBURNE

WHEREAS, the Municipal Act, 200I, S.O. 2001, c.25, Section 227 defines that the

municipality may appoint a Deputy Treasurer;

AND WHEREAS the Municipal Act, 2001 S.O.2001, c.25 Section 227 states the role of the

municipal administration and its role as offrcers of the municipality;

NOW THEREFORE the Council of the Corporation of the Town of Shelburne, hereby

officially appoints Ms. Carey Holmes as the Deputy Treasurer for the Town of Shelburne.

I apologize for the long delay in responding to your conespondence on our Assimitative Capacity Study.

I've been holding off responding until we have had some experience with our pilot testing of a possibleeffluent filter at the shelbume wastewater.treatme-nt ptant. This letter is not meant to be a comprehensive response to your letter to Gary Tomlinson of Ðecember10,2012.

However, I wish to toucfr upon the foilowing issues at th¡s t¡me.

i) Very preliminary results from our pilot study and description of our study. We are also requesting,if possible, a recommendation on our óampting apþroach igr"b-tåriiÀ, u"r.u, compositesamples).

i¡) Some limited data on orthophosphat€ test¡ng completed in December 2o1z and January 2013and discussion.

Currently, the unit is installed in the garage of the treatment plant. We are ¡n the midst of completing four(4) different phases of the pilot study being as follows:

i) Phase 1 - filtering secondary effluent with the cloth filter in parallel with the existing sand filter

¡D Phase 2 - same as Phase 1 but adding alum to the secondary effluent before it is filtered by thecloth filter and the sand filter

¡¡i) Phase 3 - feed the cloth filter with flow from the sand filter. No atum wiil be added. This wiltmimic "double filtration" il two (2) cloth filters arê installed by tho Municipality and run in series

iv) Phase 4 - same as Phase 3 but add alum to influent of sand filter to determine the benefits ofadding alum to the double filtration trial

I attach Table A, dated Apral 9, 2013 with results of Phase 1 to date. As above, phase 1 consists ofcornparing the results of the cloth filter versus sand filtration without any alum.

These results would show.thet the incomíng-secondary influent (before filtration) is approximatety 0.1T9/L ano after sand filtration and the cloth filtration, results arE similar at appi.oximäiely O.Oo rig/LThese results are quite consistent to results we have seen previously from the existing sand filtrations¡ætem.

You will note that we have sampled. each location six (6) times as part of Phase L On one day eachweek, the sample of the final effluent (sand fillration) is done using à composite sampler which prbvidesthe weekly compliance sample for the wastewater lre_atment piant. l-iowever, w'e are not using acomposite sampler to sample the effluent from lhe cloth filter or to sampte the secondary lnituent before itenters the sand (or cloth) filter.

Hopefull¡ if the results of the,pilot sludy are successful, including showing that double filtration mightpotentially reducephosphorus levels lower than 0.03 mg/L, we would frope ó use the data trom tne fñoistudy to help iustify a possible increase in the rated.caþacity of the shdburne plant. we would grdailyregret if, at that time, the. As part of our pilot study, w6 are. also doing .orthoplosphate (solubte) testing on every third sampte.However, we are having some trouble with the lab (sGS) in being abþ tô proviù'e the low detection limitsfor the orthophosphorus compared to total phosphorus.

However, once the existing sand filter was repaired last lall, we did three (3) rounds of additional test¡ngof phosphorus from the sand fílter using Caduceon Laboratories. This data'is provided in fá¡e t.Caduceon Laboratories w9-qb-19 to analyze for total phosphorus and orthophosphorus samples down toa very low detect¡on limit of 0.002 mg/l-.

This lesting showed, perhaps surprísingly, that the orthophosphorus fraction was only i6% of the totalphosphorus before filtration, and that lhe orthophosphorus did show further removal through the sandfilter process, even without additíonal alum.

As above, the orthophosphorus fraclion before fillration was approximately 16% of total phosphorus.After sand filtration, it inøeased lo zP/o of total phosphorus, but still reduced in 2 of the 3 samples wEanalyzed through the sand filtration process. Data so far from the pilot study would show that theorthophosphorus is below 0.03 mg/L for samples (before and after filtration). We are investigating waysto further refine the orthophosphorus values for this study.

