ResistancetoChange:WhyApartmentRe-ZoningsareaDifficultPoliticalIssueRe-zoning property for apartment development by overcoming local opposition continues to be one of the most challenging, politically-charged barriers to making “new deals” happen, despite the fact that there is widespread acceptance of the need for apartment housing, an understanding that consumers increasingly prefer rental apartments over other housing types, and a conclusion that apartment com-munities make good land use sense. This is especially true in “urban in-fill” sites. Why is this? It has to do with resistance to change and resistance to housing choice in a given geography near the proposed apartment site (usually by long-established single-family neighborhoods), and is fueled by suppositions and stereotypes that apartments bring more traffic, more crime, and lower nearby property values. Sometimes, neighborhood groups in opposition to proposed apartments will figuratively “throw anything against the wall” with their anti-apartment arguments in hopes that something, anything, will stick. As an industry, we apartment folks need to be prepared to counter these claims both broadly and at the individual project level in order to tell our story in a convincing way and have greater success in what ultimately are political decisions. Because of the depth of this resistance to change, it won’t be easy, though.

Apartment developers want to be good neighbors and want to be welcomed by the immediate and broader community. We want to fit in. Developers eager to meet the housing needs of consumers, though, are often thwarted by misguided local “not-in-my-backyard” (NIMBY) activists. The good news is that there is an ever-increasing body of research which indicates that apartments are not a threat to local property values and are a net plus to communities.

It is important for apartment professionals, including our industry association, the GCAA, to educate all the actors in the process that Higher-Density Development can:

• Reduce taxes by concentrating public services such as water, sewer, roads, and police and fire service over a smaller area.• Reduce traffic and commuting time by allowing more people to walk, bike, or take public transportation to work and other

destinations.• Boost the local economy by providing housing for the workers that businesses need and creating a community that attracts

a diverse range of professionals and service workers.• Foster a sense of community and create safer neighborhoods, because people living at higher densities are more likely to

walk, shop locally, and get to know their neighbors.• Offer the health benefits of a walkable, bike-friendly environment;• Provide more green space: with denser housing, the same number of units can be clustered in less space on a given site,

allowing the remaining land to be reserved for open space as parks, trails, or woods;

What are the keys to obtaining political entitlements (re-zonings, permits, etc.) despite NIMBY opposition? My experience with my company suggests:

• Meeting early and often with as many of the NIMBY proponents as possible.

• Attempting to educate/change perceptions about apart-ments and the development under discussion.

• Making no concessions before you absolutely have to.• Constantly gauging the political climate and the poten-

tial for support; “Count the votes”.• Building support.

Good design is one of the most effective ways to over-come community opposition to apartment properties. Another is that a simple change in terminology from the word “density” to the phrase “compact develop-ment” or “efficient, walkable community” may help to allay the NIMBY concerns of existing neighbors. Finally, visual aids are much more effective than written descriptions alone when persuading citizens that apartment communities can be a well-designed benefit to their community.

Welcome 2013! I am very pleased to greet the New Year as President of the Products and Services Coun-cil. I would like to thank Gayle Sebastian for her leadership as 2012 President; I know I have a lot of hard work ahead of me to fill her shoes! 2012 was a very successful year with several events like our Charity Golf Classic which raised $2,361 for Crisis Assistance Ministry, our Trade Show “Once Upon A Time”, which saw attendance of over 1,260 vendors and guests, and a record number of volunteers who participated in our annual Work Day at Crisis Assistance Ministry.

We have already begun planning 2013 events, so get ready to save the dates! Our largest event of the year is the Trade Show; this year’s theme is “The Games Show” which will be held on March 14, 2013 at the Char-lotte Convention Center. This event is always a great time to network, have fun, and see all of the products and services offered to our industry. New at the 2013 Trade Show is the “Private Preview Hour” at 4:30 pm

for Upper Management. Vendors - booth sales are underway and are selling quickly, if you have not already done so, reserve your booth today (see page 7). Onsite and management members – register your whole team to attend NOW (online at www.greatercaa.org). We have lots of prizes and giveaways so don’t miss out!

