Section 4(f) Evaluation Coordination for the Proposed Ocean Parkway Bikeway Project in Nassau & Suffolk Counties, New York

Dear Ms. Reilly:

On behalf of the Federal Highway Administration, we are writing to confirm the information stated in your letter dated November 12, 1999 regarding your comments on the proposed Ocean Parkway Bikeway (see attached). Previous correspondence between our consultant KC Engineering and New York State Office ofParks, Recreation and Historic Preservation included detailed information and mapping on the proposed action because of its use of State Park property.

Please respond to this letter in order to confirm or dismiss the previous determination ofno harm to Jones Beach State Park, Captree State Park, and Gilgo State Park. Following Alternative I-A, the bikeway passes through Jones Beach and Captree State Park, and along the edge ofGilgo State Park. However, due to its close proximity to the bikeway, Gilgo State Park has been included as a Section 4(f) resource in addition to Jones Beach State Park and Captree State Park. In accordance with 23 CFR §771.l35, coordination with those having jurisdiction over the said properties is required.

Please provide comments within 21 days of receipt of this letter. In particular, we are requesting your concurrence that the proposed use ofthe properties under your jurisdiction "will not impair the use of the remaining park properties". This determination is necessary in order for the project to proceed under Section 4(f) of the Federal Department of Transportation Act. I am asking for your assistance in my efforts to construct' a bicycle and jogging path along the north side of Ocean Parkway from the Nassau County path to Gammers Park in West Islip. My request for a feasibility study on the path was sub'!1itted to the L0.'19 Island .State Park and Recreation Commi.ssion iTlmid-JulYQ' '.' ,

The extension of this path from the Wantagh Parmvay to Gardner's Park would provide a wide, range of benefits to the people of SUffolk. COWlty. ;It would insure greater u~ilizati01l of ow' marvelous shoreline, promote healthful recreation9' and tmpro-Je our ~nvironment.

A bicycle and fogging path would give a :sedentary population in. danger of cardiovascuZar disease the means to engage in vital aerobic exercise. Those Who now enjoy riding, rwming, and rollerskating in proximity to the ocean. now often are forced to use, the', roadway, endangering themselves as well Q3 motorists. Entire families woulti. have a chance for wholesome outings. '

This path would offer a iafe route for yowlg people, 'Who do not drive.. to get to and from the beach.. It would create a productive outlet for teenagers whop too often, have unstructured time on tneir hands and would discourage the dangerous practice of hitch-hiking.

Construction of a bicycle and jogging path 'Would provide a boost to ou.r economy. Income would certainly be generated for Long Island citizens through jobs in the building of the path and increased tourism.

The Town of Islip would like to take this opportunity to express its strong support for a proposal to provide a bikeway on the bridge between Robert Moses and Captree state Parks.

The vista from L~is bridge offers a breathtaking view which would be enhanced by bicycle use. The spectacular success of the Newsday Bike-a-thon where over 18,000 bicyclists use the bridge is an experience, which in our opinion, should become permanent. The long standing success of the Wantagh Parkway Bikeway tor ones Beach is a similar example of the appeal bicycle access to the ocean has or Long Islanders. We also feel that providing access for bicycles on the

Robert Moses Causeway between captree Island and West Islip would be appropriate. With the increased use of bicycles by all ages of the population, such a link extending from Montauk Highway, already a well used road for bicycle clubs and individuals, would all a priceless recreational amenity to our region.

I Dear Mr. Petrou:

Please allow me, on behalf of all cycling enthusiasts in Suffolk County, to express my· support for the construction ofa bike trail along Ocean Parkway, from Captree State Park to the Wantagh Parkway.

I have been informed that rehabilitative construction has already commenced on a similar path along the Robert Moses Parkway, terminating at Captree. Likewise, I understand a cycling path currently exists along the Wantagh Parkway, terminating at Ocean Parkway. This additional route I beleive would prove a perfect complement to the existing paths. In addition to making the ocean beaches more accessible to our non-motoring public, such a route might lure cyclers from other areas to Long Island, thus increasing tourism and its related revenues.

Judgmg from a review of recent amendments to the Surface Transportation Program (STP) dated April 17th., it is obvious that the Department is committed to several cycling projects, both of a safety and a\';cess nature, in the near future.

While I am cognizant of the limited funds which may be available for Departmental projects following the iidoption of a state budget, it would be appreciated if this idea could be considered by the Department and its affiliated advisory committees.

Dear Director Petrou:

I am writing on behalf of thousands of constituents, to urge the State of New York to include a bicycle lane on the Robert Moses Causeway,

The reconstruction of the causeway's span over the Great South Bay provides New York with a perfect, cost efficient opportunity to provide a magnificent enhancement to our transportation and parks systems. Tens of thousands of cyclists from senior citizens to children would welcome the opportunity to bike across the Bay to the State and Town parks. Bicycling and Roller Blading continue to grow in popularity as more people appreciate the value of exercise, sport and recreation. For as long as I can remember. constituents have wondered why the Wantagh Parkway possesses a bike path leading to the ocean beaches, but the Moses Causeway does not.

A bike lane will ease motor traffic, reduce pollution, contribute to improved public health, and promote public confidence for govenunent initiatives.

Accordingly, I urge the State to construct a bicycle lane from 27A to our and along our ocean beaches as part of the Robert Moses Causeway reconstruction.

