    Dear Ms Chick,

    Thank you for you letter of 8 November which was considered by the Council at its meeting on Monday 2 December 2013.

    The Council was very disappointed to hear that Craven District Council was considering withholding all or part of the parishes portion of the Council Tax Benefit Support Grant as awarded by Government for 2014/15.

    CLG Minister, Brandon Lewis MP, made it clear at the Despatch Box on Monday 25 November that the Government expects all billing authorities to pass the grant on, and has informed NALC that he will approach directly any authority withholding it.

    In response to your question regarding the potential halving of the grant by Craven, due to the uncertainties concerning the future availability of the grant and the potential capping of the precept, this Council took the decision to set a precept to cover all its expenditure in 2013/14. This led to a 6% increase in precept payments on residents that pay Council Tax but ensured that the Councils ability to cover the cost of its services was protected ongoing. The grant payment received last year will be used to offset any possible increases in spending required in the coming year. Likewise any available grant for the coming year will be used for the same purpose.

    The uncertainty over the grant payment at this time of year is extremely unhelpful, particularly when budgets are tight and parishes are attempting to pick up the tab for services no longer provided by the District and County Councils like public toilets, some grass cutting and other general maintenance.

    The Council would hope that the grant will be passed on in full, as is the expectation of the DCLG and would urge Craven District Council to comply.

    I am writing with the comments of Draughton Parish Council on proposals for the parishgrant 2014/15 (your letter dated 8 November refers).

    If the District Council is to halve or withhold altogether the government grant intendedto be passed on to parishes to mitigate the effects of the Localisation of Council Tax,Draughton Parish Council will set a parish precept which will raise sufficient funds forbudgeted expenditure. Although the impact of a decision not to pass on grant moniesis, for us, fairly minimal, as we are a relatively small council, we would like to registerour concerns about the possible impact on other (larger) local councils in the area.

    I understand that the District Council has yet to take a decision on whether to pass ongrant funding, and I hope our comments will be useful to them in the decision-makingprocess.

    Many thanks for your letter of 8 November which was discussed at our finance meetinglast Monday night. The issue was discussed at length, as you might expect, and theresult was that the members intend to increase the precept to cover the shortfall. Wehave a very small reserve, which is needed for cash flow, and the members are notwilling to reduce the services they provide. They will seriously be considering chargingfor the public toilets near the Community Centre to help offset their maintenance cost,but of course this will involve initial outlay. It would help a lot if we did not have topay business rates for both sets of public toilets.

    Thank you for your response.

    Unfortunately we are currently unable to confirm CDCs position with regards the grants for2014-15. We had been under the impression that the grant we received last year (and passedon in full to parishes) was for one year only. However it seems like this may not actually be thecase, but we have not received a definitive answer as yet, so we are unable to advise you.

    We will obviously let you know as soon as we are in a position to do so and apologise for anyinconvenience this may cause. What we can say is that it is unlikely that the CDC element ofthe grant would be paid over this year (as a result of the ever increasing budgetary pressurethat CDC is facing).

  • Regarding Nicola's letter of the 8th Nov regarding the precept for2014/15 please can you confirm the position regarding the Central Govtgrant element for 2014/15 - is this definitely withdrawn ? (This was41.75 for 13/14.)

    Does the grant element being considered by Craven district for 2014/15include any shortfall to cover the loss of the govt grant or does it relatesolely to 50 % of the 2.17 element ?

    Also, when will CDC make its decision ?

    Re: PARISH GRANT 2014-2015 RESPONSE TO CONSULTATION

    With reference to the above, Skipton Town Council has a number of serious concerns regarding the proposals set out in your consultation document and in your report submitted to CDC Policy Committee on 3rd December and, subsequently, Full Council on 10th December.

    Firstly, whilst we are aware of the latest resolution of Council to hold over any decision until full details of the financial position surrounding the Grant are known, this Council remains extremely concerned that the potential existed for decisions to be made by Craven District Council before the deadline date for this consultation exercise.

    Indeed it was clear from the two meetings that, contrary to what was detailed in your report, the views of the Parishes had not and indeed could not have been fed back to Members before they were asked to make a decision.

    Whilst we are disappointed at the lack of co-ordination between the consultation exercise, the timing of your report and the associated meetings, we do acknowledge that the opportunity to comment is now available and we would ask that the views of Skipton Town Council are brought to the attention of Members before any decision is made.

    General Comments

    Before responding to the specific questions set out in your consultation letter, Skipton Town Council would like to make the following more general comments on the proposals set out in your report to CDC Policy Committee on 3rd December:

  • Whatever the final settlement figure is, the Government has made it clear that Billing Authorities are expected to pass on any element of the grant intended for Town & Parish Councils.

    To keep the funding allocated would be, in effect, holding onto money not intended for CDC.

    Para 4.8 of your report indicates that it is prepared on the basis of the significant financial challenges the Council faces in its Medium Term Financial Strategy. The financial position of CDC should not be a factor in determining whether or not it passes on grant funding received on behalf of other public bodies.

    Central Government Position

    Craven District Council is not alone in considering holding onto funding intended for Town and Parish Councils. The National Association of Local Councils (NALC) has been co-ordinating concerns raised nationally - and has met with DCLG Minister Brandon Lewis MP to discuss the matter.

    At the meeting, Mr Lewis made it clear that he will be doing whatever he can to ensure that the grant is passed on to the Councils it was intended for.

    Mr Lewis also made an undertaking to approach directly any billing authority where the grant might be withheld.

    Additionally, Mr Lewis made a statement in the House of Commons on Monday 25th November (Hansard: 25 Nov 13: Column 10) where, in response to a question from the MP representing Hexham highlighting a proposal from a billing authority in the north-east to retain Parish grant funding, he said: I thank my hon. Friend for raising that important point. We made it clear this year that councils should pass the money down to parish councils, and my hon. Friend is right to put pressure on councils that do not do what they are supposed to do.

    The Governments position on this matter seems clear enough.

    Last Years Grant

    As indicated in your report it is true that, last year, Skipton Town Council decided to retain approximately 20,000 of the central government grant, in reserves, for use in subsequent years.

    This was done on the basis of the likelihood that there would be no grant funding available this year . Even by doing this, the Town Council would be facing a budget shortfall in 2015/16, 2016/17 and 2017/18 directly as a result of the impact of the Council Tax Benefit changes.

    The decision to spread the use of the grant funding allocated last year is an internal budgeting matter for the Town Council and is not a valid reason for CDC withholding payment of any funding made available this year.

  • Consultation Letter Specific Questions

    Both of the specific questions in your consultation letter are hypothetical. The Town Council has already identified potential shortfalls in funding for the next three financial years directly as a result of the changes implemented last year.

    Any grant received this year (or in any subsequent years) would be used to reduce the ongoing impact of those changes and to protect the services provided by Skipton Town Council. In the event that grant funding is not passed over, the Council would have little option but to consider raising the precept by an amount equal to the funding withheld an action which, in itself, could increase the likelihood of legislation restricting any future increase on a similar basis.

    The Town Council is not minded to propose any alternate methodology reflecting a desire by Craven District Council to generate a saving in the grant payable.

    We believe this is a very simple situation: The Government has allocated grant funding for use by Town & Parish Councils.

    The Government has given this funding to Billing Authorities on the understanding that it should be passed on.

    Senior Government Ministers have confirmed this via meetings with organisations representing local councils across the country and via direct comment at the despatch box in the Commons.

    Any grant allocated is not CDCs to retain and it should be passed on in full.