The Products and Services Council has many goals. However, at the top of our priority list is to bring our owner-manager mem-bers and associate members together. Please take a look at your Member Directory and Buyer’s Guide when it arrives or visit the GCAA website (www.greatercaa.org) when trying to find a member vendor to match your needs. Doing business with a member throughout the year is encouraged and rewarded with our annual “Do Business with a Member” contest. Thank you and Con-gratulations to Tower Place Apartments and Perimeter Station for winning in 2012 and helping spread the word on how valuable a GCAA membership can be! I hope everyone had a joyous holiday with your family and friends. It is the time of year that we all set goals and make plans; while you are making those plans don’t forget to include the GCAA. Be a part of the organization that is the voice of the multifamily industry. Volunteer to be on a Committee (see p. 19) or join us at one of the volunteer days at Crisis Assistance Ministry; there are so many ways to be involved and if everyone does a little, a lot can be accomplished!

PRESIDENT - CHAD M. HAGLER • WOODFIELD INVESTMENTSChad Hagler is a Partner with Woodfield Investments, a multifamily development company focused in the Mid-Atlantic region. Chad has been responsible for all facets of Woodfield’s development activities in the Charlotte area since early 2006. He joined Woodfield from Camden Property Trust and its predecessor Summit Properties, where he was a Director in the Real Estate Investments Group and managed Camden’s development activities in North Carolina. Prior to joining Summit/Camden, he was Vice President of Development for a small, family-owned development company based in Jacksonville Beach, Florida which specialized in affordable housing and

historic adaptive reuse. Chad holds a Bachelor of Science degree in Business Administration from the University of North Carolina, Charlotte, where he majored in Finance and graduated Cum Laude. He and his wife, Elizabeth, have four energetic young boys and have lived in the Charlotte area most of their lives.

VICE PRESIDENT - PARRY COBB, CAPS • GCI RESIDENTIALA Savannah, GA native, Parry Cobb is Regional Manager for GCI Residential, a Real Estate Development and Management firm. She oversees operations for both established communities and new construction. She served as Chair of the Operations Committee in 2009 and Membership Committee in 2010 and 2011. Parry served as Treasurer of the GCAA Board in 2012 and will act as Vice President in 2013. She was the recipient of the Manager of the Year Award in 2006. She holds a BA in Communications from the College of Charleston and is a member of the Golden Key National Honor Society. Parry is an Accredited Resident Manager through NAHB and Certified

Apartment Property Supervisor through NAA. On a personal note, Parry and her husband Chris have a 5 year old daughter, Han-nah and 2 year old Mason. She loves vacationing at the beach and in the mountains!

TREASURER - COURTNEY LUNDQUIST, CAPS • S.L. NUSBAUM REALTY COMPANY Courtney Lundquist is a Regional Vice President for S.L. Nusbaum Realty Company. She joined S.L. Nusbaum in 2006 and oversees properties in the Southeastern region. Courtney has over 15 years of property management succesful experience working in both conventional and affordable housing in the midwest and southeast. She was part of the first GCAA Leadership Lyceum in 2009, was named GCAA’s Manager of the Year in 2010, and has completed her CAPS designation through the NAA. She served as chair of the membership committee in 2012 and will serve as Treasurer of the Board in 2013. On a personal note, Courtney and her husband, Randy have five

children, Taylor (13), Nathan (9), Ethan (6), Aiden (4), and Emily (2). She is an active volunteer in Union County Public Schools and has started running in her spare time. She enjoys traveling and spending time with family.

SECRETARY - GAYLE SEBASTIAN, CAS • APARTMENT FINDERGayle is an Account Executive for Apartment Finder. She began her career in property management in South-east Florida 1992 where she worked for 14 years both onsite and on the vendor side. She was awarded Associate Sales Representative of the Year in 2003 by the SEFAA. In 2005, Gayle and her family relocated to Charlotte, and she obtained her NC Real Estate Brokers License. She joined the Apartment Finder team in 2009 and has been active with GCAA and the Products and Services Council, serving as President of the PSC in 2012. Gayle partici-pated in the 2011 GCAA Leadership Lyceum and received her Certified Apartment Supplier (CAS) designation

in 2012. Gayle is an active member and volunteer at Elevation Church and is an avid animal lover and horseman. She most enjoys spending time with her favorite people; her husband of 22 years, Rich, and her daughters, Samantha, 21, and Sydney, 17. Go Duke!

IMMEDIATE PAST PRESIDENT - LISA T. TAYLOR, CPM, CAM, CAPS • GREYSTARAs Managing Director of Real Estate for Greystar, Lisa is currently responsible for the firm’s NC, SC, GA, AL and TN portfolio which consists of approximately 30,000 units. She has over 20 years of successful property manage-ment and business development experience with an extensive background in portfolio management, property operations, and strategic positioning of conventional assets. Lisa’s expertise includes new constructions, lease ups, acquisitions, renovations, repositions and financially and physically stressed assets. Prior to joining Grey-star in 2005, she worked for Summit Properties and Trammell Crow Residential Services. Lisa graduated from the American Business & Fashion Institute (The Art Institute of Charlotte). She is a Certified Property Manager

through the Institute of Real Estate Management and a CAM and CAPS designate through the NAA. She previously served on the Historic SouthEnd Board of Directors. Lisa has held a North Carolina Real Estate license since 1987. On a personal note, Lisa will celebrate her 25th wedding anniversary this year!