These inítial resufts would suggest that orthophosphaie levels from the Sheìburne sewage treatment planthave minimal potêntialtó aÍÍect biologicalprocesses in the receiving stream'.

You might recallduring our discussions of our Assimilative Capacity Study, including comments from theNottiawas;aga Valley Conservation Authorit¡ that lhe orthophosphorus was thought to likely form a majorportion of lhe total phosphorus component and was unlikely to be removed further through the filtrati-onprocess. This data to date shows that the orthophosphorus fraction is actually quite smali and a certainfraction of it is likely removeable through the filtration process.

AddítipnalWgrk Prooosed for This Summer

While not offigially approved by Town statl at this point, we would anticipate further work on ourAssimilative Capacity Study this sumrner. Work would include the following:

i. Re'installation of the metal weir struclure at the samo location on the Boyne River pencting landowner approval.' ln addition to adding the submerged pressure transducer, we would certainlyadd the adjacent, above-water pressure transducer to subtract changing atmospheric pressuréfrom the water pressure.

ln this regatd, your comments on our study were certainly valid. Subsequently, we were able toobtain daiU air pressure data from the Mount Forest weather station, and then do the air pressure"subtraction". This reduced the negative pressure resufts we saw initially, but still do not fullyqrwide background stream flow pattems that appear to be realistic. However, it is quite likefthat the revised procedure this year would show that background stream flows are quite búrduring the dry summer period. Nonetheless, reinstallatión of the stream flow gãuge isrecommended.

i¡. We would anticlpate doing additional stream sampling, but reducing the total number of stationssampled. We would increase the number of samples, however, as suggest€d, for each samplingstation.

However, prior to starting any field work this summer, we would like to have a follow-up meeling with yourMinistry to review your letter of last December, and the results of the pilot study that are currenilyundenray. We anticipate the pilot study being completed by mid-May of 2013, with a repoñ on"tho studtavailable shortly thereatter.

Since learning that SMHA is hosting the Local League All Star Garne in April, Skate CanadaShelburne has requested consideration to hold their annual skating carnival that same weekend.This opportunity may be advantageous to SMHA as they since learned that they cannot performrep tryouts that week to utilize the 2A hours they have committed to. We are currently workingto see if the AII Star Game can be rnoved to Sunday, April 7û to allow the skating club to havetheir carnival on the Friday night and Saturday morning.I have received information that there will be a cost of $1,500 to produce and distribute. I haveattached the explanation ftom Karin Rossi, London PublishingSMLA (lacrosse) recently forwarded information from CLA regarding new net regulations.SMI-A has asked that the CDRC purchase these new nets. - I have contacted Steve Murphy from the County of Dufferin regarding the additional cost of53,000 to wire the Town of Shelburne generator from 208 voh to 600 volt. Suggested we senda request for funding to be reviewed.

- John Telfer is currently working on the SaveOEnergy grant. We should know the outcomewithin a couple ofweeks. John has also included replacement of both compressors and a timeextension. 530,000 is currently budgeted tn2014 to replace compressor #1. Ifwe aresuccessful at receiving the grant we may be able to replace both compressors at the same timefor $30,000

- I would like to take an ORFA course in April within the Professional Development Workshopsin Guelph. The cost is $840. I am looking at two courses. Advanced Recreation FacilityEnergy Management and Managing People at Work

- By rnaking a few adjustments, we are now successfully diverting recyclable waste to reduceour waste disposal charges

Dear Mr. Hodder;

Thank you for your letter of April 3, 2OL3 re CCTV surveillance in Shelburne. I am glad that you perceiveShelburne to be a quiet, safe and friendly place. ln your letter you refer to the newspaper article inwhich Chief Moore says that cameras are being located in Greenwood Park because teens use thebicycle and skateboard facilities there. You "wonder why that segment of our community has to bemonitored in such a way". The answer is that the bicycle and skateboard facilities in Greenwood park

are unsupervised by parents or coaches unlike soccer pitches or baseball fields. Like every town inOntario, we have people living in our midst who are registered sex offenders. When the children ofShelburne play at the skateboard and bicycle facilities in Greenwood Park, they should be safe and theShelburne Police Services Board believes that it is worth the cost of the cameras to ensure this safety. I

can tell you that as an insurance broker, cameras on streets have solved several crimes and likelydeterred the commission of many more. The lives and safety of our children should also be protectedwith surveillance cameras. I hope that this explanation convinces you that this intrusion into one,s rightto privacy is worthwhile.

