It is with pleasure that I provide my annual report as President of the Shire of Carnarvon. Notably, it has been an extremely busy and challenging year with a number of significant milestones being achieved and some important projects being progressed. In summary I would like to touch on a number these: Local Government Elections 2013 The Ordinary Local Government elections were conducted in October 2013 that saw 5 of the 8 elected member seats being filled on Council. Those successfully re-elected included Cr Max March (4 year term) and Cr Neil Ganzer (4 year term), while Cr Denis Durmanich (4 year term), Cr Lex Fullarton (2 year term) and Cr Kane Simpson (4 year term) were elected by the community for the first time. My congratulations to all of them. I would also like to thank outgoing Councillors, Melissa Gibbings and Graham Murphy, for

their contribution over the past 4 years and additionally acknowledge the contributions of Bill Hopkinson and Eddie Smith for their time on Council. Local Government Probity Audit With the Department of Local Government and Communities performing an audit of the Shire’s governance and compliance requirements, I was pleased to report the Council embraced and addressed all 26 of the audit recommendations. This included changes to the Shire’s procurement and project management processes as well as training for all Elected Members which has been well attended. Robinson Street Revitilisation Following the first stage of the Robinson Street revitalisation project that delivered alfresco dining options and a more pedestrian orientated CBD, the Council in response to community sentiment regarding safety concerns and general presentation has moved to implement further enhancements to the main street. An allocation of funding by the Shire and from Royalties for Regions culminated in a further public consultation process and concept design being finalised that will guide implementation of the identified works in the 2014/2015 financial year. This will see re-arrangement of some car parking and additional ACROD parking in the main street, improved pedestrian access across the street with lawning of the centre drainage swale, and the introduction of feature lighting and public art.

Fascine Foreshore Upgrade Like the main street the Carnarvon Fascine is also being enhanced thanks to a total of $7 million of Royalties for Regions funding. The first stage of this project, completed in 2013, involved removal of the existing sea wall from the Fascine Robinson Street roundabout through to Baxter Park and replacing it with new steel sheet piling. A limestone hob wall and 4.0 metre wide pedestrian pathway was also constructed by In-Situ Construction and Maintenance. To complete the Fascine ‘make over' the Council in February 2014 embarked on further public consultation and planning that will

see construction of three new cantilevered jetty structures suspended off the Fascine wall offering access to the water via a floating pontoon, hard and soft landscaping along the Fascine foreshore including more green grass, a rejuvenation of the existing ‘T’ Jetty, and if funding permits, a swim platform anchored in the Fascine off Town Beach. I am expecting these works will also be implemented in the 2014/2015 financial year.

Carnarvon Airport From a strategic perspective the Council successfully completed a land use Structure Plan over the existing Carnarvon Airport Precinct in 2014 that details a staged approach in catering for future airport infrastructure and urban development. The endorsed Structure Plan provides a focus over the immediate, medium and long term that places the Shire in a position to respond to economic growth and demand and affords Council the ability to ‘opt out’ at any stage in favour constructing a new airport if there is a sufficient economic driver that can justify and sustain a new airport facility. I believe this Plan presents a sensible and realistic position under the current economic climate and allows the Council to direct its immediate attention to ensuring the existing airport infrastructure meets current civil aviation standards. Flood Mitigation Following the 2010 floods the State and Commonwealth Governments generously allocated $60 million to the Carnarvon Community for design and construction of a flood levee system that will mitigate against very high flood

waters consistent with those experienced in 2010. The funding provided by the State amounted to $45 million through the Initiatives of Water & Natural Resource Management under then Royalties for Regions Funding, and a further $15 million from the Commonwealth Government secured through the Regional Development Australia (RDA) Fund. The levee system primarily consists of 6 levees to the east of Carnarvon that will act to significantly reduce flood peaks in Carnarvon. These works were started in October 2012 and recently completed on time and within budget within the earlier part of 2014. I would like to take this opportunity to thank all involved in this project,

and specifically acknowledge the Hon. Member Vince Catania for his support with Royalties for Regions funding, Regional Development Australia for their funding assistance, the Shire’s previous CEO, Mr Maurice Battilana for his hard work and diligence in representing the communities interests, and the Browns Range Alliance (BRA) together with Macca Civil, the principal contractor, for their respective efforts in constructing the levees. Coral Bay Temporary Fuel Facility I am proud to acknowledge the Shire’s efforts with the assistance from Geraldton Fuel Supplies in installing an automated retail fuel facility in Coral Bay that averted a significant issue of Coral Bay being left with no retail fuel supply on the eve of the 2014 tourist season. This was achieved with limited notice of the existing fuel outlet at the Peoples Holiday Park being closed due to licencing and environmental concerns, and a team effort that resulted in a timely solution through installation of a temporary facility for up to 3 years until a permanent fuel filling station is constructed under the direction of the State Government. Coral Bay Workers’ Accommodation Council during the year elevated compliance action in relation to existing workers’ accommodation in Coral Bay, known as ‘Little Kanya’, where buildings breach current health and building standards. This poses significant risk to the wellbeing of residents and places substantial liability on the Shire. Given this situation has been ongoing for some time the need arose for the non-compliance to be addressed. This resulted in formal notices under the Building Legislation being served by Council on the occupants of the workers’ accommodation in May 2014 with respective appeals being lodged with the State Administrative Tribunal (SAT).

The Council is willingly seeking to mediate a solution through the SAT in a collaborative and cooperative manner with all existing owners and residents of the accommodation to address the issues of non-compliance and ensure that all of the workers’ accommodation is made safe. The mediation process is presently underway with a resolution to this matter expected in early 2015.