CAUDLE, CPMWESTDALE REAL ESTATE INVESTMENT & MGMT.Linda, Vice President of Westdale Real Estate Investment & Management, is responsible for management, leadership and operations of properties in North Carolina, South Carolina and Tennessee. She is a native Charlottean

with over 30 years of experience in multifamily management. Linda holds her CPM designation and is a member of the In-stitute of Real Estate Management. She also has a NC Real Es-tate Brokers license and is Broker-in-Charge for Westdale. She served as Board President of the GCAA in 2011 and has served as a member and/or chair of various committees since 1981. On a personal note, Linda and her husband Jimmy have been married 29 years and have one daughter, Amber, who lives in Raleigh. They enjoy visiting different wineries in North Carolina and Virginia and spending time at the mountains and beach.

BEN COLLINS • CRESCENT RESOURCESAs Regional Director for Crescent, Ben man-ages and oversees all aspects of the develop-ment process throughout the Southeast. Ben previously served as development manager for Colonial Properties Trust, where he led a southeastern regional development office.

He has also held development management positions with Grubb Properties, the Charlotte Housing Authority, and The Affordable Housing Group. A Madison, Wisconsin native, Ben earned a bachelor’s degree in business administration from the University of Wisconsin-Madison. He received an MBA de-gree with a concentration in real estate from UNC-Charlotte. Ben is a founding member of the UNCC Real Estate Alumni As-sociation, past chair of the NC Housing Coalition, a member of the GCAA’s Government Affairs Committee, and is the GCAA’s representative on the REBIC Board of Directors.

CHARLOTTE EAKER, CAM, CAPSCWS APARTMENT HOMES, LLCAs Executive Community Director for CWS, Charlotte has over 20 years of successful prop-erty management experience and holds both the CAM and CAPS Designations. She has been with CWS Apartment Homes since July, 1999

and currently manages two communities totaling 736 units with 16 associates. Her career with CWS includes two years as Region Manager overseeing nine communities in the Raleigh/Charlotte/Atlanta markets. Her previous experience includes 9 years with Trammel Crow Residential Services as Commu-nity Director and she managed 3 active lease-up communities assisting with designing collateral materials to achieving full operational status within 6 months. In 2009, Charlotte com-pleted the GCAA’s inaugural Leadership Lyceum Program. She has served on the Operations Committee and chaired the Public Relations Committee in 2012. On a personal note, Charlotte enjoys volunteering with groups such as Interfaith Hospitality Network and Hospice Community Care. Charlotte and her husband, Bill have been happily married for 11 years and enjoy spending time at the beach.

AMANDA KITTS, CAPSRIVERSTONE RESIDENTIAL GROUPAmanda Kitts (formerly English) has worked with Riverstone Residential Group since May of 2006 and has been in the multifamily real estate business since 1998. Amanda holds the CAPS, Certified Occupancy Specialist,  Housing Cred-

ited Professional, and Public Housing Manager designations and is also a licensed Real Estate Broker for North Carolina.  She has served on GCAA Committees several times and will continue to serve on the Membership Committee in 2012 as the commit-tee chair. Amanda is a 2011 graduate of the GCAA Leadership Lyceum program. Her expertise includes acquisitions, lease ups, senior housing, physically and financially stressed assets, Sec-tion 42 / Tax Credit and Public Housing / Section 8. On a personal note, Amanda volunteers with Charlotte Mecklenburg Schools, Big Brother Big Sister, YMCA and at various other organizations in and around Charlotte. In her “spare time” Amanda enjoys spending time with her four children and granddaughter.

TAMI FOSSUM, CAPSBLUE RIDGE COMPANIESTami Fossum is the Vice President of Manage-ment Services and has been in the multifamily industry since 1989. Tami hosts both her Certi-fied Apartment Portfolio Supervisor and Hous-ing Credit Certified Professional Designations.