You also raise the topic of cross walks. We have spent S2O,O00 on the cross walk at Main and WilliamStreets and would have spent over 550,000 had we illuminated it as the MTO originally requested. I

have had just as many complaints about the creation of this crosswalk as I have had compliments. you

want more crosswalks and other people want fewer; you want fewer cameras and other:s want their kidsplaying on the skateboard and bicycle facilities in Greenwood Park with cameras and police providingprotection. We try our best to find a balance amongst the competing and contradictory desires andneeds of our cit¡zens and I thank you for taking the time to share your views with us.

Asa resident of over two years, I have noted that the town is a quiet, sare aná friendly piace. lfthere is a low crime rate, it is for the reasons of a community of peace-loving residents, and abountifully staffed potice force doing its job--

Shelburne's low incidence of crime is similar to the town where I grew up in Amprior, Ontario.Yet' it seems to me that there is an over sufficiency of law and orãer ¡n tn¡s town, as implied bythe article informing the residents of Shelbume thát more CCTVs will be installed. The articledoes not provide reasons why Greenwood Park has been drosen for rnore CCws except tomention that teenagers gather there with their bicycles and skateboar:ds. Thatmakes mewonderwhy that segment of our community has tä Oe mon¡tored in such a u,iay.

WHEREAS the Premier of Ontario has recently conveyed the Government'sdesire to limit lndusûial Wind Turbine (lWT) Projects to communities that arewilling hosts;

AND WHEREAS Council for the Townshþ of Wainfleet has received a clearmessage from its residents that they are not willing to host to lWTs in Wainfleet;

AND WHEREAS Council for the Township of Wainfleet has taken a consistentposition on the issue of lWTs;

NOW THEREFORE BE lT RESOLVED THAT the Council for the Township ofWainfleet applauds the position taken by the Premier and the Government;

I would like to t¿ke this opportunþ to make you aware of enhancements to theOmitted/Supplementary Products with the delivery of these files in 2013.

During 2013, similar to the Tax Incentive Approval (TIA), Post Roll Amended Notice (PRAI.Ðand Advisory Notice of Adjustrnent (ANA) delivery, we will also be providing the PropertyAssessment Change Notice (PACIQ file in )OVIL (Extensible Markup Language) format. Thisnew format will be in addition to the text file format that has been provided in the past.

Beginning with the first delivery of these products this year, MPAC will be piloting the inclusionof this additional file format and supporting this transition with three municipalities, with thegoal being to provide the XML format to suppliers and all municipalities with the Septemberdeliverable.

XML is designed to structure, store and transport information in a "selÊdescriptive" texfual dataformat. As an industry standard that is highly compatible with most user applications, as well asbeing the default format for most ofÏice-productivity tools, XML provides for a file format forenhanced daø delivery.

THE CORPORATION OF THE TOWN OF SHELBURNE

BY-LAW #25-2013

Being a By-law to confirm certain proceedings of Council of the Corporation of theTown of Shelburne for its Regular Council meeting held April 1512013.

WHEREAS it is the desire of the Council of the Corporation of the Town of Shelburne to confirmcertain proceedings and By-laws;

NOW THEREFORE THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE TOWNOF SHELBURNE HEREBY ENACTS AS FOLLOWS:

1. That the action of the council at its Regular Council meeting held April 15,2013,in respect to each by-law and resolution and other action passed and taken ordirection given by council at its said meetings, is, except where the priorapproval of the Ontario Municipal Board is required, hereby adopted, ratified andconfirmed.

2. That the Mayor or in his absence the presiding officer of Council and the properofficials of the municipality arc hereby authorized and directed to do all thingsnecessary to give effect to the said action or to obtain approvals where required, andexcept where otherwise provided, the Mayor or in his absence the presiding offrcer,and the Clerk are hereby directed to execute all documents required by statute to be

executed by them, as may be necessary in that behalf and to affix the corporate seal

of the municipality to all such documents, and the Mayor or in his absence thepresiding officer, and Treasurer are hereby directed to execute all other documentsnecessary in that behalf and to affrx the corporate seal of the municipality to all suchdocuments.