Dear Mr. Glass:

After reviewing the documentation sent to us concerning the possible construction of a bicycle path along the Robert Moses Causeway, we offer the follov..ring comments for your consideration:

1) We believe that such a facility is definitely needed and should be constructed. It should run from the Long Island mainland to the interior of Robert Moses State Park. Although this will be more expensive than tenninating the path at Captree State Park, there will likely be a bicycle accident on the Fire Island Inlet Bridge unless provisions are made for the safe passage of bicycle traffic over that structure, since most bicyclists will want to make the beachfront at Robert Moses their ultimate destination.

2) We favor cantilevering the bicycle path off both the Robert Moses Causeway Bridge and Fire Island Inlet Bridge, rather than encroaching on existing motor vehicle lanes to provide for bicycle traffic. Where the shoulders of the road provide more space, we recommend installing the paved bicycle lane(s) away from the motor vehicle lanes and along the brush line with an appropriate guide rail separating bicycle traffic from motor vehicles ..

Although we recognize that design and construction of a bicycle path in line with the recommendations above will result in significant expense, we are convinced that this is the only way to provide for a reasonable margin of safety while, at the same time, addressing- the fact that most bicyclists will choose Robert Moses State Park, not Captree, as their destination. Neil Ackerson and I received the attached aerial photocopy of Captree state Park. We met with Neil Rosenberg and discussed the possibility of extending the existing parking field to the west for both the purposes of a bicycle corral, bus transfer station, and additional parking for the boat launching ramp.

The attached photocopy shows the approximate outline of this area, leaving a secure area for our existing maintenance yard while allowing east/west traffic to flow into the newly constructed area, and a walkway to allow those people who may be parking in the area access to the boat launching ramp.

Thank you once again for the opportunity to discuss the future design of the bicycle paths and possible parking facility.

Engineering is assisting Site Blauvelt with the environmental research. The objective of the project is to design and construct a bikeway between the Wantagh Parkway and the Robert Moses Causeway. This will provide a continuation of the existing bikeway at Wantagh State Parkway and connect the Captree and Jones Beach State Park systems. Attached are copies of the project location and topographic maps.

We would appreciate your review of the Significant Habitat Program and Natural Heritage Program Files for any occurrences ofendangered, threatened, or special concern wildl ife species, rare plants, and critical or unique habitat areas that have been recorded on or in close proximity to the project site. We understand that the absence ofdata does not necessarily mean that rare species or habitats do not exist, and that this information wi II not be a substitute for site-specific surveys.

The above referenced project, as described in the attached design repo~, proposes to construct a bikeway running parallel to Ocean Parkway from the Jones Beach Bath House to the Captree State Park. On May 6, 1999, NYSDOT Region 10 met with the OPRHP Long Island Regional staff who supported the project. This project is the first of several projects NYSDOT Region 10 anticipates progressing on Long Island National Register eligible Parkways.

NYSDOT requested that we setup a meeting with your office to discuss this project and the integration of bikeways into the National Register parkway system. We plan to contact Julian Adams this week to set up a meeting in late September.

This responds to your letter ofNo~ember 7, 2001, requesting updated infonnation on Federally listed or proposed species for the Ocean Parkway Bikeway Project in Nassau and Suffolk Counties, New York. We previously provided comments to your office on this project in our September 14, 1999, letter.

As'mentioned in our September 14lh letter, the piping plover (Charadrius melodus) and seabeach amaranth (AmaTcmthus pumilus), both Federally listed threatened species, are known to occur in the vicinity ofthe proposed project area. The project's environmental documents should, therefore, include an evaluation of the potential direct, indirect, and cumulative effects of specific project-related activities on the piping plover and seabeach amaranth or their habitats, and include appropriate measures1 ifnecessary, to protect these species and their habitats. This information should be forwarded to this office and it will be used to evaluate potential impacts on the piping plo~er and seabeach amaranth or their habita4 and to determine the need for further consultation pursuant to Section 7 ofthe Endangered Species Act (87 Stat. 884, as amended: 16 U.S.C. 1531 et seq.).

Except for the piping plover, seabeach amaranth, and occasional transient individuals, no other Federally listed,or proposed endangered or threatened species under our jurisdiction are known. to exist in the project impact area. In addition, no habitat in the project impact area is currently designated or proposed "critical habitat" in accordance with the provisions of the Endangered Species Act. Should project plans change., or ifadditional information on listed or proposed species becomes available, this determination may be reconsidered, .An updated compilation of Federally listed and proposed endangered and threatened species in New York is enclosed for your information.

The above comments pertaining to endangered species under our jurisdiction are provided pursuant to the Endangered Species Act. This response does not preclude additional Service comments under the Fish and Wildlife Coordination Act or other legislation.

The black rail (Lateral/usjamaicensis) is known to also occur in the project area. This species is considered a species ofconcern (formerly known as Category 2 Candidate species) by the

and its status is being monitored throughout much of its range. Species of concern do not receive substantive or procedural protection under the Endangered Species Act; however, the Service does encourage Federal agencies and other appropriate parties to c0nsider this species in the planning process. The common tern ~terna hirundo) is also known to occur in the project area, but is only considered a species of concern by the Service in the Great Lakes region.

Federally listed enda.ngered and threatened marine species may be found near the project area. These species are under the jurisdiction of the National Marine Fisheries Service. Work in certain waters and wetlands of the United States may require a permit from the U.S. Anny Corps ofEngineers (Corps).