She received her North Carolina Real Estate Broker’s license in 2006 and holds her South Carolina Salesmen’s licenses. She is currently a CPM (Certified Property Manager) Candidate with the Institute of Real Estate Management (IREM). Tami has been actively involved in the GCAA since 1993 and has been a board member since 2004. She served as the GCAA President in 2010. She has and continues to serve on many of the GCAA com-mittees. In 2004, Tami chaired the Education Committee and in 2006 chaired the Programs Committee. GCAA named Tami Manager of the Year in 2003, Volunteer of the Year in 2005, and Instructor of the Year in 2007. She received her highest accolade in 2008 when she received the National Apartment Association (NAA) Paragon award for the Designate of the Year. In 2006, she became a faculty member of the National Apartment Associa-tion Education Institute (NAAEI). She has served on the NAA’s membership committee and currently serves on the NAA’s Lyceum Committee and NAAEI’s Curriculum Development and Apartment Careers Committees. 

PETE HARRISON, CAS • GLASS DOCTORPete Harrison has served as the Senior Account Manager at Glass Doctor of Charlotte for over five years. Pete’s contribution with Glass Doctor has led to being honored with the prestigious Dwyer Group Franchise of the year for 2009 and earning the Top Gun award for 2010 and

2011. Covering all the Greater Charlotte area, he has played a key role in Glass Doctor of Charlotte becoming one of the top 3 sales producers in the USA and number one in the South East region. Pete is a Certified CE instructor, qualified to teach about 12 different courses to Insurance Agents in North and

Pete has held a seat on GCAA’s Products and Services Council for over five years and served as PSC President in 2011. He completed GCAA Lyceum Leadership Program in 2009 and in 2012 had an amazing GCAA year by serving as Secretary for the Association’s Board of Direc-tors, earning the NAAEI’s CAS Designation, and being named Associate of the Year at the annual Bravo Awards event. Pete and his wife Mamie have 5 children that keep them very busy at home. Pete also enjoys teaching Bible studies for 6th grade boys at his Church at Carmel Baptist.

KRISTINE KEE, CAM COLONIAL PROPERTIES TRUSTKristine Kee, Regional Vice President for Colonial Properties Trust, is responsible for overseeing the operations of a portfolio of seven multifam-ily assets throughout Charlotte, Greensboro, and Winston Salem, North Carolina. She joined

Colonial Properties in 2006 as an Assistant Manager and quickly rose through the ranks to Property Manager, then to Area Prop-erty Manager, to her current position as Regional Vice President.  Kristine has over 10 years of property management experience working exclusively in multifamily housing. She was part of the GCAA Leadership Lyceum in 2011, and holds her CAM Designa-tion. Kristine is originally from Vermont; she and her husband Kenner have two children, Kayla (11) and Kolton (7). 

ALISHA LAPORTE, CAM, CAPS WESTDALE REAL ESTATE INVESTMENT & MGMT.Alisha began her career in the apartment in-dustry in 1997 in Austin, Texas and is currently employed with Westdale Real Estate Investment & Management. She holds her CAM and CAPS Designations, serves on the GCAA’s PR Com-

mittee and was a member of the Leadership Lyceum class of 2011. Alisha has a very diverse background in property man-agement and has worked in several capacities both onsite and at a corporate level. In addition to conventional properties, she also has an extensive background in compliance for Tax Credit, Bond (501c3), and mixed income properties. Alisha has been married to her husband, Damon, since 2003 and they have two children, Gracie (8) and Roeman (6) as well as two furry rescue “kids”, Daisy & Fozzy. In her spare time, Alisha enjoys spending time with family, scrapbooking and serving at her Church.

PHYLLIS McLENDONPIEDMONT NATURAL GASPhyllis began her career with Piedmont Natu-ral Gas 27 years ago as a Team Leader in the Customer Contact Center. For the last six years she has been a Residential Energy Specialist, where she has enjoyed working with the en-

gineering design teams to create cost-efficient gas infrastruc-ture for the building industry. Phyllis has been an involved GCAA member for six years where she served on the Programs Committee for three years and has more recently joined the

Membership Committee. She notes that her GCAA participa-tion keeps her educated and involved in the apartment indus-try and that she is looking forward to continuing her term on the GCAA Board of Directors. Phyllis is currently positioned to graduate from Belmot Abbey College with a B.A. Degree in Business Management and a minor in Accounting. She loves her two daughters very much, often providing Taylor with free air fare and MacKenzie with free taxi cab rides.