Coral Bay Settlement Structure Plan The Coral Bay Settlement Structure Plan, completed by Council in early 2014, seeks to identify the best possible development opportunities and land use management systems over the next 25 years to ensure Coral Bay’s ongoing status as a regional tourism node, while protecting the treasured Ningaloo Reef environment that is its greatest asset. With this Plan having been adopted by Council endorsement was sought from the Western Australian Planning Commission (WAPC) in April 2014. However, with the Western Australian Premier Collin Barnett having expressed a personal desire to be more involved in Coral Bay in October 2013, it was announced in May 2014 that a Cabinet Sub-Committee would review the status of a number of coastal nodes along the WA coast, including Coral Bay. While the findings of the Cabinet Sub-Committee is yet to be handed down, I believe the Shire has taken a responsible approach to the planning for this iconic tourist node and I look forward to receiving acceptance of the Coral Bay Settlement Structure Plan from the State Government upon conclusion of its review.

Finally I wish to acknowledge the support of my fellow Councillors, the Shire Staff for the amiable and proactive working relationship we have developed to make the Shire of Carnarvon a more attractive place to visit and live.

I am pleased to submit my Annual Report as Chief Executive Officer with the Shire of Carnarvon. The 2013/2014 financial year has proved challenging with the completion, commencement and continuation of a number of major projects within the Shire of Carnarvon, while addressing some 26 recommendations detailed in the Department of Local Government and Communities (DLGC) Compliance Probity Audit 2013 applicable to the Shire, and dealing with a number of enforcement matters. Some of the Shire’s achievements for the year are summarized below and detailed on other sections of this Annual Report:

FLOOD MITIGATION – STAGE 2 The Shire of Carnarvon continued to fulfil its role in the Stage 2 Carnarvon Flood Mitigation Works Project managed by the Browns Range Alliance (BRA) that includes:

Lawson Street Levee;

Nichol Bay Levee;

South River Road Levee; and

McGlades Levee With the project successfully completed on time and within budget in March 2014, I would like to acknowledge BRA and its main contractor MACA Civil for its efforts, as well as the collaboration and tireless efforts of the various Government Departments, (i.e. Department of Regional Development, Main Roads WA, Gascoyne Development Commission, Department of Water and Department of Lands) that ensured this important project came to fruition. Furthermore, as a Local Government with limited resources, a project of this nature and scale would not be possible without acknowledgement of the generous funding contributions received from the State Government’s Royalties for Regions of $45m and $15m from the Commonwealth Government’s Regional Development Australia Funding. CARNARVON FASCINE REVITALISATION - COMPLETION STAGE

In 2013/2014 the Council secured an additional $3.8m in funding through Royalties for Regions for the Fascine Revitalisation Completion Project being the final stage in the broader Carnarvon Fascine Revitalisation and Town Centre Precinct Project. This final stage will see landscaping and additional recreational facilities to the Carnarvon Waterfront and enhancement of the Main Street to achieve a seamless interface between Carnarvon’s Town Centre and the Fascine Foreshore area. Upon completion in 2015 the community will benefit from:

The construction of new recreational jetty structures, the restoration of an existing ‘T’ Jetty, soft and hard landscaping works to the waterfront area and the provision of car parking.

The enhancement of the Main Street to accommodate the safe passage of pedestrians and vehicles, and presentation of the street through improved parking, public art and town entry statement, and streetscape landscaping.

CORAL BAY TEMPORARY FUEL Whilst not core business of Local Government, as mentioned by the Shire President, it was gratifying for the Shire to assist the community through installation of a temporary fuel facility in Coral Bay. This involved the need for prompt action by the Shire to secure entitlement to land from the State Government through a licence agreement, conduct a formal tender process, award a contract, and grant required regulatory approvals for installation of the facility within a short time frame (December 2013 to March 2014) to avert a dire situation of Coral Bay being left with no retail fuel supply. STRATEGIC PLANNING INITIATIVES From a strategic perspective the organisation has been pro-active in either completing, progressing or commencing a number of important planning projects, listed as follows:

Coral Bay Settlement Structure Plan – Completed May 2014 - pending State Cabinet approval.

Blowholes Reserves Management Plan – In progress / projected completion December 2014.

Carnarvon Airport Structure Planning – Completed / endorsed by Western Australian Planning Commission.

East Carnarvon Structure Plan – In progress / projected completion April 2015.

Babbage / Whitlock Island Structure Plan – In progress / projected completion October 2014.

Shire of Carnarvon Local Planning Strategy - In progress / projected completion July 2015.

Shire of Carnarvon Local Planning Scheme No.13 - In progress / projected completion July 2015. These initiatives are outlined in more detail in the Development Services section of this report. WASTE MANAGEMENT & AIRPORT OPERATIONS Due to a significant change in direction by the Council in February 2014 to deliver its waste management services (including road side collection and management of the Brown Range landfill facility) for Carnarvon using ‘in-house’ resources, the Shire proceeded to recruit suitably skilled staff and acquire the necessary plant and equipment to ensure a smooth transition and continuity of service effective from 1st May 2014. Similarly, operational management of the Carnarvon Airport also moved from a contractual arrangement ‘in-house’ at the end of the 2013/2014 financial year. This prompted recruitment and training of additional staff toward the latter part of the year to ensure a seamless transition and continuity of this service. LOCAL GOVERNMENT ELECTIONS The local government elections were conducted in October 2013 with five elected member positions being filled through the local community electing (or re-electing) the following candidates to the position of Councillor:

Cr Alexander Fullarton – Gascoyne/Minilya Ward (Expires 17th October 15)

Cr Denis Durmanich – Planation Ward (Expires 21st October 17)

Cr Neil Ganzer – Town Ward (Expires 21st October 17)

Cr Max March – Town Ward (Expires 21st October 17) Although belated, I would like to acknowledge the aforementioned Elected Members and thank them for their contributions to date. I would also like to recognize former Councillors Melissa Gibbings, Bill Hopkinson and Eddie Smith for the contributions to the community as elected members over the past 4 years.

