Dear All An opportunity to make a difference We at SAVE the Vaal Dam urgently require you to register as an interested an affected party (IampAP) in the Environmental ImpactAssessment (EIA) Process of the licensing of the Vaalmarina Landfill Site A Brief HistoryWe at SAVE vaaldam have for several years objected to the Vaalmarina Landfill Site which pollutes the area the ground waterand the water in the Vaal Dam Despite our efforts an EIA process was begun to license this site This process was seriouslyflawed and even though we registered as an IampAP the public participation process was never followed to allow the public toparticipate which was in contravention to laid down procedures As a result we contacted the Gauteng Department ofAgriculture Rural Development and with their assistance the process was overturned and restarted This will allow all theInterested and Affected Parties to come forward and participate in the EIA process which was not allowed previously The PublicParticipation Process has again not been advertised at all in our area so please use this opportunity to register and stop thisactivity from proceeding Some of our reasons for objecting to the licensing of the Landfill Site

1 The Landfill Site is too close to the water course2 The landfill site is on a slope and in the rainy season the water flowing over the landfill site becomes contaminated and

flows into the Vaal Dam3 This contaminated water flows in close proximity to where we extract our drinking water for Vaalmarina Vaal la Mer and

Mamello (This includes all the Complexes) as well as in close proximity to where Eskom extract their drinking water4 This also affects downstream users and the drinking water quality of Gauteng5 This site is too close to the Vaalmarina residential area6 This water flows through a wetland which is not mentioned in the EIA report7 Water from a borehole used for drinking purposes is downstream of this site

complaint from SAVE requesting GDARD to intervene SAVE had requested to

be registered as IampAPs for the Waste Management Licence Application on Portion

1 of Farm Vaalview 486 IR Vaal Marina landfill site - Project reference Gaut

00209-10W0035 however the Environmental Assessment Practitioner (EAP)

Khalimba Consulting neither registered them as IampAP nor communicated with

SAVE on the project SAVE had provided GDARD with its communication with

Mr TM Shabangu of Khalimba Consulting which was reviewed by GDARD

32 TP indicated that it was not correct that he had told SAVE that a waste licence was

issued to Midvaal

33 ZS indicated that GDARD wants to confirm that contrary to the claim made by

SAVE the waste licence for Vaal Marina landfill site has not yet been issued by

GDARD She explained that in terms of the Waste Act DWA is required to issue a

Record of Decision (RoD) before a waste management license may be issued by

GDARD An ROD was received by GDARD from DWA on 19 February 2013

34 ZS concluded that the meeting was therefore a fact-gathering session whereby

GDARD will gather information to address the complaint regarding the

Environmental Impact Assessment Process (EIA) process going forward

4 Background

41 ZS indicated that GDARD is the Competent Authority for issuing waste

management licence applications for general waste sites in the Province and has

reviewed the application She then checked with ACE (the new EAP for the

project if ACE has received the GDARD response regarding the application ZS

indicated that upon review GDARD found that SAVE was not included or

registered as IampAPs on the EIA process

42 GU indicated that the NEMA public participation process is clear on what needs to

be done He also indicated that when they took over the project from Khalimba

and they have not seen a letter or any documentation from SAVE requesting to be

registered as IampAPs

43 GU then requested clarity from SAVE if they have registered as IampAP and

requested SAVE to furnish ACE with the background documents (It then became

clear that the new EAP did not have the records of SAVE being registered as a

IampAP)

44 IM indicated that SAVE had registered but they were ignored and not included as

registered IampAP by the EAP Khalimba Consulting SAVE then sent a request to

the Office of the Gauteng Premier Hellen Zille and DWA to investigate the matter

as they have objections to the development SAVE alleged that this landfill causes

pollution in the Vaal dam

45 IM further indicated the public participation adverts for this application on the Star

Newspaper were advertised during December holidays

5 Discussion

51 ZS suggested that SAVE must send all the information to ACE as they are the

new project EAP and all correspondences must be made with them

52 ZS indicated that ACE must address all the issues raised by IampAP as required

53 ZS enquired where and when sampling for the water sample results attached on

the complaint letter taken by SAVE IM indicated that the water samples were

taken in 2011 from the barrow pit which was conducted independently by CSIR

54 SM indicated that the Midvaal municipality conducts water sampling annually

and have a borehole on site When doing water sampling they follow minimum

requirements guidelines from DWA

55 ACE suggested that during the EIA construction consideration may need to be

done to mitigate potential impacts

56 OP indicated that the water sample from the pit was filled with garden waste

and the water which is channelled to the dam was storm water

57 TP indicated that the 2011 water sample results submitted by SAVE are outdated

and suggested that SAVE MLM and EAP should take new water samples

together and a proper scientific analysis must be done TP suggested an Isotope

analysis will have to be undertaken

58 ZS indicated that based on the suggestions that TP have put forward he should

confirmverify if the water analysis method was included in the RoD drafted by

DWA ZS advised that DWA do not have to come up with new methods which

are not on the RoD

59 GU commented that there should be no contamination from landfill to the Dam

if mitigation measures from EIA are implemented He also suggested that DWA

should provide a suitable sampling method for this activity TP indicated that he

will first check what the RoD conditions are saying before coming with

suggestions

510 BV indicated that their (Eskom) lab is not accredited and they do onsite

sampling including hydro-census sampling on a monthly basis

511 RH alleged that the landfill is illegal and from his point of view if the site is

going to be licensed it will not be closed

512 ZS indicated that in South Africa we have old landfill sites without licences

which existed before environmental laws regulating landfill sites came into

effect Vaal Marina landfill site is operating without mitigation measures or

compliance conditions currently as it is unlicensed However the move taken by

Midvaal Local Municipality to license this site is commendable as this will

ensure there are compliance conditions for operating the site in order to prevent