CHERYL MURPHY, CASCLICK PACK MOVE, INC.Cheryl is the owner/president of Click Pack Move, Inc. She has been active in the GCAA for five years and currently serves on the PR com-mittee. In 2013 she will continue to serve on the PR committee as well as the Green Com-

mittee. Cheryl participated in the 2011 GCAA Leadership Ly-ceum Program and is currently an instructor for NALP.  Cheryl is originally from Toledo, Ohio and moved to Charlotte in 1984.  She has been in the apartment leasing and property management business in Charlotte since 1985.  In October 1996 she started the apartment locating business All About Locating Apartments, and then in 2010 she incorporated as Click Pack Move, Inc. Cheryl is also a licensed North Carolina Real Estate Broker in Charge.  Cheryl and her husband Steve have been married for 21 years and have two sons, Steven (20) and Michael (16). They enjoy travelling and spending time at the beach. Cheryl is also an avid amateur bird watcher and her yard is a Certified Wildlife Habitat. 

JOYA PAVESI • CAMDEN PROPERTY TRUSTJoya is the Regional Marketing Director for Cam-den Property Trust. She has more than ten years of marketing and public relations experience, seven of which are in the multifamily industry. She is responsible for regional and corporate marketing initiatives for more than 3,000 units

across North Carolina, Maryland, Virginia, and Washington DC; in addition to more than 500 new units in development. She has served on the PR Committee for the GCAA and holds a B. A. in Communications and Journalism from UNC Charlotte. When she is not working Joya spends time with her family including her husband Stefano and daughter Liliana.

DARLINE PAYNE • GINKGO RESIDENTIALDarline Payne joined Ginkgo Residential in 1998 as an Accounting Assistant. In 2004, she moved to the property management department as Settlement Coordinator. Mrs. Payne received her Associates Degree in Business Administra-tion in 1994 from Gaston College and holds a

NC Notary Public license. She has been active with the GCAA since 2009, most recently serving on the Membership Commit-tee and the Public Relations Committee, the latter of which she co-chaired in 2010 & 2012. In addition, Mrs. Payne received the GCAA 2009 Support Team Member of the Year award, as well as the following service awards from Ginkgo Residential – 1999 Brass Award, 2007 BEST Award and the GEM Award. BRANDI ROBELOTTO, CAS • LEASEHAWKBrandi has worked in the multifamily industry and has participated as an active member of the Greater Charlotte Apartment Association since 1992. Her first opportunities in property management were with Merry Land and Invest-ment Company and Equity Residential, after

which she transitioned to Cornerstone Residential as Regional Marketing Director. After 11 years in Property Management, Brandi worked as Market Sales Manager/Publisher for The Greater Charlotte Apartment Guide. In her current position with LeaseHawk (formally CallSource) as Regional Advisor for the Carolinas, she is an active member of six apartment associations. Brandi served on the GCAA Board of Directors in 2005-2006, as well as the Membership committee (Chair, 2006), Public Rela-tions Committee, and Government Affairs Committee. Brandi has served on the Products and Services Council since 2003 and is the Council’s 2013 President. Brandi and her husband Michael have raised two amazing daughters, Stephanie (25) and Megan (20). In her spare time you can find her visiting NC wineries, listening to music, cooking or gardening.

JENNINGS SNIDER • SYNCO PROPERTIESJennings is a Vice President for SYNCO Proper-ties.  In his role as Vice President he serves as the company’s Director of Reporting & Analysis and Senior Investment Officer.  Prior to joining SYNCO in 2006, Jennings spent nearly two years as a financial analyst with Bank of America in

their real estate finance group. Jennings holds a Bachelor of Arts and Science degree from the University of North Carolina, Chapel Hill, where he graduated Summa Cum Laude and was a member of the Phi Beta Kappa National Honor Society.  In addition to his work as an officer of SYNCO, Jennings serves on the board of directors for the Council For Children’s Rights, a non-profit organization focused on ensuring that every child in Charlotte/Mecklenburg is safe, healthy and educated.

JONATHAN TEE, CASPARAGON SERVICES GROUP, LLCJonathan Tee joined Paragon Services Group, a construction, site work, and ancillary service provider for the multifamily industry in 2012. He holds the NAAEI’s CAS designation, is a graduate of the GCAA’s Leadership Lyceum program, is

currently serving as the GCAA’s NAA Leadership Lyceum can-didate, and has held his real estate broker’s license in NC since 2004. After graduating from North Carolina State University, Jonathan began his career in the new construction industry as a project manager overseeing the building and development

of communities in the Raleigh area. Since then he also worked in the insurance restoration industry for several years. He has served on multiple GCAA Committees including PSC, Govern-ment Affairs, and Programs, the latter of which he will chair in 2013. On a personal note, he enjoys spending time outdoors and giving back to a community which has offered him so much through volunteering and outreach programs.    