Corporate Compliance Rates Rate income increases for the previous four years has been as follows: Differential Rates were again used in the Unimproved Valuation areas of the Shire for Mining, Pastoral and Intensive Horticulture. These rates were adopted by Council, advertised for public comment and endorsed by the Minister as required under the Local Government Act and Regulations.

Specified Area Rates were again set for Fruit Fly, and Coral Bay Refuse Site. The purposes of these Specified Area Rates are detailed in the Financial Report. Reserves The cash backed reserves remain high due predominantly to the “Unspent Grants and Contributions Reserve”, which is used to remove all grant and contribution funds out of the Shire’s Municipal Fund. In previous years these funds have been retained in the Municipal Funds and though identified as restricted assets, have resulted in an inflated surplus position in the Shire’s Municipal Funds at year end. The “Unspent Grants and Contributions Reserve”, makes up approximately 83.78% of the total cash backed reserve funds held by Council at the 30 June 2014. Therefore, there are limited cash backed reserves which have been derived from Council’s own resources for areas such as:

Information and Communication Technology Information and Communication Technology (ICT) continues to be a significant operational resource demand on the Shire. With this in mind, the Shire sought assistance from experts in both the IT and Communications field to develop some rationale behind the on-going and future ICT requirements for the organisation. An ICT equipment replacement plan is now in place which has moved the Shire away from the “break and fix” practices of the past. Council also brought this “in house” with the employment of an IT Support Officer. Youth Outreach Service: Council and the Shire continued to support the Carnarvon Youth Outreach Service to ensure that young people are supported across the Shire. The service was generously funded by the Department of Child Protection and the Department of Corrections, who both have a commitment to ensuring young people at risk are supported to reduce

harm and to provide opportunity to reach their full potential. Community Development Our Community Development Officer focused on ensuring that the community has been kept well informed about Shire business and activities. The Shire newsletter Community Update was produced regularly, radio announcements ensured the community knew what was going on, information pieces appeared regularly via the ‘What’s On’ in the local paper and a robust email network was established. Engaging with the community, supporting and assisting residents and groups work towards their aspirations and celebrate the many

community assets was also a core focus for the Community Development Officer, who regularly met with the Seniors Group,

Vietnamese community and worked with service clubs, sports groups and individuals on various activities. Sport and Recreation Disappointingly the Club Development Officer position was a challenge to fill during the 12/13 financial year. The Club Development program has the capacity to provide valuable support and assistance to sport and recreation Clubs in Carnarvon. In the absence of a dedicated Club Development Officer the Community Development Team worked together to ensure that clubs received any information and support they were seeking and that KidSport was delivered to its full potential. The KidSport program provides assistance to low income and disadvantaged families that allows their children to participate in sports. The programme provides funding to Clubs to assist with costs of fees, uniforms and equipment. During the 12/13 financial year over 135 applications for KidSports were approved with over $20 680 provided to ensure kids and young people could enjoy the benefits associated with being involved with a sporting club. A positive relationship also continued with the Gascoyne Office of the Department of Sport and Recreation, ensuring a strategic approach to sport and recreation occurred across the Gascoyne region.

LIBRARY AND ART GALLERY The library had yet another rewarding year beginning with a successful move to the new premises on Egan Street. The Library and Regional Art Gallery was officially opened by WA Premier Colin Barnett and Member for Regional Development Brendon Grylls on October 25th 2013. The library has stock in excess of 20,000 items available to borrowers including books, DVDs, audio books and magazines. All borrowers have access to the public inter-library loans system and e-Resources which are available online via the State Library of WA. The number of public computer terminals has increased to six providing internet access, word processing, printing as well as access to State Library e-resources. Wireless internet access is also available 24/7. The new community reading area has daily newspapers and community information material available, while reference material is available in a separate study area. Children’s Services continues to run weekly Story time and Baby Rhyme Time sessions, including school holiday craft activities, as well as coordinating the Better Beginnings early literacy programme for Carnarvon. Once again, Children’s Book Week was celebrated with a visit from West Australian author Elaine Forrestal who made visits throughout the week to Carnarvon’s schools.

Adult services included a Book Club, Beginners computer classes and Senior’s Week speakers, including a morning tea for 40 Year Reflections on Carnarvon and the Gascoyne Region. The Art Gallery hosted the very successful 30th Anniversary Gascoyne Biennial Art Awards from 31st May to June 13th 2014, which resulted in a considerable increase in the number of visitors to the gallery. While once again this year’s statistics are slightly down from previous years, this is mainly due to the transition period during which the library re-located to new premises and the lapse of time taken by borrowers to familiarise themselves with the new facility. ENVIRONMENTAL HEALTH

The Shire’s Environmental Health Service remained under the Regulatory Services Directorate for the first 6 months of 2013/14 before the section was moved in an organisational restructure to the Development Services Directorate after the departure of Mr Dave Hadden. Notwithstanding this change, the Environmental Health Section has been successful in securing the services of qualified and experienced Environmental Health Officers its delivery and monitoring on a range of programs and activities to enhance and safeguard public health and promote a safe environment for the well-being of our community.

