The information you provide in this document is collected under the authority of Section 140 of the Immigration and Refugee Protection Act (IRPA) for the purposes of recording events and key information related to seizures as well as to track the handling and disposition of the travel and/or identity documents. The information may be disclosed to Citizenship & Immigration Canada (CIC) for the purposes of admissibility determination. Individuals have the right of access to and/or can make corrections of their personal information under the Privacy Act. The information collected is described within Info Source under the Travel and Identity Document System (TIDS) Personal Information Bank CBSA PPU 036 which is detailed at http://www.cbsa-asfc.gc.ca/.

Under the Immigration and Refugee Protection Regulations (see reverse), you can apply for the return of seized document(s) if you are: • the lawful owner of a seized document, or • the person from whom the document was seized.

THE PERSON FROM WHOM THE DOCUMENT WAS SEIZED If you are the person from whom the document(s) was/were seized, you may apply in writing for the return of the document(s) within 30 days after the seizure if the document(s) was/were seized on the ground(s) that it was/ they were fraudulent or improperly obtained or used. The seized document(s) shall be returned to you, the person from whom the document was seized, if you demonstrate that:

• the document was not fraudulently or improperly obtained or used. LAWFUL OWNER * Please note that for certain travel/ identity documents eg. passports, the lawful owner is the authority that issued the document and not the document bearer. If you claim to be the lawful owner of the document(s) that was/were seized, you may apply in writing for the return of document(s) within 60 days after the seizure. The seized document(s) shall be returned to you, the lawful owner, if you demonstrate that:

• you were the lawful owner of the document before its seizure and remain the lawful owner; • you did not participate in the fraudulent or improper use of the document; • you exercised all reasonable care to determine that the person permitted to have the document was not likely to use the document fraudulently or improperly; and • the return of the document would not be contrary to the purposes of the Immigration and Refugee Protection Act.

The Immigration and Refugee Protection Regulations provide the following provisions whereby a person may apply for the return of a seized object. 254. (1) The lawful owner of a thing seized or the person from whom it was seized may apply for its return. 255. (1) For the purposes of paragraph 253(2)(b), a person who claims to be the lawful owner of a seized thing may apply in writing for its return within 60 days after the seizure. (2) The thing seized shall be returned to an applicant if the applicant demonstrates that they (a) were the lawful owner prior to its seizure and have remained a lawful owner; (b) did not participate in the fraudulent or improper use of the thing; and (c) exercised all reasonable care to satisfy themselves that the person permitted to obtain possession of the thing was not likely to fraudulently or improperly use it. (4) A thing seized shall only be returned if its return would not be contrary to the purposes of the Act. (5) The applicant shall be notified in writing of the decision on the application and the reasons for it. If the applicant is notified by mail, notification is deemed to have been effected on the seventh day after the day on which the notification was mailed. 256. (1) If a thing was seized on the ground that it was fraudulently or improperly obtained or used, a person from whom it was seized may apply in writing within 30 days after the seizure for its return. (2) The thing seized shall be returned to an applicant if the applicant demonstrates that it was not fraudulently or improperly obtained or used. (3) An applicant shall be notified in writing of the decision on the application and the reasons for it. If the applicant is notified by mail, notification is deemed to have been effected on the seventh day after the day on which the notification was mailed.