JESSE M. “JAY” TILLMAN III LAW OFFICES OF JAMES W. SURANE, PLLCJay Tillman has specialized in civil litigation since 1999, has practiced in Charlotte since 2005, and began working with Jim Surane in 2011. Although he concentrates his practice in the areas of Landlord/Tenant Law and Prem-

ises Liability, Commercial Law, Construction Law, Products Liability and Transportation Law, he also has represented a number of businesses in Commercial Real Estate claims and transactions. Upon graduating from law school, Jay received the prestigious Trial Advocacy Award from the North Carolina Academy of Trial Lawyers. After receiving his undergraduate degree from the University of North Carolina at Chapel Hill, Jay was commissioned as an officer of the U.S. Navy and flew EA-6B Prowlers from the U.S.S. Dwight D. Eisenhower (CVN-69) in Desert Shield and in post-Desert Storm operations. Jay main-tains the rank of Captain in the United States Navy (Reserve Component) and has been active in Operations Iraqi Freedom, Enduring Freedom, and other operations in the Middle East. He just returned from his final activation in which he served the Commanders of Navy Central Forces/U.S. Fifth Fleet and Central Command. Jay and his wife Carolyn have two sons, James who is eight and Joshua who is five.

MARCIE WILLIAMS, CAM, CAPS • GREYSTARMarcie has been in the apartment industry for over 20 years and is currently Senior Director of Real Estate for Greystar. She is a graduate of the University of North Carolina with a BA in Journalism. She is a long-standing member of the GCAA Board of Directors and served as Presi-

dent in 2008. She chaired the Membership Committee (2003, 2009), the Seminars Committee (2004), Programs Committee (2005) and the Education Committee (2006). Marcie has been an active instructor for NALP, CAM and CAPS classes in Charlotte and Columbus OH. She holds her CAM and CAPS Designations. GCAA named Marcie Manager of the Year (2001), Volunteer of the Year (2004), and Instructor of the Year (2006). In 2012, she served as chair of GCAA’s Education Advisory Council and the GCAA Education Foundation Board of Directors. On a personal note, Marcie and her husband Chris have been married for 20 years and have two children, a daughter Avery (16) and a son Seth (13).

He represents and promotes the rental housing industry before the media, legislative bodies, other trade associations, and the GCAA membership. Ken is a Registered Lobbyist in the North Carolina General Assembly and has served on several committees of the NC Building Code Council. He has twice been named “Association Executive of the Year” by the National Apartment Association. He holds a B.A. degree in Urban Geography from the State University of New York at Albany and a Master’s in City & Regional Planning from Western Kentucky University. He is a member of the American Institute of Certified Planners and the Urban Land Institute. Ken is a graduate of Leadership North Carolina, serves on the Charlotte-Mecklenburg Coalition for Housing, and is a recipient of the Charlotte-Mecklenburg Community Relations Commit-tee’s “Fair Housing Hero” Award. His career in housing and com-munity development has included jobs in Texas, Ohio, Indiana, Kentucky, and his native New York. In his spare time Ken coaches youth basketball and enjoys playing tennis.

In her present position, Irene handles all of the GCAA’s pub-lications, marketing, and electronic communications projects. She authors, designs, and disseminates GCAA and AANC in-formation via the GCAA website (www.greatercaa.org), the Apartment Times magazine, broadcast email, and social me-dia. Irene also serves as GCAA’s chief photographer and fields most inquires from the local media. Often focused on the GCAA’s Associate Membership, she is the staff liaison to the Products & Services Council and manages all aspects of the annual Trade Show. Irene graduated Summa Cum Laude from James Madison University with a B.A. in English. Outside of work she enjoys making pottery, practicing yoga, and spend-ing time with her 15-year-old daughter, Emma .

Fran oversees all the accounting functions of the three associa-tions (GCAA, GCAAEF & AANC) run from this office including invoicing, accounts receivable and payable, and more. She also provides senior member service support, serves as staff liaison to the Public Relations Committee, and manages the forms world for AANC. Fran’s previous experience includes a real estate evaluation and accounting position with Meineke

Car Care Specialists and customer service provider at the YMCA. Fran has lived in Charlotte for over 35 years and spends free time with her family (husband Bruce, daughter Hannah, and dog Sophie), at the YMCA, and reading .

