Another Major Company Drops Cargill over DeforestationConcerns

IntraFish reports that "Global salmon giant Grieg Seafood has excluded Cargill Aqua Nutrition from the proceeds of its $92 million green bond until its parent company Cargill has significantly reduced its soy-related deforestation risk in Brazil." In response to the news, Mighty Earth CEO Glenn Hurowitz released the following statement:

"Cargill's recklessness has destroyed forests, fueled climate change, displaced Indigenous communities, and imperiled workers from vulnerable communities in its meat plants. But today, a new victim of Cargill's recklessness has emerged - Cargill itself.

"Norwegian salmon company Grieg Seafood has announced that it will exclude Cargill from its $92 million green bond, citing concerns about Cargill's ties to deforestation in Brazil. This news is just the latest blow to Cargill's bottom line, as a growing number of consumer-facing companies are unwilling to associate their hard-earned brands with Cargill's sullied reputation. Late last year, Nestle announced it would cease purchases of Cargill's Brazilian soybeans over fears they were being grown on deforested land.

"Cargill has responded with the usual vague statements and commitments that never seem to find their way beyond a piece of paper. Major supermarket chains like Costco and Casino should take notice: Cargill hasn't changed, and doing business with deforesters is a liability that your customers will no longer accept."

    Rapid Response Report 27 final v2[1].pdf;

    Hi Girish,

Thank you again for your response. As we continue to have internal conversations on the topic, I had a couple of clarifying questions that I don’t think we’ve addressed yet.

    1. P&G has Sarawak Oil Palms (SOPB) listed in its mill list, which is still sourcing from Samling as highlighted in Rapid Response report 27 (p. 21 attached). SOPB has recently told us directly that some of the Samling CPO and PKO, bought by SOPB, is sold to other traders. How is P&G addressing this Samling risk with its Tier 1 suppliers?

    2. Also, we have been informed by a trader that Kwantas Corporation (listed in P&G’s mill list) may also be sourcing from Samling. How is P&G addressing this potential Samling risk with its Tier 1 suppliers?

Given the complexities, we continue to recommend a company-wide suspension of Samling palm oil to ensure leakage does occur in the present or future into P&G’s supply chains.

    Thank you,Asha

Sime Darby informed Mighty Earth that: “We would like to confirm that we have notified Samlmg that we will no longer be sourcing from them due to cojicerns raised by our key customers. Central to these concerns is the adoption ofNDPE conunitments across the whole Sajnling Group, and 7wt just for Glenealy Plantatiojis.”

On 15 April 2020, Sanding responded to these suspensions - not by halting all Sanding group-wide deforestation, but by offering up the smallest fig leaf: Glenealy Plantations Sdn Bhd announced an NDPE policy and a memo issuing a “group-wide moratoj'ium oji any lajid clearing for all greenfield development on mineral soil and peatland 1'egai'dless of depth with immediate effect until further notice.’”

Several traders and biodiesel companies - AAK, BLD, Neste, Olam, Sarawak Oil Palms Bhd (SOPB) - and consumer brands, including Mondelez, Nestle, and PepsiCo, have yet to take action to suspend Sanding from their supply chains.

Glenealy has also been circulating information to traders claiming that ‘Glenealy holds all the oil palm estates and mills’ and that the company owns 100% of the shares in Timor Enterprise Sdn Bhd (through Puncak Selasih Sdn Bhd) which owns the Jelalong, Lana and Belaja palm oil operations, Sanding Plantations Sdn Bhd and other entities (see left graphic below).

Based on this information, it would be assumed that the moratorium applies to all Glenealy-owned plantation areas. However, according to shareholder ownership data obtained from the Companies Commission of Malaysia, Glenealy Plantations only owns 15.31% of Timor Enterprise Sdn Bhd. The majority shareholder (84.68%) in Timor Enterprise Sdn Bhd is Lingui Developments Sdn Bhd, which is 100% owned by Sanding Malaysia Incorporated, registered in the British Virgin Islands (see right graphic below).

Although SOPB published an NDPE policy in January 2019, the company has not published a mill list disclosing its suppliers and sources of palm oil. While SOPB has listed several of Mighty Earth’s Rapid Response cases on Samling in its grievance list, the company has failed to address these grievances or suspend Samling.

Several traders, biofuel companies and consumers brands are sourcing palm oil originating from SOPB (see tables below). These companies should file grievances with SOPB, requesting that it acts on the Samling case and suspends them.

The following cases have been identified through screened GLAD alerts (see methodology below). As these cases are either repeat cases from previous Rapid Response reports or where Mighty Earth did not determine any supply chain links for these concessions/groups, no satellite image analysis was conducted for these cases to save resources.

Mighty Earth expects that palm oil traders and biofuel companies conduct their own due diligence to determine if they are exposed to sncli companies/Groups and conduct their own satellite image analysis of these cases.

Methodology:For Indonesia, GLAD alerts are screened using the Indonesia Ministry of Forestry and the Environment land cover dataset for 2017 which classifies existing palm oil plantations and primary and secondary forest. Hence, only GLAD alerts in primary and secondary forest according to that dataset are included.

For Malaysia, GLAD alerts are screened to exclude known plantation areas using the Global Forest Watch (GFW) plantations dataset. This automatically eliminates the most common false positives, i.e. the replanting of palm that existed prior to the year 2000.

    Samling Scorecard

Asha Sharma Mon 7/6/2020 5:20 PMTo: Ake, Jean-Philippe Cc: [email protected] ; [email protected] ; [email protected]

    Dear JP:

I hope this email finds you well! I am writing to confirm your score in our forthcoming scorecard that will be evaluating consumer brands’ response to Samling Group’s continued clearance of tropical forests in Malaysia. As mentioned in previouscorrespondence, Samling Group is a Malaysian conglomerate that owns and operates oil palm plantations and timber concessions. Our Rapid Response monitoring system has identified at least 779 hectares of deforestation within four of the company’s concessions in Sarawak, Malaysia. Furthermore, the company has a long history of human rights abuses. Therefore, buying from Samling constitutes a serious violation of No Deforestation and No Exploitation policies.

Our scoring rubric is as followed:

A: Full SuspensionCompany has communicated a “no-buy” requirement to their palm oil suppliers to ensure Samling is excluded from their supply chainsB: Partial SuspensionCompany has not issued a formal “no-buy” requirement; however, the company has taken other significant action to ensure Samling palm oil is excluded from their supply chainC: EngagementCompany is engaging their suppliers on the issue of SamlingF: No responseCompany has not responded to Mighty Earth’s emails

The Hershey Company currently has a score of “A.” Please confirm if our information is correct by Friday, July 10th.

Please let me know if you have any questions or concerns.

    Best,Asha Sharma