Regulatory programs often required under State law and carried out by the Shire’s Environmental Health Officers is extensive:

Food Act administration – incudes registration, inspections and food sampling. Regular inspections of food premises has also continued throughout the year with significant improvement in cleanliness and hygiene as proprietors of food businesses embraced their responsibilities pursuant to the new Food Act 2008, Food Regulations 2009 and the ANZ Food Standards Code. Specifically, the Food Act 2008 and Food Regulations 2009 give a broad approach to the requirements for food businesses incorporating provisions for the encouragement of food businesses to comply with the legislation by a decrease of surveillance fees for compliant businesses, and an increase in the same fees for premises that register a high level of non-compliance. It should be recognised that the Environmental Health Officers have approached the requirements of compliance with the Food Act 2008 through a number of education and training workshops with business owners and community groups.

Caravan Parks & Camp Grounds Act Administration - incudes registration, inspections and dealing with large historical issues. Shire Health officers have continued to annually inspect caravan parks and work with owners/operators in Carnarvon and Coral Bay to ensure compliance is met with the Caravan Parking and Camping Grounds Act 1995 and associated regulations. As for remote camping locations the Shire is intending to work with owners to register and improve servicing Nature Based Camping facilities, notwithstanding it is necessary for campers in isolated situations, particularly pastoral camping areas, to provide and maintain their own basic health requirements.

Health Regulations – Public buildings – includes assessing applications, yearly inspections and public safety of temporary events.

Health Regulations – On-site wastewater Treatment & Disposal – includes involvement in all unsewered areas to ensure proper sewage management, assessing applications, providing advice and responding to poorly maintained systems.

Health Regulations – Air-handling & Water Systems (e.g. legionnaire control in cooling towers) – includes assessing applications and responding to complaints.

Health Regulations – Aquatic Facilities – approvals issued by DOH – main responsibility is monthly sampling.

Health Local Laws – Lodging Houses – includes issuing registrations, yearly inspections, investigating illegal and unhealthy boarding houses.

Health Local Laws – Offensive Trades – includes issuing approvals and yearly inspections.

Health Local Laws – Liquid waste pump-out & removal – includes issuing approvals and inspections monthly to yearly. As reported in previous years the Health Department WA has approved the use of alternative treatments for the treatment and disposal of sewage and liquid waste. One of the alternative disposal methods is the use of Aerobic Treatment Units with sub-surface drip irrigation and sprinklers for the re-use/disposal of waste water in a compliant manner. There are also guidelines for “grey water” disposal. Collectively, these new systems are proving popular for watering gardens and lawn areas, thereby reducing the water consumption from the reticulated water supply, and a related decrease in the supply cost.

Health Local Laws – Keeping of large animals & roosters – covers pigs, goats, horses, cows and roosters in townsite areas, includes issuing approvals and responding to complaints.

Health Local Laws – Private water supplies – includes assessing and approving private supplies and routine sampling and assessments in regional areas.

Local Government Local Laws – Hawker, trader, stall holder licensing – includes issuing licences (high frequency) – LL to be repealed and replaced by new ones.

Regulatory programs with only discretionary monitoring and no approvals – mostly includes responding to complaints and providing advice as well as discretionary power to monitor compliance and undertake occasional health promotional programs

Health Act, Regulations & Local Laws – Sanitary provisions, general powers to respond to sanitary concerns.

Health Act – Unfit dwellings, general powers to respond to unsanitary or unsafe living situations.

Health Regulations – Asbestos – potential scope for promotional program, asbestos awareness week coming up in November.

Health Regulations – Construction camps – sanitary conditions and health risks.

Health Regulations – Fly eradication – potential scope for promotional program.

Health Regulations – Hairdressers – addresses health risks.

Health Regulations – Skin penetration (e.g. tattoo, body piercing, beauty therapy) - includes receiving notifications of new shops.

Health Local law – Nuisance and other provisions – includes mainly responding to complaints.

Programs providing direct professional assistance to the Shire either for compliance with or under the guidance of State departments:

Department of Health – Mosquito management program – includes: mosquito and disease surveillance; sentinel chicken program (early warning surveillance e.g. for

Murray Valley Encephalitis); prevention programs; control/treatment programs; media and public awareness campaigns; and extensive funding available which signifies a high level of

priority Statewide, despite there being no legislative requirements.

The Shire’s Environmental Health Service was successful in gaining access to funding from the Department of Health for subsidised chemicals used in the above treatment programs, equipment for the treatment of mosquitoes and staff training.

Department of Health – Recycled Water Scheme compliance management and monitoring – includes routine sampling of ponds and treated effluent and potentially managing compliance of the Shire’s storage ponds.

Department of Health – Recreational Water Safety (environmental waters) - includes routine monitoring of natural water bodies from a recreational safety point of view and potentially other aspects of recreational water safety (e.g. public beach events).

Department of Environment Regulation – Fascine Development Precinct Waterways Monitoring Program – includes routine monitoring and sampling of Fascine waterways to test for ecological health. The Shire’s Health section has continued to sample and monitor local waterways to ensure compliance with required health

standards. The Fascine and Small Boat Harbour is regularly monitored so that these recreational waters are maintained an acceptable biological standard for recreational purposes, including swimming.

Department of Environment Regulation – Licensed facilities monitoring and compliance management: Carnarvon Waste Disposal Site – may include ground water sampling to monitor contaminant levels, may

include general compliance management. Coral Bay Waste Disposal Site – potentially as above. Carnarvon Water Storage Ponds – potentially as above, in contrast to the Recycled Water Scheme approval

above, this would be monitoring compliance against ‘ecological’ and ‘protection of the environment’ requirements.

Other programs:

Strategic environmental health – incorporating all environmental health principles and considerations in the strategic planning of the Shire – benefits include reducing costly reactive involvement and better living standards generally.