potential environmental impacts

513 RH further indicated that due to water quality we cannot compare this landfill

with other landfills even though it is old

514 OP indicated there are three (3) realities for Vaal Marina Landfill site

a) No landfill at all (this was not an option as the nearest landfill would be

about 60 km away)

b) Have the landfill without conditions or

c) Have a landfill with conditions

515 OP further indicated that it will depend on the outcome of the recommendations

made on the final report which need to be resubmitted to GDARD with

addressed concerns from IampAPs

516 SM indicated there is money available from MIG funding to put up

infrastructure SM further indicated that people should see this exercise that will

help the site to be operated appropriately

517 During a walk-about on the site OP raised noted that the site maps used by

SAVE in support of its complaint were incorrectly indicating the boundary of

the landfill site relative to the surrounding neighbours It was noted that SAVE

was selling properties around the site

6 Way forward

61 It was concluded that the public participation process must be conducted again

and be open and transparent

62 MLM and ACE to indicate in the EIA report when the landfill was established

63 SAVE to provide ACE with all their concerns and ACE must respond to all the

issues raised in the Environmental Impact Assessment Public Participation

Dear All We would like to make changes to the minutes as follows 32 TP indicated that it was not correct that he had told SAVE (vaaldam) that a wastelicense was issued to MidvaalSAVE (vaaldam) never claimed that a waste license had been issued SAVE (vaaldam)were advised at the last Vaal Dam Water Forum Meeting that took place on the 28February 2013 that the EIA process had been approved for the abovementioned site byMr Thya Pather and that a ROD had been issued by DWA However no publicparticipation took place nor were any meetings held to this affect in Vaalmarina Vaal laMer or Mamello 44 IM indicated that SAVE (vaaldam) had registered but they were ignored and notincluded as registered IampAP by the EAP Khalimba Consulting SAVE (vaaldam) then sent arequest to the Office of the Gauteng Premier the GDARD ndash Euphenia Shezi and MrLourens Badenhorst and DWA to investigate the matter as they have objections to thedevelopment SAVE (vaaldam) alleged that this landfill causes pollution in the Vaal Dam 45 IM further indicated that a public participation advert for this application was placedby Khalimba Consultants on the door of LFS Hardware to register as an IampAP that weregistered but he advised that he had just finished the Public Participation Process forWalkerville and would let us know when the meeting for the Vaalmarina Landfill Sitewould be held in Vaalmarina This never happened Nor were adverts placed in lsquoTHESTARrsquo which is the only newspaper that is available in this area by the Company thattook over from Khalimba Consultants which SAVE (vaaldam) scrutinize on a daily basis 56 OP indicated that the water sample from the pit was filled with garden waste andthe water which is channeled to the dam was storm water SAVE (vaaldam) producedphotographic evidence that this was not the case Photographic evidence was also shownwhere the water from the burrow pits was pumped out and left to flow into the VaalDam The tests conducted by the CSIR confirmed the contamination of the water test 510 BV indicated that their (Eskom) lab is not accredited and they do onsite samplingincluding hydro-census sampling on a monthly basis SAVE (vaaldam) stated that this

borehole which was used for drinking water was not mentioned in the EIA report Norwas the close proximity to the Water Purification Works mentioned The close proximityof Eskom Grootvlei and Vaalmarina abstraction pumps was also left out of the EIAreport 512 ZS indicated that in South Africa we have old landfill sites without licenses whichexisted before environmental laws regulating landfill sites came into effect Vaal Marinalandfill site is operating without mitigation measures or compliance conditions currentlyas it is unlicensed However the move taken by Midvaal Local Municipality to license thissite is commendable as this will ensure there are compliance conditions for operating thesite in order to prevent potential environmental impacts SAVE (vaaldam) stated that thelandfill site was less than 400m from the Vaal Dam and had a direct impact on the waterquality of the Vaal Dam How can you license something that is illegal and has adetrimental affect on the drinking water of Gauteng 514 OP indicated there are three (3) realities for Vaal Marina Landfill sitea) No landfill at all (this was not an option as the nearest landfill would be about 60 kmaway)b) Have the landfill without conditions orc) Have a landfill with conditionsSAVE (vaaldam) stated that Midvaal should source another site which does not haveinherent fatal flaws that affect the Vaal Dam Mr Thya Pather was requested at a WaterForum meeting to liaise with Midvaal a long time ago as we had a Landowner who wasprepared to donate a portion of his property to Midvaal for this purpose provided he begiven environmental credits Mr Thya Pather never came back to SAVE(vaaldam) andnothing happened and the land was subsequently sold 517 During a walk-about on the site OP raised noted that the site maps used by SAVE insupport of its complaint were incorrectly indicating the boundary of the landfill siterelative to the surrounding neighbours Only one map was incorrect The Google EarthMaps and Garmin Maps are correct in showing the distances away from the Vaal DamWater Purification Plant and surrounding properties It was noted that SAVE was sellingproperties around the site SAVE (vaaldam) do not sell properties at all SAVE (vaaldam)is a registered NGO which fight pollution of the Vaal Dam and other environmentalissues This should be amended to lsquothe Property Owners whose properties border on theLandfill Site are unable to sell their properties due to the proximity of the Landfill Site tothese propertiesrsquo 64 Save (vaaldam) needs to correct their information as site maps submitted regardingthe site were incorrect Only one map was incorrect The Google Earth Maps and GarminMaps are correct showing the distances away from the Vaal Dam Water PurificationPlant and surrounding properties OP also stated that the Landowner behind the LandfillSite had fenced some of the land belonging to Midvaal in with his farm however theLandowner had his property surveyed by a Land Surveyor according to the SG Diagramfor his property before he refenced his property