full-time position of Education & Member Services Coordinator include overseeing and coordination of all NAAEI Designation & Certification programs and providing services in response to member requests. Other duties include recruiting and retain-ing members to the GCAA. She also supports the Education Advisory Council and the Membership Committee. Jennifer and her husband Billy have two sons, Christian and Ryan, and a baby daughter, Kate.

the Programs and Operations Committees, oversees the annual New Construction Bus tour and Golf Tournament, and manages a variety of inter-office matters such as HR, staff scheduling, and payroll. Pat joined the GCAA staff in October of 2005, coming to the Association from a previous position as a Member Retention Specialist at the Harris YMCA. Pat’s previous career was in the human resources field where she worked as a Benefits Analyst for Mitsui & Co. (U.S.A.), Inc. and USA Network. She holds a B.A. degree from the State University of New York at Geneseo. Pat and her husband Ken relocated to Charlotte from New York 18 years ago. They keep busy with their 3 children, Michael (21), Brian (17), and Claire (14).

local newsCharlotte Rental Property Ordinance UpdatesThe following information from the Rental Property Ordinance Unit of the Charlotte Mecklenburg Police Department summa-rizes the January 1st, 2013 effective changes to the Ordinance, which apply to both single- and multi-family rental proper-ties.  At Apartment Times press time in December, the online registration system was not yet functional. Summary of Rental Ordinance taking effect January 1, 2013:

1. Mandatory, free registration will start on January 1, 2013. 

2. As soon as the database is completed for registration, community coordinators will be notified for dissemina-tion of registration information and there will be adver-tising in local media, City TV, websites, and other areas of advertising. Several real estate groups and property management companies are already informing their members/clients of the upcoming changes to the rental ordinance as well.   

3. Crime and disorder will be reviewed on a quarterly system.  There will still be nine categories of properties.  These categories are listed in the ordinance.

4. Quarters for review will be Jan, Feb, March, etc.5. Property crimes will not factor in determining crime

and disorder.  6. One homicide, regardless of category of property, will

place the property in the program.7. For a single family home it will take, 1 homicide, 2

violent crimes, or 3 disorder calls for service during the quarterly time period to place the property under the ordinance.  Presently, under the ordinance that expires on December 31, 2012 at midnight, a single family home only needed one violent crime, or a combination of property crimes and disorder calls for service to be placed under the ordinance for the review period of May 1 to April 30.  The quarterly system provides real time response to current issues on properties.

8. As the size of the property increases (unit wise), so too does the amount of crime and disorder needed to place the property under the ordinance.

9. Cost recovery fees remain the same for properties found to fall under the ordinance.

10. There will NOT be a mandatory rental registration sticker or certificate that has to be placed in all registered rental properties.  Several owners have called and stated that the “rumor” was that there would be a rental sticker required for every window on the rental property and that there was a $25 cost per sticker.  This is not true.  The only fee associated with the program is the cost recovery fee for properties falling under the ordinance.

11. The new ordinance will take effect January 1, 2013 and the fourth quarter of 2012 (October, November, and December) will be reviewed for ordinance purposes.

If a customer has not established a satisfactory credit history – or has no credit history – a security deposit will be required before new service can be established. In addition, builders, prop-erty managers, landlords and realtors must settle any unpaid obligations prior to establishing new electric service accounts. Our credit evaluation is based on regulatory guidelines.

You WILL NOT be assessed a security deposit if you’ve es-tablished a satisfactory credit history. An account has a satisfactory credit history if electric service has been active for more than 12 consecutive billing months, and during the past 12 months: • Service has never been disconnected for nonpayment of

the bill.• There have been no more than two past due bills.

You WILL be assessed a security deposit if your credit his-tory is unsatisfactory.If you do not have a satisfactory credit history established with Duke Energy – or if you have not yet established a credit history – you will be assessed a security deposit when establishing new service. An account has an unsatisfactory credit history if there are unpaid bills, or if, during the past 12 months:• There have been more than two past due bills.• Service was disconnected for nonpayment of

the bill.

You can avoid paying a security deposit by establishing a satisfactory credit history.• Maintain a satisfactory payment record by

paying all accounts on time, before the past due date.

aanc newsAANC’s Comments to NC Utilities Commission

Your state apartment association is continually acting on behalf of its member apartment owner/operators throughout the state of North Caroli-na to ensure the most optimal regula-tory conditions for operating safe, af-fordable, and quality rental housing. Most recently, AANC provided the

following feedback to the NC Utilities Commission with regard to the emerging issue of utility billing practices in student housing scenarios:

The AANC has reviewed the Public Staff’s Petition, as well as SB 533 (N.C.G.S. 62-110(g)) and Commission Rule R22, and finds that the Public Staff’s request to alter and amend the rules to require refunds of any unused portion of landlord-provided electricity credits contravenes the clear language of the legislation, its pur-pose and intent, and the collaborative approach used to arrive at acceptable billing practices in North Carolina. The intent of this entire process was to work with the Public Staff and the Com-mission to craft straightforward language in which to develop a streamlined framework permitting landlords to provide electric service to residents while encouraging conservation at student housing properties in North Carolina.