Disaster management – incorporating environmental health principles in the planning, preparation, response and recovery of disaster situations, high priority area during disasters and therefore deserving of preparation.

Disease investigation – working with the Department of Health where required.

Environmental Health Staff: The Shire has continued to see a number of changes to staff over the past year and are please to advise that it secured the services of Mr Dane Wallace and Ms Caitlin Clothier both who are committed to enhancing the delivery of health services for the local community. In addition, the Shire undertook to establish the role of Environmental Health Cadet and appointed a local Carnarvon Community College graduate, Mr Liam Ryder to the position. In addition, the Shire also undertakes to periodically utilise the consulting services of Mr Alan Hobbs whose experience and wealth of knowledge of local health related matters is a vital asset to the community. BUILDING SERVICES The Shire’s Building Services Section has continued to perform in the monitoring of all building activities within the Shire. The Section remained under the Regulatory Services Directorate for the first 6 months of the 2013/14 financial year before it was moved in an organisational restructure to the Development Services Directorate after the departure of the Regulatory Services Director, Mr Dave Hadden. While doing so, the Building Section continued to adjust to changes brought about by the introduction of the new Building Act 2011. The functions of the Building Services Section has continued to include:

Inspection of buildings

Asset Management

Project Management

Enforcement of non-compliant and unauthorised building works

Building Staff: The Building Services Section has also benefited from Mr Ron Ashenden joining the Shire as Principal Building Surveyor. Mr Ashenden is a certified Building Surveyor with over 30 years of expertise as a builder and working in Local Government. New Building Act 2011: The change in legislation with the Building Act 2011 increased focus on certification of buildings and practitioners and other building professionals to ensure accountability and conformity with building standards.

The Building Act has proven to be challenging for this Shire, as well as the building industry and most other local governments throughout Western Australia, due to a lack of accountability and confusion in its implementation by the WA Building Commission. ECONOMIC DEVELOPMENT, ENTERTAINMENT AND TOURISM For the first 6 months of 2013/14, the Shire’s Development Services Directorate retained the economic development and tourism portfolio that included the Carnarvon Visitor Centre and Civic Centre. However after the elevation of Mr Ian D’Arcy to Chief Executive Officer in October 2013 and an organisational restructure, the Civic Centre was placed under the care and control of the Corporate Services Directorate in November 2013. Visitor Centre – In July 2012 the Council accepted the responsibility for continued operation of the Carnarvon Visitor Centre Carnarvon Visitor Centre (CVC) due to financial viability difficulties experienced by the Carnarvon Tourist Bureau Inc. The CVC has continued to investigate and improve initiatives which focus on bringing our business mission ‘to promote the Carnarvon region by providing excellence in all areas of service, promotion and the facilitation of tourism to visitors, while providing an environment which allows for the continuous development of the community and our Visitor Centre team’ to fruition. These services are aimed to assist the local tourism industry and the CVC business by better enabling the promotion of the Carnarvon region:

• Provision of accommodation, tour and event booking service – This allows the CVC to convert visitor’s intentions into behaviour encouraging them to experience more and stay longer within the town and region where possible.

Caravan & Camping Show (CCS) – attendance at the annual CCS to assist in the promotion of the town and the region.

Perth Royal Agricultural Show – the Shire provided staffing for the Perth Royal Agricultural Show display allowing the town and the region to be promoted to a wide sector of the Perth community. This resulted in creating a heightened awareness of our region, its industries, attractions and activities within Carnarvon’s biggest visitor market. The Shire’s direct involvement in managing the Show event significantly impacted both the operational and financial role of the organisation for the period. It is likely that the Shire will look to the direct input of the GDC, local tourist industry and other local governments to undertake the role in 2014/15.

Carnarvon Holiday Planner– this document is used by visitors and contains new and updated information and photos, an updated town map (to scale) and also a map of the coastal area.

Carnarvon Visitor Centre Website – the CVC, launched a new look and feel website in 2014 which is consistent with the Carnarvon branding. The new site allows for easier navigation and increased ability for CVC to updated listed information and allows visitors to make online accommodation and tour bookings.

Carnarvon Town Map Pads (50 pages A2 – double sided) – the CVC in association with the Tourism Alliance Committee, has designed a double sided, tear off map. This is used by operators and CVC staff to assist visitor orientation around Carnarvon and the region and identifies ‘things to do’, which in turn encourages visitors to stay in the town longer and increase their spending.

Tourism Touchscreen- was installed at the Visitor Centre in 2013, the touchscreen allows for 24 hour access to local information via through-glass touchpad technology to visitors who arrive after hours. The Visitor Centre sponsors 6 pages on the machine and uses these pages to promote Carnarvon and its membership base via listings of members on pages for accommodation, eating out/retail & services, local attractions and regional attractions along with a promotional video of the town and Visitor Centre details.

Economic Initiatives – The initial focus from an economic development perspective has been the appointment of a local Economic/Tourism Officer to assist in the development and promotion of tourism through establishment of the new Visitor Centre website, revision of the tourist planner, and compilation of the new membership package.

