Our firm is distinguished for being:

a multidisciplinary team combining scientific and legal expertise of lawyers, European patents, trademarks and designs attorneys and engineers

a “paperless” organisation, with an entirely computerised management of files and secured electronic communication with the courts,IP offices and our clients

When creating the firm in 2003, the founders wanted it to be more than a law firm specializing in intellectual property. The objective was to create a firm dedicated to innovation in all its aspects : strategic, legal, financial etc… with a consultancy approach inspired by its litigation practice. The clients benefit from the skills and expertise of our team of lawyers and patents attorneys for the filing of IP rights (patents, trademarks and designs), in the financial assessment of IP portfolio, the negotiation of contracts and for representation before French and European courts, notably the European Union Court of Justice and the Unified Patent Court.

The Trademarks and Designs Department assists our clients in all creation and protection phases of their distinctive signs and in their defense in collaboration with our litigation department.

• filing trademarks, designs, copyrights and domain names in Europe and around the world

The Litigation Department represents our clients directly in all pre-litigation stages and during litigations.

• warning letters, cease and desist letters • implementing provisional and protective measures (bailiff seizures, preliminary injunctions, expertise, Customs seizures…)

• legal proceedings (infringement, invalidity, unfair competition, contractual and criminal liability, employees’ inventions, etc.)

• implementing alternative solutions to resolve conflicts (mediation, negotiation, arbitration, settlement) • transnational disputes strategy and coordination

The department’s main activities are:

The Contracts and Business Department assists our clients with their daily business, both in drawing up legal deeds and successfully valuing their intellectual property.

• Contractual drafting of research and technology transfer agreements related to patents, softwares, trademarks, designs • Conducting contractual negotiations and facilitating discussions between a large number of parties

• Contractual engineering, coordination of contractual issues in large consortia (from R&D to commercialization of products and services, including research material transfer and regulatory issues)

• Financial assessment of IP rights within transfer or licensing transactions • Knowledgeable and practical solutions for startups and spinoffs regarding corporate and commercial law

As a legal practice, LOYER & ABELLO can represent its clients directly in dealing with European and international offices as well as national and EU jurisdictions (EUCJ, UPC, etc.).

In countries where it is necessary to launch local proceedings, LOYER & ABELLO has a global network of representatives available to assist its clients. LOYER & ABELLO knows how important it is to select the right overseas representatives and has therefore built a network of foreign lawyers who offer the same level of excellence and who have a high level expertise in Intellectual Property law in their home countries.

In 2015 LOYER & ABELLO wrote the French Chapter of the Book “Employees’ Intellectual Property Rights” AIPPI Law series edited by Kluwer Law International. This comparative law publication describes and analyses employers’ acquisition of employees’ intellectual property rights, first in general and then in depth as manifested in 33 jurisdictions worldwide.

In 2016, LOYER & ABELLO published a practical guide regarding the preserving of evidences in IP and unfair competition cases.
