4th AMENDMENT

Prohibits unreasonable searches and seizures and sets out requirements for search warrants based on probable cause.

The proper search and seizure law is used a lot in courts today. People have a right to their property and this ensures that. This amendment greatly influenced the New Jersey vs. TLO supreme court case in 1985, a case that limited the students rights in school.

5th AMENDMENT

Sets out rules for indictment by grand jury and eminent domain, protects the right to due process, and prohibits self-incrimination and double jeopardy.

This amendments gives all criminals certain rights (the Miranda rights) when being arrested and the process that goes with that. Also, because of this law people can not be tried for the same crime twice.

6th AMENDMENT

Protects the right to a fair and speedy public trial by jury, including the rights to be notified of the accusations, to confront the accuser, to obtain witnesses and to retain counsel.

This amendment sets up the boundaries of trials for criminals. People have the right to and speedy trial, and participate equally in trial.

Provides for the right to trial by jury in certain civil cases, according to common law.

This amendment gives the right to every person to have a trial if they want to. Again, its setting up boundaries so people can’t abuse the justice system.

8th AMENDMENT

Prohibits excessive fines and excessive bail, as well as cruel and unusual punishment

This is a huge human rights amendment. This affects our discipline laws and death penalty rules today. Every person and animal has the right to a fair punishment.