Blowholes Reserves Management Plan – An important strategic tourist and economic plan for the Shire is the preparation of the draft Blowholes Reserves Management Plan for the Blowholes Reserves. The purpose of the Management Plan is to establish a framework for the layout, standard of development, implementation of works and ongoing governance regime to regulate use and activity as the Council moves forward with enhancement of the Blowholes in consideration of public access and environmental management. A draft Management Plan was endorsed for advertising on 27 May 2014 by Council with the timeframe for submissions closing in August 2014. It is anticipated that the final plan will be adopted by Council in September 2014. It should be noted that the position of Economic/Tourism Officer was instrumental in the preparation of the draft Management Plan for the Blowholes. Shire of Carnarvon Demographic & Economic Profile 2014 – In an attempt to assist the development industry and the community as a whole, the Shire prepared an economic and demographic profile that addresses the population, commercial ‘drivers’ and growth potential for the whole Shire. The economic and demographic profile is available on the Shire’s Website: http://www.carnarvon.wa.gov.au/wp-content/uploads/2014/08/Carnarvon-profile-Aug-2014.pdf RANGER SERVICES The Shire’s Ranger Services Team remained under the Regulatory Services Directorate for the first 6 months of 2013/14 before the section was moved in an organisational restructure to the Development Services Directorate after the departure of Mr Dave Hadden. In 2013/14, the Ranger Services Team comprised three new Rangers; Team Coordinator Paul Wilson and Rangers, Luke De Sousa and Theo Brugman. Ranger Services substantially increased regular presence within the town. Rangers are equipped with new utility vehicles custom designed to the unique operational demands placed upon them. Smart new uniforms and modern technology complement an overhaul of procedures in order that the Rangers stay at the forefront of municipal law enforcement. The Shire Rangers team have made issues regarding strengthening community relationships, improvements in response times and sharing information with the community in regards to the Acts and Regulations and any amendments to this affect being their top priorities among others. As such the Dog Act 2011 has been amended and a new Cat Act 2011 has been created and implemented which was enforced from 1st November 2013.

The Planning Section within the Development Services Division is responsible for guiding the Shire by the planning of residential development areas, commercial centre, tourist development, rural land use activities, recreational areas and other land uses. This is achieved through administration of the Shire’s two Town Planning Schemes, assessment of development, rezoning, and subdivision application referral to the WAPC, consideration of applications under the Mining Act along with formulating policies and strategies for sustainable development and conservation. The Section is also responsible for ensuring compliance with land use and building controls and is involved in a variety of land administration processes including road closures and State land matters. Strategic and Policy Outcomes and other Planning Initiatives for 2013/14 The Shire has in place a number of Strategic Plans to guide the development of the Shire. Strategic Planning across the Shire over the past 12 months has seen a number of formal planning initiatives and documents being progressed paving the way for future development opportunities. A number of Scheme Amendments to change the zoning of land, along with structure plans to set the outline of development have been considered through 2013/14. It is pleasing to advise that progress has been made this year with the following being undertaken: Coral Bay Planning – In February 2012 and in response to mounting pressure on Coral Bay as a premier tourist node, the Shire initiated a planning review of the Coral Bay based on a vision for the next 25 years. Throughout 2013/14 and with the assistance of consultants that included CSIRO, The outcome was a draft Coral Bay Settlement Structure Plan (CBSSP) was prepared that identifies and recommends changes to accommodate future tourist and development pressures without seeking to cause detriment to the Ningaloo coastal environs. Following community consultation (from 21 August 2013 to 14 October 2013), Council adopted a final CBSSP on 17 December 2013 and referred it to the Western Australian Planning Commission (WAPC) for endorsement.

The WAPC sought some minor modifications to the CBSSP and these were endorsed by Council on 29 April 2014. However, on 13 June 2014, the Premier announced that the State Government will examine existing and future Western Australian coastal settlements to allow more West Australians and tourist access to the WA coastline. Known as the ‘Coastal Towns and Settlements Cabinet Subcommittee’ (CTSCS), it would investigate the development and revitalisation of priority coastal settlements and examine future coastal sites, particularly on the south coast of

Western Australia. It is understood that State Cabinet would consider the CBSSP based on advice from the CTSCE. Endorsement by Cabinet would significantly elevate that status of the Plan.

East Carnarvon/Kingsford Planning – In early 2013, Council resolved to review the East Carnarvon –Kingsford Subdivision Guide Plan that had originally accompanied the adoption of Town Planning Scheme No. 10 in 1988. The review seeks to identify the opportunity for infill development and land-use change in consideration of conflicts of land-use, adequate utilities and servicing, flood risk and protection of prime agricultural land.

Babbage/Whitlock Island Planning – In March 2013 Land Insights was appointed as the lead consultant by the Shire to prepare a Structure Plan for Babbage

& Whitlock Islands (‘Structure Plan’). The project is being funded by the Department of Planning through the 2012/2013 Royalties for Regions Northern Planning Program.

Following a literature review and site inspections by the Consultant, public participation including one-on-one stakeholder consultations and a community forum were conducted that led to an Outcomes Report released in November 2013 and adopted by Council on 17 December 2013. Council also resolved to “…. proceed with preparation of the draft Babbage & Whitlock Islands Structure Plan, in line with the outcomes and recommendations detailed in the endorsed Outcomes Report for this project, with a particular focus on self-sustainable development centred on renewable energy and recycling, presenting a flagship model on modern, eco-friendly sustainable development.”

The draft Structure Plan proposes a range of precincts that will guide land use and development across the islands over time. To achieve the vision and intended character the following precincts are proposed including: Low Density Residential; Tourist and Independent Housing; Foreshore Reserve/Low Key Recreation Nodes; Camping Area; Conservation/Tramway; and Golf Course. It is anticipated that the draft Structure Plan will be advertised for community consultation in August 2014 and referred to Council for final consideration in October 2014.

