DPR AMENDMENTS TO HEALTHY SCHOOLS ACT

SUBJECT: AMENDMENTS TO THE HEALTHY SCHOOLS ACT
New Requirements for School sites and
Pest Management Professionals
Recently Governor Brown signed Senate Bill 1405 which amends the
Healthy Schools Act (HSA) to require school sites (public K-12 schools and
public and private child care centers) to develop an integrated pest
management (IPM) plan and report to the Department of Pesticide
Regulation (DPR) school site pesticide use done by school site employees.
It also requires anyone doing a pesticide application at a school site to
receive specific training. This training is in addition to the existing
requirement for employers to provide pesticide safety training to employees
who apply pesticides.
CAC Involvement This letter summarizes the new HSA requirements for school sites, school
site employees, and licensed pest management professionals. The
information should help the County Agricultural Commissioners (CACs)
address questions from school site staff, DPR and Structural Pest Control
Board (SPCB) licensees, and the public; as well as, clarify the CACs' role
with respect to the HSA.
Requirements for Unlicensed School site
Pesticide Applicators
Starting January 1, 2015:
• School sites must develop an IPM Plan.
• School sites must send pesticide use reports annually to DPR for any
applications made by any unlicensed person.
Starting July 1, 2016:
• School site IPM Coordinators and any unlicensed person applying
pesticides at a school site must complete DPR-approved HSA training.
• Training must be completed annually.
DPR is currently developing online training courses to meet the HSA
requirements.
Requirements for Licensed Pest
Management Professional
Starting July 1, 2016:
• Any person hired to apply a pesticide at a school site must complete a
DPR-approved training course in school IPM and the safe use of pesticides
in relation to the unique nature of schools and children's health.
• The training course must be completed prior to using pesticides at a School
site and again during each license renewal cycle.
• This training course will be approved for continuing education credit for
both the DPR and the SPCB licensees.
CACs' Role in HSA Compliance Most of the HSA requirements are in the Education Code. There is no
enforcement of the Education Code by DPR or CACs. If CAC staff
encounters potential violations of the Education Code's HSA provisions,
they should inform the school site that they are out of compliance with the
HSA requirements as a courtesy. The requirement for anyone applying
pesticides at a school site to receive specific training has been added to the
Food and Agricultural Code section 13186.5. This section is enforceable by
DPR, not the CACs. This requirement goes into effect July 1, 2016.
Healthy Schools Act Amendments • Education Code (amended Sections: 17609, 17610, 17611, and
17612; added Sections: 17611.5 and 17614.

• Food and Agricultural Code (amended Sections: 12996, 12999.4,

The Department of Pesticide Regulation’s (DPR) School Integrated Pest Management (IPM) Program has produced an
online IPM video series. These ten entertaining, short, educational videos review IPM techniques, include practical IPM tips
from experts, and compliance information for the California Healthy Schools Act. The video series includes information
presented by UC IPM specialists, licensed pest management professionals, California school district employees, and DPR
scientists. Topics covered in the video series include: pest prevention, inspecting and monitoring for pests, IPM for ants,
cockroaches, gophers, turfgrass weeds, and much more.

My name is Sharise Elaine Alvitre. In 1986 my twin
sister Shanna and I were born into a farming family of
three; my Dad Peter, Mom Kim and Brother Justin. I’m a
Visalia California native that quickly fell in love with
agriculture, the lifestyle my family had so long been
immersed in. While attending Golden West High School
my focus became horticulture and anything plants.
I was a member of the Ornamental Horticulture Judging
Team, which I enjoyed immensely, and took every class
I could pertaining to the subject. Once enrolled at the
local Community College, my studies continued to be
heavy in horticulture. Upon transferring to Cal Poly
San Luis Obispo I entered into the Horticulture/Crop
Science Department where my passion for plants
developed into a Bachelor’s of Science Degree in
Environmental Horticulture Science and a minor in Plant
Protection Science.
After graduation, I jumped into the working world and
decided to get my Pest Control Advisors License and
Qualified Applicators License. I worked in the vegetable
transplant industry, the post-harvest chemical market
and now I am truly enjoying my new career as the PAPA
Regional Educational Director for the Central Valley.
I also enjoy photography, baking, gardening and all
things outdoors. Lastly, I’d like to mention that in May,
my love for plants will shine through yet again as I marry
my fiancé, Cody Van Dam, amongst the gardens at
Cambria Pine Lodge! I look forward to my future with
PAPA as well as meeting all the fine people involved
with the organization!

PAPA holds a yearly golf tournament to raise funds for
the scholarship program.
The Pesticide Applicators Professional Association
Golf Tournament was initiated thirteen years ago to
raise funds for a statewide scholarship program as an
investment in the agricultural and horticultural indus-
tries. In the past thirteen years, PAPA has awarded
over 36 scholarships to students interested in building
a career in our industry.
Through this Golf Tournament, you can be part of
continuing this great tradition of providing scholarships
to deserving students and encouraging their continued
interest in the agricultural and horticultural fields.
Levels of participation range from $150 (Hole/Tee
Sponsor) to $1,000 (Platinum Beetle).

In August 2012, we wrote about the Asian citrus psyllid (ACP) in UC IPM’s Green Bulletin newsletter (http://
www.ipm.ucdavis.edu/PDF/PUBS/greenbulletin.2012.aug.pdf). At that time, ACP was found only in San Diego, Imperial,
Riverside, San Bernardino, Los Angeles, and Orange counties. It has since been detected in Ventura, Santa Barbara, San
Luis Obispo, Fresno, Kern, and Tulare counties, and in the last three months has been found in San Joaquin and Santa
Clara counties (Figure 1). Because ACP can transmit the bacterium causing the most devastating disease of citrus in the
world, huanglongbing (HLB) or citrus greening, it is imperative that this pest be managed as intensely as possible
(Figure 2). To keep the psyllid from spreading further, ACP host plants (citrus and close relatives) in all or part of these
counties are under quarantine and cannot be moved out of the quarantine area. We cannot stress strongly enough that
landscape professionals, including residential and maintenance gardeners, can play a major role in minimizing the spread
of this pest or HLB. To build upon the information from 2012:
Always purchase citrus trees from a reputable nursery that sells certified disease-free trees.
Uncertified trees may provide the insects with a source of disease they can pass on to other trees!
Be careful not to move any citrus trees out of the quarantine area to un-infested areas. If you purchase a citrus plant
from a nursery that is within an ACP quarantine area, it will have a blue or yellow tag on it that requires the plant to
stay within the quarantine area. Purchase plants close to where you plan to plant them!
As you are planting or caring for citrus, carefully check the leaves and stems for psyllids. See these web sites for pho-
tos of the pest: http://www.CaliforniaCitrusThreat.org or http://www.PeligranCitrusenCalifornia.com. If you or your
customer suspects you have seen the pest or disease, immediately call the CDFA Hotline 1-800-491-1899. When you
report the psyllid, CDFA personnel will tell you if they will be treating the reported trees or if you are to manage the
ACP population yourself.

It is very important to know if you are in an ACP infested area and; if you are, to handle green waste carefully. If you
are pruning citrus or other ACP hosts, double bag prunings before transporting them to avoid moving ACP to new
areas.
Educate your clients to dry out their clippings before placing them in green waste bins to avoid spreading A C P.
If you think you have seen the disease, CDFA personnel will take leaf samples to confirm infection of the tree by a
biochemical test; and if the infection is found, regulatory actions such as tree removal will take place.
Be vigilant and help to protect California’s citrus trees!