As a non-profit industry trade association, the AANC has a num-ber of member firms that operate an emerging housing type (common in other states) where the landlord has a separate lease for each bedroom within an individual dwelling unit. Such manner of leasing, typified by student housing complexes, was reflected in the new law and Commission-adopted rules. The consensus among AANC member firms is that SB 533, which was unanimously approved by our legislature, was intended to elimi-nate any ambiguities regarding a landlord’s ability to provide conservation credits and divide up per-unit electric bills to each individual bedroom for electricity. Another introduced bill, HB 771, which was supported by many in the apartment industry, proposed to bypass Commission jurisdiction entirely as it relates to the electric resale. HB771 was not the collaborative path our member firms wanted to take with the Public Staff, and so we en-couraged the cooperative efforts that resulted in the passage of the new law.

However, since passage of SB533, numerous issues have been brought to the attention of the AANC that beg the question of whether an approach such as that set forth in HB771 should have been pursued. The Public Staff’s Petition is one of the most con-cerning, as it undermines the entire collaborative approach taken by all sides involved with SB 533, as it attempts to change – not clarify – the law that was unanimously supported and passed.

The AANC believes that Rule R22-5(h), as currently written, sup-ports the billing practice where landlords provide conservation credits or allowances up to a certain cap, and only bill residents who exceed the monthly cap, with no requirement that an under-usage or non-usage be refunded. Such practice has been imple-

mented in other states, and the consensus we’ve learned has been overwhelmingly positive with respect to this billing model. Students (and parents alike) enjoy the convenience of receiv-ing a per-bedroom bill with their specific charges enumerated thereon – and view the conservation credit as exactly what it was intended – to encourage conservation and promote wise use of electricity. Landlords and residents did not enter into leases with the intention that credits would be issued for non-usage or us-age under the allowance or cap. Current leases do not provide for credits of unused electricity, and a landlord’s financial model for providing a fixed allowance does not do so either.

If the Commission changes the law and requires this credit be given, the AANC believes that most member firms will switch to a $0 “allowance” so that all charges are passed through as actu-ally incurred, and this issue will become moot. Note, that rents and other charges, which are market-based, would remain un-changed in the event of such a change – so it would effectively result in the students’ loss of the $30 credit (or similar amount) or viewed another way, students who would otherwise receive no bill for electricity usage, would suddenly begin receiving bills for all amounts used. We do not believe that this would be in the best interest of tenants or the state of North Carolina, as the conser-vation cap model does in fact promote conservation in offering students extra incentive to limit their electric usage. Public policy dictates that such a program should be praised rather than elimi-nated in the state of North Carolina.

“Love Your Freedom” – Late in 2012, GCAA partnered with WSOC-TV to create a television ad campaign which will include several different 15-second commercials promoting rental apartments as desirable options for housing in the Greater Charlotte area. This TV Campaign will be aired on WSOC TV and WAXN TV64 during the first quarter of 2013. Ten GCAA-member management companies provided financial support for this project; each of them will have two of their communities featured in the TV ads. The ten contributing management companies include: Blue Ridge Companies, Camden Property Trust, CWS Apart-ment Homes, Fairfield Residential, Ginkgo Residential, Greystar, Marsh Properties, Northwood Ravin, Weinstein Properties, and Whitehall Venture (Woodfield Investments). In conjunction with the TV spots, WSOC is creating a Facebook page which will be maintained by PR Committee volunteers.

Camp Hope and PTSD.org - This will be a P. R. Committee service project for 2013 and beyond. The end result will be transitional housing for United States Veterans suffering from Post-Traumatic Stress Disorder while they wait for assistance from the Veterans Administration. This effort will take several years, and the first steps will be identifying mentors for the veterans, creating mentoring groups, and finding places for these groups to meet. At present, PR Committee volunteers are compiling an information sheet that they’ll be able to share with potential support partners such as churches, social groups, etc. Committee members are in the very initial stages of the project, and while the big picture isn’t quite finished being drawn, the group is definitely very excited about the opportunity and hopes to glean support from the broader GCAA community.