Carnarvon Airport Planning – In early 2013, Council resolved to nominate the existing airport landholding as the preferred site to cater for Carnarvon’s aviation needs in the foreseeable future (up to 20 years). In addition, Council resolved that an alternate airport site for the long term aviation needs (up to 50 years) was subject to further investigation and to be triggered by substantiated economic growth indicators; a sound business case and available capital/funding to build a new airport. From this, the draft Carnarvon Airport Precinct Structure Plan (‘Structure Plan’) recommended an extension to the existing main runway from 1679m to a minimum of 2000m. Through a comprehensive site selection process and engagement program, it was determined that considering a number of factors, the current airport precinct represented the best location for a new airport where new development around the airport would act as the catalyst to drive economic and population growth within the town. The draft Structure Plan for Carnarvon Airport sets the strategic framework for future development of land uses within the airport site and immediate surrounds. Importantly, it acknowledges a two stage implementation process and identifies a third stage, should the airport facility relocate to another site in the future, thus releasing the remaining land for development. From 5 February 2014 to 9 April 2014, the draft Structure Plan was advertised for community consultation purposes with a total of 14 submissions received from Government Departments, Community Groups, Organisations and individuals. In May 2014, Council considered the submissions and with minor modifications to the draft Structure Plan adopted the Airport Precinct Structure Plan and subsequently referred it to the WAPC, who endorsed it in October 2014.

Formulation of Local Planning Policies – The Council embarked on commencement of formulating new Planning Policies to assist in guiding and regulating future land use and development across the Shire. This process also involves the evaluation of existing Policies to ensure they remain current and relevant to the community sentiment and expectation.

Local Planning Strategy – The Shire is required to prepare a Local Planning Strategy (LPS) with the purpose of providing an effective medium to longer term planning framework which guides future townsite development, infrastructure delivery and consideration of community facilities. An LPS also sets out the planning principles, rationale and strategies for implementation across all areas of land use planning.

In May 2014, URBIS planning consultants were appointed to assist the Shire in the preparation of the draft LPS with

the intent to set out the key aspirations of stakeholders, accommodating the future needs of the community, creating opportunities to enhance and protect local attributes while facilitating the achievement of long term local and regional objectives and goals. The Strategy, among other matters, further intends to guide the preparation of a new local planning scheme for the Shire – to ultimately replace existing Town Planning Schemes 10 and 11. The LPS will also provide a framework for investment by both the public and private sector.

Town Planning Scheme Review – Land use and development within the Shire is regulated by Town Planning Scheme No.10 – Carnarvon Town site and Environs and District Zoning Scheme No. 11 that covers the balance of the district, including Coral Bay. Both Schemes are scheduled for review under the Planning and Development Act, 2005, the Town Planning Regulations 1967, and the WAPC's Local Planning Manual (2010). The Planning Section is in the process of a formal review culminating in the preparation of draft Local Planning Scheme No.13, as well as preparing the Local Planning Strategy to guide future land use change. Draft Local Planning Scheme No.13 will comprise the Scheme Text, a Scheme Map(s), and any Local Planning Policies associated with the implementation of Scheme provisions (where required).

Statutory Planning The 2013/14 financial year has seen continued processing of Development (Planning) Applications and providing advice to the WAPC on subdivision/strata applications. Additionally, the State Government has continued to introduce a number of reforms to the planning system in Western Australia. The following provides some insight on these matters and a comparison of planning considerations over recent years:

STRATEGIC COMMUNITY PLAN As part of the Integrated Planning framework which was introduced by the State Government in July 2012, the Shire of Carnarvon adopted its Strategic Community Plan in November 2011 following extensive consultation with the community to provide for the visions and aspirations for the Shire’s future direction. The Plan provides the objectives and strategies for the key themes, including: Economic Environment Social Cultural Civic Leadership A copy of the Strategic Community Plan 2011-2021 is available on the Shire’s website at www.carnarvon.wa.gov.au.

DISABILITY ACCESS & INCLUSION PLAN Section 29(2) of the Disability Services Act requires local governments to report about the implementation of the plan. A review of the Shire of Carnarvon’s Disability Access & Inclusion Plan (previously Disability Services Plan) required by Part 5 of the Disability Services Act was carried out in 2012. In particular, the following areas were identified as priorities and have been progressed with appropriate strategies:

Robinson St/Town Beach upgrade has introduced seamless pavement throughout the precinct area to enhance access for people with mobility disability;

Pathways – maintenance of existing, to include off ramps, consult with users to determine priority areas;

Camel Lane Theatre – improve access for people with mobility disability;

Pelican point universal fishing platform repaired and made safe;

Pelican Point platform and access to beach;

Public toilets – need to be universal access;

Development of You’re Welcome website promoting local business, facilities which are accessible;

RECORDKEEPING PLAN In accordance with the State Records Act 2000, the Shire of Carnarvon and all its employees are legally obliged to comply with the Shire’s Record Keeping Plan. This Plan had been endorsed by the State Records Office of Western Australia in 2010. A review of the plan was carried out in 2014 and a copy is with the State Records Office for endorsement.

PUBLIC INTEREST DISCLOSURE

The Public Interest Disclosure Code was established by the Commissioner for Public Sector Standards under Section 20 of the Public Interest Disclosure Act. One of the principles of the Code is not just to provide protection to those who make disclosures (and those who are the subject of disclosures) but also to encourage a system of transparency and accountability in the way government officials act and utilise public monies.

Matters that fall into the category of public interest include:

Improper conduct (irregular or unauthorised use of public resources);

An offence under State Law including corruption (substantial unauthorised or irregular use of, or substantial mismanagement of, public monies)

Administration matters generally (conduct involving a substantial risk of injury to public health, prejudice to public safety or harm to the environment)

Matters that relate to the Shire of Carnarvon should be referred to the Shire of Carnarvon’s Public Interest Disclosure Officer. Disclosures to the Public Interest Disclosure Officer can be made not just about officers of the Shire of Carnarvon but also about its elected officials. There is an obligation of the Public Interest Disclosure Officer in the Public Interest Disclosure Act to ensure that the disclosure is confidential and that the person making a disclosure is provided adequate protection from reprisals, civil and criminal liability or breach of confidentiality. The Shire of Carnarvon had no Public Interest Disclosures during the reporting period.

FREEDOM OF INFORMATION

Section 96 of the Freedom of Information Act requires local governments to publish an Information Statement. In summary, the Shire of Carnarvon’s Statement indicates that the Shire of Carnarvon is responsible for the good governance of the Shire and carries out functions as required including statutory compliance and provision of services and facilities. All Council meetings are open to the public and meeting dates and venues are advertised on a regular basis. Members of the public are invited to ask questions during Public Question Time shortly after the commencement of each meeting. The Shire of Carnarvon maintains records relating to the function and administration of the Shire, each property within the Shire and includes such documents as the Minutes of Meetings, Rate Book, Town Planning Scheme, Local Laws, Codes of Conduct, Register of Financial Interests, Register of Delegated Authority, Financial Statements and Electoral Rolls. These documents can be inspected free of charge at the Shire Office, 3 F r a n c i s Street, Carnarvon during office hours. Wherever possible and practical and in line with privacy laws, the Shire of Carnarvon makes personal information readily available free of charge. Five (5)Freedom of Information requests were made during the reporting period.

NATIONAL COMPETITION POLICY STATEMENT

The Competition Principals Agreement is an Inter-government Agreement between the Commonwealth and State/Territory Governments that sets out how government will apply National Competition Policy principles to public sector organisations within their jurisdiction. The State Government released a Policy Statement effective from July 1996 called the Clause 7 Statement, which forms part of the Competition Principles Agreement. The Clause 7 policy document sets out nominated principles from the Agreement that now apply to Local Government. The provisions of Clause 7 of the Competition Principles Agreement require Local Government to report annually as to the implementation, application and effects of the Competition Policy.

The Competition Principles Agreement, under Clause 7, specifies three broad areas of reporting, they are: Competitive Neutrality Structural Review of Public Monopolies; and Legislative Review In accordance with the requirements of the National Competition Policy the Shire of Carnarvon makes the following disclosure for 2013/14. Competitive Neutrality The objective of competitive neutrality is the elimination of resource allocation distortions arising out of local government ownership of significant business activities. The Shire of Carnarvon does not operate a business enterprise that has been classified by the Australian Bureau of Statistics as either a Public Trading Enterprise or Public Financial Enterprise. Legislative Review Parties to the National Competition Policy agreed that legislation should not restrict competition unless the:

· Benefits of the restriction to the community as a whole outweigh the costs; and · Objectives of the legislation can only be achieved by restricting competition.

Accordingly, the Shire of Carnarvon is required to implement a systematic review of all its existing legislation to determine whether there are any direct or indirect effects on competition. In relation to a Legislative Review the Shire of Carnarvon discloses that: At the reporting date the below Local Laws are currently under review –

Shire of Carnarvon Parking and Parking Facilities Local Law 2014 – To update and improve upon parking and the use of vehicles under the Local Laws Relating to Local Government Act Local Laws which were Gazetted on 26 February 1998;

Shire of Carnarvon Repeal Local Law 2014 – To repeal Bye-Laws/Local Laws that are considered to be superfluous, defunct and obsolete.

Shire of Carnarvon Dogs Local Law 2014 – To extend the controls over dogs which exist under the Dog Act 1976.

Shire of Carnarvon ‘Keeping and Control of Cats Local Law 2014 – To extend the controls over cats which exist under the Cat Act 2011.

Shire of Carnarvon Local Government Property and Public Places Local Law 2014 – To control the use of local government property. Some activities are permitted only under a permit or under a determination and some activities are restricted or prohibited.

The new local laws seek to establish the most up to date governance regime and ensures the Shire is responding to relevant changes in the legislative environment. Legislative Review and Reform State Legislative changes impacts the strategic and operational activities of the Shire and has on occasion created variation in the long term financial planning and current year’s budgetary requirements. The Shire’s awareness of legislative requirements allows for continual execution of professional and legal probity. State Acts affected in the 2013-2014 reporting year, listed in alphabetical order, include:

Criminal Code Amendment 2014 and Criminal Code Act Compilation Act 1913;

REGISTER OF MINOR COMPLAINTS

Section 5.121 of the Local Government Act requires the complaints officer for each local government to maintain a register of complaints which records all complaints that result in action under section 5.110(6) (b) or (c) of the Act. Section 5.53 (2) (hb) of the Local Government Act requires that details of entries made under section 5.121 during the financial year in the register of complaints, including: (i) the number of complaints recorded on the register of complaints; (ii) how the recorded complaints were dealt with;

There were nil complaints for the 2012/2013 reporting year.

CORPORATE BUSINESS PLAN

Council adopted its Corporate Business Plan in September 2013 and provides for the projects that are aligned with the objectives and strategies of the Community Strategic Plan for the next four years. This is also a requirement of the Integrated Planning Reporting Framework. The Corporate Business Plan provides for the delivery of community services and has been aligned to each objective of the Strategic Community Plan

WORKFORCE PLAN

We have developed our ten year Strategic Community Plan and our four year Corporate Plan which outlines our hopes and aspirations for our community. Our Workforce Plan, as part of the Western Australian Local Government’s integrated planning framework, helps to ensure the Shire has the right people in the right place at the right time, to meet the needs of our community. The Workforce Plan will be reviewed in November 2014.
